WHAT IS AGRARIAN?
Agrarian is derive from the Latin noun ager and the Greek noun agros,
meaning "field“. Specialized meaning "having to do with cultivated land"
first recorded 1792.

REFORM?
• Defined as the rectification of the whole system of agriculture
• The redistribution of lands, regardless of crops or fruits produced, to
farmers and regular farmworkers who are landless
• It comprises not only land reform but also the reform and
development of complimentary institutional frameworks, rural
education, and social welfare institutions.
• Concerned with the relation between production and distribution of
land among farmers.

HISTORY OF AGRARIAN

REFORM
For a long period of time, the agrarian system of Philippines was being
controlled by the large landlords. The small farmers in Philippines were
struggling for their rights to land and other natural resources.
The implementation of Agrarian reforms proceeded at a very slow pace.
This was due to the lack of political will. The redistribution of land was
also very slow.

BY THE SPANISH
Land during the Spanish Era were owned and controlled by the friars (a brother and a member of one of the
mendicant orders founded in the twelfth or thirteenth century). The land distribution was done in the form of
rewards to the peasants because of their loyalty and faithful to the Spanish officials.
BY THE AMERICANS
Land that owned by the Friars were sold to those families who can afford to buy big tracts of lands which later
on became haciendas.

ADMINISTRATION
Agricultural Land Reform Code (RA 3844) was a major advancement of land reform in the Philippines and was
enacted in 1963 under President Diosdado Macapagal. It abolished tenancy and established a leasehold system
in which farmers paid fixed rentals to landlords, rather than a percentage of harvest. It also established the Land
Bank of the Philippines to help with land reform, particularly the purchase of agricultural estates for division
and resale to small landholders, and the purchase of land by the agricultural lessee.

INDAR
THE PROGRAM
Department of Agrarian Reform is the lead implementing agency of Comprehensive
Agrarian Reform Program (CARP). It undertakes land tenure improvement and
development of program beneficiaries. DAR conducts land survey in resettlement
areas. It undertakes land acquisition and distribution and land management studies.
The DAR also orchestrates the delivery of support services to farmer-beneficiaries
and promotes the development of viable agrarian reform communities.

COVERAGE OF CARP

The comprehensive Agrarian Reform Law of 1988 shall cover, regardless of the
arrangement of tenure and commodity produced, all public and private agriculture lands
as provided in Proclamation No. 131 and Executive Order No. 229, including other lands
of the public domain suitable for agriculture. The following lands are covered by the
Comprehensive Agrarian Reform Program:
All alienable and disposable lands of the public domain devoted to or suitable for agriculture.
All land of the public domain in excess of the specific limits as determined by Congress in the preceding
paragraph;
All other lands owned by the government devoted to or suitable for agriculture; and
All private lands devoted to or suitable for agriculture regardless of the agricultural products raised or that
can be raised thereon.

COMPONENTS OF CARP

1. Land Tenure Improvement
• Land Distribution- the main essence of the CARP.
• Leasehold Operation-a non-land program that protects the tenurial status of tenant-farmers in
lands.
• Production and Profit Sharing- a temporary arrangement.
• Stock Distribution Option- qualified beneficiaries are given the right to purchase from landow
corporation capital stocks that are equivalent to the value of the land devoted by the company
agricultural activities.
• Commercial Farms Deferment- under the arrangement, several agricultural lands are listed for
acquisition and distribution.

REPUBLIC ACT NO. 8532
Section 63. Funding Source. — known as Republic Act No. 8532 (Agrarian reform fund); The
amount needed to implement this Act until the year 2008 shall be funded from the Agrarian Reform
Fund.
• Additional amounts necessary for this purpose are hereby authorized to be appropriated in
excess of the initial funds, amounting to Fifty billion pesos (P50,000,000,000.00) provided
under Sections 20 and 21 of Executive Order No. 229.

The lands covered by the CARP shall be distributed as much as possible to landless residents of the
same barangay, or in the absence thereof, landless residents of the same municipality on the follow
order of priority:
Agricultural lessees and share tenants;
Regular farmworkers;
Seasonal farmworkers;
Other farmworkers;
Collectives or cooperatives of the above beneficiaries; and
Others directly working on the land.

UNDER
Compulsory acquisition (CA), a mandatory CARP
land acquisition by the State of all private agricultural
lands in accordance with the procedure as described in Section 16 of RA 6657. This mode of
acquisition is undertaken if the landowner fails to comply with the requirements for VOS or VLT;
Offer to sell (Voluntary Offer to Sell), a mode of land acquisition where landowners come forward
and voluntarily offer their agricultural lands for CARP coverage. These transactions are exempt
from payment of capital gains tax and other taxes and fees;
• Voluntary Land Transfer/Direct Payment Scheme, a direct transaction between the landowner of an agricultural
land covered by CARP and the qualified beneficiaries of such land. Transactions under this mode are not
exempt from payment of capital gains taxes and other fees (Sec. 20 & 21, RA 6657);
• Rice and Corn lands (Operation Land Transfer) under PD 27 and EO 228). Operation land transfer is a mode by
which the ownership of tenanted rice and corn lands are transferred to tenant beneficiaries.

A Notice of Coverage initiates the compulsory acquisition and distribution of private
agricultural lands and is considered by DAR as one such proceedings referred to by
CARPER.
DAR had begun fast-tracking the preliminary work leading to the issuance of NOCs in 2012 leading in a
substantial increase in NOCs issued to landholdings above 10 hectares. But because of limitations placed by
RA 9700, NOCs for small landholdings 10 hectares and below began to be issued only starting April 2013.

In 2012, the DAR was able to issue 25,841 NOCs covering 239,337 hectares for landholdings above 10
hectares.
For 2013, 30,558 NOCs were issued covering 281,192 hectares
Among those not yet issued NOCs are some 4,397 landholdings covering 43,676 hectares for which DAR has
already requested certified true copies of title from the Land Registration Authority.
In addition, there are 7,058 landholdings covering 69,339 hectares which are problematic and thus, no NOC has
yet been issued. These are the lands for which DAR has encountered problems like missing titles, unreadable
titles, chop-chop titles, etc.
