Operation phase

It is the period of time that the relevant part of the authorised development is in operation
after construction and commissioning is complete, which begins on the date specified in the
operational phase notice. It includes all impacts during the use phase of that building
including maintenance, repair, replacement, refurbishment. When it comes to materials, the
importance in the operational phase involves the construction and performance of the building
envelope. When we say building envelope includes all the building components that
separate the indoors from the outdoors. Building envelopes include the exterior walls,
foundations, roof, windows and doors.

2.4 Construction Services

A registered Civil Engineer;

✓ May engage in construction contracting after being licensed as a contractor by the

Contractors Accreditation Board.

A registered civil engineer may engage in construction contracting after being licensed as a contractor
by the PCAB.

CAB or here in the Philippines is the PCAB, the PCAB aims to understand the requirements of our
constituents and recognize the importance of accountability, responsibility and transparency. It simply
states here that the registered civil engineer must have a licensed as a contractor before he or she
engage in construction contracting or to have a license before his bid is considered. Because according
to my research, Republic Act No. 4566 as amended by Presidential Decree. No. 1746 provides that no
contractor (including sub-contractor and specialty contractor) shall engage in the business of contracting
without first having secured a PCAB to conduct business. And also, I’ve read that Pcab requires only on
government projects but not in necessary in a private corporation. It is said that a valid contract is just a
meeting of two minds. But on contrary it is better to have a bidding contract that requires
responsibilities for both parties to safeguard the interest of both client and the contractor. and some are
saying that, if by administration, no need for PCAB. If by contract you need PCAB.

2 types of licenses:

1. Regular license – a license awarded to domestic construction companies classified as a sole

proprietorship, a partnership, or a corporation with at least sixty percent (60%) Filipino equity.
2. Special license - A license granted to a consortium, a foreign contractor, a joint venture, or a
project owner who only allows the construction of a single, specific project/undertaking.

And there are 2 types of licenses, and these licenses are valid for 1 fiscal year. Since the license is not
transferrable, it is unethical for a civil engineer to allow his license to be use by any other construction
company except his own.

A civil engineer may provide the services of a supporting technical employee as required of a
construction company.
 In accordance with section 23 of RA 544, only the registered CE can take charge or supervise
construction or alteration of any building or structure and any other civil engineering works.
When the civil engineering is employed, it os required to comply with the code of ethics of the
profession as a consulting civil engineer.

Section 23 of RA 544 – only registered Civil Engineers can take charge construction of any building and
any other civil engineering works mentioned in Section 2.

2.5 Special Services for Construction Projects

Special services required during the study, design, construction, and operation phases of a construction
project may include investigations, reports, ad activities beyond the scope of the basic services. It is also
may relate to the client’s decision as to the feasibility scope, and also the location oof the project.

the soil or the strength and properties of a required building foundation.
