Islam tertegak atas dasar aqidah. Penyibaran Islam keseluruh dunia ialah atas tujuan yang sama iaitu menegakkan aqidah Islamiah. Kedatangan Islam ke Tanah Melayu ialah untuk menukarkan agama orag Melayu daripada kepercayaan Hindu dan animisma kepada penyembahan kepada Allah swt yang esa. Aqidah Islamiah telah menukar kehidupan orang Melayu kepada amalan hidup Islam berteraskan al Quran dan Sunnah.

Perkara 3(5) Menyatakan Ydpa Ketua Agama Islam Bagi Wilayah Persekutuan Kl Dan Labuan.

Benarkah Islam Melarang Perempuan Menjadi Imam Bagi Jamaah Yang Terdiri Dari Lelaki Dan Perempuan? April 2005 Pelbagai reaksi dan pandangan telah diberikan terhadap peristiwa Amina Wadud yang merupakan seorang professor pengajian Islam dan juga ahli teologi, yang mengimami solat jamaah yang terdiri dari lelaki dan perempuan di New York pada 18 Mac 2005. .. Dalam hal solat jamaah yang diimami oleh Aminah Wadud itu sendiri, kesemua makmum lelakinya tiada membuat sebarang aduan mengatakan mereka tidak dapat khusyu' dan nafsu mereka timbul akibat berimamkan perempuan. Sejarah juga menceritakan bagaimana Sayidina Umar r.a. tidak sedar anak panah yang terbenam di kakinya telah ditarik keluar ketika beliau khusyu' mengerjakan solat. Adapun khusyu'nya solat itu bermula dari hati yang bersih dan penumpuan dalam ibadah.. Harus kita renung - mengapakah peristiwa seorang imam perempuan yang dipersetujui oleh makmumnya yang juga hampir separuh terdiri dari orang lelaki dewasa, menimbulkan kontroversi, kemarahan dan kebencian masyarakat Islam sedunia? Apa yang pasti, konsep imam perempuan bagi jamaah lelaki dan perempuan ini memang telah wujud dalam sejarah Islam dan bukannya tercetus hasil apa yang dihebohkan sebagai pengaruh gerakan feminis barat. Masyarakat Islam tidak harus mengambil sikap tertutup seolah-olah tidak ada ruang lagi dalam Islam untuk mempertimbangkannya. Kita semua sesungguhnya bertanggungjawab menyambung dan merealitikan amanah perjuangan Nabi s.a.w yang memartabatkan hak-hak dan kedudukan kaum perempuan. Wallahu a'lam Sisters In Islam

Malaysian Government Must Take a Brave and Principled Stand to Respect Freedom of Religion
Sisters in Islam views with concern the punitive action taken by the Malaysian authorities on Ayah Pin Against members of the Sky Kingdom The saga of the Sky Kingdom shows how religious authorities use state and federal resources to punish Ayah Pin and his followers. This happens despite the principle of freedom of religion clearly affirmed in the Qur'an and reflected in Article 11 of the Federal Constitution and Article 18 of the Universal Declaration of Human Rights. The Qur'an is explicit and consistent in its recognition of freedom of religion. Surah al-Baqarah verse 256 states, "There is no compulsion in matter of faith." (Ahmed Ali translation). This Medinan verse was revealed when some companions asked Prophet Muhammad for permission to coerce their relatives to profess Islam. It has been widely interpreted to mean that no one can be compelled to embrace Islam. How can religious authorities and Muslims demand that those wishing to convert to Islam should have all the freedom to do so yet at the same time, deny this freedom to Muslims who wish to leave their faith or believe otherwise? . Sisters in Islam is against any effort to criminalise people on the basis of their faith. In the current context of many groups using violence and terror in the name of religion, it is imperative that we uphold and respect the right of believers to peacefully practice their faith. Officers' Action Cannot Be Seen As 'Islamic
23 January 2005 Sisters in Islam regrets the action taken by JAWI officers following the raid on an entertainment outlet in Kuala Lumpur recently. Refusing one of the detainees access to the bathroom (resulting in her having to answer the call of nature in her clothes) and ordering the women detainees to parade themselves in front of the officers in order to 'determine' their 'offence' is conduct unbecoming of any officer, let alone those from the religious authority. It smacks of disrespect of another human being and cannot -by any lens -- be seen as "Islamic".

When this kind of treatment is done by those who represent the self-appointed moral guardian of Muslims in this country, it goes to show that these officers are hiding behind the cloak of sanctity of religion in denying others the right to dignity and respect.
If the idea was to protect women's dignity, the Qur'an (in Surah an-Nur 24:30-31) first orders men, if they be believers, to lower their gaze and guard their own modesty. In their misplaced zeal to guard the morality of others, these officers have failed that acid test. More importantly, they have violated fundamental Islamic principles of dignity and justice. The Qur'an and Sunnah call for decent and respectful treatment for all, even when it aims at a certain moral standard which included dress (among other things). If women were encouraged to understand fully the various Qur'anic verses and hadith concerning dress and related issues of modesty such as zinat (adornment) and tabarraj (wanton display of beauty and adornments), they would be able to make choices based upon their own understanding of faith, and certainly not on institutional coercion. Muslim women should choose their dress from inner conviction. No coerced choice can ever really be moral; such coercion, in fact, runs counter to Islam's emancipatory emphasis upon reason/freedom as the basis of human morality. We at Sisters in Islam are concerned about the impact of such actions against our rights and fundamental liberties in multicultural, multireligious Malaysia. This action is yet another example of how the religious authorities are increasingly shaping and redefining our lives today and therefore, defining the kind of Malaysia we live in. Sisters in Islam

Proposal conversion cases be heard jointly in Civil court
26 January 2007 SIS supports any proposals that can ensure justice being served. It is quite unfortunate that after Article 121 (1A) was introduced, the Civil court is viewed somewhat negatively by some Muslims, even though they acknowledge its supremacy in many matters. The civil court was originally meant and is still a court of general jurisdiction and Article 121 (1A) is not meant to be an attack or in opposition to the Civil court. Muslims have been known to go to Civil courts to settle their disputes even in Islamic matters and Muslims should be confident of the universality of justice in the civil court. A cooperation between the Civil and Shariah courts is thus necessary to ensure that all people in Malaysia receive justice in all areas. SIS hopes that judges, both in Civil and Shariah courts, would always be fair and just in their judgements, and never be intimidated by external pressures. Sokong Penubuhan Suruhanjaya Antara Agama (Ifc)


Siapakah yang mencadangkan penubuhan IFC?

IFC digagaskan penubuhannya oleh Malaysian Consultative Council Of Buddhism, Christianity, Hinduism dan Sikhism (MCCBCHS) atau pun Majlis Perundingan Malaysia Agama Buddha, Kristian, Hindu dan Sikh melalui memorandumnya kepada Majlis Peguam bertarikh 21 Ogos, 2001. Presiden MCCBCHS ialah V. Harcharan Singh. Siapakah yang paling bersemangat sekali menyokong penubuhan IFC? Majlis Peguam2 terutamanya Jawatankuasa Kecil Hak Asasi Manusia amat kuat menyokong penubuhan IFC dan amat berharap ia akan berjaya. Kronologinya seperti berikut: * Pada 8 Ogos, 2001, Majlis Peguam telah menerima satu memorandum daripada MCCBCHS mengenai perkara ini dan selepas itu ide penubuhan IRC berjalan dengan lancar. * Pada 10 Disember, 2001, Majlis Peguam menganjurkan forum mengenai 'Kebebasan Beragama' dan menerbitkan jurnal khas bernama INSAF. * Pada 8 Disember, 2001 satu perayaan 'Festival of Rights' diadakan dengan tema 'Kebebasan Beragama'. * Pada 17 Mac, 2003 bengkel untuk menimbang keperluan wujudnya IRC diadakan. Bengkel ini gagal apabila kesemua NGO Islam menarik diri daripada terlibat dengan penubuhan suruhanjaya ini iaitu ABIM, ACCIN4 , JUST dan Sisters In Islam5 termasuk Dr Chandra Muzaffar yang menjadi antara orang awal yang mencadangkan dialog antara kepercayaan. Bagaimana pun Sisters In Islam kemudian menyertai semula dan menyokong penubuhan suruhanjaya ini. * Pada pertengahan tahun 2004, satu persidangan mengenai penubuhan IRC diadakan. Bagi menunjukkan wujudnya sokongan, penganjur seminar telah melantik kesemua ahli Jawatankuasa Kecil Syariah Majlis Peguam sebagai ahli jawatankuasa penganjur tanpa pengetahuan mereka.

KUALA LUMPUR: Is it an offence to place pictures of verses from the Quran and Hindu deities in restaurants? This is the poser following the confiscation of such pictures from two restaurants in Lorong Maarof, Bangsar, here.

A spokesman for Restaurant Aiswaria, A. Mohd Dhasthagi, said officers from the Department of Islamic Development (Jakim), Kuala Lumpur City Hall and the Domestic Trade and Industry Ministry inspected the premises on Tuesday.
A notice was issued, saying that the restaurant did not have halal certification from Jakim and also did not have Muslim workers. The owner was asked to rectify the situation. The team took away a picture of Mecca and another with verses from the Quran. Aiswaria owner Jehabar Ali Hussain Kader said yesterday: "I have not broken any laws. Its ridiculous that I was cited for these offences. I never knew that it is an offence to display religious pictures in my premises. Being a Muslim, I purchase food items from a halal vendor."

He said he had Muslim workers.


Restaurant Seetharam, a few doors away, was also cited for similar offences. The raiding team confiscated three pictures of Hindu deities placed behind the cashiers counter. The employees said they were baffled by the removal of the pictures. The issue was highlighted yesterday by opposition leader Lim Kit Siang. He had earlier visited the outlets with two other MPs, Chong Eng and Fong Po Kuan. Lim said this was not the first time such raids were conducted and he feared it could set back inter-racial harmony. Jakim director-general Datuk Mustafa Abdul Rahman said he was not aware of the incident. "If it is true, I will ask for a report from the officers involved. This is a sensitive issue and I cant comment until I know the whole story." Perlis Mufti Dr Mohd Asri Zainul Abidin said the display of religious pictures had nothing to do with the food served. He said Muslims could consume food in restaurants as long as the ingredients were halal and the preparation followed Islamic principles. "Islam allows the display of religious pictures and paraphernalia in a private area as long as it doesnt disturb the peace. This incident must be investigated carefully as we dont know what the real issue is."

Suruhanjaya Antara Agama (Ifc)


Apakah Interfaith Commision (IFC)? IFC yang nama asalnya ialah IRC - Inter Religous Council (IRC) adalah sebuah suruhanjaya yang dicadangkan penubuhannya seperti sebuah badan berkanun yang mempunyai kuasa undang-undang yang boleh mengubah ajaran sesetengah agama (baca: agama Islam) akibat desakan penganut agama lain. Badan ini berfungsi mirip sebuah mahkamah dan segala keputusannya adalah muktamad ke atas agama yang bersabit. IFC juga juga akan berfungsi seperti SUHAKAM yang menerima dan melayan aduan-aduan berkaitan dengan agama. 2 Siapakah yang mencadangkan penubuhan IFC? IFC digagaskan penubuhannya oleh Malaysian Consultative Council Of Buddhism, Christianity, Hinduism dan Sikhism (MCCBCHS) atau pun Majlis Perundingan Malaysia Agama Buddha, Kristian, Hindu dan Sikh melalui memorandumnya kepada Majlis Peguam bertarikh 21 Ogos, 2001. Presiden MCCBCHS ialah V. Harcharan Singh. Siapakah yang paling bersemangat sekali menyokong penubuhan IFC? Majlis Peguam2 terutamanya Jawatankuasa Kecil Hak Asasi Manusia amat kuat menyokong penubuhan IFC dan amat berharap ia akan berjaya. Kronologinya seperti berikut: * Pada 8 Ogos, 2001, Majlis Peguam telah menerima satu memorandum daripada MCCBCHS mengenai perkara ini dan selepas itu ide penubuhan IRC berjalan dengan lancar. * Pada 10 Disember, 2001, Majlis Peguam menganjurkan forum mengenai 'Kebebasan Beragama' dan menerbitkan jurnal khas bernama INSAF. * Pada 8 Disember, 2001 satu perayaan 'Festival of Rights' diadakan dengan tema 'Kebebasan Beragama'. * Pada 17 Mac, 2003 bengkel untuk menimbang keperluan wujudnya IRC diadakan.

Tuntutan Org Bukan Islam Melalui IFC


Apakah tuntutan orang-orang bukan Islam yang dibuat melalui IFC?
1. Seseorang anak yang dilahirkan oleh ibubapa Islam tidak seharusnya secara terus menjadi orang Islam. 2. Orang-orang bukan Islam yang telah memeluk agama Islam hendaklah diberikan kebebasan untuk kembali kepada agama asal mereka (murtad) dan tidak boleh dikenakan tindakan undang-undang. 3. Sebarang kes pertukaran agama orang Islam kepada bukan Islam tidak sepatutnya dikendalikan oleh mahkamah syariah tetapi dikendalikan oleh mahkamah sivil. 4. Tidak perlu dicatatkan di dalam kad pengenalan seseorang Muslim bahawa ia beragama Islam. 5. Orang bukan Islam tidak perlu dikehendaki menganut Islam sekiranya ingin berkahwin dengan orang Islam. Orang Islam hendaklah dibenarkan keluar daripada Islam (murtad) sekiranya ingin berkahwin dengan orang bukan Islam tanpa boleh dikenakan apa-apa tindakan undang-undang. 6. Seseorang atau pasangan suami isteri yang menukar agamanya dengan memeluk Islam tidak patut diberikan hak jagaan anak. 7. Orang-orang yang bukan Islam yang mempunyai hubungan kekeluargaan dengan seorang yang memeluk Islam hendaklah diberikan hak menuntut harta pesakanya selepas kematiannya. 8. Kerajaan hendaklah menyediakan dana yang mencukupi untuk membina dan menyelenggara rumah-rumah ibadat orang bukan Islam sebagaimana kerajaan menyediakan dana yang serupa untuk masjid. Kerajaan juga perlu membenarkan pembinaan rumah-rumah ibadat orang bukan Islam tanpa perlu adanya peraturan-

9. Orang-orang bukan Islam hendaklah dibenarkan dan tidak boleh dihalang daripada menggunakan perkataan-perkataan suci Islam dalam percakapan dan sebagainya. 10. Bibel dalam Bahasa Malaysia dan Bahasa Indonesia sepatutnya dibenarkan untuk diedarkan kepada umum secara terbuka.

11. Pelajaran agama bukan Islam untuk penganut agama itu hendaklah diajar di semua sekolah.
12. Program-program berunsur Islam dalam bahasa ibunda sesuatu kaum hendaklah ditiadakan. Program dakwah agama lain selain Islam pula hendaklah dibenarkan untuk disiarkan dalam bahasa ibunda masing-masing.

13. Orang-orang Islam yang membayar zakat tidak sepatutnya dikecualikan daripada membayar cukai pendapatan dan wang hasil zakat sepatutnya digunakan juga untuk keperluan orang- orang bukan Islam.
14. Sepatutnya Islam tidak disebut sebagai pilihan pertama masyarakat Malaysia seperti dalam soal pakaian menutup aurat kepada pelajar sekolah.

Menolak Artikal Perlembagaan Persekutuan Islam Agama Persekutuan Federal Constitution confirms the secular nature of our country 18/07/2007
In response to the statement made by the Deputy Prime Minister, Dato Sri Najib bin Tun Razak that Malaysia is an Islamic state and that we have never been secular because being secular by Western definition means the separation of the Islamic principles in the way we govern a country. We have never been affiliated to that position. We have always been driven by our adherence to the fundamentals of Islam which was reported in Bernama (17 Jul 07), based on primary historical documents, YB Wong Nai Chee, MCA Member of Parliament of Kota Melaka puts forward the view that such interpretation is not in accordance with the spirit and intent of the Federal Constitution. Islam is the official religion. But it is clearly spelt out in the 1957 Reid Commission which has taken into account 131 memorandums, one of which was submitted by the Alliance party at that time which consisted of UMNO, MCA and MIC that clearly stated that the religion of Malaysia shall be Islam. The observance of this principal shall not impose any disability on non-Muslim nationals professing and practising their own religions and shall not imply that the State is not a secular State, explained YB Wong reiterating that an Islamic state was not the intention of the Alliance which was clearly evidenced in the Reid Commission in 1956. The issue of Malaya as a secular state was vigorously debated again during the 1962 Cobbold Commission before the entry of Sabah and Sarawak forming Malaysia. Again, the secular nature of Malaysia has been re-iterated as already been stated in the Reid Commission. The secular nature of our Federal Constitution has been the basis for our nation building since 1957 and re-inforced in 1963. Moreover, the fact that the Constitutional position of Malaysia being a secular state has also been confirmed in the 1988 Supreme court decision in the case of the Public Prosecutor versus Che Omar where it clearly spelt out the secular nature of our Federal Constitution. Therefore, legally we cannot see how it can be interpreted differently now. YB Wong added that the fact that we have Muslims being the majority does not in itself make Malaysia an Islamic state. Joint Statement; Malaysians Against Moral Policing
The State Has No Role in Policing Morality It has become apparent in the past few months that we, as Malaysians, can no longer afford to remain silent over the increasing role of the state in policing the morality of its citizens. The arrest of a transgender in the garden of a friend's house by religious authorities in Taiping (The Star, March 2, 2005, p12); the Malacca Belia 4-B campaign to spy on young people under the pretext of controlling morality (Malaysiakini.com, February 22, 2005); and the JAWI raid on a Kuala Lumpur nightclub and subsequent detention and humiliation of approximately 100 Muslim youth (Sunday Mail, Jan 23, 2005, p1) are unfortunate incidents that demonstrate how moral policing violates the personal dignity of humans and their rights as citizens. We question the state's role in defining and controlling the morality of its citizens and its use of punitive religious and municipal laws. Forced and fearful compliance with such laws results not in a more moral society but a mass of terrified, submissive and hypocritical subjects. We are concerned that when religion is so much part of the political arena, it increases the state's inclination to police the private lives of its citizens. Given the multi-religious and multi-ethnic composition of our society, any attempt to regulate a person's conscience, faith or private life has grave implications for all citizens and communities, as well as the relationships between communities. The use of state instruments such as the police, religious and Rela officers to control morality is nothing new. The use of Muslim youth to spy on other Muslims, however, is unprecedented. It violates not only Qur'anic injunctions but also common standards of community trust. Further, it invites vigilantism. Reported plans to rope in non-Muslim youth to spy on non-Muslim couples indicate how quickly such invasive and authoritarian policies can affect Malaysians. We are against the use of these state instruments, and the individuals and groups enlisted as their surrogates, to regulate morality. How people dress and where, how and with whom they socialise are personal choices.

The outcry following the nightclub raid and detention of some 100 Muslim patrons by JAWI officers recently and the case of a couple booked by City Hall enforcement officers for holding hands at the KLCC park in August 2003 indicates the Malaysian public's concern over the issue. In the past, many similar incidents went unreported because those who were charged pleaded guilty without legal representation for fear of the shame and discrimination of a prolonged public trial. It is clear that public opinion has changed, and that laws must be changed to reflect our increasingly open and progressive society. Any law that attempts to regulate a citizen's life to the smallest detail has far-reaching consequences to the point that it becomes unjust and unenforceable. The vague provisions of such laws leave them wide open to interpretation and abuse by enforcement officers, which can lead to selective prosecution and victimisation, usually on those from a marginalised class, gender and/or community. The responsibility of the Government is to uphold and protect the rights of its citizens to justice, equality, freedom and dignity at all times. In the spirit of our democratic and pluralistic society, we the undersigned affirm that morality is a matter best dealt with by individuals and their families, and we call for: a) The repeal of provisions in religious and municipal laws that deny citizens their fundamental right to privacy, freedom of speech and expression, and those that overlap with the federal Penal Code;

b) The appointment of a committee to monitor the process of repealing these laws, including representation from women's groups, human rights groups, civil society organizations, progressive religious scholars and constitutional experts; c) The strengthening of our pluralism through community dialogue around morals in our society, rather than the divisiveness bred by sub-contracting of moral policing and neighbours spying on neighbours.
