ORDINANCE No. 03 Series of 2020 ‘Author: Hon. Raquel DC. Molarte AN ORDINANCE CREATING A NEIGHBORHOOD WATCH PROGRAM IN THE MUNICIPALITY OF GAINZA, CAMARINES SUR AND ESTABLISHING A HOTLINE AND STREET SIGNAGES FOR THIS PURPOSE. BE IT ORDAINED, by the Sangguniang Bayan of Gainza, Camarines Sur, that: Section 1. TITLE. This Ordinance shall be known as, “NEIGHBORHOOD WATCH ORDINANCE”. Section 2. SCOPE. ~ This Ordinance shall cover all programs, activities, violations and offenses herein defined within the territorial jurisdiction of the Municipality of Gainza. Section 3. PURPOSE. To empower the residents of the Municipality to actively participate and support for the enhancement of appropriate security measures, increase vigilance, reduce opportunities for crimes, assist in detecting crimes, promote an effective communication system and prompt reporting of suspicious and criminal activites for the general safety of the community. Section 4. DEFINITION OF TERMS. The following words and phrases, whenever used in this Ordinance, shall be construed as defined in this Section: ‘a. Neighborhood Watch. This means an organization of residents in the Municipality in partnership with local and national government agencies intended to bring people together to become Gainza a safer place to stay or lve in. b. Neighborhood Watch Program. This means a package of various projects and activities that will enable people protect ‘themselves and their properties safe without fear of crime through an improved home security, greater vigilance and accurate reporting to the authorities promoting a community safeguarding effort. ¢. Hotline. This refers to a telephone line (landline or mobile nos.) open to the public for reporting to the concerned authorities regarding an incident ora subject that requires immediate attention, action or response. specific number shall be posted in conspicuous places accessible to the general public and allow people to obtain and give information. d. 24/7 Monitoring and Reporting. This refers to the activity by which the neighborhood watch shall be conducting to ‘ensure the security and safety of the people within the territorial jurisdiction of the municipality of Gainza. Informant. This refers to the person/s reporting of an incident or subject whose identity shall be protected with strict confidentially to prevent or avoid conflicts. f. Receiver. This refers to the concerned person/s or authority who has received the information regarding an incident lor subject that needs immediate attention, action or response which the neighborhood watch is obliged to provide or extend immediate assistance. 8 Concemed person/s or persons in authority. This refers to those person/s whose major concem is on the implementation of the Neighborhood Watch Program and those who are by their positions are authorized by laws, rules, regulations, polices or local ordinance to ensure the maintenance of peace and order in the municipality and provide necessary interventions for the protection, safety and security of the people and their properties. { Page | of Ord #03 2020- fh. Signages. This refers to the signs, symbols or materials posted on the streets, buildings and other facilites for the purpose of communicating and conveying informations designed to guide the people and assist the neighborhood watch as part of the information education campaign program enhancing knowledge and awareness and shall also help deter the would-be criminals. Section 5. PARTICIPATING AND IMPLEMENTNG AGENCIES. ‘The local government departments and the national government agencies involved in partnership with civil Society organizations or other concerned organizations shall be the identified participating and implementing agencies. a. The Office of the Local Chief Executive or the Municipal Mayor. Shall serve as the head of the implementing agency and shall act as the Chairperson in the formulation of the implementing rules and regulations for this program. b. The Sangguniang Bayan. As the Policy making body which shall support the initiatives of the Local Chief Executive to realize the purpose of this program and include in the legislative agenda supporting policies for the enchantment and sustainability of this program. c. The Philippine National Police (PNP). The PNP as the law enforcement agency in the municipality is mandated to take the lead to prevent and control crimes, maintain peace and order, and ensure public safety, internal security with active support of the community, and shall designate an officer and create a Special Task Force known as “Neighborhood Watch Task Force” for the effective implementation of the Ordinance. d. The Department of Education (DepEd). The Deped is mandated as the responsible agency tasked to. manage and govern system of basic education in this country shall ensure access, promote equity, and improve the quality of basic education; and formulate policy for the educational system. As such the role of the Deped is essential in enhancing knowledge, capacitating the people, especially the youth of the right approaches and skills in support of the neighborhood watch program as a development partner of the local government for successful implementation of its program. e. The Department of Social Welfare and Development (DSWD). Shall provide assistance as mandated by Law to develop, administer and implement comprehensive social programs designed to uplift the living conditions and empower the disadvantaged children, youth, women, other persons with disabilities, families in crisis or at risk and the communities. {The Barangay Officials ~ shall assist the residents in the planning of projects and activities relative to this ordinance and shall coordinate with the proper agencies that affect the welfare of the constituents. . The Barangay Tanods ~ also known as the Barangay Police Officer shall also help/coordinate with the neighborhood the program and activities related to this ordinance as they make rondas and nightly patrol for the maintenance of Peace and Order in the Community. h. Other Concerned Agencies, Organizations and Individuals. This refers to all other agencies (government or non- government), civil society organizations or business organizations, an individuals who are willing and volunteering their services for the upliftment of this program. Section 6. ENFORCEMENT PROCEDURE. The Philippine National Police (PNP) in the Municipal Police Station Is tasked to formulate an enforcement procedure in dealing with the violators of this Ordinance and take the necessary action in accordance with the existing laws including the creation of Task Force in-charge on the monitoring. Prank callers and texters shall be dealt with accordingly upon verification by concerned authority based on the formulated procedure. 4 Page 2o Ort. #034 2020 Section 7. FUNDING. There shall be a specific fund appropriated and for the exclusive use in the implementation of this Ordinance with an initial amount of Thirty Thousand Pesos (Php 30,000.00). Section 8, SEPARABILITY CLAUSE. Any provision or portion of this ordinance found to be violative of the constitution or invalid shall not impair the other provisions or parts thereof which shall continue to be in force and ineffect. Section 9. REPEALING CLAUSE. Ordinances, rules and regulations or parts thereof, which are inconsistent or in conflict with the provisions of this ordinance are hereby repealed and/or modified accordingly. Section 10. EFFECTIVITY. This Ordinance shall take effect upon its approval subject to compliance of the Publication requirements provided for by law. Municipal Mayor Date: 77 28-20% Page 3 of Ord. # 031 2020- Republic of the Philippines Province of Camarines Sur MUNICIPALITY OF GAINZA -000- OFFICE OF THE SANGGUNIANG BAYAN MINUTES OF THE PUBLIC HEARING ON VARIOUS MUNICIPAL ORDINANCES PROPOSED BY THE SANGGUNIANG BAYAN OF GAINZA, CAMARINES SUR, HELD ON JUNE 22, 2020 AT THE MUNICIPAL COVERED COURT, THIS MUNICIPALITY. ATTENDANCE : (refer to attached attendance sheets) ‘The public hearing started at around 1:50 in the afternoon thru the recitation of Dasal ng Bayan led by Hon. Teresita San Pascual. t was followed by the singing of the Philippine National Anthem and the Himno ng Gainza. Hon. Glenn Romeo M. Gontang, the Municipal Vice-Mayor, delivered his welcome message and thereafter conveyed that all ordinances proposed by the Sangguniang Bayan should be presented to the public through public hearing as part of the enactment process. He stressed that the supposed schedule of this activity was somehow affected due to limitations in the conduct of gathering caused by this covid pandemic. He then encouraged the public to feel free raise their ‘comments/suggestions during the presentation for the good of each ordinance as representatives from the concerned sectors in the barangay. He then took the opportunity to acknowledge and expressed thanks to the presence of the invited participants from the different concerned sectors ofthe eight barangays, this Municipality, as well as the employees. Presentation of ORDINANCES by the respective authors with hereunder noted Observation/suggestions and recommendations from the public: 1. An Ordinance Creating a Neighborhood Watch Program in the Municipality of Gainza, Camarines Sur and Establishing ‘Hotline and Street Signages for this Purpose. - author: Hon. Raquel DC. Molarte Bey. Kagawad Romeo Adan of Sampaloc suggested to possibly replicate what the council thru his committee on peace and order is being adopting such as the establishment of a "Bantay Sona” wherein each zone in the barangays wil assigned 10 persons, with respective hotline and to maintain a logbook for the purpose basically to monitor individuals coming in the barangay. He then asked PLT. Alfelor, the PNP-Gainza COP whether the barangay is allowed to let a non-resident person register in a logbook upon entry in the barangay particularly during night time. The later replied on the affirmative particularly from the start of curfew and onwards for verification purposes and in case of resistance he advised to report the same to the PNP. On the other hand, Mr. Dino Teodoro suggested to consider imposing sanctions to prank callers/texters. On the other hand, Ms. Cristeta Chica, the MPDO expressed that there must be @ verified complaint/information with the help of the participating agencies mentioned in the ordinance and the same must be aware of what is happening as she an anticipation that improper reporting might create trouble among the residents in the barangay. VM Glenn Gontang informed the body there will be task force to be created thru Executive order to be issued by the Mayor and with regard treatment of prank calls/text messages, received, the PNP shall conduct further validation to confirm the same. The foregoing were duly noted by the author who ‘thereafter expressed thanks for sharing and suggestions raised thereto. 2. An Ordinance Prohibiting Any illegal Constructions and Obstructions Along Public Roads in the Municipality of Gainza, Camarines Sur and Providing Penalties for Violations Thereof. authors: Hon. Efren Mico D. Olano and Hon. Noe! Surbano Mr. Rodino Paulo Teodoro, the Municipal Budget Officer suggested inclusion in the granting of special permit for temporary use of sidewalks other activities such wake, wedding occasion and also the dumping of construction materials for a specific number of days/specific period for all types of construction projects. He added that fees for special permit may vary depending on the activity/purpose applied basically to make the constituents aware of the LGU policy for that matter. He also ‘proposed for inclusion of Engr. Cecilia Alayan, the Municipal Engr. and PNP in the lead implementing agencies. Ms. Cristeta Chica conveyed that one of the noted causes of accident in Gainza is its narrow road and applying the standard measurement for road right of way for barangay is seven (7) meters with 4 m width alloted for sidewalk, wherein for municipal road ~ twelve (12) m road right of way and same 4m carriageway and for provincial road @ minimum of 15m to 20 m standard road right of way with supposedly 12m carriageway but actual is only Sm. Besides, she added that there must be alloted 1.5 meter both sides for drainage construction purposes standard road hence, for her granting of special permit for temporary use of sidewalks would create obstructions along carriageway. On the other hand, PB Arnolfo Aguirre, asked who shall collect for the fee in the grating of special permit should the area to be utilied is under First District. Hon. Mico Olano replied the proceeds will accrue to the Municipal Treasury. page 1 of The former further suggested to consider provision/sanctions for ilegal house construction along the easement and likewise requested to give a consideration of at least 2 or 3 days to allow the dumping of construction materials on sidewalks in the barangay with no other area that can be utilized for the purpose. Mrs. Tita Chica commented that there must be fees to be collected for temporary use of public areas as itis part of revenue collection of the LGU. In view thereof, VM Glenn Gontang informed the body that usage of sidewalks and other public places has specific provision in the Tax Code for computation of fees to be collected for the purpose hence, the same has basis. The foregoing were noted thereof. 3. An Ordinance Granting Incentive to Barangay Tanods in the Municipality of Gainza, Camarines Sur. - author: Hon. Moises SJ. San Buenaventura Under Section 4 thereof, PB Amolfo Aguirre suggested for inclusion of the BHWs as additional beneficiary. The author said that BHWs were included in the original draft but did not qualify for the purpose. In view thereof Mr. Dino Teodoro informed the public that it was disallowed on review by the province as accordingly there was no provision in the Local Code allowing the LGU to grant benefit to BHWs except to Tanods and Lupon per Section 393 of said code which he suggested incorporating the same as basis thereto. VM Glenn Gontang affirmed the foregoing because he cited that even in the ordinance granting of the philhealth insurance benefits previously enacted by the SB the same consideration was made in the review. The foregoing were noted thereof. 4. An Ordinance Effecting Amendment on Municipal Ordinance No. 12 Series of 2014 Titled; An O' ‘Transport and Traffic Ordinance of the Municipality of Gainza, Camarines Sur. PB Amolfo Aguirre expressed his observation on overloading of passengers hence, he proposed not to allow a maximum of ten passengers as it will not fully accommodate the same considering the trimobile and for safety purposes. The author explained that 10 passenger are allowed for the extended design with avallables seats at the back portion of the unit, nevertheless he noted the foregoing observation. On the other hand, Ms. Tita Chica expressed that said number of allowed passenger will breach the protocol on social distancing thus she proposed to indicate special provision in the ordinance what to observe in time of pandemic including the allowed fare to be collected in fairness to the operator-driver. During ordinary time she commented why no adopt 8.00 instead of 5.00 to give motivation to the driver/operators not to overload passengers for a ‘maximum of 5km ride or better yet specify in the ordinance specific distance covered by such 5.00 fare. The author informed the public that the LGU already authorized a special fare and one-passenger scheme observing the minimum health protocols this ‘time of pandemic. VM Glenn Gontang informed the public that application/enforcement of the amendment in this Ordinance willbe in the normal situation whereas in this time of pandemic he conveyed that the tricycle operators in Gainza are compliant with the present health protocols laid down by the ATF and waiting for guidelines to be issued for special fare though there is special fare of 30.00 with only passenger and the same will operate meantime no PUI operation yet. Observation/ suggestions were duly noted thereof. ‘An Ordinance Declaring Every Friday of the Week as Clean-Up Day in the Municipality of Gainza, Camarines Sur. ~ author: Hon. Jose A. Teodoro, Jr. Bey. Kagawad of Loob asked for the dumping site of the wastes collected during the cleaning operation. The author advised the public pending provision of the sanitary landfill the barangay may adopt composting in the respective barangays and no to burning. He also announced the LGU has a program called plastic to rice swap which is one way to minimize waste collection aside from observing the 3Rs. Bey. Ked. Adan of Smpaloc proposed to impose sanction to non-cooperative households for not cleaning their respective areas and to encourage participation of 4Ps as the latter counterpart for the assistance received from the government. On the other hand, Ms. Tita Chica recalled that there was already previously enacted solid waste management ‘ordinance but she observed there seems no strict implementation hence, there exists many violators. She stressed adherence on RA 9003 with supposed coordination with implementing agencies the LGU which should provide the sanitary facility however per ENR validation the LGU did not qualify due to its geographic location hence, the LGU is looking into a possiblity to contract with other LGU Naga in particular or other LGUs for the management of wastes. She also stressed visible violations such as burning and throwing of wastes along creeks and rivers. She added what the DENR recommends which is the segregation at source (household) to easily manage respective wastes accumulated and non-compliance thereto has corresponding penalties and there ‘must be discipline among the residents. The author stressed that the Sangguniang Bayan is the legislative body and the Mayor is the implementing officer of all approved ordinances. He also noted herein-observations/suggestions. 6. An Ordinance Creating the Municipal Drug Nuisance Abatement Board of the Municipality of Gainza, Camarines Sur. author: Hon. Moises SJ. San Buenaventura Ms. Tita Chica asked for the difference of the existing Municipal Anti-Drug Council with the Municipal Drug Nuisance Council because the MADAC creation is pursuant to DILG mandate hence, she proposed to consider the policy where this ordinance is anchored. The author explained that the anti-drug council is concerned to individual drug user whereas this ordinance is concerned to groups existing in the area found to be nuisance hence, separate from each other though it was also ‘mandated by the DILG. He then noted the foregoing observations. page 206 7. An Ordinance on Collection of Corresponding Barangay Clearance Fee in the Application for Any Related Transactions in the Municipality of Gainza, Camarines Sur. ~ author: Hon. Moises SI. San Buenaventura ‘The author presented the text of said ordinanc ind nobody raised comment/observations thereto. 8. An Ordinance Regulating the Operation of Videoke and Karaoke Machines in Gainza, Camarines Sur’. ~ author: Hon. Alicia M. Martinez ‘The author read the content of her proposed ordinance and nobody raised observation thereto as presented Motoryeie Drivers the Jurisdiction of Gainza, Camarines Sur and Providing Penalties for Violations Therefor. - author: Hon. Efren Mico D. ‘lano COP Jonathan Aifelor, OIC of Gainza MPS informed the public that they have basis whenever apprehending traffic related regulations such as the non-wearing of helmet which involve higher violation unike when locally enacted ordinances. He then proposed inclusion of Electic Trike Scout thereafter expressed thanks to COP Alfelor and the public. 210. An Ordinance Implementing a Modified Curfew in the Municipality of Gainza, Camarines Sur During Public Health Emergency Due to a Pandemic. ~ author: Hon. Moises SJ. San Buenaventura Mr. Dino Teodoro suggested to cite in Section 1 as - Modified curfew Ordinance During State of public health emergency to apply whenever there is declaration or occurrence of such and until there is virus. Further, he suggested to replace corona virus to deadly infected disease under Section 3 thereof and under Section 7, to indieate..... shall be terminated by the Sangguniang Bayan upon recommendation of the Local Chief Executive so as to have official declaration in view of the apprehensions being done by the LGU enforcers and that the same will be offically lifted. The foregoing were noted thereof. ‘VM Glenn Gontang then informed and reminded the public of the ordinance enacted by the SB on mandatory wearing of facemasks due this pandemic which the SB deemed proper to impose penalties for 1% offense 300 of one day community service, 2™ offense ~ 500 or 2-day community service and for 3 and succeeding offenses — 1,000 or 3 days community service, He stressed that the violator has an option in case no capacity to pay the fine though he stressed that this a way to discipline and, to deter the commission and eventually realized by the residents the value of money they are earning. Hence, he enjoined full cooperation of all concerned. He also presented before the public the resolution proposed by the Liga President for recommendation to the IMT thru the Mayor the suspension of conduct of cultural activities in view of fiesta celebrations due to this covid pandemic. COP Jonathan Alfelor stressed that itis part of their job to enforce laws and regulations in the Municipality thus, he also enjoined everyone to follow/obey so as not to commit violations. He claimed that indeed he is strict but with basis though he apologized for being such. Hon. Moises San Buenaventura, the SB committee chair on Laws, Ordinances and Legal Matters in his closing message then expressed thanks to aii wino attended the public hearing.
