your purchase of a puppy, we: (1) provide you with a Bill Of Sale which incorporates these Terms Of Sale and Health Guarantee; (2) provide you with a vaccination and deworming record; (3) provide the Certificate of Interstate Movement required for airline shipping; and (4) arrange for shipping or delivery according to your instructions. You are responsible for (1) payment of the purchase price of the puppy; (2) instructing us as to the mode and manner of shipping; (3) the cost of any shipping, boarding or other service charges after you take possession of the puppy; 4) the cost of any veterinary or other medical treatment for the puppy after you take possession of the puppy. Possession and risk of loss of or injury to the puppy transfer to you when we place the puppy for shipment or delivery. TERMS OF HEALTH GUARANTEE For a period of one (1) year after you pay for and take possession of the puppy, we will replace your puppy with another puppy if your puppy chronically suffers or dies from a serious health problem of hereditary or congenital origin. The terms of this health guarantee DO NOT apply to any the purchase of an adult dog. An adult dog is defined as any dog who is one year of age or older at the time of purchase. All adult dogs are sold as-is without any health guarantee of any kind and the buyer is not entitled to any warranty or contract damages including the replacement guarantee. Puppies with serious health issues will be replaced. The terms of this replacement guarantee are limited as follows: (1) A serious health problem means a life-threatening or crippling defect of genetic or hereditary origin, and can include skeletal, muscular, internal organ or other abnormalities deemed hereditary or congenital. A serious health problem does not include contagious disease, injury or other harm acquired after you take possession of the puppy; allergies, hernia, coat or skin conditions, training problems, parasites (including worms, coccidia and Giardia), bone or joint injuries. (2) To confirm whether the problem is a serious health problem, you must provide to us or to a veterinarian of our choosing written opinions from two (2) veterinarians licensed in your state who practice at different clinics. One of the veterinarians must be board-certified in the specialty(ies) applicable to the health problem in question. Both veterinarians must confirm the hereditary or congenital origin and the serious nature of the health problem. (3) In the event of death, if you believe the death is related to a serious health problem, you must arrange for a necropsy or post-mortem examination of the puppy, and written report, by a veterinarian other than the treating veterinarian(s). We will not accept a necropsy or post-mortem examination performed at the clinic or hospital where the puppy died, or by the attending veterinarian(s) prior to death. The puppy will not be replaced if you do not arrange for a necropsy or post-mortem examination and provide us with a written report of same within ten (10) business days from the date of the puppies death. (3) The puppy will be replaced with a comparable quality puppy from the next available litter and the determination of compatibility shall be at the sole discretion of the seller. (4) You are responsible for payment of all costs related to making a claim under this guarantee, including veterinary or other medical treatment, medications, shipping and boarding.(5) For any returned puppy, you must provide all medical records and the puppy must be current on vaccines. We reserve the right to replace your puppy without taking possession of the puppy. We do not guarantee or otherwise replace puppies: (1) due to low blood sugar; (2) for undescended testicle(s) until one year of age, and then only if the puppy was purchased for breeding or shows; (3) for tooth or bite conditions; (4) for appearance, size, or cosmetic attributes; (4) who do not win at shows. DISPUTE RESOLUTION The Law of the State of Colorado currently in force, shall govern the construction, interpretation and applicability of any provision under this Lease. Unless otherwise agreed upon, the applicable default provisions of the Colorado Uniform Commercial Code as codified in the Colorado Revised Statutes, shall apply to every provision herein set forth. Venue shall be in Larimer County Colorado. The parties further stipulate that the prevailing party shall be entitled to attorneys fees and costs. FINAL AGREEMENT This Agreement terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only by a further writing that is duly executed by both parties.
