39.1 Applicability

This part prescribes policy for issuance of


AD that apply to Aircraft, aircraft engines,
propellers, or appliance (hereafter
referred to in this part as “products”)
when-
a)An unsafe condition exists in a
product; and
b) That condition is likely to exist or develop in
other products of the same type
design
39.3 Unsafe condition
An unsafe condition will exist when Evidence is
found during the evaluation of failures, malfunctions,
defects, services difficulties or further analysis or test :

(a) that the design does not comply with the


applicable airworthiness requirements and this
non compliance reduces the safety level
required for the product.
(b) that the design although complying with
airworthiness requirements, exhibits
characteristic that reduce the safety level
required for that product
Unsafe Conditions are defined as
failures, malfunctions or defect which:
a. Inherently do not allow the aircraft to
continue safe flight and landing
b. Reduce the safety level below that
required by the applicable
airworthiness regulations
c. Cause a hazard to people in the
aircraft or on the grounds
39.5 Issuance of AD

The director will issue airworthiness


directives in a timely manner which
will mandate action necessary to
correct an unsafe condition
ADs are divided into 2 category:
a. Emergency AD, those of an urgent nature that
require compliance within a short period time.
b. Routine AD
39.7 Issuance of ADs based upon
foreign issued AD

39.13 Variation to the compliance

43.13 Performance rules (general)

manufacturer’s instruction or acceptable by
DG

certificates issued under part 121 0r 135
43.15 Additional performance rules for
inspections
• Shall perform inspection iaw airworthiness
requirements and inspection program
• Shall inspect any system iaw MM or instructions for
continued airworthiness (rotorcraft)
• Shall use a 100 hrs checklist, which is contained in
Appendix D
• Shall run the engine for any performance iaw the
manufacturer recommendation before approval (100
hrs engine inspection)

as prescribed in the progressive inspection schedule

Appendix A – Major alterations, major repairs, and
preventive maintenance

• “Major Alteration” means an alteration not listed in the


aircraft, aircraft engine, or propeller specification
• “Major Repair” means a repair:
– That, if improperly done, might appreciably affect weight,
balance, structural strength, performance, powerplant operation,
flight characteristic, or other qualities affecting airworthiness; or
– That is not done according to accepted practices or cannot be
done by elementary operations
• “Preventive maintenance” means simple or minor
preservation operations and the replacement of small
standard parts not involving complex assembly operations
Appendix B – Recording of major repairs
and major alteration

• Shall execute DGAC form 43-337


• Forward a copy to the DGAC within 48
hours after the “products” is approved for
RTS
• Retain at least two years from the date of
approval for RTS the products
Appendix D – Scope and detail of items (as applicable to
the particular ac) to be included in annual and 100 hour
inspection
• Before that inspection, remove or open all necessary
inspection plate, access doors, fairing, and cowling
• Shall thoroughly clean the aircraft and aircraft engine
• Shall inspect in the following;
– Fuselage and hull group
– Cabin and cockpit group
– Engine and nacelle group
– Landing gear group
– Wing and center section assembly
– Empennage assembly
– Propeller group
– Radio group
– Miscellaneous item
Appendix E – Altimeter system test and inspection

• Required by part 91.411 Altimeter system and


reporting equipment tests and inspections
• Must inspect within the preceding 24 calendar months
• Shall perform test and inspection in the following;
– Static pressure system
– Altimeter instrument
– Automatic pressure altitude reporting system
• Comply with the provision of the section 43.9 Content,
form, and disposition of records
• Must conducted by Manufacturer, AMO, AME with
A/F rating
Appendix F – ATC transponder tests and
inspections

• Required by part 91.413 ATC transponder tests and


inspections
• Must inspect within the preceding 24 calendar
months
• Shall perform test and inspection in the following;
– Radio reply frequency
– Suppression
– Receiver sensitivity, etc (10 item)
• Comply with the provision of the section 43.9

Applicability
• This part prescribes for Identification of
aircraft and identification of aircraft
engines and propellers that are
manufactured under the terms of a type or
production certificate
• Identification of certain replacement and
modified parts produced for installation on
type certificated products; and
• Nationality and registration
marking of Indonesian registered aircraft
Aircraft and Aircraft engine
Aircraft and aircraft engine under a
type or production certificate hall
identify that engine, by means of
FIREPROOF PLATE that has
information specified in the section
45.13 of this part marked on it by
ETCHING, STAMPING,
ENGRAVING and other approved
method of fireproof marking.
• Identification must be :
– Secured
– Non critical surface
– Non removable (Fixed)
Identification data
The identification include the following
information:
1. Builder’s name
2. Model designation
3. Builder’s serial number
4. Type certificate, if any
5. Production certificate number, if any
6. For aircraft engines, the established rating
7. For the engines specified in part 34 of the
CASR
8. Any other information the DG finds
appropriate.
Nationality and Registration

Aircraft nationality and registration marks


must-
1. be painted on the aircraft of affixed by
any other means insuring a similar
degree of permanence;
2. Have no ornamentation;
3. Contrast in color with the background;
and
4. Be legibly
Nationality and Registration

The aircraft nationality and


registration marks may be affixed
to an aircraft with readily
removable material if-
1. It is intended for immediate delivery to
a foreign purchaser
2. It is bearing a temporary registration
number; or
3. It is marked temporarily

SUBPART C-NATIONALITY AND REGISTRATION MARKS


Location of marks on fixed wing

a) Fuselage or Vertical Horizontal
b) Wing
Location of marks: non fixed wing
aircraft
a) Rotorcraft:
• The marks on rotorcraft shall be once on the
bottom surface of the fuselage and once on
the each side surface of the fuselage.
b) Airship :
1) The marks on airship shall be displayed on
the hull or on the stabilizer surfaces
Location of marks: non fixed wing
aircraft
c) Spherical balloons:The marks on a spherical
balloon shall be displayed on the surface of the
balloon in two places diametrically opposite.
They shall be located near the maximum
horizontal circumference of the balloon
d) Non-spherical balloons; The marks on a
non-spherical balloon shall be displayed on each
side surface of the balloon. They shall be located
near the maximum cross section of the balloon
immediately above either the rigging band or
the points of attachment of the basked
suspension cables.
e) Non-conventional aircraft; If the design of
an aircraft is such that none of the requirements
of part is fully applicable, the marks of such
aircraft shall be displayed on the aircraft in a
manner as determined by the DG.
Sale of aircraft; removed of marks

When an aircraft that is registered


in Indonesia is sold, the holder of
the C of R shall remove, before its
delivery to the purchaser, all
Indonesian marks from the
aircraft, unless the purchaser is-
a) A citizen of Indonesia
b) When the aircraft is to be based and
primarily used in Indonesia, a corporation
lawfully organized and doing business
under the laws of Indonesia.
CASR Part 47
Applicability

This part prescribes the


requirements for registering
aircraft under articles 9 of the
Aviation Act of 1992. Subpart B
applies to each applicant for, and
holder of a C of R.
Articles 9 of the Aviation act of 1992

(1) Aircraft which is operated in


Indonesia shall have registration
mark.
(2) Civil aircraft which are eligible to
obtain an Indonesian registration
mark is any aircraft which is not
weather country and which meet
one of the following conditions;
Articles 9 of the Aviation act of 1992

… the following condition;


• It is owned by an Indonesian citizen or
owned by an Indonesian legal entity
(badan hukum).
• It is owned by a foreign citizen or
foreign legal entity and operated by an
Indonesian citizen or Indonesian legal
entity, for a period of at least two
consecutive years based on a hire-
purchase agreement (sewa beli), a
lease agreement (sewa guna), or any
other form of agreement.
Register of Civil Aircraft
The DG shall record in the register the following particulars
in respect of each civil aircraft registered in Indonesia

(a) The number of the (f) The address of registered


C of R; owner;
(b) The nationality and (g) The name of registered
registration marks; operator;
(c) The manufacture’s (h) The address of registered
designation of the operator
aircraft; (i) The date on which the

Registration of marks

(a) The registration mark shall be assigned by the


DG and shall consist of three letters
(b) Combinations of letters designed for the
registration mark shall not be used which
might be confused with the FIVE-letter
combinations used in the International Code of
signals, Part II, or the three letter
combinations beginning with Q used in the Q-
code, and the distress signal SOS or other
similar urgency signals, e.g. XXX, PAN and TTT
Change of ownership of aircraft
(a) Where there is a change in the
ownership of a registered aircraft, the
Certificate of Registration shall
thereupon be deemed to be canceled
and the vender or transferor of the
aircraft shall forward the following to
the DG:
1. A notification of the change of ownership,
setting out the full name and address of
the new owner and date of change of
ownership; and
2. The Certificate of Registration of the
aircraft.
Cancellation of Certificate for Export
purpose

(a) The holder of a certificate of Aircraft


Registration who wished to cancel the
Certificate for the purpose of export
must submit to the DG
1) A written requested to cancellation of the
Certificate describing the country to which
the aircraft will be exported; and
2) Evidence satisfactory to the DG that each
holder of a recorded right has been satisfied
or has consented to the transfer

 A basic certificate is equivalent to a licence without ratings


and issued by the DG to persons who meet the age,
knowledge, skill and experience
 A certificate of maintenance approval is equivalent to a
licence, but the group or type rating may be limited in
respect of validity and scope
 A licence is the document described in Annex 1
 A group rating is a rating covering a group of aircraft or
components
 A type or rating is a rating for a specified individual
aircraft or component
 A group or type rating, when added to a basic certificate,
is a licence

Application for a licences, certificates and

licence and such period shall not be exceed two
years from the date of issue or previous renewal
• May be renewed for a further period not
exceeding two years
• Within the immediately preceding 24 moths,
has for periods totalling at least 6 month
Eligibility Requirements
• A basic certificate may be issued who is not
less than 19 years of age and meets the
applicable requirements.
• A licence may be issued to a person who is
not less than 21 years age, pass the written
and oral examination, has met the experience
requirements, able to write, speak, and
understand either Indonesia or English to
read and understand Technical English as
used in Maintenance Manual
Issuance and Extension of licence
 The Director General may grant a
licence to an applicant who meets the
requirements of this part.

 The Director General may


subsequently “Extend the Privileges”
by endorsing in it additional rating for
such extension.
Recognition of foreign licences
 The Director General Will, upon application
issue an Indonesian AME licence to the
holder of a valid AME Licence (or Equivalent)
issued by an ICAO Contracting state provided
the applicant :
Complies with the requirements of this part
(valid)
Passes an examination on Indonesian
aviation Regulations
 Such aircraft are on the Indonesian Register

GENERAL OPERATING AND FLIGHT
RULES
SUBPART A - GENERAL
Applicability
a) General rules governing the operation of
aircraft within Indonesia territory.
b) This part does not apply to the following
aircraft:
1) Those aircraft operating in accordance with
Section 91.703, and
2) Aircraft governed by Part 101 (Baloon Etc),
and Part 103 (ultralight vehicles).
Civil Aircraft Flight Manual, Marking,
And Placard Requirements
a) civil aircraft should be complying with the
operating limitations specified in the approved
Airplane or Rotorcraft Flight Manual, markings,
and placards, or as otherwise prescribed by the
certificating authority
b) No-person may operate an Indonesian-
registered civil aircraft unless that aircraft is
identified and marked in accordance with
applicable policies of the CASRs
c) Any person taking off or landing a helicopter at
a heliport constructed over water, if the
equipment of emergency to accomplish a safe
emergency ditching on open water
Alcohol Or Drugs
No person may act or attempt to act as a

including Part 43.

• Operate and perform an aircraft for which a


manufacturer's maintenance manual or instructions
for continued airworthiness and an airworthiness

Maintenance Required
• Shall have that aircraft inspected as prescribed
in Subpart E and in Part 43;
• Shall ensure that maintenance personnel;
• Shall have any inoperative instrument or item of
equipment, permitted by Manufacture minimum
operation; and
• Listed discrepancies include inoperative
instruments or equipment, shall ensure that a
placard has been installed as required by the
CASR 43.11.
Operation After Maintenance

undergone maintenance unless

R I I - General Information
The operator must designate those items that need to be
inspected, and must develop methods for performing the
required inspections. The operator should include the following
in determining what tasks to designate as RII items:

domestic AMO.

(a) The DG may prescribe opspecs containing limitations


that the DG determines necessary to comply with the
airworthiness requirements of the CASRs.

certificate and rating, or for an additional

Subpart D-Limited Rating for Manufacture

(a) an AMO certificate with a limited rating for a


manufacturer may be issued;
(1)The holder or licensee of a TC who has an approved
production inspection system;
(2)The holder of a Production Certificate (PC);
(3)Any person who meets the requirements of Part 21;
(4)The holder of a TSO authorization.
