Instruction: Carefully read the scenarios provided. Explain or state briefly the rule or reason for
your answers. (3 items x 10 points)

1. Martin is obliged to deliver 50 sacks of rice to Tin. However, Martin only delivered 5 sacks
of rice. Was the obligation extinguished?

 Complying with Tin's request to deliver 50 sacks of rice was not fully accomplished just
by delivering only 5 sacks. Martin remains obliged to pay to Tin the amount of 45 sacks
rice or to accept Tin's fulfillment of the agreement as a payment in satisfaction of the
debt. Without that modification, Martin would have had to execute the entire
contract.

2. Monica obliged herself to create a wedding gown for Anna within three (3) months.
However, in the second month, Monica got into an accident and became comatose.
What is Monica’s liability?

 For Monica's obligation to create a wedding gown for Anna, her liability would
depend on the circumstances surrounding her inability to fulfill the contract due to the
accident and subsequent coma. If Monica's condition renders her permanently
incapable of completing the gown within the agreed timeframe, she may be excused
from further liability due to impossibility of performance.

3. Manny and Carlo are best friends. When Manny was hospitalized, Carlo lent his money
in the amount of P10,000 to be paid on November 05, 2021. Before that, however, Carlo
was indebted to Manny in the amount of P10,000 to be paid on November 05, 2021. Is
Manny still obligated to pay Carlo, and what mode of extinguishment of obligation is
this?

 Regarding Manny and Carlo's situation, the debts between them may potentially
offset each other. If Manny owes Carlo P10,000 and Carlo owes Manny the same
amount, the debts can be extinguished by compensation, a mode of extinguishment
where two persons, in their own right, are creditors and debtors of each other. In this
case, Manny's obligation to pay Carlo may be considered extinguished through
compensation, assuming the conditions for compensation under Philippine civil law
are met.
