‭RESIDENTIAL CONTRACT OF LEASE FOR RENEWAL‬

‭Road,‬ ‭Caloocan‬ ‭City‬‭represented‬‭therein‬‭by‬‭its‬‭President‬‭John‬‭Carlo‬‭F.‬‭De‬‭La‬‭Cuesta‬‭,‬
‭hereinafter called the “‬‭LESSOR‬‭”.‬

‭Contract‬‭under‬‭mutually‬‭agreed‬‭upon‬‭terms.‬‭The‬‭LESSEE‬‭may‬‭signify‬‭his‬‭intention‬‭to‬‭renew‬
‭the‬ ‭Contract‬ ‭by‬ ‭notifying‬ ‭the‬ ‭LESSOR‬ ‭at‬ ‭least‬‭sixty‬‭(60)‬‭days‬‭before‬‭the‬‭Contract‬‭expires.‬
‭Should‬ ‭the‬ ‭LESSEE‬ ‭AND‬ ‭LESSOR‬ ‭fail‬ ‭to‬ ‭agree‬ ‭on‬ ‭the‬ ‭terms‬ ‭for‬ ‭the‬ ‭Contract’s‬ ‭renewal‬
‭within‬‭thirty‬‭(30)‬‭days,‬‭the‬‭lease‬‭shall‬‭not‬‭be‬‭renewed‬‭and‬‭be‬‭terminated‬‭on‬‭the‬‭original‬‭date‬
‭stipulated herein.‬

I‭ f‬ ‭the‬ ‭LESSEE‬ ‭shall‬ ‭pre-terminate‬ ‭the‬ ‭Contract,‬ ‭the‬ ‭LESSEE‬ ‭has‬ ‭to‬ ‭serve‬ ‭a‬ ‭notice‬ ‭to‬ ‭the‬
‭LESSOR‬ ‭at‬ ‭least‬ ‭thirty‬ ‭(30)‬ ‭days‬ ‭before‬ ‭the‬ ‭pre-termination.‬ ‭Furthermore,‬ ‭If‬ ‭the‬ ‭LESSEE‬
‭pre-terminates‬‭the‬‭contract‬‭before‬‭the‬‭term‬‭of‬‭the‬‭lease‬‭on‬‭____________,‬ ‭the‬‭LESSEE‬‭shall‬
‭be‬ ‭responsible‬‭for‬‭paying‬‭an‬‭early‬‭termination‬‭penalty‬‭of‬‭PhP______________equivalent‬‭to‬
‭2 months of rent and forfeit any security deposit and advance rentals.‬
‭3.‬ ‭ ENTAL‬ ‭RATE.‬ ‭The‬ ‭LESSEE‬ ‭and‬ ‭LESSOR‬ ‭agree‬ ‭that‬ ‭the‬ ‭monthly‬ ‭rental‬ ‭is‬ ‭PhP‬

‭___________‬ ‭monthly‬ ‭and‬ ‭paid‬ ‭on‬ ‭the‬ ‭2nd‬ ‭of‬ ‭each‬ ‭month‬ ‭via‬ ‭Direct‬ ‭deposit‬ ‭to‬ ‭GCASH‬
‭account.‬ ‭Furthermore,‬ ‭the‬ ‭LESSEE‬ ‭is‬ ‭responsible‬ ‭for‬ ‭any‬ ‭transfer‬ ‭fees‬ ‭associated‬ ‭with‬ ‭the‬
‭deposit, the LESSOR shall receive an amount no less than the monthly rental stated above.‬

‭ he‬‭monthly‬‭rental‬‭will‬‭increase‬‭yearly‬‭by‬‭1%‬‭on‬‭the‬‭next‬‭renewal‬‭date‬‭based‬‭on‬‭the‬‭monthly‬

‭rental‬ ‭of‬ ‭the‬ ‭immediately‬ ‭preceding‬ ‭year.‬ ‭Unpaid‬ ‭rental‬ ‭balances‬ ‭shall‬ ‭be‬ ‭charged‬ ‭300‬
‭hundred‬ ‭pesos‬ ‭per‬ ‭month‬ ‭from‬‭the‬‭due‬‭date‬‭until‬‭full‬‭payment.‬‭This‬‭is‬‭without‬‭prejudice‬‭to‬
‭the LESSOR’s other remedies under the Contract and law by reason of such default.‬
‭4.‬ ‭ DVANCE‬ ‭&‬ ‭SECURITY‬ ‭DEPOSIT.‬ ‭Upon‬ ‭signing‬ ‭the‬ ‭Contract‬ ‭renewal,‬ ‭the‬ ‭LESSEE‬

‭will‬‭not‬‭be‬‭required‬‭to‬‭pay‬‭any‬‭1-month‬‭advance‬‭payment‬‭or‬‭2-months‬‭security‬‭deposit‬‭to‬‭the‬
‭LESSOR.‬‭However,‬‭the‬‭security‬‭deposit‬‭paid‬‭during‬‭the‬‭initial‬‭contract‬‭will‬‭remain‬‭in‬‭place‬
‭as‬ ‭stated‬ ‭in‬ ‭the‬ ‭principal‬ ‭contract.‬ ‭The‬ ‭security‬ ‭deposit‬ ‭covers‬ ‭the‬ ‭LESSEE's‬‭unpaid‬‭water‬
‭bills‬ ‭and‬ ‭damages‬ ‭related‬ ‭to‬ ‭the‬ ‭leased‬ ‭property,‬ ‭excluding‬ ‭electricity‬ ‭bill‬ ‭and‬ ‭rental‬
‭payments.‬‭If‬‭damages‬‭exceed‬‭the‬‭deposit‬‭amount,‬‭the‬‭LESSEE‬‭is‬‭liable‬‭for‬‭the‬‭balance.‬‭The‬
‭deposit,‬ ‭minus‬ ‭chargeable‬ ‭amounts,‬ ‭is‬ ‭refundable‬ ‭without‬ ‭interest‬ ‭ninety‬ ‭(90)‬ ‭days‬
‭post-contract termination provided the property is returned in good condition.‬
‭5.‬ ‭ CCUPANTS‬‭.‬ ‭The‬ ‭LESSEE‬ ‭will‬ ‭exclusively‬ ‭use‬ ‭the‬ ‭Leased‬ ‭Property‬ ‭for‬ ‭residential‬

‭purposes‬ ‭only‬‭and‬‭for‬‭no‬‭other‬‭purpose‬‭without‬‭the‬‭LESSOR’s‬‭written‬‭consent.‬‭The‬‭Leased‬
‭property‬ ‭allows‬ ‭a‬ ‭maximum‬ ‭of‬ ‭8‬ ‭occupants‬ ‭at‬ ‭any‬ ‭given‬ ‭time.‬ ‭LESSOR‬‭can‬‭audit‬‭tenants.‬
‭Unlisted‬‭occupants‬‭without‬‭LESSOR's‬‭consent‬‭may‬‭lead‬‭to‬‭contract‬‭termination.‬‭The‬‭Leased‬
‭property shall only be occupied by the LESSEE and following individuals:‬

‭6.‬ I‭ MPROVEMENTS‬ ‭&‬ ‭REPAIRS.‬ ‭The‬ ‭LESSEE‬ ‭shall‬ ‭not‬ ‭introduce‬ ‭any‬ ‭improvement‬ ‭on‬
‭the‬ ‭Leased‬ ‭Property‬ ‭without‬‭the‬‭LESSOR’s‬‭consent.‬‭If‬‭the‬‭LESSOR‬‭allows‬‭the‬‭LESSEE‬‭to‬
‭introduce‬ ‭an‬ ‭improvement‬ ‭on‬ ‭the‬ ‭Leased‬ ‭Property,‬ ‭such‬ ‭change‬ ‭or‬ ‭improvement‬ ‭will‬
‭automatically‬‭become‬‭the‬‭LESSOR’s‬‭property,‬‭without‬‭any‬‭obligation‬‭on‬‭the‬‭LESSOR’s‬‭part‬
‭to refund.‬

‭ he‬‭LESSEE‬‭shall‬‭be‬‭responsible‬‭for‬‭maintaining‬‭the‬‭cleanliness‬‭of‬‭the‬‭leased‬‭property‬‭and‬

‭expense‬ ‭of‬ ‭all‬ ‭repairs,‬ ‭including‬ ‭any‬ ‭damage‬ ‭caused‬ ‭by‬ ‭their‬ ‭visitors.‬‭For‬‭new‬‭tenants,‬‭the‬
‭LESSOR‬‭may‬‭provide‬‭a‬‭30-day‬‭warranty‬‭to‬‭repair‬‭any‬‭defects‬‭or‬‭damage‬‭existing‬‭prior‬‭to‬‭the‬
‭move-in‬ ‭date.‬ ‭Any‬ ‭repairs‬ ‭or‬ ‭replacement‬ ‭beyond‬ ‭the‬ ‭30-day‬ ‭warranty‬ ‭period‬ ‭shall‬ ‭be‬ ‭the‬
‭sole responsibility of the LESSEE.‬
‭7.‬ ‭ ERMINATION.‬‭If‬‭the‬‭LESSEE‬‭fails‬‭to‬‭pay‬‭the‬‭rent,‬‭water‬‭bill,‬‭and/or‬‭electricity‬‭bill‬‭for‬‭2‬

‭consecutive‬ ‭months,‬ ‭the‬ ‭LESSOR‬ ‭has‬ ‭the‬ ‭right‬ ‭to‬ ‭terminate‬ ‭this‬ ‭contract‬ ‭and‬ ‭evict‬ ‭the‬
‭LESSEE‬ ‭from‬ ‭the‬ ‭property.‬ ‭The‬ ‭Contract‬ ‭can‬ ‭be‬ ‭terminated‬ ‭by‬ ‭the‬ ‭LESSOR‬ ‭through‬
‭electronic or written notice, without the need for barangay and court action.‬

‭ he‬ ‭LESSEE's‬ ‭termination‬ ‭can‬ ‭only‬ ‭be‬ ‭cured‬ ‭by‬ ‭making‬ ‭full‬ ‭payment‬ ‭of‬ ‭all‬ ‭outstanding‬

‭amounts,‬‭including‬‭water‬‭bill,‬‭electricity‬‭bill,‬‭and‬‭rental‬‭payments,‬‭as‬‭well‬‭as‬‭addressing‬‭any‬
‭violations‬‭of‬‭house‬‭rules‬‭within‬‭fifteen‬‭(15)‬‭days‬‭of‬‭receiving‬‭notice.‬‭In‬‭case‬‭of‬‭eviction,‬‭any‬
‭personal‬ ‭belongings‬ ‭left‬ ‭by‬ ‭the‬ ‭LESSEE‬ ‭at‬ ‭the‬ ‭Leased‬ ‭Property‬ ‭will‬‭be‬‭disposed‬‭of‬‭by‬‭the‬
‭LESSOR following the relevant legal procedures.‬

I‭ n‬‭the‬‭event‬‭of‬‭non-payment‬‭dues,‬‭the‬‭LESSOR‬‭reserves‬‭the‬‭right‬‭to‬‭disconnect‬‭the‬‭water‬‭and‬
‭electricity‬ ‭without‬ ‭prior‬ ‭notice‬ ‭to‬ ‭the‬ ‭LESSEE,‬ ‭padlock‬ ‭the‬ ‭leased‬ ‭property,‬ ‭and‬ ‭may‬ ‭also‬
‭forfeit‬‭any‬‭rental‬‭deposit‬‭or‬‭advances‬‭given‬‭by‬‭the‬‭LESSEE.‬‭If‬‭the‬‭LESSEE’s‬‭failure‬‭to‬‭evict‬
‭the‬‭Leased‬‭Property,‬‭the‬‭LESSEE‬‭shall‬‭pay‬‭PhP‬‭____________‬‭as‬‭liquidated‬‭damages‬‭to‬‭the‬
‭LESSOR‬ ‭and‬ ‭the‬ ‭LESSEE‬ ‭agree‬ ‭to‬ ‭appoint‬ ‭the‬ ‭LESSOR‬ ‭as‬ ‭their‬ ‭attorney-in-fact,‬
‭empowering‬‭them‬‭to‬‭retake‬‭possession‬‭of‬‭the‬‭Leased‬‭Property‬‭extra-judicially‬‭or‬‭without‬‭any‬
‭judicial process if needed.‬
‭8.‬ ‭ XPIRATION‬‭OF‬‭CONTRACT.‬‭At‬‭the‬‭expiration‬‭of‬‭the‬‭term‬‭of‬‭this‬‭lease‬‭or‬‭cancellation‬

‭thereof,‬ ‭as‬ ‭herein‬ ‭provided,‬ ‭the‬ ‭LESSEE‬ ‭will‬ ‭promptly‬ ‭deliver‬ ‭to‬ ‭the‬ ‭LESSOR‬ ‭the‬ ‭leased‬
‭premises‬ ‭with‬ ‭all‬ ‭corresponding‬ ‭keys‬ ‭and‬ ‭in‬ ‭as‬ ‭good‬ ‭and‬ ‭tenable‬ ‭condition‬ ‭as‬ ‭the‬ ‭same‬ ‭is‬
‭now,‬‭ordinary‬‭wear‬‭and‬‭tear‬‭expected‬‭devoid‬‭of‬‭all‬‭occupants,‬‭movable‬‭furniture,‬‭articles‬‭and‬
‭effects‬ ‭of‬ ‭any‬‭kind.‬‭Non-compliance‬‭with‬‭the‬‭terms‬‭of‬‭this‬‭clause‬‭by‬‭the‬‭LESSEE‬‭will‬‭give‬
‭the‬ ‭LESSOR‬ ‭the‬‭right,‬‭at‬‭the‬‭latter's‬‭option,‬‭to‬‭refuse‬‭to‬‭accept‬‭the‬‭delivery‬‭of‬‭the‬‭premises‬
‭and‬ ‭compel‬ ‭the‬ ‭LESSEE‬ ‭to‬ ‭pay‬ ‭rent‬ ‭therefrom‬ ‭at‬ ‭the‬ ‭same‬ ‭rate‬ ‭plus‬ ‭PhP‬ ‭____________‬
‭thereof‬ ‭as‬ ‭penalty‬ ‭until‬ ‭the‬ ‭LESSEE‬ ‭shall‬ ‭have‬ ‭complied‬ ‭with‬ ‭the‬ ‭terms‬ ‭hereof.‬‭The‬‭same‬
‭penalty‬‭shall‬‭be‬‭imposed‬‭in‬‭case‬‭the‬‭LESSEE‬‭fails‬‭to‬‭leave‬‭the‬‭premises‬‭after‬‭the‬‭expiration‬
‭of this Contract of Lease or termination for any reason whatsoever.‬
‭9.‬ ‭ UBLEASE.‬‭The‬‭LESSEE‬‭shall‬‭not‬‭sublease,‬‭assign‬‭or‬‭in‬‭any‬‭manner‬‭alienate‬‭the‬‭leasehold‬

‭rights‬ ‭to‬ ‭the‬ ‭Leased‬ ‭Property‬ ‭without‬ ‭the‬ ‭LESSOR’s‬ ‭prior‬‭written‬‭consent.‬‭If‬‭the‬‭LESSOR‬
‭permits‬ ‭subleasing,‬ ‭the‬ ‭LESSEE‬ ‭is‬ ‭responsible‬ ‭for‬ ‭property‬ ‭recovery.‬ ‭Should‬‭the‬‭LESSOR‬
‭need‬‭to‬‭take‬‭legal‬‭action‬‭for‬‭recovery,‬‭the‬‭LESSEE‬‭must‬‭cover‬‭these‬‭expenses.‬‭The‬‭LESSEE‬
‭and the Sub-Lessee jointly share liability to the LESSOR.‬
‭10.‬ ‭ IGHT‬ ‭TO‬ ‭ACCESS.‬ ‭The‬ ‭LESSOR‬ ‭will‬ ‭have‬ ‭the‬ ‭right‬ ‭to‬ ‭enter‬ ‭and‬ ‭inspect‬ ‭the‬ ‭Leased‬

‭Property‬ ‭at‬ ‭any‬ ‭reasonable‬ ‭hour‬‭of‬‭the‬‭day‬‭or‬‭night,‬‭especially‬‭in‬‭cases‬‭of‬‭emergency,‬‭even‬
‭without‬ ‭the‬ ‭LESSEE’s‬ ‭prior‬ ‭consent‬ ‭but‬ ‭after‬ ‭giving‬ ‭due‬ ‭notice.‬ ‭Within‬ ‭Fifteen‬ ‭(15)‬ ‭days‬
‭before‬ ‭the‬ ‭Contract’s‬ ‭termination‬ ‭the‬ ‭LESSOR‬ ‭will‬ ‭have‬ ‭the‬ ‭right‬ ‭to‬ ‭enter‬ ‭the‬ ‭Leased‬
‭Property in order to show the same to prospective lessees.‬
‭11.‬ ‭ ORCE‬ ‭MAJEURE.‬ ‭If‬ ‭whole‬ ‭or‬ ‭any‬ ‭part‬ ‭of‬ ‭the‬ ‭leased‬ ‭premises‬ ‭shall‬ ‭be‬ ‭destroyed‬ ‭or‬

‭damaged‬ ‭by‬ ‭fire,‬ ‭flood,‬ ‭lightning,‬ ‭typhoon,‬ ‭earthquake,‬ ‭storm,‬‭riot‬‭or‬‭any‬‭other‬‭unforeseen‬
‭disabling‬‭cause‬‭of‬‭acts‬‭of‬‭God,‬‭as‬‭to‬‭render‬‭the‬‭leased‬‭premises‬‭during‬‭the‬‭term‬‭substantially‬
‭unfit‬ ‭for‬ ‭use‬ ‭and‬ ‭occupation‬ ‭of‬ ‭the‬ ‭LESSEE,‬ ‭then‬ ‭this‬ ‭lease‬ ‭contract‬ ‭may‬ ‭be‬ ‭terminated‬
‭without compensation by the LESSOR or by the LESSEE by notice in writing to the other.‬
‭12.‬ ‭ RANSFER‬ ‭/‬ ‭MORTGAGE‬ ‭/‬ ‭ENCUMBRANCE.‬ ‭In‬ ‭the‬ ‭event‬ ‭of‬ ‭any‬ ‭sale,‬ ‭transfer,‬ ‭or‬

‭encumbrance‬ ‭of‬ ‭the‬ ‭Leased‬ ‭Property‬ ‭the‬ ‭LESSOR‬ ‭warrants‬ ‭the‬ ‭purchaser,‬ ‭assignee‬ ‭or‬
‭mortgagor‬‭will‬‭respect‬‭the‬‭terms‬‭of‬‭the‬‭Contract‬‭but‬‭only‬‭up‬‭to‬‭the‬‭end‬‭of‬‭the‬‭Contract’s‬‭term.‬
‭After‬ ‭the‬ ‭expiration‬ ‭of‬ ‭the‬ ‭Contract‬ ‭the‬ ‭LESSEE‬ ‭will‬ ‭have‬ ‭the‬ ‭burden‬ ‭of‬ ‭negotiating‬ ‭a‬
‭renewal of the Contract.‬
‭13.‬ ‭ BANDONMENT.‬ ‭If‬ ‭the‬ ‭LESSEE‬ ‭abandons‬ ‭the‬ ‭Leased‬ ‭Property‬ ‭before‬ ‭the‬ ‭Contract’s‬

‭expiration‬ ‭and‬ ‭the‬ ‭abandonment‬ ‭lasts‬ ‭for‬ ‭at‬ ‭least‬ ‭thirty‬ ‭(30)‬ ‭days,‬‭any‬‭security‬‭deposit‬‭and‬
‭advance‬ ‭rentals‬ ‭given‬ ‭will‬ ‭be‬ ‭forfeited‬ ‭in‬ ‭the‬ ‭LESSOR’S‬ ‭favor.‬ ‭Additionally,‬ ‭in‬ ‭such‬
‭instances,‬‭the‬‭LESSOR‬‭shall‬‭have‬‭the‬‭right‬‭to‬‭dispose‬‭of‬‭any‬‭items‬‭remaining‬‭therein‬‭without‬
‭notice‬ ‭to‬‭the‬‭LESSEE.‬‭This‬‭is‬‭without‬‭prejudice‬‭to‬‭the‬‭LESSOR’s‬‭other‬‭remedies‬‭under‬‭the‬
‭Contract and/or the law.‬
‭14.‬ ‭ HIRD‬‭PARTY‬‭LIABILITY.‬‭The‬‭LESSEE‬‭will‬‭hold‬‭the‬‭LESSOR‬‭free‬‭and‬‭harmless‬‭from‬

‭any‬ ‭damage‬ ‭or‬ ‭liability‬ ‭to‬ ‭any‬ ‭person‬ ‭or‬ ‭property‬ ‭from‬ ‭the‬ ‭LESSEE’s‬ ‭use‬ ‭of‬ ‭the‬ ‭Leased‬
‭Property.‬
‭15.‬ ‭ EGISTRATION.‬ ‭The‬ ‭LESSOR‬ ‭will‬ ‭deliver‬ ‭all‬ ‭documents‬ ‭and‬ ‭do‬ ‭any‬ ‭act‬ ‭which‬ ‭is‬

‭necessary‬‭for‬‭the‬‭LESSEE‬‭to‬‭register‬‭the‬‭Contract‬‭in‬‭the‬‭Office‬‭of‬‭the‬‭Register‬‭of‬‭Deeds‬‭for‬
‭Caloocan‬ ‭City‬ ‭and‬ ‭Meycauayan‬ ‭City.on‬ ‭demand.‬ ‭The‬ ‭LESSEE‬ ‭will‬ ‭bear‬ ‭all‬ ‭expenses‬ ‭for‬
‭registering the Contract.‬
‭16.‬ ‭ AIVER‬ ‭CLAUSE.‬ ‭Either‬ ‭the‬ ‭LESSEE‬ ‭or‬ ‭LESSOR‬ ‭failure‬ ‭to‬ ‭insist‬ ‭upon‬ ‭strict‬

‭performance‬ ‭of‬ ‭the‬ ‭Contract’s‬ ‭terms‬ ‭will‬ ‭not‬ ‭be‬ ‭construed‬ ‭as‬ ‭a‬ ‭waiver‬ ‭of‬ ‭such‬ ‭term.‬ ‭No‬
‭waiver‬‭by‬‭either‬‭Party‬‭will‬‭be‬‭deemed‬‭to‬‭have‬‭been‬‭made‬‭unless‬‭in‬‭writing‬‭and‬‭signed‬‭by‬‭the‬
‭Party concerned.‬
