To what extent do you feel that Cicero uses a broad range

of arguments in the sections of Pro Milone you have

studied?
Sections 43 – 52 ENGLISH

43 Milo would not come to the elections with blood on his hands

Without Milo (as consul) Clodius would have a lot of power

Clodius took delight in ignoring the usual constraints of law

44 Clodius said that Milo would die within 3 days (and he died on the third day). If he said it

so openly why doubt he’d actually do it?

45 Clodius would have known Milo’s movements (going to Lanuvium). It made more sense
for Clodius to be remaining at Rome (at a rowdy public meeting). Milo had no knowledge
of Clodius’ movements.

46 Clodius suddenly left for Rome.

48 Why did he need to rush to Rome? – he knew Cyrus was about to die.

49 Why would he wish to travel at night (danger). Milo could have attacked him close to

Rome.

50 An attack by Milo close to Rome could easily have been blamed on other groups eg robbers

or those who hated Clodius.

51 Milo would not have wanted to attack him close to his villa – would have attacked him at

an earlier stage.

Sections 53 – 64 LATIN

53 Why would Milo have wanted to attack Clodius in front of his villa with his many men
available and with the villa being high up?
54 Milo was not in a position to launch an attack as he was encumbered by his heavy cloak, wife
and a carriage.

Clodius seemed to be behaving strangely near his own villa– delaying and time wasting and
waiting for Milo.

55 Clodius was unencumbered – no wife, no carriage and none of his usual Greek companions

Sometimes the tables are turned and the robber is killed by the traveller.

56 Milo was well aware that Clodius wanted him dead.

Clodius was overcome because he was well-fed, drunk and yawning.

Milo's slaves behaved as they should – they feared for the life of their master.

57, It could be argued that Milo freed his slaves because he didn't want them tortured and
58 incriminating information to come forward – no – this is not the case – it is true that the
slaves killed Clodius, so torture is not needed.

59, To interrogate Clodius' own slaves to find evidence against Milo is ridiculous – they will say
60 what they need to say to save themselves.

61 Milo returned with confidence to Rome, when some expected he would not. This would not
& be the behaviour of a guilty man.
62

62 The wisest men could see the reasonableness of what Milo had done (self defence)

Sections 64 – 71 ENGLISH

64 Milo has not buckled under the weight of the damaging charges – his response is admirable.

66 Milo has nothing to hide – he even stripped off before the senators to prove he was
unarmed (in response to rumours that he was armed)

67 Is Milo really such a threat that extensive military preparations are needed against him?

68 Pompey – you and Milo have previously enjoyed a friendship which was beneficial to you
both.

If his presence was going to be disruptive in Rome, Milo would have left (unselfish).

69 In a crisis, Pompey, Milo may be useful (therefore he should not be exiled)

70 Pompey could have had Milo executed and not had a trial (if he really was a major threat).
Pompey’s law changes allow Milo to be acquitted.

71 As above, there are troops present – could have been used to punish Milo.

Sections 72 – 80 LATIN

72 Milo could be adequately defended by saying that he had deliberately killed Clodius.

Clodius is worse than others who tried to subvert the state

73 Clodius deserved what he got because:

He defiled religion
Incest
Exiled Cicero
Interfered in foreign policy for his own advantage

74 & Clodius deserved what he got because he had no respect for the properties of others

75

76 Clodius deserved what he got because if he had become praetor he would have damaged
Rome’s external relations and not kept his hands from your wives & children. He would
have raised a private army.

77 Milo could have boasted and received approval for killing Clodius

78 This will be a good year, but it wouldn’t be if Clodius was still on the scene.

79 Neither you nor the jury would want to bring Clodius back from the dead.

80 The Greeks honour men who killed tyrants and Milo should be honoured like this.

Milo would boast if he had deliberately killed Clodius.

Sections 98 – 105 ENGLISH

98 Milo has achieved glory amongst the Roman people and all nations
99 He (Cicero) couldn’t bear to see Milo condemned.

103 Exiling Milo would make a mockery of Cicero being recalled from exile.

105 You, the jurors, were chosen because you are the best, wisest and most fearless – now

show this by finding Milo not guilty.
