Dear Ms. Barnes: I am representing the Applicant, Kevin Richard Powell, in his Application For Discretionary Appeal filed in the Supreme Court yesterday evening. This morning, I also filed an Emergency Motion For Injunction Pending Appeal in this matter. This Motion seeks to enjoin the Secretary of State's anticipated certification of the results of the Georgia Democratic Presidential Preference Primary Election from Tuesday, March 6, 2012. As a point of information, I wanted to notify you, for further communication to the Court, that Vincent Russo of the Georgia Secretary of State's Office has informed me this morning that the Secretary of State's Office is currently anticipating certifying the results of the March 6, 2012 Democratic Presidential Preference Primary Election as of tomorrow, March 14, 2012. It appears that time is of the essence with regard to my client's Emergency Motion For Injunction Pending Appeal. I would therefore respectfully request that the Supreme Court act on my Emergency Motion, if at all, before the close of business today. I appreciate the Court's kind attention to this matter.
