2. Be informed that on January 10, 2024 at around 10:40 in the evening,


elements of this Station led by PLT FERMIN TIGAS conducted drug buy-
bust operation at Barbie’s Salon, Brgy. Tandang Sora, Quezon City which
resulted in the arrest of the following suspects:

a. Rolando Garcia y Periquit AKA “BARBIE”, 46 years old, single, beautician,


resident of 111 Malaya St., Brgy. Tandang Sora, Quezon City;
b. Bobby Lopez, 29 years old, single, with child, sales representative of Toyota
Philippines, Makati Branch, resident of 241 Legarda St., Sampaloc Manila.
c. One (1) CICL, 16 years old, out of school youth, and a resident of 117 Retiro St.,
Brgy. La Loma, Quezon City. (Turned over to CSWDO)

4. The following are the pieces of drug and non-drug evidence seized from the
arrested suspects:

a. One (1) powder dusted One Thousand Peso bill with serial numbers ________
money used as buy-bust money;
b. One (1) Small Black Pouch
c. Five (5) pieces of transparent plastic sachet containing while crystalline
substance suspected to be shabu weighing more or less 0.075 grams with a
Standard Drug Price (SDP) of Php 4,500 pesos;

d. Two (2) empty transparent plastic sachet with residue of white crystalline
substance suspected to be shabu;
e. One (1) Aluminum Foil and;
f. one (1) tooter.

5. In compliance with Section 21 Article II of RA 9165 as amended, in the doctrine


laid down in the case People vs Romy Lim, the seized drug and non-drug
evidence were photographed, marked and inventoried where the drug buy-bust
operation took place and in the presence of the aforesaid suspects along with the
following witnesses, namely:

a. Kagawad Tang Ineme of Barangay Tandang Sora, Quezon City; and


b. Mike Ginriquez of GMA News, Media Representative.

6. Relatively, efforts were made by tasked personnel of this unit to invite a


Representative from National Prosecution Service to witness the conduct of
photograph, markings, and inventory of pieces of evidence but there is no
available Representative at the Office of the City Prosecutor of Quezon City.

7. Arrested suspects together with the confiscated pieces of evidence were brought
to the Talipapa Police Station, Quezon City for documentation and proper
disposition.

8. Criminal complaints for violations of Section 5 in relation to Section 26 (b) and


Section 11, Article II of RA 9165 otherwise known as “The Comprehensive
Dangerous Drugs Act of 2002”, as amended by RA 10640 are being prepared
for filing before Office of the City Prosecutor, Quezon City Hall, Quezon City
against the arrested suspects while the CICL was turned over to the City Social
Welfare Development Officer of Quezon City.

2. This pertains to the Buy Bust Operation conducted by this Station that transpired
on or about 10:00 in the evening of January 10, 2024 which resulted to the arrest
of the following suspects identified as Rolando Garcia y Periquit AKA
“BARBIE”, 46 years old, single, beautician, resident of 111 Malaya St., Brgy.
Tandang Sora, Quezon City; Bobby Lopez, 29 years old, single, with child, sales
representative of Toyota Philippines, Makati Branch, resident of 241 Legarda St.,
Sampaloc Manila. and Bryan Andrew Zulueta (CICL), 16 years old, out of
school youth, and a resident of 117 Retiro St., Brgy. La Loma, Quezon City.

3. On January 12, 2024, suspects assisted by Public Attorney’s Office Lawyer, were
referred at Quezon City Prosecutor’s Office for Inquest Proceedings, docketed
under INQ-C-2024-01-12. Suspects are temporarily detained at this Station for
further proceedings.

6. CHRONOLOGICAL SEQUENCE OF EVENTS:


a. On January 10, 2024 at about 08:00 P.M., Anthony Malaya, 35, years old,
married, club entertainer appeared to our office and reported that a group
of individuals led by AKA Barbie are engaged in the distribution of illegal
drugs particularly Shabu in the areas of Quezon City. PLT TIGAS
dispatch operatives to conduct validation yielded positive result.
b. Thereafter, PLT FERMIN TIGAS relayed the information to PLTCOL DAN
DRUFF, wherein the latter as OIC, Station Drug Enforcement Unit,
designated PLT TIGAS as Team Leader and was instructed to conduct
casing and surveillance against the group while illegal drug transaction is
being finalized for buy-bust operation;

c. Thereafter, PLT TIGAS conducted a briefing that discussed the manner of


operation and the team proceeded at the aforesaid area to conduct casing
surveillance and possible Buy Bust Operation.

d. During the process, the PB of the team informed PLT TIGAS that AKA
BARBIE is about to release the said item in exchange of one thousand
pesos that pushed the TL to instruct one personnel to coordinate to PDEA
for the conduct of Buy Bust Operation and resulted to the arrest of 1.
Rolando Garcia y Periquit AKA “BARBIE”, together with his two
cohorts who is caught in the act of doing Pot Session namely Bobby
Lopez and one CICL.

e. That, during the course of apprehension, the arresting officers properly


informed the suspects of violation imputed against them, as well, apprised
of their PhilippineConstitutional Rights in a vernacular language known
and understood by them, however they opted to remain silent in the
absence of their chosen counsel.

f. The following pieces of evidence were seized from the suspects


possession and control; one (1) black pouch, one marked as DD
11:00PM 01/10/2024 Malaya Q.C. with signature five (5) transparent
plastic sachet contain white crystalline substance suspected to be shabu
marked as DD-1 11:00PM 01/10/2024 Malaya Q.C. with signature to
DD-5 11:00PM 01/10/2024 Malaya Q.C. with sigature, two (2) pieces
transparent plastic sachet with residue of same as described marked as
TD-1 11:00PM 01/10/2024 Malaya Q.C. and TD-2 11:00PM 01/10/2024
Malaya Q.C., (1) genuine powder dusted one thousand peso bill with
serial number _________, one (1) tooter marked as TD-3 11:00PM
01/10/2024 Malaya Q.C, and one (1) red zippo lighter marked as TD-4
11:00PM 01/10/2024 Malaya Q.C all are marked in the presence of the
mandatory witnesses.

g. Seized drug evidence and urine sample of the arrested suspects were
submitted to PNP Forensic Group Camp Crame, Quezon City for
Laboratory Examination and yielded positive result for
METHAMPHETAMIN HYDRO CHLORIDE.
h. Furthermore, the apprehended suspects were brought to Quezon City
General Hospital for the issuance of their provisional medico legal
certificates while pieces of non-drug evidence were brought to this station
for documentation.

i. Apprehended CICL was brought to WCPD of this station for


documentation and later on turned over to CSWDO for proper disposition.

9. Criminal complaints for violations of Section 5 in relation to Section 26 (b) and


Section 11, Article II of RA 9165 otherwise known as “The Comprehensive
Dangerous Drugs Act of 2002”, as amended by RA 10640 are being prepared
for filing before Office of the City Prosecutor, Quezon City Hall, Quezon City
against the arrested suspects. While the CICL was turned over to the City Social
Welfare Development Officer of Quezon City.

Honorable Judge Rey Mapanghusga as the Presiding Judge, docketed
under Criminal Case Number 10-13245-24 with no bail recommended for
violation of RA 9165.
n. On January 12, 2024 both accused Rolando Garcia y Periquit AKA
“BARBIE”, Bobby Lopez were committed at Quezon City Jail as per
commitment order issued by Honorable Judge Rey Mapanghusga dated
January 12, 2024.

12. Photographs during marking and conduct of inventory.

FACTS OF THE CASE:

Initial investigation disclosed that on January 10, 2024 at around 11 in the


evening, the SDEU Operatives led by PLT FERMIN TIGAS, conducted drug buy-bust
operation at Barbie’s Salon, Brgy. Tandang Sora, Quezon City which resulted in the
arrest of the suspects mentioned in the complaint above and seizure of more or less
0.075 grams of Shabu. Subsequently, suspects were informed of their Constitutional
Rights in a language known and understood by them but they opted to remain silent in
the absence of their chosen counsel.
The arrest of the suspects, marking of evidence, taking of photographs and
inventory of recovered piece of evidence were done at place of arrest and duly
witnessed by Media Representative Mike Ginriquez of GMA News and Barangay
Kagawad Tang Ineme Jr of Barangay Tandang Sora, Quezon City.

Suspect together with seized evidences were brought at this Station for
investigation. After which, the recovered pieces of evidence and suspects were brought
to PNP Forensic Group for physical examination, Analysis and Drug Test to determine
the presence of dangerous drug.

During custodial investigation, suspect was apprised of their constitutional rights


in TAGALOG language but opted to remain silent in the absence of his chosen counsel.

II. MATTERS INVESTIGATED:

To determine the facts and circumstances surrounding to the reported illegal


drug trade activity by the suspects arrested.

III FACTS OF THE CASE

Initial investigation disclosed that on January 10, 2024 at around 11 in

City which resulted in the arrest of the suspects mentioned in the complaint

IV INVESTIGATION/FINDINGS

Successful conduct of buy bust operation was achieved by this unit that
resulted to the arrest of three (3) suspects and seizure of illegal drug items. All of
the foregoing was subsequently documented thru thorough investigation
conducted by this unit.

V CONCLUSION

Based on the foregoing facts and assessment made as to the


circumstances surrounding the arrest and seizure of illegal drug items and based
on the provisions stated in RA 9165, there is a probable cause to believe that
there is a violation of law committed by the suspects.

VI RECOMMENDATION/DISPOSITION

WHEREFORE, premises considered the undersigned recommends the


referral of the case and to support the filing of criminal complaints for violations of
Section 5 in relation to Section 26(b) and Section 11 of Article II of RA 9165
otherwise known as “The Comprehensive Dangerous Drugs Act of 2002”
as amended by RA10640 before the Office of the City Prosecutor, Quezon City.
