Fundamental Breach of the Contract

• Stoppage of the Work by the Contractor without approval of the Project

Manager.
• Delay in Work by the Contractor following the Project Manager’s
instruction; which is not withdrawn in certain period.
• Bankruptcy of either the Employer or the Contractor.
• Payment not done to the Contractor after IPC issued by the Project
Manager.
• Failure of the Contractor to correct a particular defect as notified by the
Project Manager
• Failure of the Contractor to follow the Project Manager’s two consecutive
notices regarding the update of Work Schedule and accelerate the works to
meet the the intended completion date.
• Failure of the Contractor to maintain the security as required .
• Payment of maximum amount of liquidated damages.
•Engagement of the Contractor in Corrupt or Fraudulent Practice .
