Course Objectives: The objectives of this course are-


• To develop basic understanding and comprehensive knowledge of laws relating to transportation in India.
• To study the provisions of transportation law by road, air, sea and railways.
• To provide insight into the applicability of transportation law

Prerequisites:
The student should be aware of the legal issues relating to transportation and have legal aptitude to analyze the problems. Also be able to analyze legal
problems related to transportation nationally and internationally.

Module I – Law Relating to Road Transport 25`%

• Introduction to Transportation Law
• The Carriage by Road Act, 2007
• The Road Transport Corporation Act, 1950 (Relevant Provisions relating to
transportation of goods)
• The Motor Vehicles Act, 1988 (Relevant Provisions relating to transportation of
goods)
• The Road Transport Safety Bill, 2014 (Relevant Provisions)
• Overview of Master Plan regarding planning and relevance of transportation

2. Module II- Laws relating to Railways 20%

• The Railways Act, 1989

• Carriage of Goods
• Responsibility of railway administration as carriers
• Accidents
• Liability of Railways administration for death and injury to passengers due to
accidents
• Penalty and offences

3. Module III- Law relating to Air Transport 20%


• The Carriage by Air Act, 1972

• Warsaw Convention, 1929
• Hague Protocol, 1955
• Montreal Convention, 1999
• The Airport Authority of India Act, 1994 – Overview, origin and importance

4. Module IV: Law relating to Sea Transport 25%


• Carriage by Sea Act, 1925
• Indian Merchant Shipping Act, 1958 (Relevant Provisions)
• Customs Act, 1962 – provisions relating to ships carrying imported / exported goods,
power to search vessel, power to confiscate vessel, penalty for short landing of goods,
criminal prosecution, passenger baggage regulations
• Anti-Maritime Piracy Bill – Overview and provisions relating to transportation of
goods and penalties

5. Module V : Multimodal Transportation of Goods and Emerging Trends 10%


• Multimodal Transportation of Goods Act, 1993
• Inter-water transportation

Pedagogy for Course Delivery:


The course will be conducted using lectures, assignments and student writings (essays).
Different methods of remote learning process shall be part of pedagogy. In addition to this,
students would be encouraged to participate in seminars and make classroom presentations.
Course Learning Outcomes: After the successful completion of Course Curriculum, a
student should be able to:

• Identifying the transportation laws of India and comprehend emerging issues relating
to it.
• Understand the relevance of multimodal transportation as an interface between the
different modes of carriage
• Apply the modalities of the provisions of the transportation law in comprehending the
issues relating to transportation by land, rail, air and sea.
• Appraise the law relating to transportation of goods with reference to judicial
decisions.
• Assess the laws and identify the lacunas in the laws relating to transportations and
measures that can be adopted to overcome the flaws.
• Adapt and Solve problems relating to transportation of goods by incorporation the
legal provisos and case laws.
