ABOUT CIPR
Intellectual Property Rights is ever-growing in importance
and application across varied domains. The Centre for
Intellectual Property Rights (“CIPR”) was established to
enhance the Intellectual Property knowledge base with the
following objectives and functions:

Disseminate information about intellectual property


rights,

Create awareness about the regime of Intellectual


Property Rights laws,

Promote creativity and dialogue on emerging issues in


the field of IPR,

Aid in academic and policy-oriented dialogue in the


individual and intersectional areas of innovation and
Intellectual Property,

Undertake research and publications, and

Conduct activities/ events/ training/ field visits based


on IPR, and its related areas.

ABOUT THE CLIENT


COUNSELLING COMPETITION

Client Counselling is a strategic skill deeply embedded in the


basic principles of sound advocacy. The Client Counselling
Competition promotes greater knowledge and interest among
law students and exposes them to practical aspects of
advocacy that help them develop holistically. It also
encourages students to develop interviewing, planning, and
analytical skills in the lawyer-client relationship in the law
office. Moreover, a healthy educational and cultural
interchange between various learners, law teachers, and legal
practitioners is also envisaged.

This event marks the celebration of World IP Day by aiming


to foster a deeper understanding of the realm of IPR laws,
enabling the students to apply the laws they studied
practically.

GENERAL INFORMATION

The competition shall consist of Oral Arguments over the


Preliminary (Elimination) Round and the Final Round.

Dates and Timings: 26 April 2024; 10:00 AM TO 4 PM

Eligibility: The event is open to VSLLS students of all


semesters.

Language: The official language for the conduct of the


Competition shall be English.

Dress Code: Advocate’s Uniform as under the Advocates Act


1961 (barring band and gown.)

TEAM COMPOSITION

1. Each Team shall be composed of 2 members (in the role


of counsel).

2. Teams cannot be changed or altered after registration.

3. Any change or alteration in the registered team is subject to


the sole discretion of the Organizing Committee.

4. Team Codes shall be allotted to the respective teams via


email, by the Organizing Committee which shall be used to
identify the team throughout the competition

CLIENTS

The clients will be assigned by the organizers. Each team shall


interact with their client for the first time during the
‘consultation’ session. The participants shall be expected to
interact with clients on the spot and no prior information
concerning the problem shall be intimated.

STRUCTURE OF THE COMPETITION


There will be one Preliminary Round and a Final Round.

1. Each team will have one counselling session in Preliminary


Round, and one counselling session in the final round if the
team advances.

2. One team from each room will advance to the finals based
on the highest team score.

3. In case of a tie, the team having a higher score for the


‘consultation’ part, will advance to the next round.

FORMAT OF THE ROUNDS


Each session will be divided into 3 parts: Consultation, Post-
Consultation and Critique.

1. Consultation:
• This time period shall commence once the client enters the
chamber.
• This time period is intended for consultation with the client,
during which participants are expected to gather pertinent
information, outline the issue, and ascertain the client's
expectations, among other tasks.

2. Post Consultation:
• This time shall start as soon as the client leaves the
chamber.
• During this period the client will leave the chamber and
the team members may talk to each other in a manner that
is audible to the judges.
• The team members may talk with each other about the law
which may concern the situation, clarification of facts;
attorney fees, etc. and the teams will be marked on the
same.

3. Critique:
• During this time period the client will re-enter the
chamber.
• In this time period, the teams have to summarily explain
to the client the strategy for dealing with the client’s legal
problem, the basis for their arguments, and also clarify any
doubts the client may have.
• The judge(s) may ask questions during this time period.

PROPOSITION

1. The office memo for the preliminary round will be shared


with the parties 1 day before the competition.

2. The office memo for the final round will be shared after the
preliminary round is complete and the teams for the final
round are selected.

3. Finalists will be given 1 hour for preparation before the


commencement of the final rounds.

APPLICABLE LAW

The problems shall be broadly based on the “Trademarks Act”


and “Contract Law”. The participants are expected to be
familiar with other ancillary laws and procedures.

AWARDS AND CERTIFICATES

The announcement and presentation of awards and


certificates will occur exclusively during the Results Ceremony
scheduled for April 30, 2024.

CODE OF CONDUCT

1. The participants are expected to maintain decorum. In case of


any dispute arising out in the interpretation of the rules, or
otherwise, the decision of the Organising Committee would be
final.

2. Use of electronic gadgets like laptops, tablets, mobile phones


etc. shall not be allowed. (Use of any electronic gadget for
communication and/or use of the internet may result in
disqualification of the team).

3. Any unethical, immoral, or unprofessional behaviour by any


participant or those engaging may result in disciplinary action,
the sole discretion of which rests with the Organizing
Committee.

MISCELLANEOUS

1. Teams are required to report to the venue for Registration on


the day scheduled for rounds at 10 AM.

2. Participants shall not be allowed to watch proceedings of


other rounds or other CC rooms. Scouting is strictly prohibited
and if any member of a team is found indulging in scouting
activity, the same shall result in disqualification of the concerned
team.

3. The Judge-Panel and the Organizing Committee reserve the


right to decide scores et cetera. The Participants will be scored
on their IPR knowledge, analysis of the problem, creative
solution and professionalism (with the other counsel and with
the client.)
