After receiving complaints regarding the rental practices of Marshall Redder, an

investigation by the Grand Rapids Police Department resulted in the filing of a misdemeanor

complaint this week for violation of the deceptive practices provisions of the City of Grand

Rapids’ Consumer Protection Ordinance, Chapter 158 of the Grand Rapids City Code.

The complaint alleges that Mr. Redder sought to disclaim or limit the warranty of fitness

for use, without the disclaimer being clearly and conspicuously disclosed. It is also alleged

that he sought to cause a probability of confusion or of misunderstanding as to the legal rights,

obligations or remedies of a party to a transaction.

The case arose from Mr. Redder’s claim to be renting homes on an “as is” basis,

contrary to the state covenant of habitability, which requires a landlord to keep rental property

in reasonable repair and in compliance with local housing codes and from his practice of

obtaining an agreement from his tenants for the improper use of their security deposits.
