Ordinance No. 94, OF MAY 31, 2017

THE DIRECTOR OF THE NATIONAL TRANSIT DEPARTMENT - DENATRAN, in the use of


the attribution conferred by art. 19, item XXIII, of Law nº 9.503, of September 23,
1997, which instituted the Brazilian Traffic Code.

Considering the provisions of CONTRAN Resolution No. 168, of December 14, 2004;

Considering what is contained in Administrative Proceeding No. 80000.030646/2013-83,

RESOLVES:

Art. 1st Establish the TRAFFIC AGENT COURSE for professionals who carry out
inspection, operation, ostensive traffic policing or patrol activities in the
bodies that are part of the National Traffic System.

Art. 2nd The minimum curriculum structure, registration requirements, minimum workload,
didactic-pedagogical approach, frequency, evaluation and final provisions are established in
Annexes I and II of this Ordinance.

Art. 3 The course, in the form of this Ordinance, will be taught by bodies that are part of
the National Traffic System or by entities and institutions authorized and accredited by
them.

Art. 4th Other traffic agent training courses completed up to 180 (one hundred and
eighty) days after the National Traffic Department - DENATRAN publicizes the criteria
and procedures for authorization and accreditation of institutions are recognized.

Art. 5 The professional who works as a transit authority agent must take a
refresher course every 3 (three) years, starting from the date this Ordinance
comes into force.

Art. 6 This Ordinance will enter into force 180 (one hundred and eighty) days after the date of
its publication, revoking the provisions to the contrary.

ANNEX I
Minimum number of hours, enrollment requirements, minimum curriculum structure,
didactic-pedagogical approach, frequency, evaluation and final provisions of the course.

1. Minimum workload

1.1. The minimum course load is 200 (two hundred) class hours, divided into:

a) 40 (forty) class hours dedicated to Module I (Traffic Legislation);

b) 20 (twenty) class hours for Module II (Notions of Traffic Engineering


and Traffic Signaling);

c) 48 (forty-eight) class hours for Module III (Applied Traffic


Law);

d) 08 (eight) class hours for Module IV (Ethics and Citizenship);

e) 12 (twelve) class hours for Module V (Applied Psychology);

f) 08 (eight) class hours for Module VI (The Agent's Educating Role);

g) 08 (eight) class hours of Module VII (Portuguese);

h) 16 (sixteen) class hours for Module VIII (Traffic Operation and


Inspection);

i) 40 (forty) class hours for Module IX (Operational Practice).

1.2. A period of 50 (fifty) minutes is considered a class hour.

1.3. The daily workload cannot exceed, in an intensive regime, 08 (eight) hours/
class per day.

2. Requirements for enrolling in the training course

2.1. Be a public servant (CLT or statutory) or military police, appointed by the body
with jurisdiction over the road, within the scope of its competence.

4. Didactic-pedagogical approach.

4.1. The didactic-pedagogical approach of the traffic authority agent course consists
of the presentation of theoretical and practical classes taught in a dynamic, expositive
and dialogical way. For practical activities, images, videos, case studies and technical
visits, inspection activities, operation, ostensive traffic policing or patrolling can be
used.

5. Learning Assessment.

5.1. At the end of each module, a test will be held on the contents worked on by the
institutions that teach the courses.

5.2. The student who obtains a minimum score of 70% (seventy percent) in
each module will be considered approved in the training course.

5.3. The student who fails at the end of the module may take a new test at any time,
without prejudice to the continuity of the course. If you still do not get a satisfactory result,
you must repeat the module in another edition of the course.

5.4. The minimum attendance is 75% (seventy-five percent) in each of the modules. If the student
does not reach the minimum frequency established in one or more module(s), he/she may repeat
it(s) in another class or edition of the course, taking advantage of the modules in which he/she
reached the established.

5.5. In refresher courses, the evaluation will be done through direct and constant
observation of the students' performance, with no assignment of a grade at the end of the
course.

6. Final Provisions

6.1. The faculty of the course must be formed by at least 70% (seventy percent) of
professionals who have higher education and experience in the area related to the
contents contained in the course's curricular structure.

6.2. Proof of said title must be presented to the bodies that are part of the
National Traffic System and to the entities and institutions approved by the
National Traffic Department - DENATRAN to teach the course object of this
Ordinance.

6.3. The maximum number of participants per class should be 50 (fifty) students.
6.4. The certificates will be issued by the bodies that are part of the National Traffic
System or by entities and institutions authorized by them, provided that they are
approved by the National Traffic Department - DENATRAN to teach the course object of
this Ordinance.

6.5. Modules I, II, IV, VI and VII, described in Chapter 3, Annex I, of this Ordinance,
may be carried out in the distance learning modality.

6.6. The content present in the curriculum structure and the workload can be
added in order to meet the specific needs of the body with jurisdiction over the
road.

ANNEX II

UPDATE COURSE

The refresher course will have a minimum workload of 32 (thirty-two) hours/class according
to the curricular structure below.
