BOARD SUMMARY
THE EXECUTIVE
The executive can be defined as the organ of government responsible for the formulation of
policies and implementation of laws to ensure peace, order and tranquillity in the state.
The executive is the organ of government charged with the responsibilities of implementing a
country’s laws and the administration of its functions. It ensures that the policies of
government are brought to the awareness of the members of the public and to ensure that the
laws are implemented to meet the purpose of their enactment. Therefore, the executive is
regarded as the “managers” of government agency or department.
TYPES OF EXECUTIVE
There are two main types of executive: the parliamentary executive and the presidential
executive.
1. PARLIAMENTARY EXECUTIVE: This type of executive is found in a cabinet
system of government. This types of executive has two heads, that is, the head of states
may be president or king as in Britain. He performs purely ceremonial functions like
presiding over national ceremonies, receiving foreign dignitaries, assenting to bills etc.
Also, there is the head of government, who is the prime minister. He performs real
governmental functions together with his minister.
2. PRESIDENTIAL EXECUTIVE: A presidential executive is one who is both the head
of state and the head of government. He is elected by the majority of voters across the
country for fixed period of time. The president with his appointed ministers, special
advisers and special assistants constitute the executive and they are constitutionally
charged with law execution and good governance. Examples of countries with
presidential executive are Nigeria, U.S.A. etc.

FUNCTIONS OF THE EXECUTIVE
i. The executive formulates and implement policies that guide the general
administration of the country.
ii. It initiates, controls and coordinates the administration of the state, i.e. recruitment
and discipline of civil servants, provision of essential social series, creation of
employment, etc.
iii. The executive initiates and submit bills to the legislature for or consideration and
passage into law.
iv. The executive prepares the budget of the country every year which will be
deliberated in and approved by the legislature.
v. It executes or implements the laws made by the legislature and ensure obedience to
the law.
vi. The executive has power, in some countries, to summon and dissolve parliament.
vii. The executive, in exercise of delegated power, issues statutory orders and rules for
the governance of the country.
viii. The head of the executive has power to appoint and remove cabinet members,
including the chief justice and justices of the Supreme Court.
ix. The executive controls the armed forces and war against any external and internal
aggressor. (the head of the executive arm of government is the commander-in-chief
of the armed forces.
x. It formulates policies that guide the administration of the state.
xi. The executive maintains foreign relations and sign treaties agreement with foreign
nations and bodies.
xii. The chief executive signs, or give assent to bill before they can become laws.
xiii. The executive, through the power granted to it by the constitution can grant amnesty
and pardon to certain convicted persons or offenders.

CONTROL OF THE EXECUTIVE
In order to avoid misuse or abuse of powers by the executive, there are some adequate control
measures of the executive which include the following;
(i) The Principle of Constitutionalism: The executive is restricted by the constitution
in the exercise of powers and performance of functions.
(ii) Legislative Control: The legislature has the power to control the executive through
the power of approval of some actions and policies as well as approval of some
appointments made by the executive. E.g. appointment of ministers, ambassadors, as
well as approval of budget and loans and ratifications of agreement and treaties.
(iii) Judicial Control: The judiciary can declare any action or decision of the executive
as null and void, if such action does not conform with the constitution. Also, the
judiciary can also compel the executive to perform or not to carry out certain actions
through the use of habeas corpus, injunction, mandamus, etc.
(iv) Removal of the head of executive: The executive president can be removed from
office through impeachment while the prime minister and cabinet can be removed
through a vote of ‘no confidence’ when they breach the provision of the constitution.
(v) Electorate control: This is the power exercised by the citizens in peacefully
changing the government through election to vote in a better government.
(vi) Public opinion: The executive can be controlled by the members of the public
through negative reaction and judgement on certain undesirable policies of the
government.
(vii) The Media: The Mass-media serve as the watch-dog on the activities of the
executive as a control measure.
