The average width of the available land was ranging between 8 to 11 meters and only single lane
road was available.
Hence it was necessary to acquire additional land to achieve average corridor of 24 meter width for
double lane standard as per IRC norms.
The Acquisition of land was accordingly started way back during 2007 under Land Acquisition Act-
1894, now Amended to Right to Fair Compensation and Transparency in Land Acquisition ,
Rehabilitation and Resettlement act, 2013 ( 30 of 2013) ( Herein after shall be referred as amended
Act- 2013).
The State Govt., through its agency i.e Land Acquisition Collector HP.PWD., Winter Field Shimla,
initiated the process of land acquisition and hence the appointment of CALA was not required. An
amount of Rs. 487.12 lacs was also paid by state Govt. to land owners.
BRIEF NOTE ON THE CONSTRUCTION / WIDENING
WORK ON NH 21A IN KM 35/0 TO 66/275 ( Two projects of
widening and strengthening work had been sanctioned)
1 DESCRIPTION OF SANCTION AND AWARD
In view of the major financial implication of cost of land acquisition for 31.275 kms.
the State Govt. requested the Ministry ( MORT&H) to treat land acquisition for NH21-
A at par with other National Highways.
Subsequently, the work of Land acquisition in the above stretch was approved under
Annual Plan 2014-15 by MORT&H and estimate amounting to Rs. 1393.63 lacs was
sanctioned accordingly on 13.03.2015 which is inclusive of Rs. 487.12 lacs paid by
state Govt. already prior to sanction of this estimate.
25.15 hectare land was proposed in the original estimate inadvertently, by collecting
the area figures from notification under section 4 of the L.A. Act- 1894 which takes
approximate area under the notification whereas actual area is calculated in the
subsequent notification under section 6& 7, which works out to be 22.67 hectare.

Need for Revised Cost Estimate
Initially, the estimate for land Acquisition was based on 22 No. awards passed by
LAC from year 2010 to 2012 covering an area of 120.33 bigha.
Remaining area of about 214.55 bigha was also assessed on average rate of these
awards.
In the mean while, Land Acquisition Act, 1894 was amended to Right to Fair
Compensation and Transparency in Land Acquisition , Rehabilitation and
Resettlement act, 2013 ( 30 of 2013) and remaining awards were announced by the
LAO on the basis of Amended Act.
Land owners approached Distt. Court for enhancement of awards given by
LAO.
The court has allowed enhancement in 6 no. awards so far out of which the
state has filed RFA in High Court of Himachal Pradesh in 2 no. awards after
seeking legal opinion of Law Department in each award.
Earlier sanctioned estimate did not provide for such changes. Hence
Revised Cost Estimate has been prepared on the basis of latest awards and
Enhancements given by the Distt. Court.
