Introduction

 Started in 1946
 Extended to all states
 To every establishment wherein 100
or more workmen are employed
 Once applicable to the establishment
then it continuous if the no. of
workmen employed gets reduced to
less than 100
Objectives of Act

 To ensure that the terms and conditions


of the employment are known to the
employee and thus to minimize
exploitation of the workers.
 To have uniform standing orders in
respect to workers, factories, and
working relationship
 To promote industrial peace and
harmony by promoting fair industrial
practices
 To minimize industrial conflicts
Standing Orders……

 Conditions of employment---
Conditions of recruitment,
discharge, disciplinary actions,
holidays, etc.
 To avoid disputes & vagueness in
terms of employment.
 The rules made in this regard are
known as “STANDING ORDERS”.

 Appropriate Govt [sec.2(b)]


 Appellate Authority [sec.2(a)]
 certifying officer [sec. 2(c) ]

 Industrial establishment

Scope and application of the act

 Extends to the whole of India


 To every establishment wherein 100 or
more workmen are employed
 On any day preceding twelve months
 The appropriate Govt. can exempt any
establishment from any of the
provisions of the Act
Scope and application of the act

 It applies to railways, factories,


mines, quarries, oil-fields, tramways,
motor services, docks, plantations,
workshops, civil construction and
maintenance works.
 The Act has 15 sections and a
schedule.
 It applies to all the skilled or
unskilled, manual, supervisory,
technical, clerical work

• Manner of intimating to workmen
• Shift working
• Attendance & late coming
• Conditions of, procedure in applying
leave & holydays

• Termination of employment.
• Suspension or dismissal etc.
• Transfers
• Vacancies
• Confirmation, retirement, etc
Procedure for certification of
standing order
 Every employer has to prepare
Standing Orders

 Copies of these orders should be sent


to Certifying Officer .

 The Certifying Officer will inform the


Union and workmen.

Payment of Subsistence allowance

 Payment of subsistence allowance by


an employer to a workman.

 The allowance for first 90 days

 The allowance after 90 days


Penalty

 When employer fails to submit draft


standing orders or modifies it.

 In case of any contravention of


Standing Orders.
