AFFIDAVIT OF SERVICE

I, WANJIRA KIHARA, of P.O. Box 1343-00200 Nairobi hereby make oath and state as
follows:

1. THAT I am an advocate of this Honourable Court duly authorized to serve civil process.
2. THAT on 8th September 2023 I received in duplicate copies of Summons to enter
appearance, Plaint, Verifying Affidavit, List of Witnesses, Witness Statements and List
of Documents with the documents attached from Mbriri Ngugi & Co. Advocates with
instructions to serve upon the 1st and 2nd Defendant herein.
3. THAT on the 8th day of September, I proceeded to the 1 st Defendant’s offices; Bycliff
Enterprises, Luthuli House, Luthuli Street.
4. THAT upon arrival I found the secretary to whom I introduced myself and the purpose
of my visit. I served the abovementioned documents upon the secretary who
acknowledged service by electronically endorsing a stamp and a signature on the
principal copy which I herewith return as duly served.
5. THAT on the same day, I sent to the 1st Defendant herein via WhatsApp Platform
Mobile Phone Number +254 720 289 369 the said document. This mobile phone number
is registered under the 1st Defendant’s name. It immediately indicated to have been
received and read as two blue ticks appeared on his platform. A print out is attached.
6. THAT on the 8th day of September, I proceeded to the 2nd Defendant’s offices Panafric
Builders Limited, Jampark Plaza (DAGORETTI/RIRUTA/3203, Ngong road.
7. THAT upon arrival, I found the secretary to whom I introduced myself and the purpose
of my visit. I served the documents mentioned in number (2) above, upon the secretary
who acknowledged service by electronically endorsing a stamp and a signature on the
principal copy which I herewith return as duly served.
 8. THAT on the same day I sent to the 2 nd defendant herein via WhatsApp Platform Mobile
Number +254 725 286 835 the said document. This mobile phone Number is registered
under the 2nd defendant’s name. It immediately indicated to have been received and read
as two blue ticks appeared on his platform. A print out is attached.
9. THAT what is deponed herein is true to the best of my knowledge, information and
belief.
