(STATEMENTS OF FACTS)

IN THE HON’BLE HIGH COURT OF DELHI


Criminal Appeal no. 330/2023

IN THE MATTER OF:-


SHEKHAR SHARMA … APPELLANT
VERSUS
STATE OF NCT OF DELHI … RESPONDENT

1. An Indian Administrative Service Officer (Shekhar Sharma), returning from a


private party in a private vehicle at round 02.00 am with a female companion
(Smita, the owner of the vehicle), in allegedly intoxicated state over speeds, loses
control of the vehicle and runs over a biker who had parked his bike by the side of
the road and was talking to someone over his mobile phone.

2. The vehicle after running over the biker rams into the compound wall of a nearby
house. Two passersby who witnessed the accident rushed to the spot only to see
the biker lying face down in a pool of blood. They informed the police station and
police officers from the nearby police station arrived at the spot and shifted the
biker to the hospital.

3. The biker was pronounced dead on arrival at the hospital. Police who was initially
reluctant to arrest the IAS Officer, succumbed to public outrage and recorded his
arrest after almost eight hours of the accident. In the meantime, the accused had
already got admitted himself in a private hospital of his choice and started
undergoing treatment.

4. Police obtained his blood samples after almost eight hours of the accident and
could not detect any traces of alcohol or other intoxicants beyond permissible
levels. The accused in his statement to the police denies his being intoxicated and
also claims that he was not driving the vehicle but indeed driven by his friend.

5. However, two eye witnesses gave statements to the police confirming seeing the
accused coming out of the driver’s seat. Police recorded statement of the fellow
passenger (Smita) who also happened to be the registered owner of the vehicle.
She, in her statement claims that the IAS officer is her friend and that he had
telephoned her on the said night to drop him home from the party. However,
when she reached there and asked him to get into the car, he insisted on driving
the vehicle. Though she initially refused due to his inebriated condition, he
somehow convinced her of letting him drive. Smita also says that in spite of her
warning him, the latter was over speeding.

6. An FIR was registered at the jurisdictional police station pressing charge under
section 304 A of IPC along with other relevant provisions. Later on, on the basis of
facts and circumstances the trial court decided the matter and found the IAS
officer Shekhar Sharma guilty under various heads of offences.

7. Thereafter, Shekhar Sharma filed an appeal and challenged the trial court
judgment on the basis that neither he was intoxicated nor he was driving the car
and the judgment has been passed on false facts. On the other hand, the
representatives of the deceased also filed an appeal being aggrieved by the trial
court judgment that lesser punishment has been given to Shekhar Sharma and
requested the court to dismiss the appeal of Shekhar Sharma and to punish him
under II part of section 304 IPC.

2. Counsels are required to bring all the required bare acts and books relevant to the
case.
RULES OF THE COMPETITION

1. COMPETITION FORMAT
The competition is structured as per the following format:
(1) Preliminary Round
(2) Semi Final Round
(3) Final Round

2. OFFICIAL LANGUAGE
The official language of the competition shall be English for written and oral
submissions.

3. ELIGIBILITY
Student of 3 year or 5 year law degree courses from any
University/College/Institution/Department are eligible to apply for registration of
their team. However, only one team shall be allowed to participate from one
University/College/Institution/Department provided that if any college is running
both the courses (3 year and 5 year) it may send two teams exclusively, one from each
course. However, each such team of the same college shall pay fees separately.

4. TEAM COMPOSITION
(i) Each team shall consist of only three members, comprising of two Mooters and
one Researcher.
(ii) Any alteration/change in the names of the team members shall be intimated
in writing by The Principal/Dean/Director/Head of the Department of the
School/Department/College of Law, of the team requesting such
alteration/change positively to the Organizing Committee. However, any such
alteration is permitted only once.
(iii) Once the competition commences, the team composition cannot be altered
under any circumstances whatsoever. Inability of any team member to
participate shall lead to disqualification of the team from the competition.
However, the team is free to rotate among the 3 members the roles of
mooter/researcher as they think fit.

5. REGISTRATION
Participating teams should register themselves by sending duly filled registration form
along with registration fee of Rs. 2000/- per team to be paid through PAYTM on paytm
no. 9990127899 and memorials through email at law@ime.in and Cc to
advocatesushantdabral@gmail.com. Hard copy of the registration form along with the
payment details of PAYTM shall be received by hand at IME Law College, Sahibabad
till 16.03.2023. Acknowledgement of the same shall be sent by the IME Law College,
Sahibabad Moot Court Organisation Committee on the same date.

6. GUIDELINES FOR MEMORIALS


a. Teams have to prepare memorials for both the sides. Teams may raise grounds of
challenge other than those stated in the statement of facts.

b. The memorials should be either in English. Once the memorials are submitted, no
revision, supplements or addition will be allowed.

c. The teams may seek clarification on moot problem till 03.04.2023, thereafter no
such request shall be entertained.

d. The teams shall submit 6 hard copies of the memorial for each side by 16.04.2023
which shall be addressed to Mr. Naveen Mavi, Faculty of Law.

e. The contents of the hard copies must be the same as the soft copy sent on
law@ime.in and advocatesushantdabral@gmail.com. Non compliance with this rule
will lead to disqualification of that team.

f. The memorials have to be submitted on A4 size paper, printed on one side only
and must be in the following order:
• Cover page;
• Table of contents;
• Index of authorities;
• Statement of jurisdiction;
• Statement of facts;
• Statement of issues;
• Summary of arguments;
• Arguments advances;
• Prayer.

g. The memorial must be printed in Times New Roman, 12 font size with 1.5 line
spacing and the heading must be in 14 font size.

h. The arguments advanced should not exceed 20 pages per team.

i. The memorial as a team should not exceed 40 pages including the cover page.
j. The memorial should have margin measuring one inch on all sides of each page.

k. The numbering should be on the bottom-center of each page.

l. The petitioner’s memorial cover page shall be printed on Blue Colour A4 size
paper, and the respondent’s memorial cover page on Red Colour A4 size paper.

m. The memorials front page should inscribe specifically P and R representing the
petitioner and respondent respectively.

n. The front cover of each memorial must have the following contents:
• The name of the Court
• The year of competition
• The name of the case. (Shekhar Sharma versus State of NCT of Delhi)
• The title of the memorial (i.e. “Memorial for petitioner” or “Memorial for
respondent”)
• A uniform style of citation should be followed throughout the memorial
• Participants are required to carry with them the required reference
materials for their own use during the oral examination of the competition.

o. The maximum scores for the memorials shall be 100 marks. The memorials shall
be evaluated on the following criteria:

p. The Memorial shall be only spiral bound.

7. ROUNDS

Draw of lots
Each team will be provided with a Team Code in the Inaugural Session. After the
draw of lots, each team will be assigned a side (Petitioner or
Appellant/Respondent). Fixtures of the team will be pre-determined based onthe
team codes.
The Competition is divided into
(1) Preliminary Rounds
(2) Quarter-Finals (if need be)
(3) Semi-Finals
(4) Finals

(1) Preliminary Rounds


Each team is allowed 12 minutes to represent their cases. Each team shall represent
from both the sides. The winner ofeach court-room will be decided on the basis of the
scores awarded by the judges in this round and the marks awarded byMEC.
Note: The results of the Preliminary Rounds shall be declared soon after the conclusion of
the Preliminary Rounds. Thequalified teams after this round will proceed to the Quarter-
finals/Semi-Finals

(2) Quarter Finals


(a) The qualified teams from the Preliminary Rounds will qualify for the quarters-finals.
(b) The side for the quarter-finals shall be decided by ways of draws of lots.
(c) The quarter-finals shall be a knock-out round.
(d) The win-loss shall be decided on the basis of the aggregate speaker score.
(e) Each team will get 15 minutes for arguing & 2 minutes for rebuttal.

(3) Semi-Finals
(a) The top four teams from the Quarters-Finals will qualify for the Semi-Finals.
(b) The side of the teams shall be decided by way of draws of lots.
(c) The Semi--Finals shall be a knock-out round.
(d) The win-loss shall be decided on the basis of the aggregate speaker score.
(e) Each team will get 15 minutes for arguing & 5 minutes for rebuttal.

(4) Finals
(a) The top two teams selected after Semi-Finals will proceed to the Finals.
(b) The side of the teams shall be decided by way of draws of lots.
(c) The win-loss shall be decided on the basis of the aggregate speaker score.
(d) Each team will get 25 minutes for arguing & 5 minutes for rebuttal.

NOTE:- The division of time per speaker is left to the discretion of the team.
The arguments should be confined to the issues presented in the memorial. The
researcher needs to be present with the speakers during all the rounds

8. RESULTS
(i) The decision of the judges with regard to the outcome of all the rounds shall
be final and binding.
(ii) The results of the final round shall be announced at the Valedictory Function
to be held thereafter on 22nd April, 2023.

10. DRESS CODE


Ladies: Black coloured salwar or trouser, white coloured kurta or shirt with black coat/
suit (black)
Gentlemen: White shirt with tie and black coloured trouser with black coat/suit
(black).

11. MISCELLANEOUS
(i) The clarification, if any, regarding the Moot Problem may be sought through
mail sent to law@ime.in. or Cc to advocatesushantdabral@gmail.com or through
student volunteers.
(ii) All the teams have to follow the rules of the competition strictly; defaulting
teams can be disqualified for any failure in abiding by any of the foregoing
rules.
(iii) No TA or accommodation shall be provided by the Institute.

12. VENUE AND DATE


The Competition shall be held on 21st Arpil 2023 (Friday) & 22nd Arpil 2023 (Saturday)
at Institute of Management Education, Main G.T. Road, Sahibabad, Ghaziabad, Uttar
Pradesh 201005. The participants shall report at the given address in the Department
of Law.
