‘Dekho Apna Desh, People’s Choice 2024’ (hereinafter referred to as “Initiative”) is an initiative by the
Ministry of Tourism ("Ministry"). This initiative aims to celebrate India’s treasures and hidden gems,
honoring the best Tourist Attractions to visit within the country.
The Initiative will be conducted on a web portal as will be notified by Ministry ("Website") based on the
rules and regulations stated hereunder. Voting will be conducted on the Website with respect to
conducting votes for Tourist Attractions (“Tourist Attractions”) by the participant(s) (“Participant(s)”)
who wish to take part in the voting for Tourist Attractions through the Website. If you do not agree with
any of the Rules and any amendments thereto, you must not cast the votes through the voting process of
the Initiative.

1. Eligibility
1.1. During the Voting Period (defined below), individuals with an active Email ID and/or active
Indian mobile network connection can participate in the voting.
1.2. By participating in the Initiative, it is deemed that the Participant(s) have read, understood,
accepted and agree to abide with all the terms and conditions of voting as mentioned herein, and
agrees to be unconditionally bound by any decisions made by the Ministry in its sole discretion,
including any interpretations of the Terms and Conditions.
1.3. The Participant shall be required to provide personal information about them to participate in the
voting.
1.4. Participant(s) hereby represent and warrant that Participant(s) is not under any disability,
restriction, or any kind of prohibition, which shall prevent the Participant from performing or
adhering to any of the Terms and Conditions herein and have not entered into and shall not enter
into any agreement that may violate the Terms and Conditions herein.

2. Voting Mechanism
2.1. The Website can be accessed by Participants on their mobile devices and/or through their
desktop devices.
2.2. The voting shall tentatively commence from 7th March 2024, till 30th April 2024 (‘Voting
Period’).
2.3. Votes received after or before the defined timelines shall be considered ineligible and therefore
shall not be considered.
2.4. The Participant(s) is required to be updated with the Voting Period, as mentioned in the Terms &
Conditions, from time to time. The Ministry reserves the right to alter, modify or change the
Voting Period and the voting timeline at its sole discretion. In the event of any changes, the same
shall also be communicated on the Website. The Ministry will not be liable for any losses arising
out of any such changes to the Participant(s). Participants interested in voting can participate by
casting their votes (“Vote”) for their preferred Tourist Attractions through the mechanism
detailed below:
• Participant(s) will be required to submit their mobile number and/or Email ID and then enter
the One-Time Password (OTP). The OTP verification system will only work for Participants
voting from an Indian mobile number (i.e.: ‘91’) and/or active Email ID.
• Participants will be prompted to answer a few personal information questions, including
Name, Gender, Age, etc. Upon submitting these details, the Participant can proceed to vote.
• The first voting page will ask Participants their most preferred attractions that they have
visited and display five categories for voting: (1) Spiritual, (2) Cultural & Heritage, (3)
Nature & Wildlife, (4) Adventure and (5) Other. Participants must vote for at least one
category and can vote for up to 5 categories. Once a Participant votes for one category, they
cannot vote for the same category again. Voting for at least one category is mandatory.
• To vote for Tourist Attractions they have visited, Participants may type their responses in the
available space provided. Attractions will appear in a list in the form of predictive text basis
the information inputted by the Participant, as a point of reference. If the Attraction is
identified, Participants may pick the option available. If a Participant wishes to vote for an
Attraction that does not appear in the predictive text, they may choose the ‘Other’ category,
type ‘New’ and type out the Attraction of their choice in the form of: Name of Tourist
Attraction, District, State. Participants must additionally select the checkbox if they would
visit the attraction again, and choose what they would like to improve (if anything) at the
attraction using the dropdown list provided.
• The second voting page will ask Participants which tourist attractions they would like to visit.
Voting for at least one attraction is mandatory.
• To vote for Tourist Attractions they want to visit, Participants may type their responses in the
available space provided. Attractions will appear in a list in the form of predictive text basis
the information inputted by the Participant, as a point of reference. If the Attraction is
identified, Participants may pick the option available. If a Participant wishes to vote for an
Attraction that does not appear in the predictive text, they may type ‘New’ and type out the
Attraction of their choice in the form of: Name of Tourist Attraction, District, State.
• A vote is considered “Valid” when the response to the mandatory field questions (i.e.: one
attraction and parameter for improvement for the first question, and one attraction for the
second question) has been submitted.
• Upon submitting their vote, the Participant(s) will be able to download a shareable e-
certificate. Providing a response to the mandatory field questions or receiving the e-certificate
does not guarantee that the Participant’s vote will be used to derive the final vote count. Once
submitted, a vote cannot be withdrawn.
The above mechanism shall hereinafter collectively be referred to as “Voting Mechanism”.
2.5. The Participant(s) will not be levied any charges to cast the vote via the Voting Mechanism,
however, the network provider may levy data and other charges to the Participant, at the
applicable rate for using internet connection. It should be verified by the Participant(s) at their
sole responsibility. In case of casting vote while roaming in different circle/zone, additional
roaming rates for browsing of the internet may be applicable by the network provider. For
further details please contact your service provider. The Ministry shall not be responsible for any
such charges incurred by the Participant(s).
2.6. The Vote of the Participant(s) through the Voting Mechanism detailed above will be deemed to
be received and valid only when the Participant(s) answers both mandatory field questions.
2.7. Only 1 vote per mobile number and/or email ID will be counted through the Participant(s)
mobile or desktop device. If a Participant votes twice, only the first vote submitted shall be
considered, and not any subsequent ones. For abundant clarity, only one vote per Participant, per
mobile number and/or email ID will be considered.
2.8. The Participant(s) shall be required to submit all required data. Any incomplete, erroneous, or
unclear information, shall be considered invalid and deemed null and void.
2.9. In the event of any technical errors, the Ministry shall not be responsible for the same, and
further will not be responsible for any Votes received and/or not received as submitted by
Participant(s). The Ministry shall have sole discretion in such cases.
3. Lucky Draw Participation, if any
3.1. If the Ministry so chooses, a Lucky Draw, or adjoining Contest will simultaneously occur,
during and/or after the Voting Period.
3.2. By participating through the Voting Mechanism, the Participant is automatically eligible for the
Lucky Draw. Each Participant will be considered basis their first vote submitted (i.e.: upon
answering the mandatory field questions). For abundant clarity, only one vote per Participant,
per mobile number and/or email ID, will be captured and entered into the Lucky Draw.
3.3. The prize type and form/reward model, if any, will be determined by the sole discretion of the
Ministry. More information regarding this will be announced by the Ministry closer to the time,
if applicable.
3.4. The winners, if any, will be chosen randomly. The Ministry will have final discretion over the
winners chosen. The selection of the winners is by no means an endorsement of and/or an
endorsement by any specific individual, group, entity, and/or otherwise.
3.5. If a Participant wins a prize in the Lucky Draw once, they will not be eligible to win again.
3.6. The results of the Lucky Draw shall not be challenged by any Participant(s) and/or deemed
competitor(s).
3.7. Additional details and timelines (if any) will be communicated by the Ministry if and as
required.
3.8. The Participant(s) will be solely responsible for bearing any and all applicable taxes to the prizes
received, as determined by the Income Tax laws of India.
3.9. Regarding distribution of prizes (if applicable):
• Cash Prizes: In case of any third-party fraudulent credit/debit, and/or fraud, the Ministry will
not be held responsible and will not issue or reclaim any sum lost.
• Other Prizes: The Ministry shall not be responsible for any defect in the prize, non-delivery,
non-receipt, and/or any other related fraudulent activity. The Ministry will not reclaim or
issue any sum lost.
• Participants cannot claim any losses from the Ministry.
3.10. The Ministry will reach out to the Participant(s) for gratification purposes, if any, via
mobile number and/or email ID. Upon sending the initial communication, the Ministry will wait
for up to pre-defined number of hours for confirmation from the Participant(s). In case of no
response, the Participant will no longer be eligible for the prize. For abundant clarity, if a
Participant does not respond to winner communication from the Ministry, their prize shall lapse.
The winner gratification and dispersal mechanism are subject to change. The Ministry will
confirm and communicate additional details, if any.
3.11. In the event of any unforeseen circumstances, the Ministry reserves the right to amend
and/or withdraw Lucky Draw/Contest at any time. For the avoidance of doubt, this includes the
right to amend these terms and conditions.
4. Personal Information
4.1. The Participant(s) hereby consent to the collection, storage, use, disclosure, and transfer, of
sensitive personal information which may be collected during the voting period for the purposes
of the Initiative and/or any other allied activity such as promotional content and/or marketing
connected to the Ministry. The Participant(s) hereby agree and acknowledge that the collection,
storage, use, disclosure, and transfer, of the sensitive personal information for the Initiative is for
lawful purposes and is necessary for the aforementioned purposes. The Participant(s), by
providing the aforesaid personal information and/or sensitive personal information hereby agree
that the Ministry shall have the right to share the information so collected with any such other
service provider, sub-contractor and/or third party as required for the purpose of the Initiative
and/or marketing purposes defined above. The Participant(s) hereby agrees that they shall not
file any claim against the Ministry for sharing such personal information. Participant(s) who
participate in the voting process for the Initiative agree and acknowledge to these Terms and
Conditions which shall govern the Initiative.
4.2. The Ministry shall deal with any data/personal information including sensitive personal
information, if any, that it receives from Participant(s) or otherwise collects, holds, uses and
processes in the following manner: a) The Ministry may also disclose data/ personal information
including sensitive personal information, if any, to other governmental agencies and regulators
(e.g., tax authorities), social organizations (e.g., the social security administration), human
resources benefits providers (e.g., health insurers), external advisors (e.g., lawyers, accountants,
process advisors, and auditors), courts and other tribunals, and government authorities, to the
extent required or permitted by applicable legal obligations, b) The level of data protection using
technical, managerial, operational and physical security control measures by the Ministry shall
be such as to be in compliance with all applicable laws. c) The term “data/personal information”
including sensitive personal information, if any, shall include the mobile numbers, etc., of the
Participant(s).
4.3. The Ministry reserves the right to use aggregated and/or anonymized data for data analysis,
statistical and/or research purposes.

5. General Terms & Conditions


5.1. In participating with the Voting activity, it is assumed that the Participant is in agreement with
the Terms and Conditions herewith.
5.2. The winning Tourist Attractions will be determined through the number of votes received. For
the sake of abundant clarity, the Attractions with the highest number of total votes received will
be deemed the winners. The selection of winners is by no means an endorsement of and/or an
endorsement by any specific location, city, state, individual, group, entity, and/or otherwise. The
total quantum of winners determined across category and/or State/UT will be at the sole
discretion of the Ministry.
5.3. The database of Tourist Attractions on the website for the categories: (1) Spiritual, (2) Cultural
& Heritage, (3) Nature & Wildlife, (4) Adventure, acts as a point of reference in the form of
predictive text while casting Votes, if required, and may span across sites that are, Cultural &
Heritage, Hill Stations, Coastal, Wildlife, Shopping Experiences, Adventure Activities or
Spiritual, etc. This database is not comprehensive in nature by any means or form and/or
endorsed for by a specific individual, region and/or governing body. The database may be
updated from time to time, as deemed fit. To determine the final vote count, at the end of the
voting period, the latest updated database will be considered. The Ministry has sole discretion
over which Tourist Attractions to include as part of the voting mechanism.
5.4. For responses inputted through manual entry, to determine the final vote count, the Ministry has
the sole discretion to accept, delete, modify, update, change, and/or alter these responses. In case
a Participant inputs an incorrect Tourist Attraction, and/or there is a discrepancy in the response,
the vote will not be considered as valid. Further, the Ministry has the sole discretion to (1)
consider the vote as is, (2) invalidate the vote in case of any discrepancies in the response, or (3)
modify and consider the vote to the closest match (i.e.: updating minor spelling errors, etc.), as
deemed fit and on case-to-case basis and aggregate the votes as per the modification.
5.5. Participation in the Initiative does not imply any endorsement, approval, or support by the
Ministry for products, services, or opinions expressed by participants. The Ministry disclaims
any responsibility for individual views expressed during the Initiative, and/or related to the
Initiative. The Participant agrees and understands that they are solely responsible for their use of
the Website and for all activities that occur under their account, once registered.
5.6. The Participant(s) acknowledge that their participation in the Initiative is voluntary, and they are
under no obligation to provide a response. Additionally, Participant(s) declare that they will not
vote in a manner which is fraudulent, and/or cast their votes under duress and/or under the
influence of anyone else.
5.7. The Ministry reserves the right to disqualify the Participant(s) and/or disregard Participant’s
Vote(s) in case a discrepancy is found to exist in the information provided by the Participant(s)
and/or the Ministry has sufficient reason to believe in there is breach of any of these Terms and
Conditions by the Participant(s) and/or the Participant(s) has casted votes by any unfair practices
and/or it has reasonable grounds to suspect that fraudulent voting has occurred or if it considers
there has been any attempt to rig/manipulate the voting, at any point in time during the Voting
Period or otherwise.
5.8. The Ministry reserves the right in its sole and absolute discretion to amend, alter, modify,
change, vary or terminate any aspect of the Initiative format (including but not limited to,
nomination of the Tourist Attraction(s) and the selection/ determination/declaration of the
eventual winners of the vote and Lucky Draw, if any, timelines, and/or format), and/or any terms
and conditions mentioned and accordingly the rules for voting, these Terms and Conditions
and/or Initiative at any time, at its sole discretion, during the Period without giving any prior
notice. It shall be the sole responsibility of the Participant(s) to regularly access and view any
related communication. In case any portion/clause of these Voting rules is deemed invalid or
becomes unenforceable, such portions shall be considered divisible and shall not be part of the
consideration, and the remainder shall be valid and binding. The Ministry shall not be liable to
any of the Participant(s) for any reasons whatsoever. Further, the Votes casted for the Tourist
Attractions through the Voting Mechanism are binding on the Participant and in no event shall
the Participant dispute the same. The Participant(s) by participating in the voting agrees to such
amended terms.
5.9. In no event shall the Participants dispute any decision(s) made by the Ministry. By participating
in the Voting Mechanism, it shall be construed that the Participant(s) has hereby expressly or
irrevocably waived his/her right to raise any dispute with regard to the Initiative and/or the
results declared by the Ministry or attempt to restrain or injunct or enjoin, the development or
exploitation of the Initiative and/or the continuance of the Voting Mechanism against the
Ministry including but not limited to, its third party and/or its service providers and sub-
contractors. The Ministry shall not be answerable to any person with regards to any of the
processes related to the Initiative, including but not limited to determination of winners and/or
deriving the final vote count. No appeals or re-evaluations regarding winner determination will
be entertained.
5.10. The Participant(s) shall not in any circumstances make any claims against the Ministry,
including but not limited to, their divisions, their employees, their respective agents and
representatives, affiliates, if any, service providers and/or sub-contractors,, arising out of or
relating to any and all costs, injuries, for any kind of losses, damages, costs or injuries of any
kind, including due to any problems caused by technical disruption and/or failure, server
problems or any other difficulties.
5.11. In case of events beyond the reasonable control of the Ministry, including but not limited
to (1) acts of God, (2) war, including armed conflict, (3) strikes or labour disputes, (4) an
epidemic or pandemic, (5) government regulation or advisory (including travel advisory
warnings), (6) civil disturbance, (7) terrorism or threats of terrorism as substantiated by
governmental warnings or advisory notices, (8) curtailment of transportation services or facilities
which would materially affect any individuals related to the implementation of the Initiative (9)
disaster, fire, earthquakes, hurricanes, (10) unseasonable extreme inclement weather, (11)
shortages or disruption of the electrical power supply causing blackouts or rolling blackouts or
other essential utilities or (12) any other force majeure reasonably beyond the Ministry’s control
(collectively referred to as “Occurrences”), making the Initiative commercially impracticable,
then the Ministry reserves the right to modify the Initiative format, change the voting format or
voting medium, cancel the voting, delay the voting, conduct a re-voting or disqualify the voting
received in the manner it deems fit. Such decision shall be final and binding on the Participant(s)
and the same shall not be disputed and/ or challenged in a court of law.
5.12. Participant(s) agree and acknowledge that nothing contained in these Terms and
Conditions will be deemed to constitute a grant of license/ assignment and/or transfer of any
rights in and to the Voting Mechanism and/or Initiative whatsoever from the Ministry in
Participant’s favour. The Terms and Conditions shall be available on the Website to ensure that
no Participant is misled and understands the entire process and the other terms and conditions
mentioned herein prior to participating in the voting process.
5.13. The Participant(s) specifically agrees and acknowledges that any disputes or claims shall
be resolved individually, and the Participant(s) agrees to not file by resort to any form of class
action and/ or through any family member and/or third party applications, criminal and/ or civil
proceedings in any courts or forums against the Ministry, including but not limited to, their
employees, officers, affiliates, if any, service providers and/or sub-contractors, to claim any
damages. Under no circumstances will the Ministry, including but not limited to, the Ministry
entities, it’s service providers and sub-contractors, be liable for any consequential, indirect,
special punitive, or incidental damages or lost profits, whether direct or indirect, arising in any
way whether in contract, tort (including negligence) or otherwise.
5.14. Participant(s) agree and irrevocably acknowledge that the Ministry shall have the sole
and exclusive right including but not limited to intellectual property rights (copyrights and
trademarks) and other proprietary rights in and to the format of the Initiative, Voting Mechanism
and all its components whatsoever.
5.15. Participant(s) undertake that the Participant(s) shall not violate the rights of any third
party including but not limited to privacy rights, copyrights, trademark or any other intellectual
rights; shall not upload, reproduce, edit, change, prepare, store, collect, transmit or cause the
upload, storage, collection, transmission, of any information through the Website which violates
any applicable laws, including, inter alia, belonging to another person; or is harmful, harassing,
blasphemous, defamatory, obscene, invasive of other’s privacy, pedophilic, libelous, hateful, or
racially, ethnically objectionable, disparaging, harms minors in any way, violates any law for the
time being in force.
5.16. Participant(s) agree that Participant(s) shall not indulge in any kind of activities like
spamming or either directly or indirectly, reverse engineer, decompile or disassemble, make any
enhancements, modifications, customizations, changes, additions, translations, deceive or
mislead about the origin of such messages which is grossly offensive or menacing in nature, or
allow any kind of unfair practices such as multiple votes and affect the transparency of voting,
and/or participation in the Lucky Draw and Initiative. The Ministry reserves the right to take
appropriate action including criminal and/or civil action in such an event.
5.17. Participant(s) shall not attempt to gain unauthorized access to the Participant(s) accounts,
servers or networks connected to the Ministry services by any means including but not limited to
disrupt the Ministry services by uploading content which contains software viruses, or any other
computer code, files or Initiative designed to interrupt, destroy or limit the functionality of any
computer resource. Participant(s) agree not to disrupt, overburden, or aid or assist in the
disruption or overburdening of any computer or server used to offer or support the Ministry or
the Ministry services. Participant(s) shall not attempt to transmit content regarding services,
products, surveys, contests, pyramid schemes, spam, unsolicited advertising, or promotional
materials, and/or chain letters.
5.18. The Ministry shall not be responsible for any errors or omissions in the Terms and
Conditions contained herein. All information provided is provided “As is” without warranty of
any kind. The Ministry makes no representations and disclaims all express, implied, and
statutory warranties of any kind to the Participant(s) and/or any third party including, without
limitation, warranties as to accuracy, timelines, completeness, merchantability, or fitness for any
particular purpose.
5.19. Regarding Technical and/or Network disruptions:
a. The Ministry shall not be responsible for any break or disconnection or disruption
and/or be liable in any manner whatsoever for any network problem, unclear network,
disruption in the network, connection failure, electricity failure, internet service
provider, facility provider, or due to capacity constraints or any other reason
whatsoever irrespective of the network being used. In addition, the Ministry shall not
be responsible and liable in any manner whatsoever in the event of any failure in the
Voting Mechanism including without but not limited to voting system, telecom failure,
session failure, logging failure, close or any other difficulties of such nature due to
which the Participant(s) is charged by the telecom operator and/ or is unable to
participate.
b. The Ministry shall endeavor to make all reasonably practicable arrangements to ensure
uptime of systems, back-up of data, server capacity and prevent other technical
impediments, but can make no guarantee thereof and shall not in any manner be
responsible for any technical problem with the internet and by participating in the
present voting, the Participant(s) agrees not to hold the Ministry liable for any such
technical problem or shall have any claim in this regard.
c. While all attempts will be made to protect the voting data from loss and/or corruption,
Participant(s) agree and acknowledge that all systems are prone to failure and hacking
attempts. In the event of any data loss, the Ministry shall make reasonable endeavors
and may disqualify all the Vote(s) received or conduct a re-voting or continue with
whatever data available in the manner it deems fit. The Ministry will not be responsible
for any damage resulting from the loss of data or action taken by the Ministry on
account of the same. The Ministry will not be responsible to make good any loss or
dissatisfaction suffered by the Participant on account of such loss.
d. The Ministry will not be responsible if the votes of the Participants do not get
registered on the Website due to any technical errors and/or any other issues. The
Participant(s) is advised to go through the terms and conditions on the Website before
casting their votes. The Participant(s) shall not raise any claims against the Ministry for
any errors and/or omissions and/or any issues of whatsoever in relation to the voting,
and/or participation in the Lucky Draw and Initiative on the Website. Please note, proof
of submission is not proof of receipt of the same.
e. The Ministry will not be responsible for any failure, delays / non-availability /
downtime of the application service or website service or any other technical or non-
technical issue that prevents the voting or interrupts with the voting process.
5.20. The Ministry, including but not limited to, its affiliates, if any, service providers and/or
sub-contractors, are not responsible for delayed receipt or non-receipt or incomplete receipt or
corrupt receipt of votes and/or OTP verification during voting process.
5.21. The Ministry, including but not limited to, its affiliates, if any, service providers and/or
sub-contractors, process evaluators, process advisors, process auditors, contractors, partners and
promotion and/or advertising agencies are not responsible for technical, hardware, software, or
other communications malfunctions, errors or failures of any kind, lost or unavailable network
connections, Web-site, Internet, or ISP availability, unauthorized human intervention, traffic
congestion, incomplete or inaccurate capture of information (regardless of cause) or failed,
incomplete, garbled, jumbled or delayed computer transmissions which may limit Participant’s
ability to vote, resulting from participating in or downloading any materials. The Ministry and its
organizers are not responsible for lost, late, illegible, incomplete, invalid, unintelligible,
technically corrupted or misdirected votes, which will be disqualified. The Ministry shall attempt
to use commercially reasonable efforts to ensure the security and accuracy of all votes.
5.22. Participant(s) acknowledges and agrees that the relationship between the Participant(s)
and the Ministry is not a confidential, fiduciary, or other special relationship.
5.23. The Terms and Conditions shall be construed and governed in accordance with the laws
of India and in case of any dispute or other matter arising shall be referred to a sole arbitrator
appointed by the Ministry and shall be governed by the Arbitration and Conciliation Act, 1996,
amended from time to time. The venue for arbitration shall be New Delhi. The Ministry shall not
be liable for any kind of charges and/or expenses in connection to the Arbitration and it shall be
solely borne by the Participant who has raised the dispute.
5.24. Read with the provisions above, the Courts having jurisdiction under the provisions of the
Arbitration and Conciliation Act, 1996, to determine all matters which the Court is entitled to
determine under the Act, including, without limitation, provision of interim reliefs under the
provisions of Section 9 of the Arbitration and Conciliation Act, 1996, shall exclusively be the
courts at New Delhi, India.
5.25. The website is controlled and offered by the Ministry from its facilities in India. The
Ministry makes no representations that the website is available for use in other locations.
Participants accessing and/or using the website from other jurisdictions, do so at their own
volition and are solely responsible for compliance with applicable laws. The Ministry cannot
guarantee whether the website will function, for a multitude of reasons, including but not limited
to: applicable laws and permissions in jurisdictions outside India, and/or if any organization has
blocked the IP/subdomain of the website, due to any network and/or connectivity issues if the
Participant is within or outside of India, etc. The Ministry shall not be responsible for the
Participants not being able to access the website and/or the Participant not being able to cast their
vote in such situations, or any other situations that may arise.
5.26. Indemnities: Any conflict related to various provisions and interpretation of these Rules
will be addressed by the Ministry. The decisions shall be final and binding.

6. Disclaimers
6.1. The Ministry has no obligation to screen information submitted and is not responsible for
monitoring information submitted, to prevent violation of intellectual property ownership rights,
or violations of any law, rule or regulation.
6.2. The Website is provided on an "as-is" basis without any warranties of any kind. To the fullest
extent permitted by applicable law, the Ministry disclaims all warranties, express or implied,
including, but not limited to, implied warranties of merchantability, fitness for a particular
purpose and non-infringement in respect of the Initiative and Website. Without limiting the
foregoing, the Ministry specifically disclaims any warranty (a) that the Website will be
uninterrupted or error-free, (b) that defects will be corrected, (c) that there are no viruses or other
harmful components that exist on the Website (d) regarding the security of information
submitted, and (e) regarding correctness, accuracy, or reliability. If use of the Website and
Voting results in the need for servicing or replacement of Participant(s) or another's equipment
or data, the Ministry is not responsible for those costs.
6.3. Participation in the voting process is free of cost and all Participants are requested to exercise
caution against any person/entity that demands money or its equivalent for the purpose of
participation. The Ministry abhors such practices and disclaims all responsibility for the same.
The Ministry shall not be liable to any Participant(s) for any amount paid in this regard.
6.4. The Ministry is the sole and unconditional owner of the Initiative, including but not limited to,
all related decisions, activities, format and adjoining intellectual property rights.

7. Limitation of Liabilities and Remedies


7.1. The Ministry reserves the right, in its sole discretion, at any time and at any stage of the
Initiative, to reject or disqualify any Tourist Attractions that are deemed ineligible, and/or any
other element of the Initiative, for any reason that the Ministry feels is necessary and/or
appropriate.
7.2. Participants, users and/or any party that accesses the Website, agrees that neither the Ministry
nor any third party content and/or service providers/sub-contractors involved in the Initiative will
be liable to Participant(s) for any loss or damages, either actual or consequential, arising out of
or relating to these Rules, Participants use or inability to use the Website, or to reliance upon
information obtained from or through the Website, participation in the Initiative, or use or
misuse of any prize (if applicable). In particular, neither the Ministry nor its third party and/or
service providers will have liability for any direct, consequential, indirect, punitive, special or
incidental damages, whether foreseeable or unforeseeable (including, but not limited to, claims
for defamation, errors, loss of data, or interruption in availability of data), arising out of or
relating to the Initiative, terms of use, visitor's use or inability to use the Website, or to visitor's
reliance upon information obtained from or through the Website, participation in the Initiative,
travel, or use or misuse of any prize, whether based in contract, tort, statutory or otherwise.
7.3. To the fullest extent permitted by law, the Ministry disclaims any liability for indirect,
consequential, incidental, or special damages arising from the Initiative, including but not
limited to loss of profits, data, or goodwill.
7.4. The participation in the Initiative implies unconditional acceptance of all these Terms and
Conditions of the Initiative by the Participant(s).
These Terms and Conditions shall be applicable from 7th March 2024.
All the content related to the Initiative has originally been written in English. In case of any conflict in the
interpretation between any translated language, the interpretation of the English content shall prevail.
