IV. What Is It

Law enforcement is probably the most visible segment of the criminal justice
process.(Doerner, 1992 p.1 in the CAT handbook by Coloma, Buena,Zapanta)

A. Community Ordinances

Ordinances are laws passed and enforced in order to protect the general
welfare and promote and order.

1. An ordinances prohibiting the drinking of beer,liqour , or other alcoholic


or intoxicating beverages in sari-sari store, sidewalk, park, plaza or other
similar places.

2. An ordinance requiring all law enforcement when conducting an arrest/s


or any operation in the barangay and further furnish the barangay captain
a copy of the post arrest or operations;subject to all laws and existing legal
rules and regulations.

3. An ordinance penalizing all forms of illegal gambling not regulated or


sanctioned under existing laws in the barangay , and for other purposes.

4. An ordinance prohibiting owners of four legged animals such


as:dogs,pigs, carabaos, goats, and other animals from allowing them to
loiter to go away in public and private streets,plazas ,and parks.

B. Crime Prevention

Crime is an act committed or omitted in violation of a public law forbidding or


commanding it.(I Bouvier’s law)

Criminal law is a branch or division of law which defines crimes,threats of their


nature and provides for their punishment.(Reyes,revised Penal Code,1993)

Crime prevention or crime preventive measure is an important perspective


in the society.it modifies opportunities of criminals to take advantages.Crime
prevention programs are attempts to incorporate the community into the criminal
justice process which are explicit,consciously planned strategies for establishing
order rather than emergent qualities of the social setting.

Crime should be preventive through community effort,in enforcing the law


by being a law abiding citizen,obedience to la and authority is the hallmark of a
dutiful citizen and good follower.

Crime cannot be prevented as long as the people are indifferent.Preventive


measures are only found in the collaborative approach to risk
management,expressed in these cases by the joint identification of problem
areas.Support from the police in enforcing the law; protecting life;keeping away
from the commission of crime; preventing people from wrecking the criminal
activities; recuperate offenders and returning them to the community of law abiding
citizens.

C. The Five (5) Pillars of Criminal Justice System

1. The Prosecution

Once the charges are logged,the next step in the criminal justice process is the
initial appearance.The initial appearance,sometimes also called the first
appearance,usually takes place within 24 hours after the arrest.Hence,the suspect
goes before a judicial officer-who formally advises the person of the charges that he
or she faces.He/She takes this opportunity to remind the defendant of certain
constitutional rights,including the right to have a court-appointed lawyer if one
cannot afford a private attorney.

2. The Courts

Most people think of this process as being synonymous with a trial which
composed of two phase the trial and sentencing phase.

3. Corrections

The final stopping point in the journey through the criminal justice process in the
correctional component of the correctional system provides care for defendants who
were found guilty and sentenced to save form of supervision.

4.The Arraignment

The next event in the trek through the criminal justice process wherein the
prosecutor reviews all the submitted case material during the time between the
initial appearance and of this.He decides whether the evidence substantiates the
charge,whether the arrest was lawful, and whether the officer obtained evidence in
a lawful manner.

5.The Law Enforcer

The most widely recognized and most visible component of the criminal justice
process is the people.The policeman are entrusted with the widest mandate of all
criminal justice representatives.They enforce laws,apprehend suspects,take part of
the court proceedings,protect constitutional rights,maintain peace,monitor vehicle
traffic,prevent crime and deliver a host of service to people who help
need.However,the very fact that the police shoulder these diverse activities point to
just how complex the police role in the society.

D.. Philippine Criminal Justice System

The Philippine Criminal Justice System is more of a process than a system.It reflects
social changes and attitudes.It is the total activities of law enforcers,the
prosecutors,judges,defense lawyer and corrections.

One important thing to remember is that the police does not exist within a
vacuum.They are members of a larger process that people call the criminal justice
system.The criminal Justice Process is the conglomeration of agencies and actors
together to deal with and the criminal.
