SECTION 1 – GENERAL REQUIREMENTS


1.1. THE REQUIREMENT
It is required that there be constructed, completed, and commissioned in accordance with
the Contract Documents the Weir and Intake Structure, Conveyance Pipe, Desander,
Penstock, Powerhouse, Tailrace Channel, and Associated Structures for the Bineng
Combined Hydro Power Project in the Municipality of La Trinidad, Benguet, Philippines,
as described herein, for the Employer, Hedcor Inc., a wholly-owned subsidiary of Aboitiz
Power Corporation.

1.1.1. General
The Bineng Combined Hydro Power Project is being developed as an
Independent Power Project to supply Electricity to Luzon Grid. The Owner has
assigned responsibility for the design, construction, testing, and commissioning of
the Project to Hedcor Inc. herein referred to in this document as the Employer.
The Employer intends to award the Procurement and Construction package which
together shall comprise all components of the Civil Works Project. The Employer
shall supply the Engineering of the Civil Works Package. The Package will
comprise:

CW Civil A Supply and Construction contract comprising the


construction of the weir/intake, conveyance pipe, desander,
penstock, powerhouse main structures including crane and
switchyard area, access roads, including Testing and
Commissioning of all the components as defined in the
Employer’s Requirements and Specifications provided in
this Contract.

This Conditions of Contract, together with the Employer’s Requirements and the
Contract Documents, describes the scope of works of the contract, which shall be
a Unit Price-Measured Contract for the building of the Civil Works with a Defect
Liability Period complying with the Conditions of Contract.
Any and all stations and levels noted hereafter refer to the Basic Drawings, as
issued with the Bidding Design Drawings and other Bidding Documents.

1.1.2. Contractors Duties


The Contractor shall provide all logistics, superintendence, labour, plant,
materials, supplies, documents, equipment, tools, temporary works and any other
things, whether of a temporary or permanent nature, whether specifically
mentioned or not, necessary to complete, test and remedy any defects of the Civil
Works package and its interfaces. The Contractor shall use state-of-the-art
equipment proven reliable in similar environmental conditions.
As required in Contract Documents, the Contractor shall provide the following
services:

Survey
The Contractor shall be in charge of survey works. He will have to use the
primary survey grid already existing that will be provided by the Employer. It shall
be his responsibility to increase the density of the primary survey grid as
necessary and to ensure its maintenance.

The Contractor shall perform the secondary survey grid for weir/intake, desander,
pipe conveyance, penstock, powerhouse main structures/switchyard area, and
access roads, structures construction, he shall ensure its maintenance as
necessary, and he shall send the reports after installation to the Employer for
review.
The Contractor shall also install micro-grid network within the powerhouse, at all
levels, in order that he can erect his equipment at the right location. Among
others, the Contractor shall design circular openings at the different floors of the
powerhouse, to facilitate micro-grid installation at different levels and survey
during the plant operation. After installation of the micro-grid network, the
Contractor shall send a report to the Employer for review, the report shall give all
the necessary information, for electromechanical equipment erection.

Civil Works
The Contractor as part of his Civil Works is to demolish the existing structures of
Bineng 1, Bineng 2 and Bineng 2B Plant identified as follows:
 demolition works for Bineng 1 Plant are weir abutment, operating platform,
flushing control gates, gate lifting mechanisms, access structure, intake chamber,
Intake shed and walkway, intake screen, intake trash remover, drop intake screen,
control structure, lighting and electrical system, access footbridge intake structure,
intake trashrack, Intake control structure, intake box flushing gate, intake box
lifting mechanism, secondary intake gate, intake box access structure, safety
railings, conveyance line pipe until Bineng 1 forebay, transition pipes, air vents,
support piers, concrete pipe encasement, flume bridges, pratt truss bridges,
catenary bridge, pipeline waterways, slope support structures, catwalk, stairways,
walkway platforms, railings, penstock steel pipe from sta. 0 + 67.88 to sta. 0 +
199.60 and anchor blocks;
 demolition work for Bineng 2 Plant is the conveyance pipe from sta. 0 + 458 to
0 + 464 and Bineng 2 staff house structure
 demolition works for Bineng 2B Plant are conveyance pipe from sta. 0 + 039 to
sta. 0 + 069.50, penstock pipe from sta. 0 + 060.89 + sta. 0 + 078.30 and sta. 0 +
106.97 to sta. 0 + 124.50, 2B forebay structure, trashrack, spillway and its
appurtenances, 2B powerhouse super structure and sub-structure, and 2B staff
house structure.
For the main Civil Works, the Contractor shall construct the following Works in
accordance with the Drawings, Specifications and Employer’s Requirements.
 any required temporary works, structures, and facilities;
 the weir and intake at Balili River;
 the water pipe conveyance and penstock pipe from the intake to the
powerhouse;
 the desander;

 the powerhouse Civil Works and most of the necessary civil-works (such as
plumbing, sanitary, electricity, partition walls, ventilation and air-conditioning,
paintings, openings plugging and the second stage concretes and grouts on the
M&E equipment;
 the switchyard platform above of the powerhouse, access road, and drainages
systems;
 the powerhouse outdoor platform and associated facilities (roads, fence,
pavements, gates, ducts, trenches, gutters, chambers, blast walls etc.);
 the powerhouse tailrace channel;
 the landscaping around the power station areas;
 the access roads from the public road going to (a) the weir/intake area, (b) the
pipelines including the desander, (d) the power-stations platform entrance;
 the access roads to spoil deposit areas for all excavations;

The Contractor shall fabricate, supply, ship, deliver to site, and install the following
electromechanical works in accordance with the Employer’s Requirements:

 The powerhouse overhead travelling cranes and all auxiliary equipment and
controls, including panel boxes, wirings from power supply to the equipment,
cable trays or ducts, support for cable trays and ducts, switches, circuit
breakers,,
 Trashracks screen of the intake structure and desander structure at outlet
zone;
 The intake, bypass, and flushing gates of the weir and intake, the desander
flushing and controls gates and the powerhouse tailrace slant gates with all of
their associated facilities and controls (refer to section 24 and 25);
 Desander four units in-line flush with all of their associated facilities and
controls (refer to section 24 and 25);
 Measurement devices such as pressure gauges, and other equipment required
for monitoring and testing of the hydraulic system;
 the general electrical and mechanical works for the weir and intake, desander
and powerhouse areas such as lightings, convenience outlets, drainage pumps
etc, including all electrical wirings, ductings, poles, insulators, panel boxes,
switches and circuit breakers (refer to section 24 and 25).
 All fire-fighting equipment required for powerhouse, and powerhouse entrance
guardhouse (refer to section 24 and 25).

Monitoring and Testing


The Contractor shall carry out monitoring and site testing as required through the
specifications, to confirm that all components of the works will function as
required.

For example, the Contractor shall perform painting steel lining tests as specified in
the specifications. Also, the Contractor shall make available at no cost to the
Employer all the necessary test equipment when requested by the Employer to
control works quality. For example, for painting of the steel lining, the Contractor
shall make available at no cost all the necessary equipment to the Employer when
requested: thickness-meter, roughness-meter, adherence test equipment,
porosity meter.

For monitoring and testing, the Contractor shall carry out:

 The monitoring of the major excavations (weir and powerhouse) from the
excavation stage to the Taking Over Certificate (TOC);
 The monitoring of weir/intake, desander, pipe conveyance, penstock,
powerhouse main structures/switchyard area, and access roads,;

Maintenance
The Contractor shall carry out maintenance works until the TOC:
 The maintenance of all existing access roads and newly constructed roads
and related structures inside the Defined Work Areas (DWA)
 The maintenance of all permanent Civil Works Structures and all
temporary works.

1.1.3. Interface Details

Interface with Electromechanical Contractor (EMC)

The interface of Civil Works (CW) with that of the EM works shall be as follows:

a) The Civil Works Contractor (CWC) shall be responsible for the supply
and installation of the penstock line including the branch manifold and
flanges connecting to the turbine inlet valves. The penstock line
includes the construction of any bifurcation, branch manifold, detailed
thrust blocks, thrust rings and conical reducers. As shown on tender
drawings.and

b) For the turbine, generator, Turbine Inlet valve, hydraulic power units,
substation transformers, and all other equipment foundations, the CWC
shall be responsible for all first stage concreting and shall leave
enough space for second stage concreting and shall be responsible for
the placement and construction of blockouts, embedded anchor bolts
(supplied by E&M Contractor) and arrangements, in coordination with
the EM contractor. The EM contractors shall install the grout beneath
the turbine base connection plates. The CWC shall be responsible for
the concreting of all second stage concrete following the completion of
installation and setting work by the EM contractor.

1.1.4. Temporary Works

General
This section stipulates the conditions encountered by the Contractor for the
temporary works, notably transportation and site installations.
This section also draws the Contractor’s attention to the main interferences, which
may arise during the site works between the works carried out by the Contractor
and those carried out by other site workers.

Installation Works
General
The Contractor shall organize his site, temporary works and crew so as to comply
with the contract and in particular the overall schedule. The Contractor shall
adapt his organization in response to any changes in order to maintain full
compliance with the contract and said schedule.
For site installations, the Employer will supply the Contractor with an area as
defined in the contract for such installations. It shall be the Contractor’s
responsibility to strip, level, drain, and install his temporary water and electricity
supply as required on the designated areas.
If other Contractors are on site, consideration shall be given to an association
between the different sub-Contractors involved in the construction project and the
common management of certain facilities (water supply, power, medical facilities,
electricity supply, etc.).
At least two months prior to the start of works, the Contractor shall submit to the
Employer for review a detailed description of his installation and the general site
services justifying that the measures proposed by him are sufficient for him to
execute the works awarded to him in the technical conditions required and for the
scheduled completion dates.
On completion of the works incumbent on the Contractor and on the Employer’s
request, the Contractor shall, within a period of three months, reinstate the
premises and land he has occupied and remove all the site installations to the
satisfaction of the Employer’s Representative.

Site Personnel
The Contractor shall undertake to retain the necessary construction and
supervisory staff until the end of the contract period. These personnel shall be
described in an organizational chart communicated to the Employer with the bid
documents and updated as often as required.
The Contractor shall keep on the site a constantly updated list of workers
employed on the site.

Construction Equipment
The Contractor shall be responsible for the supply, start-up, maintenance and if
appropriate, the renewal of all the equipment and tooling needed for proper
execution of the works on the contractual completion dates.
The minimum list of site equipment that the Contractor is able to assign to the site
shall be handed over to the Employer one month prior to the start of the Works.
Moreover, the Contractor undertakes to bring onto the site, when required, all
additional equipment needed for him to meet the contractual obligations.

Safety Measures
The Contractor shall take all safety, security and policing measures required to
comply with the regulations, the instructions from the competent authorities, and
the contract.

1.1.5. Transportation
Responsibilities
The Contractor shall be responsible for the wrapping, loading, transport, unloading
and storage on site of the equipment supplied.
Access
The Contractor shall make his own inquiries of transport firms and should not rely
on any other indications of assessed capability.
For the transportation of heavy loads, the Contractor shall also undertake the
necessary procedures for obtaining the prior permits from the authorities of the
Provinces crossed.

1.1.6. Interface with Other site Contractors and Landowners as Contractors

General
The following indications are intended to draw the Contractor’s attention to certain
interferences that may arise between the work of the Contractor and that of
others. The following indications shall in no way whatsoever be considered an
exhaustive list of these interferences.
Coordination shall take place between the Contractor and other Sub-Contractors
in order to restrict, to the minimum possible, any hindrance that may be caused by
the utilization of common installations. This coordination may, for example,
consist in creating a common schedule for use of these installations, and daily
scheduling when necessary.
All permanent equipment which will be used by the Contractor during the Works,
like lifting plant skyline or others, will be maintained and repaired by the
Contractor at his own expenses until the Taking Over Certificate. (TOC).

Access Road inside the Site


Within his defined work area, the Contractor shall construct and maintain the
roads and temporary skylines that he may require.
Outside the Contractor’s reserved area, all participants in the site may use access
roads. The Contractor shall remain responsible for any deterioration associated
with the use of these access roads that is not compatible with the normal
conditions of use as defined by the Employer.
In the event that the Contractor requires access roads other than those that are
indicated in the drawings, he shall submit a written request to the Employer.
The Contractor shall coordinate with the other participants in the site in order to
define and set up indicator boards on the outside of his site installation area.

Work and Interface with Existing Facilities

The Contractor shall take all necessary precautions to carry out his work without
disturbing or causing any damage to the existing facilities to which the works shall
interfere.

Utilization of Lifting Plant


The travelling cranes installed by the CW Contractor in the powerhouse structure
shall also be used by the Electromechanical Contractor.
A coordinated schedule shall be prepared by the CW Contractor to minimize any
disruption of the construction program due to constraints on the use of the
travelling cranes. The powerhouse travelling crane used by the
Electromechanical Contractor will be operated by the CW Contractor and shall be
the responsibility of the CW Contractor, including maintenance.

Interface with Landowners as Contractors


Some work will be awarded to the Landowners which is not included in the CW
package of the main Contractor but still part of the project. Coordination shall take
place between the Contractor and Landowners as Contractors in order to restrict,
to the minimum possible, any hindrance that may be caused by the utilization of
common installations. This coordination may, for example, consist in creating a
common schedule for use of these installations, and daily scheduling when
necessary. Coordination should involve the Engineer.

1.2. DESCRIPTION
The principal items of work to be executed under the Contract include:
a. Weir and Intake Structure
The weir is a structure designed to divert the required flow of water into the intake.
The intention is not to store water or increase head. It shall either channel the flow
towards the intake or simply provide the required depth of water at the intake for
flow to enter its own accord. Three gates will be provided for the weir such as the
intake gate, flushing gate, and bypass gate.
b. Headrace pipe conveyance.
A headrace pipe conveyance will be constructed to divert the flow of water from
the intake to the desander.
c. Desander
The desander is a reinforced concrete structure cast below current ground level.
It has a single basin with an in-line facility for flushing operation. Flushing gate is
provided downstream of the basin and a control gate is provided at the penstock
inlet.
d. Penstock
The penstock pipe for Bineng Combined HEPP are to be made from ASTM A139
Grade B of varying thicknesses and diameters. Some of the pipe will be above
ground and some will be below ground. It will be provided with reinforced concrete
supports along straight sections and be encased with reinforced concrete thrust
blocks at bends.
e. Powerhouse

The Powerhouse for Bineng Combined HEPP is to be constructed with reinforced


concrete frames up to the height of the gantry crane with steel structure above.
The powerhouse will be provided with a travelling gantry crane supplied and
installed and required for the installation of the electromechanical plant. Blast walls
(optional), substations and external landscaping are included within the
powerhouse works.
f. Tailrace Channel.
These are reinforced concrete structures which would extend to the river banks.
g. Associated Works
Associated Works are miscellaneous works such as demolition works of existing
plants structures, access walkways and railings to the control facilities, site
development and landscaping works at the powerhouse site and slope protection
works at the access paths and other areas to be designated by the Employer’s
Representative.

1.3. CONTRACT DOCUMENTS AND DRAWINGS


1.3.1. Contract Documents
The Contractor will be provided with an electronic copy of Contract Documents.
On the completion of the Contract all Contract Documents supplied shall be
returned to the Employer’s Representative.
1.3.2. Drawings
The Drawings included in the Contract are to be used for tendering purposes only.
The Drawings show the work to be carried out in accordance with the Contract, as
definitively and in as much detail as is possible at the present stage of the
development of the design. The parts of the Permanent Works for which
dimensions are not shown have been drawn to scale as nearly to the final
dimensions as possible prior to the purchase of machinery or equipment and prior
to the development of final general and detailed design. These Drawings will be
supplemented or superseded by further drawings as necessary for the
purpose of the proper and adequate execution of the Works. Three full size
prints of such Drawings will be issued by the Employer’s Representative to the
Contractor in accordance with the construction programme required under this
Contract. On receipt of these Drawings, the Contractor shall check them
carefully and advise the Employer’s Representative in writing of any
discrepancies, errors or omissions and full instructions will be furnished to the
Contractor should any discrepancies, errors or omissions be found. The
Contractor shall be required to perform the work in accordance with such further
drawings at the applicable rates tendered in the Bill of Quantities for such work or
work of a similar nature. Although the Drawings are prepared to scale, work shall
be based upon dimensions shown on the Drawings and not on dimensions scaled
from the Drawings. Drawings when read in conjunction with the Specification and
instructions that may be issued from time to time by the Employer’s
Representative, will show sufficient dimensions, specific details and typical details
to define the various features of the work, but the details necessary for the
construction of any part of the work may have to be deduced from several
Drawings. Any additional drawings which the Contractor requires to
interpret the Drawings for the use of his employees shall be prepared by the
Contractor and all costs shall be borne by the Contractor. The working
drawings and shop drawings required to be submitted to the Employer’s
Representative for approval, in accordance with this Specification, shall consist of
two prints.

1.4. ROYALTIES
The Contractor will not be required to pay royalties in respect of rock, stone, sand, gravel
and clay removed from approved sources at the Site for use in the Works. The sources
shall be approved by the Employer’s Representative.

1.5. ROAD ACCESS TO THE SITE


1.5.1. Existing roads
The Project site is approximately 256 kilometres north of Manila and 3 kilometres
northeast of Baguio City. It is accessible through the National Road from Baguio
City and through an existing trail from the Benguet Capitol to Barangay Bineng.
1.5.2. Load limits
The highways, roads and bridges may have varying load limits, and the Contractor
shall be responsible for determining the load limits existing at the time and
ensuring that his Contractor’s Equipment and any loads to be carried do not
exceed such limits. Before moving any heavy construction traffic onto highways,
roads and bridges, the Contractor shall make suitable arrangements with the
appropriate Government authorities and obtain their approval for the passage of
such traffic.
1.5.3. Special protection
Pursuant to Sub-Clause 4.15 of the Conditions of Contract where the authorities
require and specify any special protection or strengthening of highways, roads or
bridges, the Contractor shall submit to the Employer’s Representative his
proposals for such work after their approval by the authority concerned and shall
carry out this work as required by the authority at the direction of the Employer’s
Representative. All costs for any special protection or strengthening required by
Government authorities and carried out at the direction of the Employer’s
Representative shall be made in accordance with the requirements of this
Contract.
1.5.4. Tracked equipment
The Contractor shall not travel tracked vehicles or plant on any bituminous sealed
road surface. Rubber tired vehicles conforming to applicable load restrictions will
be permitted to use bituminous sealed roads.

1.6. COMMENCEMENT, EXECUTION AND COMPLETION OF WORKS


1.6.1. Order to commence
The Contractor shall commence work under the Contract in accordance with the
Conditions of Contract.
1.6.2. Execution and completion of Milestones
Pursuant to the Conditions of Contract, the Contractor shall execute the Works
outlined in Clause 1.2 herein and complete the Milestones according to the Table
of Milestones and Delay Damages detailed in the Appendix to Tender.
1.6.3. Co-ordination of construction programme
In arranging his construction programme for the execution of the Works, the
Contractor shall make allowance for the following installations and erection of
equipment to be performed by the Employer’s own forces or by other contractors.
a. Installation and Commissioning of E & M Equipment
b. Installation and Commissioning of Transformers and Switchyard Equipment

c. Installation and Commissioning of Transmission Lines

In accordance with this Specification, the Employer will integrate his design and
drawings programme with the Contractor’s construction programme and drawings
will be made available progressively from the date of receipt of the Employer’s
Representative’s order to commence.

The Contractor shall communicate directly with other contractors as listed in


Clause 1.10 on all matters of mutual interest and responsibility.

The Contractor shall cease operations in the required locations and clear the area
concerned to the extent necessary to enable the installation of the various items of
metalwork to proceed, making due allowance for the installer’s handling
equipment. The Contractor shall co-operate with the Employer’s Representative
and other contractors employed by the Employer during the erection of the various
items of metalwork prior to concrete embedment. The Contractor shall assume full
responsibility for the metalwork and the adequacy of its support when it is handed
over to him for embedment. Concrete embedment shall not commence without
the approval of the Employer’s Representative.

The Contractor shall ensure that all embedded metalwork forming part of other
contractor’s responsibilities is protected as approved by the Employer’s
Representative from possible damage due to the Contractor’s own activities.

The Contractor will be required to make good or repair any damage to the other
contractors’ embedded parts or to accurately reinstate such parts in the event of
damage or displacement when such damage or displacement is in the opinion of
the Employer’s Representative due to the Contractor’s activities.

The work required of the Contractor to allow installation of the various items will
include, but will not be restricted to, the placement of concrete and the
embedment of all necessary supports as determined by the Employer’s
Representative in time to permit the concrete to attain the specified minimum
design strength.

1.7. USE OF CONSTRUCTION FACILITIES AND WORKS AREA


1.7.1. Rights of others to use construction facilities
a. Other contractors (including sub-contractors) employed by the Employer and
their workmen and workmen of the Employer and of other Government
authorities will be carrying out work on or near the Site of the Works.
b. Other contractors employed by the Employer and the Employer shall have the
right to use without charge the access facilities including bridges and roads
which the Employer has given possession to the Contractor or which have
been constructed or acquired by the Contractor for the purposes of the
Contract.
1.7.2. Concurrent contracts
a. Concurrent with the construction of the Works, the Employer will have other
works under construction on and within the vicinity of the Site.

b. The Contractor’s operations shall be planned to avoid as far as is practicable


any interference or delay to the work of the Employer and of other contractors
employed by the Employer at the site of these operations. To assist in co-
ordinating his operations with the work being done by others, the Contractor
shall establish direct site liaison and communication as necessary with the
Employer’s Representative and other contractors employed by the Employer
for all purposes associated with his proposed operations. In the event that the
requirements of the Contractor, the Employer and other contractors conflict at
any stage of the work, the Employer’s Representative shall decide the order in
which work shall proceed.

c. Subject to the rights of the Contractor under the Contract, the decision of the
Employer’s Representative shall be final in the event of any disagreement
between the Contractor and other contractors employed by the Employer, for
the work referred to in this sub-clause, which cannot be resolved mutually.
1.7.3. Protection of electrical and mechanical plant
a. During and after installation of the turbine-generator and its control system, the
Contractor shall co-ordinate with the electro-mechanical contractor to prevent
any damage which might arise from their operations including that from
harmful quantities of airborne dust. For this purpose, mixing of concrete and
handling of any cement in the vicinity of the plant and equipment will not be
permitted after the commencement of installation, unless otherwise approved
by the Employer’s Representative.
b. The Contractor will not be permitted to erect any concrete mixing and batching
plants or cement handling plants nearer than 200 m to the new powerhouse.

1.8. MATERIALS TO BE FURNISHED BY THE CONTRACTOR


1.8.1. Materials to be furnished
The Contractor shall furnish all materials required for the execution of the Works.
1.8.2. Trade name and catalogue numbers
Unless specifically stated otherwise any reference in this Specification or on the
Drawings to trade names or catalogue number, or to a particular manufactured
product does not imply that the article or product so mentioned is the only one that
may be supplied or used. Any reference so made is purely given as a standard of
the quality, class, type and finish of the items specified to be used. Articles or
products of similar type and quality produced by other manufacturers shall be
submitted by the Contractor to the Employer’s Representative for approval for
use.
1.8.3. Conformity of materials with Specification
a. All materials that will become part of the Permanent Works shall be new and shall
conform to this Specification. Where the requirements for any material are not
stated in this Specification, the material shall conform to the Clause 1.9.
b. The Contractor shall make diligent efforts to procure the specified materials but
where, because of priorities or other causes, materials required by the
Specification are not available, substitute materials may be used. No substitute
materials shall be used without prior written approval of the Employer’s
Representative. The Employer’s Representative shall not accept any substitute
material unless there are written evidences that the Contractor has attempted to
procure material in due time.

1.8.4. Inspection, examination and testing of materials and equipment


Materials and equipment furnished by the Contractor, which will be incorporated in
the Permanent Works, shall be subject to inspection, examination and test as
provided in the Contract. To allow sufficient time to provide for inspection,
examination and testing, the Contractor shall submit to the Employer’s
Representative, copies in duplicate of all orders, including drawings and other
pertinent information, covering the materials and equipment to be furnished by the
Contractor, or shall submit other evidence in the event of such orders being
issued verbally or by letter. The inspection, examination and testing of materials
and equipment or the waiving of inspection, examination and testing shall in no
way relieve the Contractor of the responsibility for furnishing materials and
equipment meeting the requirements of this Specification.
1.8.5. Payment for cost of supplying material
a. When a separate item, which includes the supplying of any materials, is provided
for in the Bill of Quantities, the cost of furnishing, transporting, storing and
handling such materials shall be deemed to be included in the rate tendered for
that item in the priced Bill of Quantities.
b. Where no separate item is provided in the Bill of Quantities for supplying any
materials required to be furnished by the Contractor, the cost of supplying,
transporting, storing and handling such materials shall be deemed to be included
in the rates tendered for the items for which the materials are required.

1.9. STANDARDS
a. Except as otherwise specified in this Specification, all materials and workmanship
shall comply in all respects with the requirements of the appropriate specifications
and codes issued by the Philippine National Standards or the American Standards
such as the AWWA, ASTM, and ACI or such other standard as the Employer’s
Representative may approve, and is current at the date of Invitation to Tender, as
may be applicable to any parts of the Permanent Works. If after the date of
Invitation to Tender there is an amendment to a standard specification relevant to
the Contract, the Employer’s Representative will direct whether the amendment is
to apply.
b. The Contractor shall have available in his site office at all times at least one copy
of every standard specification or code referred to in this Specification.

1.10. SOIL CONSERVATION


1.10.1. Prevention of erosion
a. All proper precautions shall be taken by the Contractor to prevent the
erosion of soil from any lands used or occupied by the Contractor and the
bed or banks of any river or stream and the deposition of excavated or
eroded material in any river or stream that may result from the execution of
the Works.
b. All soil conservation measures shall be carried out in the earliest possible
season, as determined by the Employer’s Representative, to ensure that the
required protection is established by the time of completion of the Works.
1.10.2. Areas occupied by Permanent Works
Where and when directed by the Employer’s Representative, soil conservation
measures on excavated surfaces or filled material which form part of Permanent
Works shall be performed in accordance with this Specification and as shown on
the Drawings.

1.10.3. Payment
Separate payment will not be made for work required in accordance with this
Clause and all such costs shall be deemed to be included in the various rates and
lump sums in the priced Bill of Quantities.

1.11. PRESERVATION OF FLORA AND FAUNA


The Contractor shall refrain from destroying, removing or clearing trees, timber, scrub and
other flora to any extent greater than is approved by the Employer’s Representative as
being necessary for the execution of the Works and take such measures as may be
necessary to prevent the Contractor’s Personnel from hunting, disturbing, capturing or
destroying stock and such fauna as may be protected by relevant statutes.

1.12. ENVIRONMENTAL AND SOCIAL REQUIREMENTS


1.12.1. General

The Parties acknowledge and agree that the construction, testing and completion
of the Facility will involve significant environmental and social impacts and that
these will be addressed under the Contract.
The Employer’s obligations to the Philippine Government on these matters are
delineated in the Environmental Clearance Certificate (ECC) issued by the
Department of Environment and Natural Resources (DENR) for the Project.
The Contract applies the Conditions defined in the ECC and other related
Environmental Laws as the obligation of the Employer to define and allocate
responsibility for addressing the Project Impacts and the obligations of the
Contractor in this respect.
To the extent specified in the Contract, the Contractor shall undertake to address
those Project Impacts arising as a direct consequence of the Contractor
undertaking the Works specified in the Contract.
Without limiting the generality of the above, the Contractor shall avoid,
compensate, alleviate, mitigate, remedy or otherwise address all direct
construction and Project Impacts occurring within the Construction Areas,
including undertaking the following activities:

 meeting effluent standards and water quality requirements of discharges to


surface waters and groundwater;
 controlling erosion and sedimentation;
 managing on-site traffic;
 providing archeological and heritage site protection and relocation as
necessary;
 landscaping, rehabilitating and re-vegetating the Construction Areas;
 managing on-site waste;
 managing, preventing and developing an emergency plan for chemical
incidents;
 control of noise emissions and dust;
 survey and disposal of unexploded ordinance;
 construction of construction work camps, including the planning and
provision for spontaneous resettlement;
 implementing a program for construction worker education in
environmental issues;

 implementing a health program for all project staff;


 complying with Applicable Laws and Applicable Standards.

1.12.2. Employers Environmental Requirements


Contractor’s Environmental Monitoring and Management Plan
The Contractor shall prepare the Contractor’s Environmental Monitoring and
Management Plan in accordance with the requirements and shall submit it to
the Employer for non-objection no later than two (2) months after the
Commencement Date or two (2) months prior to the proposed date to
commence work on the Construction Areas, whichever is the earlier.

The Contractor’s Environmental Monitoring and Management Plan shall


describe the Contractor’s policies and actions that it will implement to ensure
compliance by the Contractor, Subcontractors and other agents with the
Environmental Requirements as set out in the Employer’s Requirements.

Contractor’s Environmental Management Plan for Preliminary Construction


Activities
The Contractor shall prepare a Contractor’s Environmental Management Plan
for Preliminary Construction Activities and shall submit it to the Employer for
non-objection no later than six (6) weeks prior to the proposed commencement
date of any preliminary construction work.

The Contractor’s Environmental Monitoring and Management Plan for


Preliminary Construction Activities shall describe the Contractor’s policies and
actions that it will implement to ensure compliance by the Contractor,
Subcontractors, and other agents with the Environmental Requirements as set
out by the Employer and elsewhere in the Contract, which are relevant to the
proposed Preliminary Construction Activities.

Summary Plan/Skeleton Outline


The Contractor shall submit a skeleton outline of the proposed Environmental
Monitoring and Management Plan with the preliminary Reference Design
submission. It shall include a summary of the proposed methodology to
develop and implement the said plan and shall outline the proposed actions for
all the requirements set out by the Employer. The summary plan shall be
submitted to the Employer at least two (2) months prior to the anticipated date
of signing of the Construction Contract.

Sub-Plans for Protection and Mitigation Measures


The Contractor shall incorporate the Sub-Plans and their requirements in the
Contractor’s Monitoring and Management Plan and shall implement the Sub-
Plans in the execution of the Works to ensure all environmental obligations are
complied with.

1.12.3. Contractors Liabilities

Contractor’s Compliance Monitoring and Reporting


The Contractor shall institute a program of self-monitoring and enforcement using
via standard international quality assurance procedures for monitoring the
environmental effects arising under the Contract and of the Contractor’s
compliance with the Employer’s Environmental Requirements. The program shall
be in accordance with the procedure included in the Contractor’s Environmental
Monitoring and Management Plan.

The Contractor shall be responsible for preparing monthly reports, as a section


within the monthly report required for submission to the Employer setting out:

 Progress of Environmental Requirements against the agreed program;


 Schedule of Works underway and planned;
 Any difficulties encountered in the Environmental Requirements and
recommendations for remedying them for the future;
 The number and type of non-conformances and proposed corrective actions;
 Sub-reports from the Sub-Contractors and Other Contractors involved in the
Works, including minutes of meetings and discussions held by the Contractor;
 Minutes of meeting from discussions held with the Employer regarding the
Environmental Requirements.

Compliance Monitoring by the Employer and Others


The Employer will have an environmental unit called the “Environmental
Management Office” (EMO) which will be responsible for monitoring the
Contractor’s compliance with the Environmental Requirements.
The DENR environmental unit called the Environmental Management Bureau
(EMB), will monitor the Employer and Contractor’s compliance with the
Environmental Requirements.
The Contractor must provide to the Employer’s EMO all necessary background
information to respond to public comments, complaints and inquiries in relation to
the Environmental Requirements.
The Employer and the DENR will appoint an independent monitoring agency to
review implementation of the management of environmental issues of the Project,
if necessary.
The Contractor shall give the Employer, DENR, and independent agency full
cooperation and provide it with access to all relevant data, documentation,
program activities and sites to facilitate the effective monitoring and evaluation of
the Environmental Requirements and the status of the Project Impacts.
The Employer will identify non-conformances to the Environmental Requirements
based on the Contractor’s Environmental Monitoring and Management Plan and
Environmental Management Plan for Preliminary Construction Activities.
Monthly meetings shall be held among representatives of the Employer and the
Contractor and any other associated parties to facilitate the administration,
coordination and monitoring of the Contractor’s Environmental Management Plan
which may also include consideration of contractual and legal obligations.

1.12.4. Site Rehabilitation


Upon issue of the Taking Over Certificate, the Contractor shall demobilize,
remove from the Site or otherwise dispose of, all plant, equipment, stockpiles,
surplus materials, hazardous materials, temporary buildings, installations and all
other facilities and things that are no longer needed for the performance of any
outstanding obligations under the Contract. The Contractor shall rehabilitate work
and living areas, including excavations, borrow areas, quarries and spoil dumps,
and shall leave the Construction Areas and the Works in clean, tidy and
workmanlike condition in accordance with the Environmental Requirements.

1.12.5. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the rates and lump sums in
the priced Bill of Quantities.

1.13. SETTING OUT WORKS


1.13.1. Responsibility for setting out
Pursuant to Sub-Clause 4.7 of the Conditions of Contract the Contractor shall be
solely responsible for the correct setting out of the Works and shall employ
experienced qualified surveyors acceptable to the Employer’s Representative for
this purpose.
1.13.2. Establishment of reference marks
a. The Contractor shall with the information to be provided by the Employer
and Employer’s Representative establish the necessary reference marks to
define datum lines and the reduced levels of suitably located reference
bench-marks to enable the Contractor to set out the Permanent Works. The
Contractor shall satisfy himself that the survey marks shown on the
Drawings and their levels if shown, agree with the existing features on the
site. Any reference marks damaged as the result of an action by the
Contractor will be replaced by the Contractor at his own expense to the
Employer’s Representative’s satisfaction.
b. The Contractor shall provide the survey of original ground of the Works area
before any excavation in the presence of the Employer’s Representative for
the purpose of quantities and setting out.
c. The Contractor shall at all times have available at the site approved survey
instruments and an experienced and qualified surveyor together with
experience survey crew.
d. All bearings shall be set out with reference to the origin azimuth or baseline
shown on the Drawings, or when not shown, with reference to a surveyed
line of known bearing indicated by the Employer. Control points as shown on
the drawings shall be marked clearly for the establishment of the reference
marks.
e. The Contractor shall furnish all materials, labour and equipment including
stakes, templates, pattern, platforms and special labour that may be
required by the Contractor in setting out any part of the Works.

1.13.3. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the rates and lump sums in
the priced Bill of Quantities.

1.14. SAFETY PRECAUTIONS


1.14.1. General
a. The Contractor shall comply with all the relevant statutory regulations of the
Philippines with respect to safety and occupational health.
b. The Contractor shall comply with any safety instruction given by the
Employer’s Representative.
c. In the performance of the Works, the Contractor shall exercise every
reasonable precaution to protect from injury persons or property. The
Contractor shall erect and maintain all necessary temporary fencing,
barricades, barriers, multi-lingual signs and lights and provide fire alarm, fire
extinguishing and fire fighting services at strategic points on the Site and
adequate lighting for his workmen. The Contractor shall adopt and enforce
such rules and regulations as may be necessary, desirable or proper to
safeguard the public and all persons engaged in the work and its
supervision and all persons authorised to be on the Site.
d. The Contractor shall produce and implement a Project Safety Plan for the
whole of the Works including, but not limited to, the items described in sub-
clauses 1.14.3 to 1.14.6 of this Clause. The Project Safety Plan shall be
submitted to the Employer’s Representative for his consent within 21 days of
the Commencement Date and before any Works commences on the site.
The Project Safety Plan shall be modified and updated with the consent of
the Employer’s Representative from time to time and as required.
1.14.2. Safety officer
The Contractor shall employ for the duration of the Works, an experienced
specialist, academically qualified in safety, and familiar with the type of work being
performed, whose assignment shall include initiation of measures for the
protection of health and the prevention of accidents and who shall see, by
personal inspection, that all safety rules and regulations are enforced. The
Contractor shall hold regularly scheduled safety meetings at least once each week
or when directed by the Employer’s Representative, with his engineers,
supervisors and foremen. The Contractor shall keep the Employer’s
Representative advised as to when these meetings are to be held and shall
provide the Employer’s Representative with a copy of the proposed agenda.
1.14.3. Temporary fencing
The Contractor shall erect and maintain as a safety measure suitable and
approved temporary fencing to enclose such areas of the Permanent Works and
areas of land occupied by the Contractor within the Site as may be necessary to
implement his obligations under the Contract, to the satisfaction of the Employer’s
Representative. Where any temporary fence has to be erected alongside a public
road, footpath, etc. it shall be of the type required by and shall be erected to the
satisfaction of the Government authority concerned. The temporary fencing shall
be removed by the Contractor after completion of the Works.

1.14.4. Lighting
a. If the Works to be carried out during night, without limiting the generality of
the Conditions of Contract, the Contractor shall provide sufficient lighting to
ensure that, in all places where work is in progress:
i. safe working conditions are provided both for the Contractor’s
Personnel, personnel of other contractors employed by the Employer
(provided they are working in the Contractor’s areas of work) and for
Employer’s Personnel/Employer’s Representative;

ii. the Works can be constructed in complete compliance with the


Contract; and

iii. a complete inspection of all works in progress can be made by the


Employer’s Representative.

b. All moving equipment or plant used during night operations shall be


equipped with sufficient lights and reflectors to ensure safe working
conditions.
c. Not less than 14 days before the start of night operations, the Contractor
shall submit to the Employer’s Representative his proposals for lighting in
the areas in which he proposes to work at night. The Contractor shall
modify the proposals if required by the Employer’s Representative, and shall
not begin operations at night as the case may be, until the proposals for
lighting (in an amended form if required) have been approved by the
Employer’s Representative.
d. The submission to or approval by the Employer’s Representative of the
Contractor’s proposals for lighting shall not relieve the Contractor of any of
his liabilities or obligations under the Contract.
1.14.5. Signs
a. The Contractor shall provide all necessary signs for the Works. These shall
include, but not be limited to:
i. standard road signs;
ii. warning signs;
iii. danger signs;
iv. control signs;
v. safety signs; and
vi. direction signs.
b. Wording on all signs shall be in English and other languages where
appropriate with the size, colour, lettering and location of all signs will be
subject to approval.
c. The Contractor shall maintain all signs placed by himself as well as those
placed by the Employer.
d. If the Employer’s Representative considers that the system of signs provided
by the Contractor is inadequate to ensure safety, or unsatisfactory in other
respects, the Contractor shall add to, amend, or otherwise change the
system to include approved multi - lingual signs.

1.14.6. Other safety measures


a. Work in the vicinity of electrical equipment
In the interest of safety and security the Contractor shall complete the
erection of any safety fencing around electrical and mechanical equipment
by the time that the said apparatus is connected to any electricity supply.
b. Explosives
In the use, handling and storage of explosives, the Contractor shall comply
with the guidelines and regulations of the Philippines. The handling or use
of explosives shall be discontinued during the approach and progress of a
thunderstorm. All persons shall be removed from danger areas to a place of
safety during such periods.
c. Accident reports
The Contractor shall promptly report to the Employer’s Representative in a
form to be prescribed, all accidents involving death or serious injury to staff
or workmen, and furnish monthly reports of all accidents to staff or workmen
involving loss of time, giving such information as may be prescribed by the
Employer’s Representative.
1.14.7. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the rates in the priced Bill
of Quantities.

1.15. BLASTING
When carrying out blasting operations, the Contractor shall use the standard blasting
warning code, on which prior approval has been obtained in writing, take all precautions
for the protection of persons, the Works and all property, and shall be responsible for any
injury caused to or death of any person, or damage done to the Works or to property by
blasting. Protected detonators shall be used in all blasting operations which use electric
firing. The location and design of powder magazines, methods of transporting explosives,
use of explosives and, in general, the precautions taken to prevent accidents shall be in
accordance with all statutory regulations of the Philippines and such other precautions as
the Employer’s Representative may require with special reference to the presence of
high-voltage electric power transmission lines and substations near sections of the Works
which may preclude the use of electric detonators. Nevertheless the Contractor shall
assume any liabilities resulting from injuries to, or deaths of persons or damage to
property caused by his blasts or explosions.

1.16. HOURS AND DAYS OF WORKING


In case of Works to be carried out beyond normal working hours as stated in the
Appendix to Tender, before commencement of work, the Contractor shall notify the
Employer’s Representative, in writing, of the hours and of the number of shifts that he
proposes to work and shall give at least forty-eight hours notice to the Employer’s
Representative of any changes to such hours of working and/or number of shifts that may
be necessary during the execution of the Contract.

1.17. CONSTRUCTION PROGRAMME, RESOURCES REPORTS AND MONTHLY


STATEMENTS
1.17.1. Construction programme
a. In accordance with Clause 8.3 of the Conditions of Contract, the Contractor
shall submit to the Employer’s Representative for approval a detailed
construction programme. Thereafter the Contractor shall furnish a further
construction programme at a monthly intervals revised where necessary.
b. The Construction programme shall provide further detailed information to
that submitted with the Tender. The programme shall show the major
construction operations for each major item of the Bill of Quantities and for
groups of like items of a minor nature, from the date of the order to
commence work to the Contract Completion Date. The programme shall be
so prepared that all of the Works are to be completed within the time
stipulated in the Appendix to the Tender. The programme shall be
submitted in bar chart and CPM network forms. The critical parts(s) shall be
marked on the network as well as float for each activity. Together with the
programme the Contractor shall submit his estimated monthly payments,
quarter by quarter for each major item of the Bill of Quantities and for groups
of like items of a main nature. The Contractor shall adhere to the approved
programme unless any deviation there from be approved on directed by the
Employer’s Representative.
c. Whenever the Contractor proposes to change the approved construction
programme he shall immediately advise the Employer’s Representative in
writing and if the Employer’s Representative considers the change is a major
one the Contractor shall submit for approval a revised programme. If such a
change in the construction programme affects the Employer’s
Representative’s design and drawing programme, the Employer will not be
responsible for the consequences of the late issue of any drawings which
are attributable to that change.
d. If the Contractor falls behind the approved construction programme he shall
within 14 days of the date of such default submit for approval by the
Employer’s Representative a revision of the programme showing the
proposed measures to complete the Works on time.
e. When requested by the Employer’s Representative, the Contractor shall
promptly furnish a detailed sub-programme for particular sections of the
Permanent Works.
f. The Contractor shall use the computer software such as Primavera P6® or
Microsoft® Project for CPM programming.
1.17.2. Resources reports
During the course of construction, the Contractor shall submit to the Employer’s
Representative each month a detailed list by trade classification of manpower
employed during the report period and a list of all major items of Contractor’s
Equipment on Site to accomplish each activity of the construction programme.
1.17.3. Monthly statement
The Contractor shall submit a monthly statement in accordance with the
requirements of Clause 14 of the Conditions of Contract. The monthly statement
shall be accompanied by copies of all survey notes, records of measurements and
calculations required by the Employer’s Representative to be prepared by the
Contractor in support of the amounts claimed for the work executed.

1.17.4. Payment
All costs associated with complying with the requirements of this Clause shall be
deemed to be included in the rates and lump sums in the priced Bill of Quantities.

1.18. PROJECT COORDINATION AND MANAGEMENT


1.18.1. Purpose
The Contractor shall have a detailed project coordination and management
document. This document defines the general principles of project coordination
and management with reference to the division of work between the various
Contractors involved in its implementation as designated below:
 The OWNERSHIP COMPANY referred to as the Owner,
 HEDCOR, Inc. referred to as the Employer of all Contracts.
 CONTRACTORS referred to as the Civil Works or Electromechanical Works
Contractor

Details of the Employer’s project management organization shall be defined in the


Project Procedures Manual (PPM) in the interest of good understanding taking
into account that the management requirements are defined in the Conditions of
Contract. The data shall be provided by the Employer to the Contractor in order
that the Contractor can include the data in the PPM.

1.18.2. Contractors Duties

Contract Management
Details of the management organization of each Contractor with all necessary
details shall be defined in the PPM and shall be updated as necessary.
The Contractor shall coordinate activities with the Employer and with other
Contractors engaged in the Project. In case of direct coordination between the
Contractors, the Employer shall be informed.
The Contractor shall be responsible for providing contract management including
all activities related thereto.
The Contractor undertakes that, in the performance of all such activities, it shall
only use suitably qualified and experienced personnel who shall be fluent in the
English language. The Contractor further undertakes that in performing the
aforesaid activities and without prejudice to its interests in the Contract, its
personnel shall at all times act in the best interests of the Project.

Contract Implementation
Each of the parties shall ensure a smooth and uninterrupted execution of the
Project in accordance with the Contract Program and with the project
management and coordination principles defined in the Contract Documents.

1.18.3. Overall Project Management

Quality Assurance
The Contractor shall supply to the Employer and update the following QA
documents, as described in the Employer’s Requirements.
 The Quality Assurance Manual
 The Quality Assurance Audit Folder
 The Contractor’s Hygiene and Safety Manual

Management Procedures & Control Documents


Any procedures used by the Contractor shall be his responsibility. Management
procedures will be at least as follows:

 The Project Procedures Manual (PPM) which establishes procedures for


coordination of day to day activities among the parties involved in the
project (e.g. correspondence and communication), and which lays down the
rules to be applied for relationships between the Employer and the
Contractor.
 The Engineering Manual (EM) which defines the general engineering rules
applicable to the Project. The purpose of this manual is to document
common terms for all the parties involved in the project (identification of
structures and equipment, definitions, contents presentation, identification
and status of documents, etc.). These rules shall be applied by the
Contractors in accordance with their contracts.
 The Interface Control Guide (ICG) which defines the means and rules for
managing engineering interfaces between parties, i.e., interface data
identified at the time of contract signature and during the course of the
Project.
 Progress Reports, which are the basic documents allowing to follow and
check the coordination and progress aspects of the Project.

First draft of PPM, EM and ICG shall be prepared by the Contractor. Then they
shall be mutually modified by the Employer and the Contractors and the final
version shall be based on the proposal of the Employer.

1.18.4. Meetings

Coordination & Liaison Meetings

The Contractors shall attend specified Periodic Coordination Meetings weekly


scheduled by the Employer. Coordination meetings shall deal with progress and
coordination of all the aspects of the project, including:

o checking manufacturing progress of equipment and materials against the


relevant delivery dates. Check that the delivery dates are consistent with
Contractor’s Program,
o assessing the status of current non-conformance and identifying measures to
be adopted by Contractors to correct any non-conformance,
o review of construction progress,
o coordination of interfaces among Contractors,
o construction schedules and planning.
o site safety review
o environmental review

Coordination meetings will generally be held at the Employer’s office at the Project
Site, or in another location to be selected by the Employer.

All Contractors will have to attend these coordination meetings, with at least two
(2) representatives who will be designated as Coordination Manager of the
Contractor, who shall be mentioned in the PPM, and who shall be well trained and
aware of the coordination problems on site. These representatives shall have full
authority from the Contractor, and shall be able to take prompt action as
requested by the Employer.

Contractors will be expected to organize additional meetings as required to


coordinate activities with other Contractors, especially with respect to
management of interface issues.

Meetings on Specific Issues

In the interest of the Project and Contract Management, the Contractors shall
attend meetings called to resolve specific issues which may arise from time to
time and which cannot be dealt efficiently by correspondence or periodic meetings
like coordination meetings. The time, location and agenda for such meetings
shall be determined according to needs and by mutual agreement among all the
parties concerned. The Employer and all shall comply with all reasonable
requirements for such meetings.

1.18.5. Communications & Correspondence

Communications
Instructions given by the Employer shall be in writing, provided that if for any
reason the Employer considers it necessary to give any such instruction orally, the
Contractor shall comply with such instruction. Confirmation in writing of such oral
instruction given by the Employer, whether before or after the carrying out of the
instruction, shall be deemed to be an instruction within the meaning of this article.
Provided further that if the Contractor within two (2) days confirms in writing to the

Employer any oral instructions of the Employer and such confirmation is not
contradicted in writing within 48 hours by the Employer, it shall be deemed to be
an instruction of the Employer.

Correspondence
The Employer shall designate by written notice to the Contractor one person to be
the Employer’s Representative duly authorized to represent, act, and bind the
Employer in connection with the administration of this contract and carry out the
duties and exercise the authority set out or necessarily implied in this Contract.
The Employer shall prepare the agenda of all meetings called by the Employer,
including the regular Coordination Meeting.
The Employer shall likewise prepare the minutes of the meetings and include the
same in the agenda of the succeeding meeting for review and non-objection. In
case of meeting on specific issues, the Employer shall transmit a copy of the
minutes of its meeting to the Contractor for non-objection. In case the Contractor
fails to deliver a non-objection or objection notice within seven (7) days from
receipt of the minutes of the meeting, the minutes shall be deemed as accepted
by the Contractor.
The Contractor shall transmit all Communications and Correspondence intended
by it or the Employer to the Employer’s representative and in general deal with the
Contractor’s Representative in all matters arising under this contract.
Except as expressly stated in the Conditions of Contract, the Employer’s
Representative shall have no authority to relieve the Contractor of any of its
duties, obligations, or responsibilities under this Contract or to amend any
provision of the Contract. Any proposal, inspection examination, testing, consent,
approval or similar act by the Employer’s Representative (including the absence of
disapproval) shall not relieve the Contractor from any responsibility as provided in
the Conditions of Contract and Contract Documents.
The Employer’s Representative may from time to time delegate any of his duties
to his assistants and may at any time revoke any such delegation. Any such
delegation or revocation shall be in writing and shall not take effect until a copy
has been delivered to the Contractor.

1.18.6. Reporting Requirements


The Contractor shall submit to the Employer’s Representative the following
Reports:
o Major corrective actions being taken or required to maintain contract
requirements, updated on a monthly basis.
o Commercial and financial status of contract, including Employer’s
commitments, payments (applied for and received) and any disputes, updated
at intervals consistent with contract payment terms.
o Implementation and monitoring of all Site Management Plans and reports,
including:
o Design documentation: schedule of submissions for next month and
variations,
o Contractor’s Environmental and Monitoring Plan,

o Health and Safety Plan,


o Site Security Plan,
o Quality Assurance Plan, including corrective action reports and
clearance status,
o Personnel,
o Construction plant and equipment inventory,
o Plant and equipment importation: progress and inventory,
o Operator and Personnel Training Programmes.
o Milestones payment status
The Monthly Progress Reports shall provide the required information using a
combination of charts, graphs and tabulation which may be based on or
developed from a comprehensive management and reporting system that would
normally be required for the effective management of a similar large project.
Reports on all components shall be summarized using appropriate key
performance indicators (KPIs), or a similar method, identified and developed in the
individual site management plans or in the submitted progress report format.
The programme shall be updated in accordance with the Conditions of Contract,
with detailed explanations and proposed actions.
The Employer may ask the Contractor to provide weekly reports if necessary, for
more specific phases and topics, like equipment tests reports, investigation
reports for urgent decisions to be taken, safety reports in case of accidents, etc.
The Employer reserves the right to require the Contractor to submit reports not
listed as the need arises.

1.18.7. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.19. DOCUMENTATION
1.19.1. General
The Contractor shall submit Documents to the Employer for review or information,
depending on the type of Document.
“Documents” means drawings, calculations, computer software (programs),
samples, patterns, models, manuals, erection and commissioning data,
scheduling information and all other technical information to be supplied by the
Contractor for the design, manufacturing, erection, construction, testing,
commissioning, operation, and maintenance of the Equipment and Works.

The “Documents” to be submitted to the Employer include not only the


Contractor’s Documents defined in the Conditions of Contract, but also other
Documents as required in the Specifications or Documents to be at the disposal of
the Employer in the factory, workshops or Contractor’s offices on site.

The list of Documents given in this section is not exhaustive and shall not relieve
the Contractor from its obligation to hold all Documents produced in the course of
the Project at the Employer’s disposal or to submit any Document “for information
only” or “for review” at the request of the Employer.
The Contractor’s Document Submittal List shall include all Documents to be
submitted during the implementation of the Contract up to the end of the Defects
Notification Period (see Conditions of Contract for the definition of the Defect
Notification Period). For each Document, the Contractor shall specify if it will be
complete at the first issue or if several steps shall be carried out during the
implementation of the studies. In the case of a Document which will be the object
of review, the Contractor shall provide the Employer with the date of the first issue
and the date of the definitive issue.
The Document Submittal List shall show the time schedule for issuance of the
Documents, Documents status, classification, and other details required for
control of Documents. The Contractor shall make adequate allowance for review
of the Documents by the Employer (and by the Owner when required) and for any
modification of the Documents. The Document Submittal List shall indicate
Documents prepared for review and Documents prepared “for information only”
separately. The Document Submittal List shall be consistent with the Construction
Schedules.
Notwithstanding any review carried out by the Employer (or by the Owner when
necessary), the Contractor shall remain fully responsible for Documents
management for all aspects of design, procurement, transportation, construction
or erection, testing and commissioning of the project.

1.19.2. Transmission of Documents

Documents shall be dispatched under cover of a Document Transmittal Sheet.


Each transmittal shall include only one type of Document and shall be sufficiently
complete to permit the Employer to check the Documents included.
The time schedule for submittals shall comply with the Contract Schedule and the
sequencing of works by the Contractor.
All Documents shall be submitted to the Employer in the format and number of
copies defined in the PPM.

All electronic files for project drawings shall be in AutoCAD for “Windows” format,
version 2014. All electronic files for reports, procedures, calculations, proposals,
lists spreadsheets and databases shall be submitted in a Microsoft Office file
format, version 2003. Adobe Acrobat Reader (version 6) file format is acceptable
for miscellaneous electronic submittals.
All electronic files for the project scheduling activities shall be in Mircrosoft Project
format, version 2003. If requested specifically by the Employer, the electronic files
for the project scheduling activities could be in MS Project, latest version at the
Contract signature date.
Final numbers and supports of Documents and distribution of these Documents by
the Contractor to the various parts of the Employer’s project management
organization shall be specified in the Project Procedures Manual. All Documents

shall be identified through the identification system to be prepared by the


Contractor for the Employer’s non-objection.

1.19.3. Submission of Documents

Documents Reviewed by Employer Only


Any document transmitted for review to the Employer for the first time shall have
the index AO and the status “PREL” (Preliminary). The comment “Document to
be reviewed by the Employer” shall be indicated on the Document Submittal
Sheet.
The Employer shall review Documents, within:
 twenty-one (21) days following receipt for the first issue of the
Document.
 fourteen (14) days following receipt for the second issue of the
Document.

One print of each Document reviewed will be returned to the Contractor, dated
and signed, with one of the following notations (by stamp):

 No Objection (NOB);
 No Objections with Revisions noted (NOB-R);
 Revise and Resubmit (RAR).

If no notation is sent to the Contractor within the review period, the document shall
be considered to have the notation (NOB).

Documents marked NOB or NOB-R will authorize the Contractor to proceed with
the works, construction, fabrication, erection or test of equipment covered by such
Documents (with corrections if any indicated thereon).
When a Document is returned marked (RAR) with the corresponding remarks and
resubmission justifications on the attached file, the Contractor shall make such
revision and/or correction and resubmit the Document within twenty-one (21) days
following receipt of Employer’s comments. The Document shall again have the
status “PREL” (for Preliminary”) and shall be submitted to the Employer again
(“Document to be reviewed by the Employer”) with an index number increased by
one (AO becoming A1).
If after the second review of the document, the Employer is not satisfied by the
said Document, then a specified urgent procedure shall be engaged (to be defined
in the PPM). When an agreement is reached, the third edition of the Document is
transmitted for review to Employer with a review period of 28 days.
Within twenty-one (21) days following receipt of the Employer’s notation, the
Contractor shall submit final Documents, in accordance with any corrections
required by the Employer, with status marked “VFE” (Valid for Execution). The
Document Transmittal Sheet shall remain unchanged from the preliminary

document but the number of the index is removed (for example, Index A1
becomes A).
No major revision affecting the Documents marked “VFE” shall be made without
resubmitting the Document to the Employer for review. Minor revisions made
after Documents are marked “VFE” shall be submitted to the Employer with
revisions clearly mentioned and the Document index updated.

Documents to be Provided NOT for Review


Documents which are not sent for review to the Employer (and the Owner when
necessary) shall be sent “for information only”.

Civil Works Documents


Documents identified in the Contract including Program and Milestones,
Specifications shall be transmitted for review.

1.19.4. Documents As-Built

Construction Documents shall be updated by the Contractor according to the


progress on site and the real construction works. This is an important part of the
Contractor’s duty, and the Contractor shall be well organized for this job. He shall
give organization details for this particular topic in his PPM.

When the works are completed, the updated construction Documents shall be
submitted to the Employer, for review. After “non-objection” by the Employer, the
Documents shall be stamped “As-Built” by the Contractor, and sent to the
Employer in five (5) copies on reproduction quality paper.

All Civil Works “As-built” Documents shall be sent to the Employer before Taking
Over Certificate is delivered.

“As-Built” Documents are Documents which shall be useful for operation of the
plant. “As-Built” Document type shall be specified later by the Employer, with, at
least, construction Drawings, diagrams, and technical notices.

1.19.5. Quality Assurance Documents


The Quality Assurance Documents shall include (but not be limited to) the
Documents listed and defined hereafter.
The “Quality Assurance Manual” is the description of the Quality Assurance
Programme implemented by the Contractor to complete the works according to
quality principles (cleanliness, consistency of the Works with construction
Documents, respect of the Work Procedures, tolerance control, etc.). This manual
shall cover notably the following topics:

o Procedures for Contractor – Employer liaison and coordination;


o Sub-Contractors’ qualification procedures;
o A Project Organization Document, which describes the
organization that the Contractor intends to establish in order to
implement the Contract.
o Quality control (QC) organization, with among other staff
organization concerning QC and a list of forecast surveillance
operations to be performed during transport, erection, construction,
inspection and testing.
The “Quality Assurance Audit Folder” shall be completed by the Contractor and
shall include all audit reports performed by the Employer, the Owner, external
bureau or other partner and concerning the Contractor’s activities.
This folder shall also include audit reports of sub-contractors performed by the
Contractor (with or without the Employer). It shall also included “non- conformance
reports”, or “deficiency reports”, or “quality surveillance deficiency reports” or other
reports which may report deficient quality of the works.

The “Contractor’s Hygiene and Safety Manual” shall define and detail hygiene and
safety precautions to be taken by the Contractor and imposed for compliance by
his various Sub-Contractors for the duration of the Works during the execution of
Works on each construction area as regards the safety of any personnel present
in Contractor’s Work area.

1.19.6. Works Procedures (or Method Statements)


For significant tasks which shall be designated by the Employer or which may be
selected by the Contractor, the Contractor shall prepare a work procedure.
In this work procedure, he will explain the detailed organization of the works,
schedule, equipment, manpower, technical dispositions, QC organization.
Some work procedures shall be sent to the Employer “for information only”, others
shall be sent for review. This shall be decided by the Employer from a list
prepared by the Contractor updated monthly and sent to the Employer.
Work Procedures shall be sent to the Employer for review at least one month
before the starting date of the Works.

1.19.7. Schedule Documents

The Construction Program shall be prepared by the Contractor for his scope,
during the Bidding Period. It shall be negotiated with the Employer and shall
become contractual at the Contract agreement date. It shall show the main tasks
of the works (example, for steel conveyance, transportation, erection on site,
concreting, grouting, painting, and tests)., with the starting dates and duration (for
example for steel conveyance erection for tunnel, starting of erection and
completion date). It shall cover all stages of the package and shall be the basis for

measuring the progress of works. This shall be sufficiently detailed to allow


precise planning and tracking of the works.
This Construction Program shall be updated by the Contractor and sent to the
Employer, when there is an official written instruction from the Employer.
This Contract Program shall be updated by the Contractor, as necessary, and
each updating shall be sent to the Employer.
The “Progress Reports” provide the Employer with information concerning the
activities (procurement, manufacturing, transport, erection testing and
commissioning under the Contract). Periodicity of these reports shall be different
according to the type of progress report.

All schedules shall be prepared by the Contractor using MS Project, Version 2003
or the latest version of any Planner software. Any schedule submitted by the
Contractor for review shall be in hard copy as well as in electronic format. The
Employer shall have the right to request a more detailed schedule for any part of
the Works at any time. The Contractor shall revise schedules to mitigate any
project delay but shall not change project milestone dates or completion dates.

1.19.8. Civil Works Documents

Detailed Construction Drawings


Detailed Construction Drawings, such as Formwork Drawings, Reinforcement
Drawings, Rebar Bending Schedules, gate shop/fabrication drawings, etc., shall
be produced by the Contractor using the Drawings.

Equipment, Assembly Drawings, and Equipment Specifications


The drawings for the Equipment supplied by the Contractor shall be prepared by
the Contractor together with the Assembly drawings and Specifications and shall
be submitted to the Employer for non-objection.
The “Equipment Drawings” are generally associated with the Specification and
provides the information required for procurement. It specifies the dimensional
and functional interfaces and furnishes the data required for equipment layout. It
also prescribes the data and details imposed on the manufacturer to equipment,
e.g. main dimensions and arrangement of interfaces (connections, orientation of
taps, etc.).
The “Assembly Drawings” give an overall representation of a component or one of
its sub-assemblies or parts, with the related dimensional characteristics. By
means of one or more views (external, cross section, etc.), it describes a relative
position. It shows the compound parts reference indication used in the parts list;
the main component dimensions, including tolerances where appropriate; and any
other relevant characteristics (play and clearances, lubrications points, etc.).
The “Equipment Specifications: is a specification issued to a Manufacturer. It
describes the scope of supply and order; specifies the equipment characteristics,
operating conditions and performance data; stipulates the requirements for
equipment design, interface, procurement, fabrication and inspection; and
indicates the criteria for shop acceptance and finishing, packing and
transportation, installation and commissioning.

1.19.9. Equipment Documents


Manufacturing Documents

The Contractor shall furnish the Employer a copy of the Requirement documents
of all equipment that he shall supply and install in this contract.
The “Manufacturing and Quality Control Documents” shall include (but not limited
to) the following:

(a) Material procurement;


(b) Manufacturing procedures;
(c) Qualification Documents for operating mode;
(d) Technical Specifications;
(e) Welding Documents;
(f) Workers Qualifications;
(g) Manufacturing specimens;
(h) Inspection procedures and reports;
(i) Results of tests and visual inspections;
(k) Factory tests procedures;
(l) Factory acceptance tests;
(m) Tests certificates.

The “Non-Conformance Sheets” prepared by the Contractor and issued to the


suppliers shall be also transmitted to the Employer. These reports shall consist in:

(a) Identification of the component and Technical Document concerned,


(b) Description of the non-conformance and comparison with the specified
criteria,
(c) Solution adopted by the Contractor, and corrective action envisaged.

The “Manufacturing Report” shall contain the Documents prepared during


manufacture to demonstrate the compliance of the item of equipment with the
contract technical specifications and with the agreed quality requirements as
recorded in the Manufacturing Procedures. It shall include, but not be limited to
relevant Manufacturing Procedures, certificate of compliance, tests reports, heat
treatment certificates, material certificates, table of Documents related to non-
conformities.

Equipment Transportation, Handling and Storage Documents

The “Equipment Packing, Transportation, Handling, and Storage Procedures”


shall be prepared by the Contractor and submitted to the Employer for review
when requested.
The “List of Packages” shall be a list submitted to the Employer indicating: nature
of equipment concerned, volume and weight for the main packages.
The “Dispatching List” shall be joined to each dispatch and shall indicate
reference to the Contract, the detailed listing of all the items contained in the
package with gross and net weights, type and brand.

Equipment Erection Documents


The “Erection Procedures” shall provide the Employer with information for
erection.
The “Quality Control Documents” “Non-conformance sheets” and “Erection
Report” shall contain the same information as the similar Documents in the
manufacturing phase.

Testing and Commissioning Documents


The “Detailed Testing and Commissioning Schedule for Powerhouse Units” shall
show the Schedule for the tests to be performed before and during
Commissioning of all units in the power station supplied by the Contractor. It shall
deal with the Contractor’s Supply and shall enable the Employer to establish a
complete testing and Commissioning program for the entire power-station
facilities.

The “Testing and Commissioning Procedures” shall state the objectives of a given
test, the method proposed, the anticipated results and, if needed their
justifications towards the stated objectives. These Documents shall give the
required values and associated tolerances on functional aspects. They shall
describe the test conditions and methods and the instrumentation and personnel
required for the given test.

Operation and Maintenance Documents

The Contractor shall submit to the Employer Operation and Maintenance Manuals
for all equipment supplied in the Contract.

The “Operation and Maintenance Manual”, designated as Equipment Manual in


the Conditions of Contract, shall contain the following information:

(a) Table of Contents;


(b) Introduction;
The introduction must contain:
(i) A brief general description of the equipment.
(ii) A brief description of technical terms used.

(c) Detailed Description. Included herein will be a complete detailed


description of the equipment, its subassemblies, components and
accessories. A detailed list of clearance tolerances, temperatures,
settings system data, etc., is required.
(d) Operating Instructions. The instructions should be clear and concise and
preferably in steps. The information shall be presented in such a manner
that the contents of this section can be used to instruct untrained
personnel in the operation of the system or any equipment. For clarity of
presentation, careful consideration shall be given to the use of charts,
tables and operating data in this section.

(e) Testing and Adjustment. The complete procedure or testing and adjusting
the system or any parts during operation, after overhaul, or during
recommended periodic checks must be covered. For all important items
of equipment, test programs in tabular form shall be included.
(f) Drawings. All layout drawings, assemblies and sections, schematic
drawings, detailed control and writing diagrams, program documentation,
flow sheet, piping diagrams, etc, and as many drawings as necessary
shall be included from those prepared under the Contract to make the
manuals complete.
(g) Manufacturer’s descriptive technical literature.
(h) Maintenance Instruction. This section will be divided into two subsections:

i) Preventive maintenance, which will indicate the periodic inspections


required, the inspection procedure, the routine cleaning and lubricating
procedures, the routine safety checks, and the like;
ii) Trouble Shooting Guide. For Repair and Adjustment, It will describe
the inspection, removal and replacement of parts for which spares are
available, electrical fluid or mechanical circuit tracing, repair, and
adjustment procedures.

The Contractor shall set out in these instructions the intervals of exchange of
equipment to be replaced in the course of operation (expressed in hour of
operation)
The supply of approved operation and maintenance instructions as a requisite for
the taking over certificate
The “In Service Inspection Programme” shall define the elements to be inspected
while the equipment is under operation and period of inspections.

1.19.10. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.20. TEMPORARY WORKS


1.20.1. General
a. The Contractor’s proposals for the erection of all Temporary Works shall be
in accordance with the Condition of Contracts or with any modifications as
approved by the Employer’s Representative from time to time.
b. Except for the permanent access roads described in Clause 1.21, the
Temporary Works shall include the work covered in Clause 1.21 to 1.35.
1.20.2. Approval of Temporary Works
a. The Contractor shall submit to the Employer’s Representative for approval
drawings and full particulars of all Temporary Works which he intends to
construct at least forty two (42) days before he desires to commence
constructing such works. The submission to or approval by the Employer’s
Representative of any such proposals by the Contractor shall not relieve the
Contractor of any of his responsibility for the sufficiency of the Temporary
Works for their intended purpose. The Contractor shall also obtain any

necessary approval from local statutory or other Government authorities


before commencing construction. Such work shall not be started without
prior approval of the Employer’s Representative.
b. No house, office, store, workshop or other habitable building will be
permitted underneath or within 3 m of the nearest point in plan of the un-
insulated overhead conductor of low or medium voltage of an electricity
supply mains or as specified by Philippine Standards or regulations.
c. Construction facilities on which interim payments have been made shall be
maintained in good order and shall not be demolished, removed from the
Site or otherwise disposed of without the prior approval of the Employer’s
Representative.
1.20.3. Removal of Temporary Works on completion
On completion of the Works, all Temporary Works constructed by the Contractor
or handed over to the Contractor by the Employer, unless otherwise specified or
directed by the Employer’s Representative, shall be removed from the Site, as
approved by the Employer’s Representative. The Contractor shall make safe all
areas affected by Temporary Works and reinstate natural drainage. The
Contractor shall finish, reinstate, clean up and relinquish parts of the Site at the
end of the Defects Notification Period or such earlier times as directed by the
Employer’s Representative. Buildings and facilities removed from the Site will
become the Contractor’s property.
1.20.4. Payment
Except as otherwise specified and provided in sub-clause 1 of this Clause,
separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the rates and lump sums in
the priced Bill of Quantities.

1.21. REQUIREMENTS FOR TEMPORARY WORKS


1.21.1. General
Temporary Works shall be designed in accordance with Applicable Standards to
be safe, reliable, and adequate for all loads and uses. All temporary works shall
be signed and sealed by a Professional Engineer and drawings and design
calculations shall be submitted to the Employer’s Representative for review in
accordance with Clause 1.20.2.
Temporary Works shall be contained entirely within the Defined Works Areas.
Where they are to be incorporated into the Permanent Works, Temporary Works
shall be designed and constructed in compliance with the Contract as if they were
Permanent Works.
1.21.2. General Services, Utilities and Amenities
The Contractor shall provide and maintain site services, utilities and amenities
within the Construction Areas during the construction period for his employees.
The Contractor shall not locate or provide areas for spontaneous settlement
without the consent of the Employer.
The site services, utilities and amenities shall be sufficient to meet the reasonable
demands of the population living and/or working within the Construction Areas and
shall conform to Applicable Laws, Applicable Standards and Environmental
Requirements.

The Contractor shall submit for the Employer’s non-objection a proposal detailing
the plans and facilities to be provided to meet his obligations in respect of general
site services, utilities, amenities and health provisions and services, no later than
three (3) months prior to the proposed construction of the services, utilities or
amenities.
Site services, utilities and amenities shall include:

(a) Construction Work Camps and Work Areas and Offices


The requirements for these areas, including requirements for health provisions
and services, are provided in the Employer’s Environmental Requirements.
(b) Roads and Common Areas
The Employer, national, and local authorities shall have open access to common
areas within the Contractor’s Camps and to the normal access roads within the
Construction Areas. The Employer’s rights of access to the Construction Areas
are as specified in the Conditions of Contract.
(c) Spontaneous Settlement Areas
Upon approval by the Employer, the Contractor shall prepare separate areas
apart from any construction work camps, to provide for the spontaneous
settlement and development associated with the presence of the construction
work camps and of the families and merchants that are expected to be attracted
by the construction activities.
The Employer’s Requirements with respect to spontaneous settlement areas
contemplate the Contractor to plan, obtain approvals and permits for the area in
conjunction with the relevant municipal and local authorities, and to selectively
clear and provide infrastructure and services in accordance with the Employer’s
Environmental Requirements.

1.21.3. Temporary Earthworks


General
Temporary earthworks, including borrows, quarries, stockpiles and spoil disposal
areas, are Temporary Works under the Contract and shall be contained entirely
within the Construction Phase Land Areas defined in this Contract.
Temporary earthworks shall comply with the Employer’s Environmental
Requirements.

Quarry Areas
The sites maybe identified by the Employer’s Representative or may be marked in
the drawings.
The Employer does not, however, warrant that these sites contain materials of the
quality and quantities sought by the Contractor. The Contractor, if requiring
additional material, shall submit a proposal to the Employer giving the location and
extent of proposed additional quarries, in addition to a Quarry Management Plan.

The Contractor shall submit a Quarry Management Plan for non-objection for each
proposed quarry site in accordance with the Employer’s Environmental
Requirements.

Spoil Disposal Areas


Materials excavated by the Contractor from open and underground excavations,
which are unsuitable for incorporation into the Permanent Works or are surplus to
such requirements shall be disposed of as spoil in spoil disposal areas.
The Contractor shall submit a Spoil Disposal Management Plan for non-objection
for all proposed spoil disposal sites.
Unless the Employer’s approval is specifically obtained pursuant to the Conditions
of Contract, the spoil disposal areas shall be wholly contained either:
 within designated areas located in Defined Works Areas subject to the
Employer’s Environmental Requirements.
Indicative locations of spoil disposal areas are shown on the Construction
Drawings. The Employer does not warrant that these locations will be suitable or
sufficient for the purpose. The Contractor shall submit a Spoil Disposal
Management Plan to the Employer for non-objection of all proposed spoil disposal
areas, in accordance with the Employer’s Environmental Requirements.

Stockpiles
Stockpiles shall be confined entirely within the Defined Works Areas.

1.21.4. Solid Waste & Rubbish


Unused construction equipment and materials, waste, scrap, debris or other
rubbish shall be disposed of by the Contractor either by:
oStock-piling, storage and subsequent removal from the Site and disposal in a
manner that complies with Applicable Laws and Environmental Requirements
as given in the Employer’s Environmental Requirements.

oDisposal at Site by burial in an approved landfill that complies with Applicable


Laws and the Environmental Requirements as provided in the Employer’s
Environmental Requirements.

oBurial in a spoil disposal area provided that it is buried no less than two meters
from the finished surface. Toxic or hazardous materials and combustible
rubbish shall not be buried in spoil disposal areas, and shall be disposed of in
accordance with Applicable Laws and Environmental Requirements as
provided in the Employer’s Environmental Requirements.

oDisposal at site by burning in a manner that complies with Applicable Laws and
the Environmental Requirements maybe allowed.

1.21.5. Site Rehabilitation


Upon issuance of the Certificate of Completion, the Contractor shall demobilize,
remove from the site, or otherwise dispose of, all plant, equipment, stockpiles,
surplus materials, hazardous materials, temporary buildings, installations and all
other facilities and things that are no longer needed for the performance of any
outstanding obligations under the Contract. The Contractor shall rehabilitate work
and living areas, including excavations, borrow areas, quarries and spoil dumps,

and shall leave the Construction Areas and the Works in clean, tidy and
workmanlike condition in accordance with the Environmental Requirements given
in the Employer’s Environmental Requirements.
1.21.6. Temporary River Diversion Works
Temporary diversion works shall be in accordance with Section 2,2 of the
Specifications. The Contractor’s design of all river diversion works shall be based
on river flows and return period supplied by the Employer’s Representative. The
Contractor shall supply detailed topographic and setting out coordinates for the in-
river diversion works to the Employer’s Representative to allow the Employer to
run Hydrological Models (HEC-RAS) to ensure the adequacy of the temporary
diversion structures to meet the required return period.

1.21.7. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.22. ELECTRIC POWER


1.22.1. Scope of Electric Supply
The Contractor shall design, supply, install, maintain and operate any electrical
generating plant and the electrical distribution system from his generating plant or
other source. Power and light for the construction of the Works shall be provided
from separate sources from those used to supply power and light to all houses,
staff quarters and camps in the township and camp area. The installation shall
provide for the following:
I. Power and light for the Contractor’s housing, camp accommodation and
camp amenities, workshops, stores, offices and all other facilities,
II. The Employer will arrange for all power and light for the Employer’s and
Engineer’s facilities.
III. Power and light for purposes other than that described above shall be as
directed by the Employer’s Representative. The requirements for such
purposes shall be limited to the available excess capacity permitted by the
Contractor’s system.
1.22.2. Submission of proposals
Not less than 35 days prior to the installation of the distribution system, the
Contractor shall submit in full details of his proposals and drawings for approval by
the Employer’s Representative.
1.22.3. Removal of distribution system
On completion of the Works, the Contractor shall remove from the Site the portion
of the electrical distribution systems in and amongst the Contractor’s housing,
staff quarters, camps, offices, stores, workshop and other areas as directed by the
Employer’s Representative. Removal of portions of distribution system shall be
such that the remaining distribution system still functions satisfactorily.

1.22.4. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.23. TELECOMMUNICATIONS
1.23.1. External telecommunications
The Contractor shall make arrangements direct with the locally operating
telecommunication services company for a normal telephone service at Site and
for any other telecommunications service he may require.
1.23.2. Internal telecommunications
The Contractor shall supply and install a reliable internal telecommunication
system, including the operation and maintenance, until completion of the Works.
1.23.3. Removal of telecommunications system
On the completion of the Works the Contractor shall remove from the Site the
telecommunications system provided under this Clause.
1.23.4. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.24. WATER SUPPLY


1.24.1. General
a. The Contractor shall design, supply and install a water supply system,
including the operation and maintenance, to supply potable water for his
construction camp and facilities.
b. Water may be sourced directly from the surrounding creeks or rivers adjacent
to the Contractor’s camp. The Employer does not warrant the quality,
sufficiency or reliability of this supply.
1.24.2. Other construction facilities
The Contractor shall make his own arrangements to install a supply of potable
water to his other construction facilities and buildings in the Works Area including
the Employer’s/Employer’s Representative’s site offices.
1.24.3. Potable water quality
Potable water shall comply with the standards of the Philippine standards for
drinking water.
1.24.4. Non-potable water supply
The Contractor shall provide an ample supply of water for aggregate processing,
concrete, washing down, and his other uses on the Works.
1.24.5. Submission of plans
The Contractor shall submit his plans for the potable water supply and reticulation
system, including filtering, chlorinating and other proposed treatment, and non-
potable water supply to the Employer’s Representative for approval, not less than
28 days before commencing construction of the installation.

1.24.6. Removal
On the completion of the Works the Contractor shall remove from the Site the
reticulation installed in and amongst the Contractor’s housing, staff quarters,
camps, offices, stores and workshops and other areas as directed by the
Employer’s Representative.
1.24.7. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.25. SANITATION
1.25.1. Requirement
a. The Contractor shall provide and install septic tank systems or other
treatment process for disposal of sewage from all houses, offices, camps
and other buildings constructed by the Contractor.
b. The Contractor shall construct, operate and maintain at the site of the works
temporary toilet facilities complete with adequate water borne water closets,
urinals and hand basins, septic tanks, absorption trenches or other
sewerage disposal installations, for his construction camp and facilities,
c. The temporary toilet facilities shall meet the requirements of the Government
health authority. The location of these facilities and their construction shall
be as approved by the Employer’s Representative.
d. Sewage from temporary facilities shall be transported and/or disposed off in
a hygienic manner as approved by the Employer’s Representative.
1.25.2. Payment
Separate payment will not be made for complying with the requirements of this
Clause and all costs shall be deemed to be included in the rates and lump sums in
the priced Bill of Quantities.

1.26. GARBAGE DISPOSAL


1.26.1. Scope of work
The Contractor shall undertake the collection of and disposal of garbage from
housing and camp area and Works areas, including houses, offices, public areas
and site offices occupied by the Employer’s Representative and the Employer.
Garbage collection shall be made daily at times approved by the Employer’s
Representative and the services shall be continued until completion of the Works.
1.26.2. Method of disposal
Garbage shall be disposed off properly and bury any non-combustible material in
a location approved by the Employer’s Representative. The Contractor shall
obtain approval of the Employer’s Representative on the procedure and plans of
such disposal, not less than 28 days before the commencement of such disposal.
1.26.3. Payment
Separate payment will not be made for complying with the requirements of this
Clause and all costs shall be deemed to be included in the rates and lump sums in
the priced Bill of Quantities.

1.27. FIRE-FIGHTING SERVICES


1.27.1. Scope of Work
a. The Contractor shall be responsible for all fire prevention measures, fire
protection and fire-fighting on the Site for the duration of the Contract. For
the purpose of this Clause, the Site shall include the location of all
Permanent and Temporary Works, including all camps, workshops, offices
and stores of the Contractor.
b. The Contractor shall be guided by the recommendations of the local fire
department.
c. The Contractor shall provide, maintain and operate all fire-fighting
equipment including, but not limited to, water pumps, trucks, lines, and
chemical fire extinguishers adequate for the protection of all structures,
buildings or work under construction.
1.27.2. Approval of services and equipment
All services and equipment provided under this Clause shall be subject to the
approval of the Employer’s Representative from time to time to meet the needs of
the project.
1.27.3. Fire alarm warning system
The Contractor shall supply, install and operate an adequate fire-alarm warning
system at office, camp and appropriate work locations.

1.27.4. Payment
Separate payment will not be made for complying with the requirements of this
Clause and all costs shall be included in the various rates and lump sums in the
priced Bill of Quantities.

1.28. SECURITY
1.28.1. Responsibility of Contractor
a. The Contractor shall specify overall security requirements for the Works for
approval by the Employer and the Contractor shall conform to such
requirements and to be responsible for such action of his personnel in
respect of such requirements.
b. The Contractor shall be responsible for the security of the Works and shall
provide and maintain continuously an adequate security force to fulfil these
obligations.
1.28.2. Employer and Other Contractors
Employer will provide security for its own existing hydropower plants. Other
contractors working on the Site concurrently with the Contractor will provide
security for their own plant and material. However, their security provisions shall
in no way relieve the Contractor of his responsibilities in this respect.
1.28.3. Marking of vehicles
All vehicles used by the Contractor shall be clearly marked with the Contractor’s
name and individual identification number.

1.28.4. Contractor’s security guards


a. As required by the Contract, the Contractor shall take the necessary security
measures to ensure the security of lives and property within the Site. This
responsibility shall be borne solely by the Contractor.
b. It is envisaged that the Contractor’s security guards will be required to carry
out duties on shift rotation to provide the mandatory 24 hour protection. The
Contractor’s security guards shall be suitably trained personnel.
c. Qualification and suitability of all Contractor’s security guards shall be
determined by the police or by Philippine registered securities companies.
All contractor’s armed or unarmed security guards shall be provided with
uniforms and accoutrements as required or approved by the concerned
authority under Philippine Laws.
1.28.5. Handling of explosives
a. Handling and use of explosives shall be in accordance with Clause 1.15 and
this Clause.
b. Special attention must be paid to the security of the main explosives
magazines and any secondary explosives magazines.
c. Transport of explosives from:
i. the main magazine to a secondary magazine; and

ii. the main magazine to any locations requiring the use of explosives
within the Site; and

iii. the secondary magazine(s) to any location requiring the use of


explosives within the Site

shall be escorted by the Contractor’s security guards or police as required by


Philippine Laws and regulations. This includes transport or handling of
explosives to any blasting location.
d. The Contractor shall arrange the delivery of explosives from the factory or
from any other locality he may wish to purchase or take delivery of explosive
to the site as per Philippine Laws and regulations. If a police escort or
similar is necessary by Philippine Laws and regulations, the costs of such
escort shall be borne by the Contractor.
1.28.6. Explosive magazines
a. The location, specification and capacity of the main and secondary
explosives magazine shall be in accordance with Clause 1.15 and are
subject to the approval of the competent authority.
b. The main explosives magazine should preferably be located in a safe and
secured complex. Secondary explosives magazines shall be located as
required. The magazines should be secluded from public view. In addition
to the requirement of Clause 1.15, additional security requirements imposed
for explosives magazines include but are not limited to the following:
i. Each explosives magazine shall be enclosed by two wire security
fences. The distance between the two fences shall be as directed by
the police. The wire fence shall be of the chain link type variety with
the lower part of the fence buried to a depth of not less than 400 mm.
The height of the chain link part of the fence above ground shall not be

less than 1.90 m with strands of barbed wire above this, making the
total height above ground not less than 2.30 m.

ii. Each explosives magazine shall be well illuminated at night time.

iii. Each magazine shall be guarded on a 24 hour basis by the


Contractor’s security guards or police with armed or unarmed
personnel, depending on the direction of the local Police Officer, the
security situation and the location of the magazine.

iv. All vegetation growth within a distance of 10 m outside the outer


security fence surrounding any explosives magazine shall be cleared
and removed. All vegetation growth within the fenced area shall
likewise be cleared and removed. The Contractor shall at regular
intervals and/or when conditions require, keep the areas described
clear from new vegetation growth as long as the magazines are in use
or contain explosive materials.

v. A stock book shall be maintained for each magazine. These stock


books are to be kept under lock and key at all times and made
available to the police upon request at any time.

vi. All explosives taken out of the magazines for any purposes shall be
escorted by the Contractor’s security guards or police in accordance
with sub-clause 5. of this Clause.

vii. The Contractor shall ensure that at all times the quantity of explosives,
detonators, cords, fuses and other consumable taken out of a
magazine shall be utilized in full as far as practicable and therefore the
Contractor shall determine his exact requirements before each blasting
operation.
viii. Any excess explosives, detonators, cords, fuses and other consumable
from any blasting operation shall be returned to and recorded at the
same magazine from which it was taken.

ix. Detonators and other blasting accessories shall be kept in a separate


room from the bulk of the explosives in accordance with the
requirements of Clause 1.15

x. Additional conditions and restrictions other than described in this


Clause may be imposed or implemented by the police from time to
time.

xi. A security hut and bachelor accommodation of the Contractor’s


security personnel or police guarding the magazines shall be provided
at each magazine.
1.28.7. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.29. CONSTRUCTION CAMP AND FACILITIES


1.29.1. General requirement
The Contractor shall provide and maintain camp and facilities on the Site at the
locations identified by the Owner’s Representative. The Contractor shall make
arrangements as necessary for the provision of all administrative offices, workshops
and other buildings and for accommodating and provision of facilities for feeding of all
his employees and others as required by providing, servicing and maintaining a
township on the site approved by the Employer’s Representative. The following
installations and facilities are required and shall be considered part of, camp and
facilities:
i. recreation facilities;
ii. security facilities;
iii. medical centre
1.29.2. Location and control of camps and facilities
a. The Employer will allocate to the Contractor sites, at the locations shown on the
Drawings, for the construction of housing, camps and for other required facilities and
amenities for his employees.
b. The Contractor shall be deemed to have inspected these sites and made his own
evaluation as to their adequacy and suitability for the development of the required camp
facilities.
c. All camps shall at all times be open to inspection by the Employer’s Representative.
Any instruction given by the Employer’s Representative for the proper cleaning and
general maintenance and sanitary and hygienic condition of any building must be
forthwith carried out by the Contractor. Before any buildings are occupied, the
Contractor shall draw up a code of rules and regulations for their control which shall be
approved by the Employer’s Representative.

1.29.3. Detailed requirements


a. General
i. The design and layout of the camp facilities shall be the responsibility
of the Contractor and shall follow Philippine Laws and Regulations.
These design layouts shall generally be in accordance with any
preliminary design and layout approved in principle at the time of
Tender.

ii. The design, construction and maintenance of the camp and facilities
shall include all necessary site works and services for water supply,
drainage, paths, sewage and garbage disposal and provision of some
open spaces in accordance with the short term needs.
b. Accommodation for Contractor’s employees
It is anticipated that the Contractor will wish to construct for his own use:
i. staff housing;
ii. staff mess;
iii. labour camps;
iv. labour messes;
v. administrative offices; and
vi. other buildings to suit his requirements.

c. Security facilities
The entire camp area and facilities shall be subject to the security
requirements set out in Clause 1.28.
1.29.4. Camp amenities
a. The Contractor may be permitted to lease areas within his labour camp or
staff quarter’s area, or space in buildings constructed by him in these areas,
for conducting such business or services as may be necessary for the
convenience of his labour or staff. The Contractor may recoup from lessees
such rent as necessary to cover the costs of administering the provision of
such business or services. Patronage of such business or employment of
such services by the Contractor’s and other contractors’ employees shall be
optional.
b. All concessions or leases shall require a submission to the Employer’s
Representative and the approval of the Employer. No concessions or
leases shall be granted for the operation of games of chance or gambling in
any form. They shall contain provisions making them subject to termination
upon both completion of the Works and in the case of the business or
service being conducted in such manner as to infringe the terms of this
Clause.
c. No buildings or area used for a business or service shall be within 15 m of
the right-of-way boundary of the entrances to the Project Site up to a point
100 m along the Road. ‘Where necessary suitable arrangements shall be
made to prevent staff or customers or any business or service from
obstructing traffic.
d. The charges for all goods and services at camp shops, canteens and the
like shall be fair and reasonable and not in excess of the charges for similar
goods and services in the area.
1.29.5. Removal of buildings and facilities
Unless otherwise directed by the Employer’s Representative, the Contractor shall
remove all buildings erected for his requirements from the Site on completion of
the Works. The Contractor shall fill in all excavated areas as directed by the
Employer’s Representative remove all refuse, debris and other objectionable
materials and leave the township and camp area in a clean and satisfactory
condition to the approval of the Employer’s Representative.
1.29.6. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.30. CONTRACTOR’S OFFICES, STORES AND WORKSHOPS


1.30.1. General
a. The Employer will allocate a portion of the camp area and other areas as
indicated on the Drawings where the Contractor shall provide and maintain
such offices, stores, workshop and adequately fenced store and delivery
compounds as are necessary for the execution of the Works, including all
necessary services for water supply, drainage, lighting, roads, paths, parking
places, sewerage and garbage disposal.

b. On the completion of the Works all buildings and facilities provided by the
Contractor in accordance with the provisions of this Clause shall remain the
property of the Contractor and shall be removed from the Site.
1.30.2. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.31. MEDICAL AND HEALTH SERVICES


1.31.1. General
a. The Contractor shall make arrangements which are satisfactory to the
Government medical authority for provision of all emergency medical, minor
surgical, first aid and health services for all persons employed by him and by
any subcontractors employed by him on the Works, including the
dependents of such persons, provided such dependents are resident on
Site.
b. The Contractor shall co-ordinate and liaise with hospitals near the Site, for
the all emergency medical, minor surgical and health services.
c. The Contractor shall provide a first aid room. The layout of the first aid room
shall be generally in accordance with the minimum requirements.
d. The provision of medical facilities under this Clause shall in no way relieve
the Contractor of his obligations under Clause 6.7 of the Conditions of
Contract.
1.31.2. Advice of competent health authority
The Contractor shall obtain and follow the advice of the competent health
authority on all such matters as water supply, sanitation, garbage and sewage
disposal, and provision of fly-screens and anti-malarial precautions and upon
industrial health and hygiene. A proportion of the Contractor’s employees shall be
trained in first aid.
1.31.3. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.

1.32. CENTRAL STORAGE AREA – NOT USED

1.33. SITE OFFICES FOR EMPLOYER’S REPRESENTATIVE – NOT USED

1.34. TECHNOLOGY TRANSFER AND TRAINING (NOT USED)

1.35. QUALITY ASSURANCE


1.35.1. General
a. The Contractor shall implement a Quality Assurance System for all the
Construction of the Works to be performed under the Contract. The system
shall be based on ISO 9001: 2008 as applicable to the Contract.

b. The Quality Assurance System shall set out the Contractor’s policies and
commitments for design, manufacturing, construction, equipping, testing and
commissioning.

c. The system shall outline the organisation and working practices to be


adopted, in the design office, at the fabrication works and on site, to ensure
that the quality of the Works complies with all applicable does, regulations
and contractual requirements. It also describes how quality related
procedures in each section of the Works are to be implemented to develop a
detailed Quality Assurance Plan and who will be responsible for
implementation of the plan.

d. All personnel employed on the Contract will be required where appropriate to


comply with the procedures defined in this document.

e. The Contractor will be responsible for ensuring that all requirements of this
Quality Assurance system are fulfilled, as far as applicable by all sub-
contractors. All Subcontractors will be required to demonstrate to the
Contractor that they have the technical and organisational capabilities to
implement their Subcontracts under Quality Assurance controlled conditions.
The Quality Assurance responsibilities of each Subcontractor will be clearly
defined.
1.35.2. Quality Assurance System
a. The Project Quality Assurance System (QA System) will refer to and be
complimented by sub project quality Systems which will define Quality
Assurance arrangements for specific areas of work. The inter-relationship of
these Systems will be clearly defined.

b. Overall control of quality will be the responsibility of the Project Quality


Assurance Manager nominated by the Contractor. Each Sub-contractor will
appoint a Quality Assurance representative who will be responsible for the
operation and administration of this own quality System and will report to the
Project Quality Assurance Manager.

c. The Quality Assurance Systems will be supported by Quality Assurance and


Quality Control Works Procedures and quality inspection and test plans as
appropriate.
1.35.3. Administration of Quality System
a. The Quality Assurance System will be administered in a systematic way and
the project Quality Assurance Manager will be responsible for the issue of all
additions or revisions of the System and maintaining distribution record. An
up-to-date list of all holders will be maintained.

b. The Employer’s Representative shall inspect all records/audits performed by


the Contractor at any stage throughout the contract period and shall also
take part in the audit process.

c. The Contractor shall be responsible for ensuring all subcontractors comply


with the requirements of the Quality System.

d. The Contractor’s Quality Representative shall be on site at all times during


the execution of Works unless otherwise approved by the Employer’s
Representative. Conformance Reports shall be submitted on a regular basis
as soon as compliance testing has been completed.

e. If the Contractor fails to establish, implement, maintain and produce Quality


system in accordance with this clause he may be considered to be in default
of his obligations under this contract.
1.35.4. Submission of Quality Assurance
a. Within 21 days of the issue of the order to commence the Works the
Contractor shall submit details of his Quality Assurance System to the
Employer’s Representative for information and comment. Following receipt
of comments from the Employer’s Representative, the Contractor shall,
within a further 21 days, submit the final plan of his Quality Assurance
System incorporating the comments of the Employer’s Representative.
During the courses of the Works, the Contractor shall submit copies of the
procedure, method statements and inspection and test plans he proposes
for use to control the various aspect of the Works to the Employer’s
Representative for information and comment. The Contractor shall not
commence any permanent works under the contract prior to receipt in
writing from the Employer’s Representative that the Quality Assurance
System confirms to the requirements of this specification.
1.35.5. Payment
Separate payment will not be made for complying with the provisions of this
Clause and all costs shall be deemed to be included in the priced Bill of
Quantities.
