A. LESSON PREVIEW/REVIEW
The formal Correctional process begins from the time the accused is convicted, whether he is to
serve time for violating an ordinance (in which case he would serve his sentence in local jails) or the
Revised Penal Code (in which case he would be sent to the national penitentiary to serve his penalty). In
the event the accused is convicted for violating the Revised Penal Code (and other special laws) and is
given a sentence with a maximum period of more than three (3) years, he is to be transported to the
National Penitentiary within a period of 60 days. This period is to be reckoned on the date of the
Commitment Order, as issued by the Court. Our lesson for today will discuss the admission procedure in
the correctional facility. So let’s start.
B. MAIN LESSON

Admission of Inmates to BuCor

An inmate shall be admitted to Directorate for Reception and Diagnostic formerly Reception
and Diagnostic Center to study and classify inmates and detainees committed to the BuCor after
the presentation of the following documents:
Mittimus/Commitment Order of the court;
Information and court decision in the case;
Certificate of detention, if any; and
Certificate that the case is not on appeal
Note:
Female inmates shall be admitted only to the facility of
Correctional Institution for women
The mittimus/commitment order shall under the signature of the
judge and shall bear the seal of the court by the clerk of court.

· Register the inmates to the registry book containing:
· Name of the inmates;
· Reason for the commitment and authority thereof;
· Sentence;
· Date and hour of admission; and
· Date and hour of discharge or transfer and basis thereof

· After registration, the inmate shall be photographed, front and side view, fingerprinted and assigned
a permanent prison number. The male inmate shall then be given a regulation haircut and his
beard/moustache, if any shall be shaven off.
Notes:
● An inmate may not wear a wig or artificial hairpiece, unless medical authorization to
do is approved by the Superintendent
● The admission of an inmate shall be made in an area that is physically separated
from the general population.

· Upon admission, the inmate shall be searched thoroughly. He shall be allowed to retain in his
possession only such articles as are authorized. All lists of articles taken from the inmate shall be
entered in the inmate’s record and received for by the officer in charge. These items shall return to
the inmate upon his discharge unless previously disposed of at the inmate’s request or ordered
condemned by the Superintendent after the lapse of two (2) years.
Note:
● Items considered as contraband shall be confiscated

he shall also issue one each of the following and be responsible for such items issued to him:

Security Risk Classification for BuCor Inmates

Super Security – for a special group of inmates composed of incorrigibles and dangerous
inmates who are difficult to manage for being the source of constant disturbance in the maximum
security institution.
Maximum Security – for dangerous or high security risks inmates as determined by the
Classification Board who require a high degree of control and supervision. Under this category
are:

Those whose minimum sentenced is twenty (20) years imprisonment;
Remand inmates or detainees whose sentences are under review by the

Security and Reformation. From the DRD, the Custodial Force and Reformation Personnel of respective
security institutions/camps shall be in charge for the security and the implementation of the
recommended individual inmate reformation treatment program and the inmate-group reformation
treatment program of each and every inmate while serving sentence, respectively.

Pre-Release and Post-Release Programs. The Directorate for External Relations (DER) shall be responsible
for pre-release and post-release programs of inmates due for release. The DER shall also evaluate,
classify and apply necessary reformation programs to inmates for readiness to join the mainstream
society upon release, as part of the pre-release program. The inmate readiness programs are
customized towards their specialization in the areas of educational growth, livelihood entrepreneurship,

1. Strip Search and Inventory of Personal Property

Upon admission, the inmate is searched thoroughly. He is ushered into the quarantine area for purposes
of physical examination. While undergoing classification or being categorized by institution, he is allowed to
retain in his possession only such articles as are authorized.

A list of articles taken from the inmate is entered in the inmate’s record and receive for by the receiving
officer. Said articles will be returned upon the inmate’s discharge, unless any or all of said articles are
previously disposed of at the inmate’s request or ordered condemned by the Superintendent after a lapse
of two (2) years.

2. Releasing the Prisoner

Kinds of Releases
Prisoners are released from confinement for any of the following reasons:

● Upon expiration of his sentence

● By order of the Court or of competent authority

● After being granted parole, pardon (clemency) or amnesty. In the matter of executive clemency and
parole cases, the Director of Corrections submits the inmate’s prison record to the Board of
Pardons and Parole within the following periods:
● For commutation of sentence: at least one (1) month before the expiration of one-third of the
minimum period of the inmate’s indeterminate sentence and in special cases, at least one (1) month
before the periods specified by the Board
● For conditional pardon: at least one month before the expiration of one half of the minimum period
of the inmate’s indeterminate sentence and in special cases, at least one month before the periods
as the board may specify
● For parole: at least one month before the expiry date of his minimum sentence.

3. Authority To Release
● Those authorized to order or approve the release of inmates are:

● The Supreme Court or the lower courts (in cases of acquittal or grant of bail)

● The President of the Philippines (in cases of executive clemency or amnesty)
