Sikkim has a past history of its own. Prior to its merger with the Union of India
in the year 1975 by the Constitution (Thirty Sixth Amendment) Act, 1975, the erstwhile
Sikkim was under a monarchy. The King who was popularly known as “the Chogyal”
was the fountainhead of justice. King’s words were the laws. Under the then
administrative set up there was no place for an independent judiciary. The judicial
procedure being followed then was very simple and free from legal technicalities.
The Courts were dispensing substantive justice based on the principle of justice,
equity and good conscience. Lawyers were not allowed to appear in Court.
The available records do not throw much light into the remote past. It can, however,
be gathered from these records that the administration of justice in Sikkim in the last
century was being carried out by the Feudal Landlords (Adda Courts), Jongpons
(District Officers), Pipons (Headmen) and Mandals with the Chogyal at the top.
In 1909, Kazis, Thikadars and Lamas were invested with judicial powers by the Stat
Council resolution. They could try civil suits up to the valuation of Rs. 500/-.
In 1916, Appellate Courts by the designation of Chief Court was created with
jurisdiction to try important originals suits and also to hear appeals against the
decisions of the Adda Courts. This Court also exercised supervisory and appellate
jurisdiction over the Adda Courts. The Chief Court was not the final Court. The
appeal against the decision of the Chief Court would lie to the Supreme Court of His
Highness, the Maharaja. The Court of the Maharaja was the final Court of appeal in
the State. It has no original jurisdiction. A Board on the lines of the Judicial Committee
of the Privy Council in England would hear the parties and scrutinize the evidence
regarding merit of the case and then tender its opinion to the Maharaja.
In 1949, the Adda Courts were abolished on the recommendation of the Judicial
Proposal Committee. The State was divided into 4(four) revenue Districts and
Magistrates were appointed in District with original and appellate jurisdiction on the
criminal and civil side. The Courts of the Assistant Magistrate and the Court of
Tahsildars were created. In the lowest rung, a few Honorary Courts of Magistrates
were created to dispose of petty criminal and civil cases. The Chief Magistrate had
both original and appellate jurisdiction on civil and criminal sides. He had unlimited
powers.
From the available records it appears that in 1953, a Judge of the High Court of
Sikkim was appointed but in 1955, High Court of Judicature (Jurisdiction and Powers)
Proclamation, 1955 was issued establishing a High Court in Sikkim. The High Court
thus established was made the final Court in all judicial matters, civil or criminal,
subject to the exercise of prerogative by the Maharaja to grant mercy, pardon,
remission, commutation and reduction of sentence in case of conviction. The
Maharaja had also retained his prerogative to set up a Special Tribunal for the review
of any review of any case, civil or criminal.
Upon merger, Sikkim became the 22nd State of India. Under Clause (i) of Article 371F,
the High Court functioning immediately prior to the date of merger became the High
Court for the State of Sikkim under the Constitution like any other High Court in the
country. Under Clause (i) of the same Article all Courts of Civil, Criminal and Revenue
Jurisdiction, all Authorities and all Officers, Judicial, Executive and Ministerial
throughout Sikkim were to continue to exercise their respective powers subject to
the provisions of the Constitution and under Clause (k) all laws in force immediately
before the appointed day in Sikkim were to continue to be in force until amended or
repealed by a competent legislature or other competent authority.
The Government of Sikkim Act, 1974, which came to be passed in the Sikkim
Assembly (which received the assent of the Chogyal on 4th July, 1974) in pursuance
of the historical agreement of 8th May, 1973, between the Chogyal, the leaders of the
political parties representing the people of Sikkim and Government of India, provided
that all Judges in Sikkim shall be Independent in exercise of the Judicial function. In
keeping with the ideal and the set goal, the process of separation of judiciary from
the executive started soon after the merger. In 1978, Sikkim Civil Courts Act was
passed with a view to consolidate the laws relating to the Constitution of Civil Courts
subordinate to the High Court and other relevant matters. The Sikkim State Judicial
Service Rules 1975 and the Sikkim Superior Judicial Service Rules 1980 were framed
providing for the mode of recruitment and service of judicial officers, thereby creating
a separate cadre of judicial officers in the State. Besides, the Code of Criminal
Procedure 1973, which provided for separation of judiciary from the executive was
extended and enforced in the State of Sikkim in the year 1994.
With the commencement of the Constitution and under the new democratic set up
the restriction placed earlier on lawyers to appear in Courts came to be ignored.
Thus institution of lawyers as it exists today came into existence.

INFORMATION REGARDING SIKKIM
Tucked away in India’s North –East corner, between Tibet, Bhutan and Nepal
is, without question, a very special part of India beautiful, unspoiled, green, full of
orchids, mountains, butterflies and greeneries. Until 1975, Sikkim remained an
independent kingdom, ruled by the Chogyal.
In Sikkim various communities with their own customs, religion and culture
intermingle freely to constitute a homogeneous blend. The predominant communities
are the LEPCHAS, BHUTIAS and NEPALESE. Many plainsmen have also settled,
especially in the urban areas and they are almost always engaged in business and
Government service. A small part of the population consists of migrant laborers
from the plains and Nepal attracted by the development activities in the state, like the
construction of roads, bridges and buildings.
SIKKIM : The state which is the second smallest state of India, lying between 27 to
28 degrees North latitude and 88 to 89 degrees East longitude is the second smallest
state in India. It is barely 7,096 sq. kms in size yet has an elevation ranging from 300
mtrs. To 8585 mtrs. Above sea level. It’s Geography is dominated by the most
majestic mountain chain in the world which includes the Khangchendzonga, world’s
third highest mountain and is worshipped by the Sikkimese as the guardian deity to
their land.

officially from May to October, Sikkim is almost always wet due to the heavy
monsoons, with rains at times continuing for days on ends.
Enchey Monastery:
An important seat of the Nyingma order, the Enchey Monastery meaning the
Solitary temple, was originally built with the solace that no other construction would
be allowed near it is build on the site blessed by Lama Drutob Karpo, a tantric
master known for his flying powers. This 200 –year- old Monastery has in its premises
images of god, goddesses and other religious objects.
Close by the White Memorial Hall and just below the Palace Ridge park is the
more recent Flower Show Hall. In recent years this show has become quite popular
and famous as there are flower exhibitions throughout the year in accordance with
the seasons and the flowers in bloom.
The Do- Drul Chorten or Stupa was build by the Venerable Trulshi Rimpoche,
head of the Nyingma order of Tibetan Buddhism in 1945. Inside this stupa, there are
complete mandala sets of Dorjee Phurba (Bajra Kilaya), a set of Kan- gyur relics
(Holy Books), complete ‘Zung’ (mantras) and other religious objects. Around this
Chorten, which is one of the most important stupas in Sikkim, are 10 Mani- Lhakor
(prayer wheels). These prayer wheels are turned by the devout Buddhist while
chanting “Hail jewel in the Lotus”, to invoke the Buddhisatva. The Chorten is
surrounded by Chorten Lakhang, where there are tow huge statues of Guru Rimpoche
(Guru Padmasambhava).
Formerly known as the Namgyal Institute of Tibetology, after the late Chogyal
of Sikkim, Palden Thondup whose brainchild it was, the Sikkim Research Institute of
Technology (SRIT), has since become one of the most prestigious depository of
Tibetan literature, rare manuscripts, paintings, thangkas, statues and religious objects
and other works of are and history. Today, it is a renowned worldwide centre for
study of Buddhist philosophy and religion.

Saramsa Garden:
About 14 kms. from Gangtok is the Saramsa Garden, the home of Sikkim’s
most exotic orchids and other rare tropical and temperate plants. Established and
maintained by the Department of Forest, it is an excellent recreation and picnic spot.
Tsomgo Lake:
Tsomgo lake is only 40 kms. from Gangtok town and is situated at an altitude
of 12,210 ft. The lake is about 1 km. long and oval in shape, 50 ft. deep and is
regarded extremely Holy. It is also a home of Brahmini ducks besides stopover for
various migratory ducks. Between May and August, it is possible to see variety of
flowers in bloom, including the rhododendrons, various species of primulas, blue
and yellow poppies, iris and many other species of birds. Open for both the Foreign
and Indian nationals. Foreign visitors have to be in a group of two or more and have
to apply for the visitors permit through a registered Travel agency.
Nathula:
About 45 minutes drive from Gangtok, 24 kms. away, is the Rumtek Dharma
Chakra Centre, the seat of the Kagyu order, one of the 4 major Tibetan Buddhist
sects. Since the late 1960s, after the arrival of His Holiness the 16th Gyalwa Karmapa,
the Centre houses some of the world’s most unique religious scriptures and religious
rare objects. Traditional in design, it is almost a replica of the original Kagyurpa
Monastery in Tsurphu, Tibet. It has over 300 centres overseas.
Build by the late King of Sikkim Shri Tashi Namgyal, it is situated 4 kms. from
Gangtok town from where one can have a clear view of opposite hills, besides Mt.
Kanchandzonga. This site offers a breathtaking panorama of the majestic Mt.
Kanchandzonga.

the Sakya Order of Tibetan Buddhism in Sikkim. It is located on a beautiful hill- top
just 5 kms. away from Gangtok.
WEST SIKKIM
Pamayangtse Monastery:
Rabdentse Ruins:
This was the second capital of the erstwhile Kingdom of Sikkim after Yuksom
and till the year 1814 A.D., the Kings of Sikkim had ruled the State from this place.
Today, the ruins lie hidden from the by applying to the Tourism Department through
a registered Travel Agency. The site has now been taken over by the Archeological
Department.
Khecheopalri Lake:

This was the first capital of Sikkim, where according to the historical records,
the first Chogyal of the Kingdom of Sikkim was consecrated in the 1641 A.D. by
three learned lamas. The evidence of the consecration ceremony is still intact in
Norbugang Chorten in the form of stone seats and a foot print of the Head Lama on
the stone.

Tashiding Monastery:
Tashiding is also famous for the most holy Chorten known as ‘Thong-Wa-
rang-Dol’ which literally means ‘Saviours by mere sight’. It is believed that the mere
act of beholding it is supposed to wash away all the sins of the devotee. Another
important feature in Tashiding is the sacred water festival popularly known as
‘Bhumchu’.
Varsey:
It lies at an elevation of 10,000 ft. and has a motorable road access upto
Hilley. An easy 4 kms. trek from there takes one up to the Varsey Rhododendron
Sanctuary. One can also trek from Soreng or Dentam in West Sikkim. The place
provides a magnificent view of the mountains. Visitors can halt at ‘Guras Kunj’
trekkers hut.
Phodong Monastery:
Phensang Monastery:
Guru- Dongmar lake is considered as one of the sacred lakes of this State
both by the Buddhists and the Hindus. The lake remains milky in color throughout
and it is believed that Guru Padmasambhava had touched the lake on his way to
Tibet.
Singhik:
The place offers one of the most spectacular and closest views of Mt.
Kanchenjunga and its ranges. A well located Tourist Lodge provides accommodation
for visitors. The area also has a number of interesting short nature trails for 1 to 3
days along the higher ridges of the surrounding hills. One can also savour the most
graceful peak in the world, Mt. Siniolchu.
Lachung:
A Bhutia village with a unique local self- governing body called the Zumsa
which substitutes the Panchayat. Lachung has emerged as a tourist destination with
the soaring popularity of Yumthang Valley which is just 25 kms. from Lachung. The
Village, spreads out on either side of Lachung Chu, has managed to retain its unique

culture and tradition. The Lachung Monastery on the slope opposite to the highway
is a focal point of all religious function of the local inhabitants. To get a glimpse of the
religious functions performed on auspicious occasion should visit to the Monastery
from part of tour itinerary.
Yumthang:
Lachen:
Lachen is situated at an altitude of 2750 mtrs. and about 6 hrs. drive from
Gangtok. The Lachen Monastery located on top of the village commands a panoramic
view of the surrounding hills and the country side. Resorts, hotels and lodges are
available for accommodation.
Namchi:
Namchi, meaning ‘Sky High’, nested among the hills at the elevation of 5,500
ft. commands panoramic view of the snow- capped mountains and vast stretches
of valley. A top Sangdruptse hilltop near Namchi, recently erected is the world’s
tallest statue of Guru Padmasambhava, the patron saint of both Hindus and the
Buddhist.
The one and only tea garden existing in the State produces one of the top
quality teas in the international market. The tea garden is spread out on a gently hill
slope originating from the Tendong Hill and provides a magnificent view for the
surrounding villages. The visit to the factory could be an eye opener for those
wanting to know more about tea processing methods.
Ravangla:
At the base of Menam Hill is Ravangla, a small township and transit to various
tourist destination in South and West Sikkim. It is also an upcoming tourist spot and
transit point for trekkers to Menam Hill and Borong. There are accommodation
facilities and numerous short nature trails. A trek down to the sacred cave ‘Sher
Chok Bephu’, one of the four holiest caves in Sikkim, would be a memorable
experience.
Budha Park:

(Monastery), itself a centuries –old place of pilgrimage. Also nearby is Ralang
Monastery, a key monastery in Tibetan Buddhism.
The statue was consecrated on 25th March, 2013 by His Holiness the 14th
Dalai Lama. The statue of Lord Buddha marks the occasion of the 2550th birth
anniversary of Gautama Buddha.
Mainam Hill:
Situated at an altitude of 10,300 ft. the scenic view from this height is perhaps,
unmatched in this part of the world. Mt. Kanchendzonga and its surrounding ranges
looms above the dwarf the richy forested and rugged hill. On a clear sunny day, it is
possible to see the plains of Bengal spanning across Kalimpong and Darjeeling
Hills in the South, right across the Indo- China border towards the North. A short
distance away is the legendary Bhaley Dhunga, a kind of rocky spur which juts out
from the ridge top and remains suspended in the air above Yangang village.
