B. PERENNIAL •Adultery
MORAL ISSUES •Concubinage
•Premarital Sex
DIVORCE

- is resorted to by couples
because of varied
justifications, namely;
1. The marital partner is hooked to vices like alcohol, gambling, maintaining
a fling;
2. There exists a kind of unreasonable behavior in one of the partners;
3. Couples are growing or living apart;
4. There is a lack of money to support the offspring and the spouse;
5. There exists contempt in one of the spouses against the partner;
6. The spouse is engrossed in violence, among others.
2 Kinds of Divorce
FORMER LATTER

- is commonly called divorce a

- is commonly known called
vinculo matrimony ( refers to a
divorce a mensa et thoro ( does
total dissolution of marriage).
not mean total dissolution of
marriage but only separation
from bed and board of parties).
Under the Family Code of the Philippines (cf. Art. 555) a petition for legal separation may be filed on any of the
following grounds:
• Repeated physical violence or grossly abusive conduct directed against the petitioner, a common child, or a child of
the petitioner;
• Physical violence or moral pressure to compel the petitioner to change religious or political affiliations;
• Attempt of respondent to corrupt or introduce the petitioner, a common child, or a child of the petitioner, to engage
in prostitution, or connivance in such corruption or inducement.
• Find judgment sentencing the respondent to imprisonment of more than six years, even if pardoned;
• Drug addiction and habitual alcoholism of the respondent;
• Lesbianism or homosexuality of the respondent;
• Contracting by the respondent of a subsequent bigamous marriage, whether in the Philippines or abroad;
• Sexual infidelity or perversion (e.g. adultery, concubinage);
• Attempt by the respondent against the life of the petitioner, and
• Abandonment of petitioner by respondent without justifiable cause for more than one year.
ADULTERY

- the act is committed

only by married
people; and the act is
infidelity to the martial
partner.

- in adultery, a married
person engages in a
sexual relation with
another person who is
not her spouse
whether this person or
not.
Adultery per se is immoral based on the
following grounds;
(1)  It violates the promise of chastity with the martial spouse.

(2)  It brings injustice to the faithful martial partner.

(3)  It offers injustice to the legitimate children.

CONCUBINAGE

- the act is an exclusive

infidelity of a ‘husband
to a wife.
It cannot be attributed
to a wife against
her husband.
Despite the glaring immorality of adultery some married
people insist to engage in such vile act because of the
following reasons:

(1) Relationship between spouses becomes strained, if not,

stale;

(2) There is sexual incompatibility between spouses;

(3) One of the spouses feels that his/her partner is no longer

attractive, among others.
The Revised Penal Code(RPC) of the Philippines defines
concubinage  as " an act done by any husband who shall
keep a mistress in the conjugal dwelling, or shall have
sexual intercourse, under scandalous circumstance, with
a woman who is not his wife, or shall cohabit with her in
any other place" (cf. Art. 334).
PREMARITA
L SEX

-- is a sex before
marriage.
Obviously, when
the act is
performed the
intention to marry
is being
postulated by the
agents.
