AN ACT REQUIRING ALL ELEMENTARY AND SECONDARY SCHOOLS TO ADOPT
POLICIES TO PREVENT AND ADDRESS THE ACTS OF BULLYING IN THEIR
INSTITUTIONS
Be it enacted by the Senate and House of Representatives of the Philippines in
Congress assembled:
74C(.89 ,. Short Title. : (his Act shall be known as the 0Anti-Bullying Act of 20,-2.
74C. 2. Acts of Bullying. : ;o% pu%poses of this Act) 0bullying2 shall %efe% to any se+e%e
o% %epeate& use by one o% mo%e stu&ents of a w%itten) +e%bal o% elect%onic e*p%ession)
o% a physical act o% gestu%e) o% any combination the%eof) &i%ecte& at anothe% stu&ent
that has the effect of actually causing o% placing the latte% in %easonable fea% of physical
o% emotional ha%m o% &amage to his p%ope%ty< c%eating a hostile en+i%onment at school
fo% the othe% stu&ent< inf%inging on the %ights of the othe% stu&ent at school< o% mate%ially
an& substantially &is%upting the e&ucation p%ocess o% the o%&e%ly ope%ation of a school<
such as) but not limite& to) the following:
a. Any unwante& physical contact between the bully an& the +ictim like punching)
pushing) sho+ing) kicking) slapping) tickling) hea&locks) inflicting school p%anks) teasing)
fighting an& the use of a+ailable ob=ects as weapons<
b. Any act that causes &amage to a +ictim>s psyche an&/o% emotional well-being<
c. Any slan&e%ous statement o% accusation that causes the +ictim un&ue emotional
&ist%ess like &i%ecting foul language o% p%ofanity at the ta%get) name-calling) to%menting
an& commenting negati+ely on +ictim>s looks) clothes an& bo&y< an&
&. Cybe%-bullying o% any bullying &one th%ough the use of technology o% any elect%onic
means.
74C. -. Adoption of Anti-Bullying Policies : All elementa%y an& secon&a%y schools a%e
he%eby &i%ecte& to a&opt policies to a&&%ess the e*istence of bullying in thei% %especti+e
institutions. 7uch policies shall be %egula%ly up&ate& an&) at a minimum) shall inclu&e
p%o+isions which:
?a@ P%ohibit the following acts:
?,@ Bullying on school g%oun&s< p%ope%ty imme&iately a&=acent to school g%oun&s< at
school-sponso%e& o% school-%elate& acti+ities) functions o% p%og%ams whethe% on o% off
school g%oun&s< at school bus stops< on school buses o% othe% +ehicles owne&) lease&
o% use& by a school< o% th%ough the use of technology o% an elect%onic &e+ice owne&)
lease& o% use& by a school<
?2@ Bullying at a location) acti+ity) function o% p%og%am that is not school-%elate& an&
th%ough the use of technology o% an elect%onic &e+ice that is not owne&) lease& o% use&
by a school if the act o% acts in Auestion c%eate a hostile en+i%onment at school fo% the
+ictim) inf%inge on the %ights of the +ictim at school) o% mate%ially an& substantially
&is%upt the e&ucation p%ocess o% the o%&e%ly ope%ation of a school< an&
?-@ Betaliation against a pe%son who %epo%ts bullying) who p%o+i&es info%mation &u%ing
an in+estigation of bullying) o% who is a witness to o% has %eliable info%mation about
bullying<
?b@ .&entify the %ange of &isciplina%y a&minist%ati+e actions that may be taken against a
pe%pet%ato% fo% bullying o% %etaliation which shall be commensu%ate with the natu%e an&
g%a+ity of the offense: Provided) (hat) in a&&ition to the &isciplina%y sanctions impose&
upon a pe%pet%ato% of bullying o% %etaliation) he/she shall also be %eAui%e& to un&e%go a
%ehabilitation p%og%am which shall be a&ministe%e& by the institution conce%ne&. (he
pa%ents of the sai& pe%pet%ato% shall be encou%age& by the sai& institution to =oin the
%ehabilitation p%og%am<

p%o+i&es info%mation &u%ing an in+estigation of bullying) o% is witness to o% has %eliable
info%mation about an act of bullying< an&
?"@ P%o+i&ing counseling o% %efe%%al to app%op%iate se%+ices fo% pe%pet%ato%s) +ictims an&
app%op%iate family membe%s of sai& stu&ents<
?&@ 4nable stu&ents to anonymously %epo%t bullying o% %etaliation: Provided! ho"ever)
(hat no &isciplina%y a&minist%ati+e action shall be taken against a pe%pet%ato% solely on
the basis of an anonymous %epo%t<
?e@ 7ub=ect a stu&ent who knowingly makes a false accusation of bullying to &isciplina%y
a&minist%ati+e action<
?f@ 4&ucate stu&ents on the &ynamics of bullying) the anti-bullying policies of the school
as well as the mechanisms of such school fo% the anonymous %epo%ting of acts of
bullying o% %etaliation<
?g@ 4&ucate pa%ents an& gua%&ians about the &ynamics of bullying) the anti-bullying
policies of the school an& how pa%ents an& gua%&ians can p%o+i&e suppo%t an& %einfo%ce
such policies at home< an&
?h@ Caintain a public %eco%& of %ele+ant info%mation an& statistics on acts of bullying o%
%etaliation in school: Provided) (hat the names of stu&ents who committe& acts of
bullying o% %etaliation shall be st%ictly confi&ential an& only ma&e a+ailable to the school
a&minist%ation) teache%s &i%ectly %esponsible fo% the sai& stu&ents an& pa%ents o%
gua%&ians of stu&ents who a%e o% ha+e been +ictims of acts of bullying o% %etaliation.
All elementa%y an& secon&a%y schools shall p%o+i&e stu&ents an& thei% pa%ents o%
gua%&ians a copy of the anti-bullying policies being a&opte& by the school. 7uch
policies shall likewise be inclu&e& in the school>s stu&ent an&/o% employee han&book
an& shall be conspicuously poste& on the school walls an& website) if the%e is any.
(he 3epa%tment of 4&ucation ?3ep43@ shall inclu&e in its t%aining p%og%ams) cou%ses o%
acti+ities which shall p%o+i&e oppo%tunities fo% school a&minist%ato%s) teache%s an& othe%
employees to &e+elop thei% knowle&ge an& skills in p%e+enting o% %espon&ing to any
bullying act.
74C. 4. #echanisms to Address Bullying. : (he school p%incipal o% any pe%son who
hol&s a compa%able %ole shall be %esponsible fo% the implementation an& o+e%sight of
policies inten&e& to a&&%ess bullying.
Any membe% of the school a&minist%ation) stu&ent) pa%ent o% +oluntee% shall
imme&iately %epo%t any instance of bullying o% act of %etaliation witnesse&) o% that has
come to one>s attention) to the school p%incipal o% school office% o% pe%son so
&esignate& by the p%incipal to han&le such issues) o% both. Dpon %eceipt of such a
%epo%t) the school p%incipal o% the &esignate& school office% o% pe%son shall p%omptly
in+estigate. .f it is &ete%mine& that bullying o% %etaliation has occu%%e&) the school
p%incipal o% the &esignate& school office% o% pe%son shall:
?a@ 9otify the law enfo%cement agency if the school p%incipal o% &esignee belie+es that
c%iminal cha%ges un&e% the Be+ise& Penal Co&e may be pu%sue& against the
pe%pet%ato%<
?b@ (ake app%op%iate &isciplina%y a&minist%ati+e action<
?c@ 9otify the pa%ents o% gua%&ians of the pe%pet%ato%< an&
?&@ 9otify the pa%ents o% gua%&ians of the +ictim %ega%&ing the action taken to p%e+ent
any fu%the% acts of bullying o% %etaliation.
.f an inci&ent of bullying o% %etaliation in+ol+es stu&ents f%om mo%e than one school) the
school fi%st info%me& of the bullying o% %etaliation shall p%omptly notify the app%op%iate
a&minist%ato% of the othe% school so that both may take app%op%iate action.
74C. ". Reporting Re$uirement : All schools shall info%m thei% %especti+e schools
&i+ision supe%inten&ents in w%iting about the anti-bullying policies fo%mulate& within si*
?6@ months f%om the effecti+ity of this Act. 7uch notification shall likewise be an
a&minist%ati+e %eAui%ement p%io% to the ope%ation of new schools.
Beginning with the school yea% afte% the effecti+ity of this Act) an& e+e%y fi%st week of the
sta%t of the school yea% the%eafte%) schools shall submit a %epo%t to thei% %especti+e
schools &i+ision supe%inten&ents all %ele+ant info%mation an& statistics on acts of
bullying o% %etaliation. (he schools &i+ision supe%inten&ents shall compile these &ata
an& %epo%t the same to the 7ec%eta%y of the 3ep43 who shall likewise fo%mally t%ansmit
a comp%ehensi+e %epo%t to the Committee on Basic 4&ucation of both the Eouse of
Bep%esentati+es an& the 7enate.
74C. 6. Sanction for %oncompliance. : .n the %ules an& %egulations to be implemente&
pu%suant to this Act) the 7ec%eta%y of the 3ep43 shall p%esc%ibe the app%op%iate
a&minist%ati+e sanctions on school a&minist%ato%s who shall fail to comply with the
%eAui%ements un&e% this Act. .n a&&ition the%eto) e%%ing p%i+ate schools shall likewise
suffe% the penalty of suspension of thei% pe%mits to ope%ate.
74C. #. &mplementing Rules and Regulations. : 1ithin ninety ?!0@ &ays f%om the
effecti+ity of this Act) the 3ep43 shall p%omulgate the necessa%y %ules an& %egulations
to implement the p%o+isions of this Act.
74C. . Separability Clause. : .f) fo% any %eason) any p%o+ision of this Act is &ecla%e& to
be unconstitutional o% in+ali&) the othe% sections o% p%o+isions he%eof which a%e not
affecte& the%eby shall continue to be in full fo%ce o% effect.
74C. !. Repealing Clause. : All laws) &ec%ees) o%&e%s) %ules an& %egulations o% pa%ts
the%eof which a%e inconsistent with o% cont%a%y to the p%o+isions of this Act a%e he%eby
%epeale&) amen&e& o% mo&ifie& acco%&ingly.
74C. ,0. 'ffectivity. : (his Act shall take effect fifteen ?,"@ &ays afte% its publication in
at least two ?2@ national newspape%s of gene%al ci%culation.

". Any othe% fo%m of bullying as may be p%o+i&e& in the school>s chil& p%otection o% anti-
bullying policy) consistent with the Act an& this .BB.

All public an& p%i+ate kin&e%ga%ten) elementa%y an& secon&a%y schools shall a&opt
policies to a&&%ess the e*istence of bullying in thei% %especti+e institutions. 7uch policies
shall be %egula%ly up&ate& an&) at a minimum) shall inclu&e p%o+isions on p%ohibite&
acts) p%e+ention an& inte%+ention p%og%ams) mechanisms an& p%oce&u%es.

(he%e shall be inte%+ention p%og%ams to p%omote the continuity of comp%ehensi+e anti-
bullying policies. .nte%+ention %efe%s to a se%ies of acti+ities which a%e &esigne& to
a&&%ess the following:
a. issues that influence the stu&ent to commit bullying<
b. facto%s that make a stu&ent a ta%get of bullying< an&
c. effects of bullying.
.nte%+entions may inclu&e p%og%ams such as counseling) life skills t%aining) e&ucation)
an& othe% acti+ities that will enhance the psychological) emotional an& psycho-social
well-being of both the +ictim an& the bully. 7uch p%og%ams may:
a. in+ol+e acti+ities that will a&&%ess acts of bullying<
b. emphasi/e fo%mati+e an& co%%ecti+e measu%es %athe% than punishment<
c. confo%m to p%inciples of chil& p%otection an& positi+e an& non-+iolent &iscipline<
&. help the +ictim) the bully) an& the bystan&e%s un&e%stan& the bullying inci&ent an& its
negati+e conseAuences< an&
e. p%o+i&e oppo%tunities to p%actice p%o-social beha+io%.
All schools shall &e+elop inte%+ention st%ategies in+ol+ing all pa%ties) such as bullies)
+ictims) bystan&e%s) pa%ents) school pe%sonnel) se%+ice p%o+i&e%s an& all othe% pe%sons
who may be affecte& by the bullying inci&ent.

4. 7ubmit a comp%ehensi+e annual %epo%t on bullying to the Committee on Basic

7ection ,0. P%oce&u%es in Ean&ling Bullying .nci&ents in 7chools
A. Ku%is&iction.
Complaints of bullying an& othe% acts un&e% this .BB shall be within the e*clusi+e
=u%is&iction of the 3epa%tment o% the p%i+ate school an& shall not be b%ought fo%
amicable settlement befo%e the Ba%angay) sub=ect to e*isting laws) %ules an&
%egulations. Complaints fo% acts co+e%e& by othe% laws shall be %efe%%e& to the
app%op%iate autho%ities.
B. P%oce&u%es.
Consistent with 7ections - an& 4 of the Act) all public an& p%i+ate kin&e%ga%ten)
elementa%y an& secon&a%y schools shall a&opt p%oce&u%es that inclu&e:
a. &mmediate Responses
,. (he +ictim o% anyone who witnesses o% has pe%sonal knowle&ge of a bullying inci&ent
o% %etaliation shall imme&iately call the attention of any school pe%sonnel.

inci&ent of bullying o% %etaliation) shall %epo%t the same to the teache%) gui&ance

4. Bepo%ts of inci&ents of bullying o% %etaliation initiate& by pe%sons who p%efe%
anonymity shall be ente%taine&) an& the pe%son who %epo%te& the inci&ent shall be
affo%&e& p%otection f%om possible %etaliation< p%o+i&e&) howe+e%) that no &isciplina%y
a&minist%ati+e action shall be taken against an allege& bully o% offen&ing stu&ent solely
on the basis of an anonymous %epo%t an& without any othe% e+i&ence.

(he school a&minist%ato%) p%incipal o% school hea&) o% gui&ance counselo%/teache%) o%
school pe%sonnel o% pe%son &esignate& to han&le bullying inci&ents shall:

(he CPC shall &ete%mine the app%op%iate inte%+ention p%og%ams fo% the +ictim) the bully
an& bystan&e%s. (he 7chool Eea& shall ensu%e that these a%e p%o+i&e& to them.

(he school hea& o% the Chil& P%otection Committee may %efe% the +ictims an& the bully
to t%aine& p%ofessionals outsi&e the school) such as social wo%ke%s) gui&ance
counselo%s) psychologists) o% chil& p%otection specialists) fo% fu%the% assessment an&
app%op%iate inte%+ention measu%es) as may be necessa%y. (he school hea& o% the
&esignate& school pe%sonnel shall notify the 1omen an& Chil&%en>s P%otection 3esk
?1PC3@ of the local Philippine 9ational Police) if he belie+es that app%op%iate c%iminal
cha%ges may be pu%sue& against the bully o% offen&ing stu&ent.
f 6isciplinary #easures
All public an& p%i+ate schools shall inclu&e in the school>s chil& p%otection o% anti-
bullying policy a %ange of &isciplina%y a&minist%ati+e actions that may be taken against
the pe%pet%ato% of bullying o% %etaliation.
Bullying inci&ents o% %etaliation shall be t%eate& acco%&ing to thei% natu%e) g%a+ity o%
se+e%ity an& atten&ant ci%cumstances.
,. (he school hea&) consi&e%ing the natu%e) g%a+ity o% se+e%ity) p%e+ious inci&ents of
bullying o% %etaliation an& atten&ant ci%cumstances) may impose %easonable &isciplina%y
measu%es on the bully o% offen&ing stu&ent that is p%opo%tionate to the act committe&.
2. 1%itten %ep%iman&) community se%+ice) suspension) e*clusion o% e*pulsion) in
acco%&ance with e*isting %ules an& %egulations of the school o% of the 3epa%tment fo%
public schools) may be impose&) if the ci%cumstances wa%%ant the imposition of such
penalty) p%o+i&e& that the %eAui%ements of &ue p%ocess a%e complie& with.

.n all cases whe%e a penalty is impose& on the bully o% offen&ing stu&ent) the following
minimum %eAui%ements of &ue p%ocess shall be complie& with:

b@ (he stu&ent shall be gi+en the oppo%tunity to answe% the complaint in w%iting) with the

.f the stu&ent) afte% an in+estigation) is foun& to ha+e knowingly ma&e a false
accusation of bullying) the sai& stu&ent shall be sub=ecte& to &isciplina%y actions o% to
app%op%iate inte%+entions in acco%&ance with the e*isting %ules an& %egulations of the
3epa%tment o% the p%i+ate school.
7ection ,,. Confi&entiality.
Any info%mation %elating to the i&entity an& pe%sonal ci%cumstances of the bully) +ictim)
o% bystan&e% shall be t%eate& with utmost confi&entiality by the Chil& P%otection
Committee an& the school pe%sonnel) p%o+i&e&) that the names may only be a+ailable
to the school hea& o% a&minist%ato%) teache% o% gui&ance counselo% &esignate& by the
school hea&) an& pa%ents o% gua%&ians of stu&ents who a%e o% ha+e been +ictims of
bullying o% %etaliation.
Any school pe%sonnel who commits a b%each of confi&entiality shall be sub=ect to
app%op%iate a&minist%ati+e &isciplina%y action in acco%&ance with the e*isting %ules an&
%egulations of the 3epa%tment of 4&ucation o% the p%i+ate school) without p%e=u&ice to
any ci+il o% c%iminal action.

7ection ,-. Bepo%ting BeAui%ement
All p%i+ate an& public kin&e%ga%ten) elementa%y an& secon&a%y schools shall submit a
copy of thei% chil& p%otection o% anti-bullying policy to the 3i+ision 8ffice within si* ?6@
months f%om the effecti+ity of this .BB. (hey shall also submit to the 3i+ision 8ffice
within the fi%st week of each school yea% a %epo%t on %ele+ant info%mation an& statistics
on bullying an& %etaliation f%om the p%ece&ing school yea%.
.n a&&ition to the %eAui%ements fo% an application fo% a pe%mit to ope%ate an&/o%
%ecognition as p%esc%ibe& by the e*isting %ules of the 3epa%tment) p%i+ate schools shall
submit a chil& p%otection o% anti-bullying policy to the Begional 3i%ecto%. (he Begional
3i%ecto% shall %e+iew the policy to ensu%e that it is consistent with the Act an& this .BB.
7ection ,4. 7anctions fo% 9on-compliance
,4.,. Public 7chools
7chool pe%sonnel of public kin&e%ga%ten) elementa%y o% secon&a%y schools who fail to
comply with the p%o+isions of the Act o% this .BB shall be sub=ect to a&minist%ati+e
&isciplina%y p%ocee&ings in acco%&ance with the Ci+il 7e%+ice Bules an& the %ele+ant
issuances of the 3epa%tment of 4&ucation.
,4.2. P%i+ate 7chools
7chool pe%sonnel of p%i+ate kin&e%ga%ten) elementa%y o% secon&a%y schools who fail to
comply with the %eAui%ements of the Act o% this .BB shall be sub=ect to app%op%iate
&isciplina%y sanctions as may be impose& by the p%i+ate school. A copy of the &ecision
in such cases shall be submitte& to the 3i+ision 8ffice.
P%i+ate schools that fail to comply with the %eAui%ements of the Act o% this .BB shall be
gi+en notice of such failu%e by the 3i+ision 8ffice. (he school shall be gi+en thi%ty ?-0@
&ays to comply. An e*tension of not mo%e than one ?,@ month may be g%ante& by the
Begional 3i%ecto% in me%ito%ious cases.
(he 7ec%eta%y of the 3epa%tment of 4&ucation) th%ough the Begional 3i%ecto%) may
suspen& o% %e+oke) as app%op%iate) the pe%mit o% %ecognition of a p%i+ate school that
fails to comply with the %eAui%ements un&e% the Act o% this .BB.
7ection ,". 7epa%ability Clause
Any pa%t o% p%o+ision of this 3epa%tment 8%&e% which may be hel& in+ali& o%
unconstitutional shall not affect the +ali&ity an& effecti+ity of the othe% p%o+isions.
7ection ,6. Amen&ment of 3ep43 8%&e% 9o 40) s. 20,2.
(he p%o+isions of 3ep43 8%&e% 9o 40) s. 20,2) on bullying a%e he%eby &eeme&
amen&e& by this .BB. All othe% p%o+isions of 3ep43 8%&e% 9o 40) s. 20,2 shall %emain
in full fo%ce an& effect.
7ection ,6. Bepealing Clause
All p%io% 3epa%tment 8%&e%s o% othe% issuances) o% p%o+isions the%eof) inconsistent with
this .BB a%e he%eby %epeale&) %e+ise& o% mo&ifie& acco%&ingly.
7ection ,#. 4ffecti+ity
