RENTAL AGREEMENT

This DEED OF RENTAL AGREEMENT is made on this 10th


day of April , 2012

BETWEEN
Ram Kumari Devi wife of Late Brahmdev Lal
Agarwal resident of Rajendra Niketan, Jamal Road, Patna-
1 currently residing at C/o- Anand Prakash Agarwal, Near
Dukhandi Mai Mandir, District-Gaya, Bihar

Herein called as Landlord, which expression shall include his heirs


assigns and administrators of one Part
AND
Sunny Anand son of Late Daman Anand resident of flat No-
203, Aparna Apartment, New Dak Bunlow Road, P.S-
Kotwali, District- Patna-1 herein called as Tenant

WHEREAS the Landlord is the wife of the Late Brahmdev Lal
Agarwal(owner of the property) of the house situated in Rajendra

Niketan, Jamal Road, Patna.


AND WHEREAS THE TENANT wanted to set up/ continue his karkhana
at Jamal Road, Patna. Keeping in view the response of the potential
customers in the areas around Jamal Road, Patna and approached the
Landlord to let out the said property to him.

AND WHEREAS the Landlord agreed to let out the said property, more
appropriately described in the Schedule hereto, for the sake of brevity
referred to as “Demised premises” to the tenant on certain terms and
conditions from the date above mentioned.

NOW THESE PRESENTS WITNESSETH and the parties


hereby agree as follows:
1. The LANDLORD agrees to let and the TENANT agrees to take the
premises for the term of 11 months to be computed from the 10th
day of April 2012 at the rent of Rs.5,500/- (Five Thousand Five
Hundred only) payable by the 10th day of every following month
inclusive of everything except the electricity charges payable by
the tenant on consumption basis.
2. The LANDLORD hereby acknowledges the receipt of a sum of
Rs.5,500/- (Five Thousand Five Hundred only) from the
TENANT as security deposit, which sum the LANDLORD agrees
to pay the TENANT on handing over peaceful vacant possession
of the tenanted premised.
3. The LANDLORD hereby agrees with the TENANT that the
TENANT paying the rent hereby reserved and observing and
performing the conditions and covenants herein contained, shall
quietly and peaceably hold, possess and enjoy the said premises
during the said term without any interruption and disturbance by

the LANDLORD or any person claiming under or in trust for him;
PROVIDED, however, and it is expressly agreed and declared by
and between the parties hereto that, in case of non-payment of rent
for any month beyond 15 days or in the event of breach of any of
the conditions and covenants to be observed and performed by the
TENANT, the agreement may at the option of the LANDLORD
stand determined when and in such an event the LANDLORD
shall be entitled to re-enter in to the property and re-possess the
same as his former estate without prejudice to his right to recover
all arrears of rent and any damages for breach of such conditions
and covenant.
4. The TENANT agrees to pay the rents regularly and punctually
without the least delay or single default to the LANDLORD.
5. The TENANT hereby agrees at all times during the term of this
agreement to keep and maintain the premises clean, tidy, healthy,
wind and watertight in all seasons and further in good and
substantial repair, reasonable wear and tear excepted.
6. The TENANT hereby agrees not to make any structural additions
or alterations to the demised premises without the consent of the
LANDLORD in writing.
7. The TENANT agrees to permit the LANDLORD, his servants and
agents at all reasonable hours to enter in to the property to inspect
the condition or to leave notice of all defects to be repaired.
8. The LANDLORD agrees that at all times during the said term to
use and occupy the demised property to carry on or permit to be
carried on any trade or business in the said premises. Further the
TENANT is allowed to use the premises as a Godown for keeping
items such as Dalda, Ghee, refined oil, diesel bhatti, sugar,
exhaust fans, generator of 5 kb etc . Further the LANDLORD
agrees that staffs of the TENANT are allowed to work at the
godown at Jamal Road.

9. The TENANT agrees that without the consent in writing of the
LANDLORD, not to assign or part with his interest in the said
premises created under these presents nor sublet the same or any
part thereof to any person or persons whomsoever.
10. That at any time during the subsistence of this agreement, the
demised premises or any portion thereof is damaged by fire or
otherwise(by neglect or fault of the TENANT or his staffs,
servants) the TENANT shall at his own cost restore and repair the
same into the original condition and shall also make good all injury
or thereto at his own cost.
11. That the LANDLORD shall be entitled to regulate the opening and
closing of all common entrance, passage, staircase, lift. Lavatory
and all other places of common use without affecting the peaceful
enjoyment of the TENANT. No person has the authority to create
hindrance in the work of the TENANT.
12. That the TENANT shall be entitled to apply or obtain at his own
cost and expenses electricity connection/ telephone connection in
or upon the demised premises and for the said purpose
LANDLORD shall sign all necessary papers.
13. That the TENANT shall not exhibit or display any goods or
merchandise at any place outside the demised premises but the
same can be done at common stair case , common passage, and
common entrance only in extreme situation of emergency.
14. That the TENANT shall not be allowed to bring heavy safe,
furniture which is likely to injure the premises but the TENANT is
allowed to install air coolers, exhaust fans without the written
consent of the LANDLORD.
15. That the TENANT shall not be entitled to further construct in the
said premises but the LANDLORD in consensus of the TENANT
may further develop or change the said premises.

16. The TENANT agrees that on the expiry or earlier determination of
the agreement, to yield and deliver peaceful vacant possession of
the premises in its entirety.
17. Both the LANDLORD and the TENANT shall have the option of
terminating this agreement by giving a 30 days notice of the same
in writing.
18. Both the LANDLORD and the TENANT agree that in case of any
dispute arising out of this agreement, they shall settle the dispute
by Arbitration as per the provisions of the Arbitration and
Conciliation Act, 1996.

SCHEDULE
The godown measuring an area of 300 square feet approx., Rajendra
Niketan, Jamal Road, Patna-1, Bihar.
IN WITNESS WHEREOF the parties have executed these
presents on the day, month and year first above-written.
