Abstract

Synopsis
Introduction: In this 21st century, the topic which is in the hottest
buzzwords is ARTIFICIAL INTELLIGENCE.
What is AI?
Artificial intelligence is simple words can be stated as
According to Winston: AI is the study of computation that make it
possible to perceive, reason and act.
According to Stuart Russell and Peter Norwick: AI means an
intelligent agent. Agent means a software system which perceives its
environment through sensor and acts upon the environment through
activation.
According to European union proposed AI act: Article 3 (I) of the
draft; It means a software that is developed with specific techniques
and approaches listed in annexure (1) and can for a given set of
human define objectives, generate outputs such as contents,
predictions, recommendations or decisions influencing the
environment they interact with.
There are various technologies and software generated by AI and
DEEPFAKE is one of the hottest technology in AI world. So basically
DEPFAKE are the photos, videos and audios created by artificial
intelligence software. Deepfake technology is a technique that
manipulates videos using high-powered computers and deep learning.
It can modify or recreate a real content in a highly realistic way. The
characteristics and movements of a face or body can faithfully imitate
a given will. The word deepfake is created by merging the term ‘fake’
and ‘deep learning’ a particular AI technology. It is the next level of
fake content creation that takes advantage of artificial intelligence.
The techniques used by deepfake are like those of the various apps
with which one can assume oneself by modifying the morphology of a
face, ageing it, changing its sex, etc.

Statement of the problem


Every technology have its own pros and cons. Similarly deepfake
technology also have its own advantages and disadvantages. On the
one hand it is proving boon to us and on the other side it is generating
serious and privacy issues due to having a high level of creative and
educational value that can be used in socially undesirable ways.
As we all know that the deepfake technology have become quite
ubiquitous and pervasive over the internet in short period of time and
thus it can have menacing consequences creating treacherous
concerns for everyone.
It raises out many ethical concerns. Deepfake videos, pictures, audios
can be used in form of creating obscenity, political campaigns, false
news reports, IPR violations and non-consensual obscenity.
Deepfake is playing an important role in emerging fraud and
cybercrime trends. This has become a growing concern among
consumers and organizations, as deepfakes are exploited by criminals
to carry out social engineering attacks, the spread of misinformation
and fraud scams.
Also globally we don’t have that much laws against the crimes being
done through the usage of deepfake technology. This has raised
concerns not only in India but around the world.
The most concerning aspect of this technology is that the cost of a
deepfake scam was estimated to exceed $250 million in 2020
globally, and this form of technology is still in its early stages.

Deepfake technology attacks:

Energy Firm CEO


This deepfake scam from 2019 is the first known deepfake attack to
occur, and it illustrates the unfortunate dark side of deepfake
technology’s capabilities. In a classic case of corporate extortion, the
CEO of an energy firm took a phone call from who he thought was
his boss and chief executive of the firm. In reality, the voice was
actually an AI-generated deepfake voice—which is why he promptly
cooperated with the urgent request to transfer $243,000 within the
hour.

Recently in Ahmedabad, India, Deepfakes replace women on


sextortion calls. And this thing is giving rise to online operating frauds,
scams, sex rackets and much alike contents. But till now there is no any
such legislation or laws made that deal with the crimes done through
deepfake technology.

As we know that deepfake propagates misinformation,


impersonate others, and perpetrate other sorts of abuse but still
there are many countries including India which does not have any
legislation on the privacy issue raised by AI’s most prominent
technology that is deepfake.

RESEARCH METHODOLOGY
In this research work of AI on the topic of “Deepfake: An issue of
privacy” the objective is to analyse the privacy issues created by the
deepfake technology and the legislation concerning with it and crimes
done through it. The research is done through thoroughly studying the
online articles on internet and the recent data updated.
