EXPLANATORY NOTE WHEREAS, Article IV Section 1 of the 1987 Philippine Constitution mandates the State to recognize the Filipino family as the foundation of the nation and shall strengthen its recognizes marriage as an inviolable social institution that is the foundation of the family and thus, shall be protected by the State; WHEREAS, Presidential Decree 965 and Section 15 of the Responsible Parenthood and Reproductive Health Law require couples who apply for marriage license to present a Certificate of Compliance, certifying that they had duly received adequate instructions and information on responsible parenthood, family planning, breastfeeding and infant nutrition; WHEREAS, Article 16 of the Family Code further requires couples, applying for marriage license, whose ages fall between 18-25 years old, to undergo marriage counseling by a marriage counselor duly accredited by the Department of Social Welfare and Development; WHEREAS, Joint Memorandum Circular (JMC) No. 1 series of 2018: Revised Pre- Marriage Orientation and Counseling (PMOC) Program Implementing Guidelines for 2018 was issued by the Commission on Population and Development (POPCOM), Department of the Interior and Local Government (DILG), Department of Social Welfare and Development (DSWD), Department of Health (DOH) and the Philippine Statistics Authority (PSA) to streamline and harmonize the implementation of the Pre-Marriage Orientation and Counseling (PMOC) Program at the local government level, Page 1 of Ordinance No. 2018-08 ee] Republic of the Philippines Province of Camarines Sur MUNICIPALITY OF CALABANGA -000- Office of the Sangguniang Bayan WHEREAS, Memorandum Circular 2018-182: Adoption of the Revised Pre- Marriage Orientation and Counseling (PMOC) Program Implementing Guidelines for 2018 was issued by the DILG enjoining all Local Government Units to adopt the JMC No. 1; WHEREFORE, by unanimous vote of ten (10) Members of this Sanggunian, in session assembled; BE IT ORDAINED by the Sanggunian Bayan of Calabanga, Camarines Sur, that Section 1. Short Title. - This Ordinance shall be known and cited as the *Pre- Marriage Orientation and Counseling (PMOC) Ordinance’, Section 2. Declaration of Policy. - It shall be the policy of the Municipality of Calabanga to: a. Recognize marriage as inviolable social institution and foundation of the family which in turn is the foundation of the nation; b. Protect and strengthen the family as a basic autonomous social institution; cc. Ensure couples are fully informed and equipped with necessary knowledge and skills in their expected roles and responsibilities as husband and wife, future parents and productive members of the society; and d. Provide pre-marriage orientation and counseling sessions to all contracting parties who are about to marry and require them to attend Pre-Marriage Orientation and Counseling sessions. Section 3. Adoption and implementation of the Pre-Marriage Orientation and Counseling (PMOC) Program Implementing Guidelines of 2018. — The current Pre- Marriage Counseling Program shall be strengthened through the adoption and implementation of the relevant provisions of the JMC No. 1 which is made as an integral part of this Ordinance. Accordingly, the program be reorganized as Pre-Marriage Orientation and Counseling (PMOC) Program, which shall provide the requisite pre- marriage orientation and counseling sessions to contracting parties applying for marriage license. For purposes of this Ordinance, circular shall refer to Joint Memorandum Circular No. 1, series of 2018, issued by the Commission on Population and Development (POPCOM), Department of the Interior and Local Government (DILG), Department of Social Welfare and Development (DSWD), Department of Health (DOH) and the Philippine Statistics Authority (PSA) Section 4. Organization and Mobilization of the Local PMOC Team. — A local PMOC Team shall be organized to oversee and efficiently perform the functions of the team prescribed in the JMC. The PMOC Team, shall be composed of: Appointed or designated Municipal Population Officer — Team Leader; Municipal Health and Nutrition Office representative - Member; Municipal Social Welfare Development Office representative - Member, Municipal Civil Registry representative - Member, and A civil society or organizations involved in health issues and concerns~ Member Page 2 of Ordinance No. Ne Cee eaeco Republic of the Philippines Province of Camarines Sur -000- Oftice of the Sangguniang Bayan tinuation of Ordinance No. 2019 — 06. Section 5. Creation of Municipal Population Section. - A Municipal Population Section is hereby created under the Municipal Health Office headed by the Population Officer. The Municipal Population Office will provide secretariat support to the local PMOC ‘Team and the implementation of the PMOC Program. Section 6. Training of PMOC Team and Accreditation of PMC Counselors. — (a) To equip the members of the PMOC with the needed competency in the implementation of the program, all members of the team shall undergo relevant training in coordination and collaboration with national government agencies. (b) The Local PMOC team shall also have at least one (1) accredited Pre-Marriage Counselor, who shall provide pre-marriage counseling session pursuant to the Family Code of the Philippines. Initially, the member from the Municipal Social Welfare Development Office shall comply with the accreditation requirements of the DSWD. Other members shall be supported by the Municipal Government of Calabanga to be able to complete the accreditation requirements of the DSWD. Section 7. PMOC Protocols. - The processes and procedures for the issuance of PMOC certificates shall comply with prescribed protocols under the existing rules, JMC. It shall be the responsibility of the PMOC Team to inform the public about the protocols for compliance. Section 8. Reporting. - The local PMOC Team shall maintain a PMOC database and regularly consolidate program and implementation reports. The said reports of accomplishments shall _be submitted to the Local Chief Executive and the PMOC Provincial and Regional TWGs annually. Section 9. Confidentiality of the Database. — (a) Personal Details of the contracting parties shall be stored and maintained confidentiality by the PMOC Team. The PMOC ‘Team must observe and respect the data privacy rights of the contracting parties. (b) The list of couples who attended the PMOC session shall be recorded in the municipal database and the municipal archives established for this purpose. (©) The use of any personal information collected, stored, and processed under the PMOC Program shall be subject to the rules and regulations as provided for by the Data Privacy Act of 2012 or RA 10173. Section 10. Consultation Fee. - The amount of One Hundred Pesos (P100.00) is hereby authorized as consultation fee per couple. Section 11. Appropriations. - (a) To ensure the efficient implementation of the PMOC program, an initial amount of One Hundred Thousand (P100,000.00) shall be allocated to the Municipal Health Office for this Program and maybe increased subject, however, to the availability of funds (b) Moreover, other local departments and offices participating in the implementation of the PMOC Program shall likewise allocate the amount necessary in their respective annual investment plan. Section 12. Separability Clause. - If any portion of this Ordinance is declared unconstitutional or invalid, the same shall not affect the validity of the other provisions not affected thereby. Section 13. Repealing Clause. - All ordinances or resolutions or parts thereof, Which are inconsistent with the provisions of this Ordinance are hereby repealed or amended accordingly. Section 14. Effectivity Clause. - This Ordinance shall take effect fifteen (15) after its publication in a newspaper of general circulation and posting in prominent places in the Municipality of Calabanga. DISCUSSION: The Chairman of the Committee, Councilor Levi S. Sta. Ana, Jr., acknowledged the presence of the members of the committee and the attending public. The proponent, Councilor Cielito G. Hilado, proceeded to read aloud the 1% proposed measure while explaining each of its provisions, to wit; “PROPOSED ORDINANCE STRENGTHENING THE PRE-MARRIAGE ORIENTATION AND COUNSELING (PMOC) PROGRAM THROUGH THE ADOPTION AND IMPLEMENTATION OF POPCOM-DOH-DSWD-PSA-DILG — JOINT MEMORANDUM CIRCULAR NO. 1 SERIES OF 2048.” Sponsor Councilor Cielito G. Hilado Councilor Sta. Ana, Jr., the Chairman himself, proposed that a query be made upon other LGUs that already have similar existing ordinance, particularly with regard the amount of pre-marriage counselling fee so that the committee may be able to arrive at a considerable amount to be imposed corresponding to said fee. Being also the Chairman of the SB Committee on Finance, Councilor Sta. Ana, Jr., ratiocinated that the amount of fifty pesos (P50.00), as what was proposed in the Measure, would be insufficient to cover the expenses in the implementation of the program. He then concluded that an amount of one hundred pesos (P100.00) or two hundred pesos (P200.00) would be reasonable for that matter. He added that the PMOC database shalll be incorporated in the proposed archives in this municipality. There having no query and suggestion to the proposed measure, the Chairman proceeded to discuss the 2"! agendum. “PROPOSED ORDINANCE PROVIDING FOR THE PREVENTION, CONTROL, REDUCTION AND MITIGATION OF MOSQUIO VECTOR OF DENGUE AND OTHER MOSQUITO-BORNE DISEASES IN THE MUNICIPALITY OF CALABANGA, CAMARINES SUR AND PROVIDING PENALTIES FOR VIOLATION THEREOF.” The Sanitation Officer, Mr. Erwin Bico, expressed high hopes for the passage of this measure, stating that it should be a continuing effort by the LGU and the community as well. In the same token, Councilor Sta. Ana, Jr. proposed to add a provision requiring all the barangay councils to consider the implementation of this measure a part of their health programs to ensure its sustainability Minutes of the Public Hearing, Nov. 4, 2019 Page 1 of 4 Republic of the Philippines Province of Camarines Sur MUNICIPALITY OF CALABANGA -000- Office of the Sangguniang Bayan Dra. Bolanos, however, suggested to consider also the limited funds of these barangays. Councilor Sta. Ana, Jr. stressed that the Municipality cannot be too complacent enough about this evolved as a life-threatening public health concern. According to him, with or without dengue cases, the barangay should allocate ten thousand pesos (P10,000.00) to defray the expenses necessary for or incidental to its implementation, Barangay Captain Bordado, in behalf of the attendees, asked as to where they could get citronella plants. Councilor Gonzales shared that citronella seeds were freely given in Albay, and the LGU of Calabanga may request for the same. There having no query and suggestion to the proposed measure, Councilor Gonzales proceeded to discuss the 3 agendum: “PROPOSED ORDINANCE PROVIDING FOR THE SPEED LIMITS FOR ALL KINDS OF MOTOR VEHICLES WITHIN THE TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF CALABANGA, PROVIDING PENALTIES FOR THE VIOLATION THEREOF, COLLECTION OF ROAD CRASH DATA AND APPROPRIATING FUNDS FOR THIS PURPOSE.” The discussion began with an introductory lecture on the background of this ordinance. Councilor Gonzales explained that this ordinance was crafted to eradicate the reported road crashes involving all kinds of vehicles in the municipality. He said that according to the Department of Transportation (DOTH), there is a compelling need for local government units (LGUs) to issue speed limit ordinances with the end view of curbing the rising number of road crashes and/or at least minimize their severity by 50% by 2020. He shared stories of reported road crash cases that took place within the municipality. He recounted that there was an instance when an LGU employee was hit by a speeding truck causing his untimely death. Another case took place in Manguiring, where a speeding car bumped the left portion of the tricycle injuring the driver and one of its passengers who have just alighted from the public utility vehicle. He emphasized that these cases had a common denominator - speeding vehicles Prescinding from this, he informed the attendees that there was already public consultation held for this purpose and that Barangay Captains of the 48 barangays were tasked to make recommendations for consideration during the public hearing. However, according to him, there were only few who complied with this request. Councilor Gonzales then proceeded to discuss the speed limit allowable based existing DPWH road classifications mentioned under Section 7. He explained that based on the guidelines set, the speed limit for cars on open roads is 70 kms per hour, but once the vehicle passes a crowded street, which include a school zone and markets, or when approaching intersections, the speed should dip to 20 kph. For trucks and buses, on the other hand, the maximum allowable speed on open roads is 50 kph Punong Barangay Michael Bordado of San Antonio, Poblacion, inquired as to how the penalty may be imposed upon these speeding drivers who were also found to be driving under the influence of alcohol. In response to this, Councilor Sta. Ana, Jr stated that they will be dealt with more severely At this point Councilor Sta. Ana, Jr. suggested to add another section providing for the determination of the end-to-end road coverage as it will become the basis for the application of the speed limit set by this ordinance. He added that, this shall be upon consultation with all of the Barangay Councils of the municipality. Councilor Gonzales reiterated that there must also be a provision on automatic reduction of speed when a vehicle passes a “crowded street,” or those within the 500-meter radius of schools, churches or markets. Meanwhile, Councilor Sta. Ana, Jr, recommended that the alternative route within the municipal compound, being within 200 meter radius from Linda's Pharmacy, be also identified and be imposed either five (5) or ten (10) kph speed limit. He also stated that the two hundred (200) meter distance must be determined with certainty. The hearing continued with the enumeration of the exceptions under Section 8 by Councilor Gonzales. At this point, the Chairman temporarily relinquished the post to his Vice Chair, Councilor Cielito Hilado. Councilor Gonzales proceeded to discuss the lead agency tasked to implement and enforce the same. He stated that the Municipality had already created a Public Safety Office which according to him, is still under the Municipal Disaster Risk Reduction Management Office (MDRRMO). He added that this ordinance mandates the conduct of trainings of law enforcement officers on the use of speed guns, speed enforcement cameras, and other speed enforcement strategies, in coordination with the LTO, among others. With regard Section 11 on Speed Limit Signs, he pointed out that appropriate traffic signs must be installed however, for national roads, the installation shall be coordinated with the Department of Public Works and Highways (DPWH). Also, he emphasized that there will be certain procedures to be followed for the enforcement of this ordinance depending on the instrument used whether a speed gun or speed enforcement camera. As to the adjudication of protests under Section 13, Councilor Gonzales emphasized the necessity of passing a municipal ordinance for the establishment of a traffic court to assume jurisdiction over issues relating to this speed limit ordinance. In terms of the penalties involved, he cautioned that any person who violates the prohibited acts mentioned under Section 6 of this ordinance shall be imposed upon him a fine of five hundred (P500.00) or one thousand pesos (1,000.00) with a concurrent penalty of four(4)-hour seminar on road safety for first offense. Moreover, he warned that the fine and penalty shall be increased for the subsequent offenses. He also reminded the public that in the event of the failure to settle the fines and penalties within the specified period, the PSO, being the lead agency, shall file a complaint before the ‘appropriate court for the enforcement of said fines or penalties. With regard the appropriation, he noted that the same shall be subject to consultation with the august body. At this point, Councilor Gonzales reiterated that the collection of road crash data from police reports and other data sources shall be the basis for the evaluation of the impact of this ordinance on the number of road crashes. This, he added, shall be utilized to develop future road safety policies and guidelines. An inquiry was raised seeking clarification on the issue whether the barangay could still pass barangay ordinance providing for the same within the territorial jurisdiction of the barangay. Answering in the affirmative, Councilor Sherwin Francis O.
