DIFFERENT TERMS USE IN ETHICAL
ISSUES IN DIGITAL AGE
COPYRIGHT - a legal device that gives the creator of a
literary, artistic, musical, or other creative work the sole
right to publish and sell that work. Copyright owners
have the right to control the reproduction of their work,
including the right to receive payment for that
reproduction. An author may grant or sell those rights to
others, including publishers or recording companies.

What are considered copyrightable works in the Philippines?
Under Philippine law, original intellectual creations in the literary and artistic
domain are copyrightable. These include books, pamphlets, articles and other
writings; periodicals and newspapers; lectures, sermons, addresses, dissertations
prepared for oral delivery; letters; dramatic or dramatico-musical compositions;
choreographic works or entertainment in dumb shows; musical compositions;
drawing, painting, architecture, sculpture, engraving, lithography; models or
designs for works of art; original ornamental designs or models for articles of
manufacture; illustrations, maps, plans, sketches, charts and three-dimensional
works relative to geography, topography, architecture or science; drawings or
plastic works of a scientific or technical character; photographic works including
works produced by a process analogous to photography; lantern slides; audiovisual
works and cinematographic works and works produced by a process analogous to
cinematography or any process for making audio-visual recordings; pictorial
illustrations and advertisements and computer programs.

Copying original and intellectual creations is
considered as copyright infringement and is
punishable under Republic Act No. 8293,
otherwise known as the Intellectual Property
Code of the Philippines (“IP Code”). In order to
prove copyright infringement, one must show
that he has a valid copyright in the work
allegedly infringed and that the perpetrator
infringed the victim’s copyright by copying
protected elements of the latter’s work.

What are the penalties provided by Philippine law for copyright
infringement?
Under Philippine law, copyright infringement is punishable by the
following:
 
1. Imprisonment of between 1 to 3 years and a fine of between
50,000 to 150,000 pesos for the first offense.

2. Imprisonment of 3 years and 1 day to six years plus a fine of


between 150,000 to 500,000 pesos for the second offense.

3. Imprisonment of 6 years and 1 day to 9 years plus a fine ranging


from 500,000 to 1,500,000 pesos for the third and subsequent
offenses.

The offending party may also be ordered to pay civil damages.

Copyright Act of 1802. Prior symbols indicating a work's
copyright status are seen in Scottish almanacs of the 1670s;
books included a printed copy of the local coat-of-arms to
indicate their authenticity.

copyright notices for works other than sound recordings The

using or closely imitating the language
and thoughts of another author without
authorization; the representation of that
author's work as one's own, as by not
crediting the original author.
A person who plagiarizes could be sued
for fraud or copyright infringement.

Criminalizing Plagiarism in the Philippines. On October


3rd, the Philippines Cybercrime Prevention Act (RA 10175)
took effect and, with it, the country instituted criminal
penalties for a variety of online acts, including spamming,
identity theft and, most controversially, libel.

school, fired from your job, or even have your career
ruined. The answer is that it depends on the nature of the

CYBER BULLYING - bullying that takes place
online, or using electronic technology such as cell
phones, computers, and tablets over
communication tools including social media sites,
text messages, chat, and websites. Examples of
cyber bullying: text messages or emails composed
to insult or demean; rumours or false statements
spread by email or posted on social networking
sites; and humiliating photos, videos, websites, or
fake profiles deliberately shared across social
media.

COMPUTER ADDICTION - the
excessive use of computers to the extent
that it interferes with daily life. This
excessive use may for example interfere
with work or sleep, result in problems
with social interaction, or affect mood,
relationships, and thought processes.

DIGITAL DIVIDE - an economic inequality
between groups in terms of access to, use of, or
knowledge of ICT. The divide within countries
(such as the digital divide in the United States)
can refer to inequalities between individuals,
households, businesses, and geographic areas at
different socioeconomic (and other demographic)
levels. The Global digital divide designates
countries as the units of analysis, and examines
the divide between developing and developed
countries on an international scale

ACADEMIC DISHONESTY = is usually
seen within schools especially in high school
and college. Today, students can go on
websites and hire someone to write a paper
for them. Others will just use others' work as
their own which is the most known issue in
academic dishonesty which is plagiarism. You
can actually go to jail for plagiarism if severe
enough, kicked out of school or fail a class
because of plagiarism.

FREEDOM OF SPEECH
When it comes to freedom of speech on the Internet.
People will voice their opinions on a topic or some
of the knowledge and opinions expressed are
academic research or hold a scientific fact. This
becomes controversial to whether or not certain
views on the Internet should be censored for the
masses. But in the First amendment of the
Constitution everyone has freedom of speech so this
topic will continue on its controversial path.

Information technology has given a great deal more pressure
to ethical issues through the developments in the Internet,
electronic commerce (e-Commerce) and electronic business
(e-Business. Some of the cases that can cause various ethical
issues and concerns can include misuse of data and
information, giving a free rein to new concerns regarding the
suitable utilization of customers’ information, the security of
individual privacy, and the protection of intellectual property
and rights. Sometimes, the staff members of an organization
having extraordinary skills and knowledge can deceive IT
resources and business systems by using fake information and
records and redirecting money at a level unbelievable in the
pre-computer age.
