Notifications Under Factories Ordinance

Following incidents should be notified to the


Department of Labour under the Factories
Ordinance
 Accidents
 Dangerous Occurrences
 Industrial Diseases

Notification of Accidents (Section 61)
Where any accident occurs in a factory which-
1. Causes loss of life to a person employed in that factory; or
2. Disables any such person for more than three days; or
3. Makes any such person unconscious as a result of heat,
electric shock or inhalation of poisonous fumes or gases,
written notice of the accident shall forthwith be sent by the
occupier to the District Factory Inspecting Engineer.

Notification of Accidents (Section 61) contd….

Where an accident occurs in the factory causing the


death of any person employed therein, no person
shall touch or disturb or cause any other person to
touch or disturb, without the permission of a factory
inspecting engineer ,any machinery or any article
which was involved in such accident, other than for
the purpose of extricating or attending on any
person concerned in such accident

1998 Amendment to section 61

Where an accident occurs to a person employed


and the occupier of the factory is not the actual
employer of the person killed or injured, the
occupier shall obtain from the actual employer of
the person killed or injured, written notice of the
accident and shall forthwith sent to District
Factory Inspecting Engineer
Important when there are sub contractors or
contract labour

If the person is disable for more than three days …

• Form 10 should be sent


• Follow up report on Form CFIE -1 should be sent
once the person returns to work

If the injured person is having a permanent
disablement Medical Examination Report
under Workmen’s Compensation Act
should be sent

Section 62- Notification of dangerous Occurrences

Dangerous Occurrences specified in Factories (Dangerous Occurrences Notification)


Regulations, 1965 should be notified to the DFIE

e.g. Explosion of a Steam Boiler , Air Receiver Collapse of a crane etc.

Displaying Addresses of the District Factory

Engineer- Section 90 of Factories Ordinance
A notice of Addresses of the District Factory Inspecting
Engineer for the district & the Chief Factory Inspecting
Engineer shall be displayed at the principal entrances
of the factory.

Maintaining an accident register (General Register) –
Section 92 of F.O

A general register shall be maintained in the


factory
Extracts from the GR shall be sent to DFIE once
in six months

Preservation of registers and records- Section 93
of F.O

The General Register and every other register or


record kept in pursuance of F.O shall be
preserved and shall be kept available for
inspection for at least two years after the date
of the last entry.

Duties of persons employed – section 95

No person employed in a factory shall willfully


interfere with or misuse any means, appliance,
convenience or other thing provided in pursuance
of F.O for securing the Safety, Health or Welfare
of the persons employed in the factory and
where any means or appliance for securing safety
or health is provided for the use of such person
under F.O he shall use the means or appliance
No person employed in a factory shall willfully and
without reasonable cause do anything likely to
endanger himself or others

Section 109- Fines

• First offence- not less than 5000/=


• Second Offence- not less than 5000/= but not
exceeding 12500/=
• Third Offence- not less than 12500/= but not
exceeding 25000/=

In case of an injury or death –not exceeding


100,000/=

Liability Under the Workmen’s Compensation
Ordinance
• Liability- The employer is liable to pay
compensation to a workman who meets with an
accident which causes injury or death. The
accident;
Must have arisen out of his employment
and
In the course of his employment
Contracting an occupational disease is also treated
as an accident in the course of his employment.
The disease must be directly or reasonably
attributed to the work in which he was engaged

Exceptions
The employer is not liable;
(a) If the injury is negligible. i.e. if the disablement does
not exceed 3 days,
(b) Any injury which does not result in death and which is
directly attributed to,
(i) the fact that the workman was under the influence
of liquor
(ii) willful disobedience of the orders expressly given
to him in order to secure safety
(iii) willful removal of or disregard of any safety device
given to the workman in order to secure safety
