RA 232 “ Education Act of 1982”

 An act providing for the establishment and maintenance of an integrated system of education.

 In accordance with Section 2, this act shall apply to and govern both formal and non-formal
system in public and private schools in all levels of the entire educational system.

 The act includes measures to increase the authority of teachers to discipline pupils and ensure good
behaviour, with a general power to search pupils for items banned under the school’s rules, the ability
to issue same-day detentions and pre-charge anonymity when faced with an allegation by a pupil of a
criminal.
Sec 3 Declaration of Basic Policy:

Special Rights of School
Administrators

School Administrators shall be deemed persons in


authority when in the discharge of lawful duties and
responsibilities, and shall therefore be accorded due
respect and protection.
Sec 16 Teachers Obligation
One of the duties and responsibilities of teachers is to participate as an agent of constructive
social economic, moral, intellectual, cultural and political change in the school and the
community within the context of national policies.

The State recognizes that formal education or the school system is the society’s primary
learning system and therefore the main instrument for the achievement of the country’s
educational goals and objectives.

Sec 24 Non Formal and Specialized Educational Services
One of the objectives of Non Formal education is to eradicate illiteracy and raise the level of
functional literacy of the population.

Sec 41 School Finance and Assistance


The government in recognition of their complementary role in the educational system may
provide aid to the programs of private schools in the form of grants or scholarship or loans from
the government financial institutions.

Sec 51 Government Assistance to Students


The government shall provide financial assistance to financially disadvantaged and deserving
students. Such assistance maybe in the form of State Scholarship, Grants-in-aid, assistance from
the Educational Loan Fund, or subsidized tuition rates in State colleges and universities.
RA 4620 “ The Magna Carta for Public
School Teachers”

 Was envisioned to provide programs for the promotion and improvement of the well-being
and economic status of public school teachers.

 It protects the rights of the teachers like the tenure of office, academic freedom, Tax reliefs
and other benefits

 Aims to improve social and economic status of public school teachers in basic education,
their living and working conditions, employment and career prospects.
Section 2 Title Definition

“TEACHERS “
- All persons engaged in classroom teaching ( full time or part-time
- guidance counselors, school librarians, industrial arts/vocational instructors
- all other persons performing supervisory or administrative functions (Principal, Head
Teachers, Supervisor)
- but shall not include school nurses, school physicians, school dentists and other
school employees.
Section 3 Recruitment and Qualification

Recruitment Policy shall be clearly defined by the Department of Education: provided, however that
effective upon the approval of this Act, the following shall constitute the minimum educational
qualifications for teacher applicants:

a. For teachers in the kindergarten and elementary grades should have Bachelors degree in Elementary
Education (B.E.Ed.)
b. For teachers of secondary schools - Bachelors degrees in Education or its equivalent with a major
and a minor; or a Bachelors degree in Arts or Science with at least 18 professional units in
Education
c. For teachers of secondary vocational and two years technical courses, Bachelors degree in the field
of specialization with at least 18 professional units in education;
d. For teachers in tertiary should have master’s degree with a specific area of specialization;
Sec 4 Probationary Period

NOTE: given only 1 year probation from date of provisional appointment
Sec 5 Security of Tenure
- Security of tenure is guaranteed
- Provisional status to Permanent Appointment (if able to serve for 10 years)
Sec 13 Teaching Hours
- 6 hours of active teaching daily. Teacher should not be teaching beyond 6 hours.
- However, teacher may be required to render more than 6 hours but not to exceed eight hours.

Sec 14 Additional Compensation


- More than 8 hours = additional compensation of at least 25% of the basic pay.

Section 22 Medical Examination and Treatment


- Compulsory medical examination shall be provided free of charge for all teachers
- Reimbursement

Section 23 Compensation For Injuries


- Compensable occupational disease ( acquired while doing the task)

Section 25 Indefinite Leave


An indefinite sick leave shall be granted when the nature of illness demands a long treatment that will
exceed one year at the least.
RA 10627 “Anti-Bullying Act of 2013”
-an act requiring all elementary and secondary schools to adopt policies to prevent and address
the acts of bullying in their institutions.

COVERAGE:
Public & Private, Kindergarten, Elementary, Secondary Schools, Learning Centers – as
facilities for learning program for out-of-school youth and adults.

BULLYING
- A severe or repeated use of physical act/gesture, written or electronic, expression or
combination thereof resulting to” – fear, physical, emotional harm, damage to property,
creation of hostile environment and infringement of rights of another student.

1. Under this Act…

Schools are directed to adopt policies, which are to be regularly updated. These policies are to
be reported to the appropriate school division superintendent of the Department of Education
(“Department”) during the first week of every academic year.

During this period, the School shall also submit a report of relevant information and statistics
on bullying and retaliation culled from the previous academic year.
2. What must these policies contain?
- Schools must likewise define the range of administrative disciplinary actions that may be
taken against a bully, or a person who commits retaliation. 

- These actions must be commensurate with the nature and gravity of the offense
committed. Such actions may include written reprimands, community service, suspension,
exclusion or expulsion.

- Educate parents and guardians about bullying, its effects, the anti-bullying policies of the
School, and how such parents or guardians can provide support in imparting upon their
charges the gravity of bullying, and to reinforce the policies of the School. 

- Provide the students and their parents or guardians with copies of these policies, which
shall likewise be included in the student and employee manual of the School.
- Reporting acts of bullying or retaliation.

- Provide an avenue wherein students may anonymously report acts of bullying or retaliation;

- Responding promptly to and investigating reports of bullying or retaliation;

- Restoring a sense of safety for a victim and assessing the student’s need for protection;

- Protecting from bullying or retaliation of a person who reports acts of bullying, provides
information during an investigation of bullying, or is witness to or has reliable information
about an act of bullying; and

- Providing counseling or referral to appropriate services for perpetrators, victims and


appropriate family members of said students;

- Failure to comply may lead to suspension, or revocation of the schools license


“Enhanced Basic Education
RA 10533 Act of 2013”
An act Enhancing the Philippine Basic Education System by strengthening its curriculum and increasing
the number of years for Basic Education, Appropriating Funds Therefore and for other Purposes.
- expanded the years of schooling in basic education from 10 years to 12 years

Sec 2 Declaration of Policy:


- The State shall establish, maintain and support a complete, adequate, and integrated system of
education relevant to the needs of the people, the country and society-at-large.

Sec 3 Basic Education 


- meet basic learning needs which provides the foundation. It encompasses kindergarten, elementary and
secondary education as well as alternative learning systems for out-of-school learners and those with
special needs.
Sec 4 Enhanced Basic Education Program 
- (1) year of kindergarten education,
- six (6) years of elementary education,
- six (6) years of secondary education, in that sequence.
(includes four (4) years of junior high school and two (2) years of senior high school
education)
Sec 5 Curriculum Development
- The DepED shall formulate the design and details of the enhanced basic education curriculum.
- shall work with the Commission on Higher Education (CHED) to craft harmonized basic and tertiary
curricula for the global competitiveness of Filipino graduates.
- To ensure college readiness and to avoid remedial and duplication of basic education subjects, the
DepED shall coordinate with the CHED and the Technical Education and Skills Development Authority
(TESDA).

Sec 7 Teacher Education and Training


To ensure that the program meets the demand for quality teachers and school leaders, the DepED and the
CHED, in collaboration with relevant partners in government, academe, industry, and nongovernmental
organizations, shall conduct teacher education and training programs, as specified:

(a) In-service Training on Content and Pedagogy


(b) Training of New Teachers
(c) Training of School Leadership
Continuing Professional
RA 10912 Development Act of 2016

An act which requires Continuing Professional Development Program for All Regulated
Professions as the mandatory requirement for the renewal Professional Identification
Card.

It is hereby declared the policy of the state to promote and upgrade the practice of
professions in the country.
 
 
Sec 2 Declaration of Policy
- To promote and upgrade the practice of professions in the country
- Institute measures that will continuously improve the competence of the professionals

Sec 5 Nature of CPD Programs


- Consists of activities that range from structured to non-structured activities, which have
learning processes and outcomes.
- Includes : Formal Learning, Non-formal Learning, Informal Learning, Self-directed learning,
Online Learning activities and Professional work experience.
Sec 8 Powers, Functions and responsibilities of the CPD Council
a. Ensure the adequate and appropriate provision of CPD Programs for their respective profession.
b. Evaluate and act on applications for accreditation of CPD Providers and their CPD Programs.
c. Monitor and evaluate the implementation of the CPD Programs
d. Assess or upgrade the criteria for accreditation of CPD Providers and their CPD Programs on a regular
basis.
e. Develop mechanism for the validation, accreditation and recognition of
self-directed leaning
f. Conduct researches, studies and benchmarking for international alignment of the
CPD Programs.
g. Issue operational guidelines with the approval of the PRC and
PRB (Professional Regulatory Board) concerned.
h. Perform such other functions related or incidental to the implementation of the CPD.
Sec 10 CPD as Mandatory Requirement in the Renewal of Professional License and Accreditation
System for the Practice of Professions.
- hereby made as a mandatory requirement in the renewal of the PICs of all registered and licensed
professional under the regulation of the PRC.

Sec 16 Fraud Relating to CPD


- Punishable under the pertinent provisions of the Revised Penal Code, the New Civil Code and other
applicable laws.
- Shall be meted with penalty of suspension or revocation of his/her PRC Certificate of Registration
and/or Certificate of Specialization.
- In case of government official or employee-shall also be subject to the administrative penalties that
may be imposed under the anti-graft laws, the Administrative Code and the Code of Conduct of
Public Officials and Employees.
