Thelegalsystemcanbeviewedasanegligentregimewhenitfailstorecognizeandaccom modateinjuryvictims.Further,whenthatsystemaddsextralayersofabuseandmagnifies theinjuriesalreadysufferedbythevictim,thesystemcanbeviewedassomewhatfascistby default.ThisEssayexaminesmylossofinnocencewithintheadversarialjusticesystem.

MynameisMurrayThompson.Iama55yearoldprofessionalartistandSociologyPhDstudentatthe UniversityofWesternSydneyinAustralia.MyDegreeisinAppliedScience,EnvironmentalHealth.Un fortunately,Iamalsoa12year(stateofNewSouthWales)DepartmentofHousing(DOH)publichousing tenant.Iwouldliketobringtoyourattentionanextensivepublichealth,ethics,humanrightsandenvi ronmentalissueregardingpesticidetoxicity.Iwishtospecificallyaddresstheissueoftheseverepesti cidepoisoningofmyselfandmythen8yearoldsonin2000/2001inmycurrentBlighParkDOHunit,and myutterexhaustionviathefurtherinsultof7years(andstillgoing)oflitigationagainstarecalcitrant DOH. WhenImovedintomyDOHgroundfloorunitin1998Inoticedthatthewoodenfencesthroughoutthis blockof16DOHunitswereinfestedwithtermites.Anumberoftenants(includingmyself)broughtthis totheDOH'sattention.However: 1.DespitehavingadvisedtheDOHinwritingforatleast3yearspriortoacceptingthisunitthatIsuf feredfromchemicalsensitiveasthma; 2.DespitehavingwrittentotheDOHdeclaringthatIdidnotwantmyDOHpropertytreatedwithortho doxchemicaltreatmentsfortermites(andthatsafer,alternativetreatmentswereavailable); 3.DespitehavingphonedtheDOHdeclaringthesameastheabove(whichdetailswererecordedinside theDOH); 4.Anddespitehavinginformedtheveryfirstpesttechniciancontractor(whoonlyinspectedandre portedonmyDOHproperty)thatIdidnotwantachemicalizedtreatmentofmyunitdespiteallthe above,onDec.7th2000,justoneyearintomynowalmostdestroyedPhDstudies,anexternalchemical barrierpyrethroidpesticidetreatmentwasforcedonmebyasecondpestcontractor,atthebehestof theDOH.Myprofounddeclineintoneverendinghealthproblemsstartedjust10minutesafterthepes ticidewasappliedviapumpintodrillholesinconcrete,andviaabovegroundsprayingoftheinfested fenceline. Withtheimpactofthepesticide'sstrongodourforcingitswayindoors,Ibecameveryillwithheadache, incoordination(dizziness/stumbling)andmassivefatigue.Withinaround2weeksafterthisacuteepi sodeIbegananintimaterelationshipwithadevelopingkaleidoscopeofsymptoms:bodywidejointpains

(polyarthralgia);musclespasms/pain;markedlydiminishedeyesight;hearingloss;immunedysfunction; lungcongestion;heatsensitivity;EMFsensitivity(ElectromagneticFrequencyradiationfromTVs,mobile phones,machinery);SPERM(motility&morphology)IMPACTS;chronic:headaches,tinnitus,fatigue, kidneystones,gastricreflux,nosebleed,skinirritation,bonedensityloss,eyedischarge;andactualbrain damageandmemorydysfunctionthatdestroyedmyPhDthesis'progress,andwhichhasmademe largelyincompetent,workwise.Then,asecondpesticidetreatment!Theeffectoftheseexposureson myemotions(especiallyfear)hasbeencatastrophic.Finally,Iamleftwithapermanentconditioncalled MultipleChemicalSensitivity(MCS),aprofoundsensitivityandnegativereactiontochemicalodours. Andyet,Ilooknormal.But,normalandpesticidepoisonedcanproducechildrenwithbirthdefectsand lymphoma(Montague,20011),sowheredoesthatleavemypotentialfutureoffspring? Ihavemedicalreportssubstantiatingmymostprominentsymptoms:xraysshowingjointimpactsand kidneystones;bloodtests:pesticideimpactonmyliver;ultrasound:echogenicliver;spermtest(Sydney Andrology):unusualspermproblems(Perry,et.al.,2006:1142;Bian,et.al.,2004:9993);psychiatricre ports:depression/suicidalideation(Parron,et.al.,1995:544);MRIandRPAHSPECT/Ceretecscans:physi calbrainimpact(Heuser,G.et.al.,20035);neuropsychtests:cognitiveabnormalities(memory,adaptive ability&infoprocessingspeed)leadingtotheabandonmentofmystudies;andanindustrialhygienist report:MCS.Literaturelinkspsychiatric/memory/intellectual/suicidalproblemstopesticidesandtheir solvents(MllerMohnssen,1999:1616;Wood&Liossi,2005:6637;Parron,et.al.,1995:6062).Thisisa PUBLICHEALTHissue. Ittookagreatdealoftimeandexpensetoprofessionallyvalidatebothpoisoningevents(thepoorcant affordtoprovetheirinjuries).WhileIslowlygatheredthisinformation,mythen8yearoldsonbecame wrackedwithabdominalpainseverymorningaftersleep.Thiswasconfirmedbyapharmacologistasa classicsymptomofpesticidepoisoninginchildren(Dr.B.Grabau,2005,pers.comm.).Thekerosenelike odourofthepesticidewasinsidemyunit24/7fornearly15monthsaftertheunit'sslabwassaturatedby thechemicalbarrierapplication,justlongenoughfortheDOHtofinallyanswer20monthsofhealth alertsandcomplaintswithanabsoluterefusalofculpability.Theodourwasnowgone,butthedamage wasdone.Mysonthenlaterbecameextremelywithdrawnandaggressiveafterafurtherexposureto herbicidefromaneighbouringgolfclub. About3yearsafterthepesttreatments(afterIgaveuponstudybecausemybraindidntworkproperly anymore),Ibeganworkonapoisoningwebsiteandstartedlegalaction.Anddespiteknowingfrommy medicalreportsthat: 1.Pesticideexposure"isasignificantcausativeandcontributingfactortoMr.Thompsonscurrentcondi tion"(Dr.B.Grabau2005,MedicalReport); 2.Stressamplifiesallsymptoms,whichthengeneratedepression(Dr.M.Donohoe2004,MedicalRe port) IwasinformedthattheDOH'slegalteamwastoldtopromotethelengthofmylegalcaseuntilthe economyimproves. Whymustaninjuryvictimsuffer10yearsofillnessandmisery(7yearsinsidelegalaction)tostillnotsee alegalmatterdefinitivelyresolved?WhywouldtheDOHslegalteamserveanabusiveandirrelevant subpoena,onedescribedbyalegalexpertasstupid?WhywouldtheDOHleaveanargumentwith theirformerinsurer(intermsofwhocoversacompensationpayout)tothesixthyearoflegalaction? comesanextendedHUMANRIGHTSissuebecausemyGPhasalsojustconfirmedthepossibilitythatI havehadastrokeofsorts(aTransientIschaemicAttack)!Howmuchtimeandhealthandlifemust peoplebeforcedtosurrendertoanunendingandabusivelegalprocessinlovewithitself? Islitigationusedasaweaponofpsychologicalassaulttogenerateadesired'failure'ofthelegalprocess throughtheexhaustedcapitulationoftheinjuryvictimandcomplainant?Ifso,whatiftheinjuredcom plainant'sreactionmanifestsasastroke,orheartattack,orsuicide?Ifbullyinginschoolsisanissue,then whynotthislegalcauseandeffect?Thesedynamicsembodyvastethicaldeficiencieswithinthelegal system.Itisimperativethatanentirelyindependentbodymonitorthecourseoflegalactioninthe contextofthekindofinjurysufferedbyaplaintiff.Thisformofmanagementoroversightisalso neededtoseeiftheextractionofextralegalfeesisbeingindulgedviaexcessivepapershuffling.Thele galsystemobviouslyenjoysfartoomuchfreedom.Howdidthelegalprofessionandprocessbecomeso abusive,unethical,perverseandsacrosanct?Whatisuntouchableandunaccountable(andthatwhich disregardsthecriticalcontextofpeopleslivesandhealthstatus)automaticallybecomesfascist.

Ihaveneverbeenofferedwithinthelegalsystemongoingsupportfromanindependentlegaladvocateor anindependentmedicalprofessionalinformingthelegalprocesswiththepowertoforceaccommodation orchanges.Whataninnovativeconcept!Andyet,varioustraumavictimsinothercircumstanceswillget neededsupport.Ihaveneverbeenspecificallyinstructedinhowtomentallyaddressthedogeatdog natureofthelegalprocess.Myinjurieshaveseverelyaffectedmypersonalityandemotions,leavingme withastressloadIcannotsustain.AllthisfromtwopesticidetreatmentsIspecificallydidn'taskfor! And,IgetregularemailsfromDOHtenantswhocomplainofsimilarproblemsandabuse. ThepesticidepoisoningissueissouniversalthatIoriginallysentouta12pageletterto250recipients worldwide.Andthevastpotentialforpoisoningsymptomstobemisdiagnosedashavingothercauses (Reeves,et.al.,1999:17188,citingSolomon&Mott,1998andZweinerd&Ginsburg,1988;Reeves,et.al., 2002:149,citingGoldman,1998)meansthisisaGLOBALENVIRONMENTALISSUE.Belowaredetailsof professionalresponsestothatletter.
