II. MATTERS INVESTIGATED:

To determine facts and circumstances surrounding to the alleged illegal


drug trade by suspects arrested.

III. FACTS OF THE CASE

Initial investigation disclosed that on January 10, 2024 at 08:00 PM,


Anthony Malata, 35 years old, married, club entertainer, reported to this station
that a group of individuals led by AKA “Barbie” are engaged in the distribution of
illegal drugs particularly Shabu in the areas of Quezon City. Acting on the
information, PLT FERMIN TIGAS dispatched operatives to conduct validation
which yielded positive result.

On the same date, at 9:00 PM, PLT FERMIN TIGAS was instructed by the
Station Commander to conduct casing and surveillance against the group.
Subsequently thereafter, a buy bust operation was planned. A coordination
form with PDEA was prepared and received by Agent Allan Martin Paladilla
under COC No. 1004-052022-0374. Thereafter, a request to serve as insulating
witness was given to Brgy. Kagawad Tang Ineme and Mike Ginriquez wherein
both of them agreed. A buy bust money, one-thousand-peso bill (Php 1,000.00)
with serial no. VF927715 was prepared and was turned over to PCpl Deo
Durant who was designated as poseur-buyer. Further, it was agreed that the
poseur buyer upon consummation of the transaction shall remove his black cap
indicating that the offense have been consummated and that the backup team
shall proceed to the crime scene.

At around 10:00 PM, same date, the operating team, led by PLT TIGAS
and seven (7) others, together with the insulating witnesses and the DEU
investigator, were dispatched on board a black Toyota HiAce van with plate
number ABC123, and proceeded at the identified location. Upon arrival thereat,
they temporarily pre-positioned themselves few meters away from the subject
location in front of 7/11 store. The confidential informant together with the
poseur-buyer (PB) knocked on the door of Barbie’s beauty salon whereby a
cross-dressed gay opened it and asked, “Ano pong kailangan nila?”, the
confidential informant replied, “I-score itong friend ko, meron pa ba?”, the latter
replied, “Meron pa naman, magkano ba? Pasok kayo sa loob.” The confidential
informant and the poseur buyer, thereafter entered the premises where subject
personality closed the door. Upon entry thereat, the confidential informant saw
one good-looking man wearing maong pants and white polo shirt with a
teenager wearing shorts and white sando repacking white crystalline substance
in transparent sachets believed to be shabu in one corner of the shop. Suspect
Barbie, asked them, “Magkano ba?”, where the confidential informant and
poseur buyer stated, “Isang libo lang”. There and then, suspect Barbie got one
sachet of shabu being repacked by the two other cohorts, and gave it to the
poseur buyer. In exchange, the poseur buyer handed onto him the one
thousand peso (Php 1,000.00) marked money. Immediately thereafter, he
opened the door and removed his black cap signifying that the transaction has
been consummated;

Upon seeing the pre-arranged signal, other members of the operating


elements rushed to the scene. PCpl Durant who acted as the poseur buyer
introduced himself as a police officer and effected the arrest of the suspect AKA
Barbie. He then apprised him of his constitutional rights in Tagalog which is
known, understood, and spoken by him as provided for under the Miranda
doctrine. Team Leader PLT TIGAS, also informed them that the entire procedure
was being recorded using a Body Worn Camera attached in his vest as required
under AM No. 21-06-08-SC. The arrest of the two (2) others was undertaken by
PCpl Manuel Marquez and Pat Tanggol Dimagiba and were equally informed of
their rights as provided for under the law;

Arrested suspects peacefully surrendered themselves to the arresting


team and exhibited no untoward reaction, hence, the operation was peacefully
conducted;

Inventory, photographing, and marking of pieces of evidence was


conducted at the place of arrest, in the presence of the two (2) insulating
witnesses. They were made to sign the receipt and were given copies thereof;

Following pieces of evidence were seized from the suspect’s possession


and control; one (1) black pouch marked as DD 11:00PM 01/10/2024 Malaya
Q.C. with signature; five (5) transparent plastic sachet contain white crystalline
substance suspected to be shabu marked as DD-1 11:00PM 01/10/2024
Malaya Q.C. with signature to DD-5 11:00PM 01/10/2024 Malaya Q.C. with
signature, two (2) pieces transparent plastic sachet with residue of same as
described marked as TD-1 11:00PM 01/10/2024 Malaya Q.C. and TD-2
11:00PM 01/10/2024 Malaya Q.C., (1) genuine powder dusted one thousand
peso bill with serial number VF927715, one (1) tooter marked as TD-3 11:00PM
01/10/2024 Malaya Q.C, and one (1) red zippo lighter marked as TD-4 11:00PM
01/10/2024 Malaya Q.C all are marked in the presence of the mandatory
witnesses;

On board mobile patrol, suspects together with the seized pieces of


evidence were brought to the station for further examination and disposition and
subsequently brought at Quezon City General Hospital for the routine physical
examination as provided for under the Police Operational Procedure;

Apprehended CICL was brought to WCPD of this station for


documentation and later turned over to CSWDO, QC for custody;

Recovered pieces of evidence was turned over by the DEU investigator at


the PNP Forensic Unit Quezon City for quantitative and qualitative drug
analysis. Suspects were also subjected for drug test;

Criminal complaint for violations of Section 5 and Section 11, Article II


of RA 9165 otherwise known as “The Comprehensive Dangerous Drugs
Act of 2002”, as amended by RA 10640 was prepared and filed against
Rolando Garcia y Periquit AKA Barbie and Bobby Lopez before Office of the
City Prosecutor, Quezon City while the CICL was subjected for discernment
examination.

IV. DISCUSSION
In this part, our unit successfully conducted the buy bust operation that
was launched on January 12, 2023, 11pm at Barbie's Salon, Barangay Tandang
Sora, Quezon City.

The minimum requirement for launching a buy bust operation was properly
followed because its elements were established. First, when there was an
exchange of the illegal drugs and money between PCpl Durant and AKA Barbie.
Second, when the operatives launched the operation, they immediately included
in the operation the insulating witnesses from the briefing up to the process of
inventory, markings and photographs of all seized evidence. Third, is the
presence of a body worn camera attached to the team leader, PLT TIGAS, that
was used and the reason for the operation being documented through the use of
BWC. And lastly, the documentation of the chain of custody from the seizing
officers, to the investigator on case to the forensic chemist of the forensic unit
where the seized drugs were finally submitted.

Successful conduct of buy bust operation was achieved by this unit that
resulted to the arrest of three (3) suspects and seizure of illegal drug items. All of
the foregoing was subsequently documented thru thorough investigation
conducted by this unit.

V. CONCLUSION

Based on the foregoing facts and circumstances surrounding the arrest


and seizure of illegal drug items and based on the provisions stated in RA 9165,
there is a probable cause to believe that there is a violation of law committed by
the suspects.

VI. RECOMMENDATION/DISPOSITION

WHEREFORE, premises considered the undersigned recommends the


filing of criminal complaint for violations of Section 5 and Section 11 of Article II
of RA 9165 otherwise known as “The Comprehensive Dangerous Drugs Act
of 2002”, as amended by RA10640 before the Office of the City Prosecutor,
Quezon City.
