Vendor Waiver and Hold Harmless Agreement


By signing and dating below, the undersigned (Vendor) represents and warrants that Vendor has read, understands, and is voluntarily and knowingly agreeing to each of the following:
1) Vendor has reviewed and agrees to comply the I RUN FOR DESMOND COMMUNITY FUN RUN 5K EVENT registration requirements in seeking admission to I RUN FOR DESMOND COMMUNITY FUN RUN 5K EVENT LOCATED AT COOKS PARK, 17005 SW
92nd Ave, TIAGARD OR 97224.
2)

Vendor agrees to allow representations and photographs of its activities during the event, its employees, and its representatives to be used for future I RUN FOR DESMOND 5K EVENTS marketing efforts.

3) 3) Vendor and Vendors personal and business property are not insured by Amy Zirkelbach/COORINATOR OF I RUN FOR DESMOND 5k EVENT, OR THE CITY OF TIGARD OFFICERS, ELECTED OFFICIALS, DIRECTORS,VOLUNTEERS AND EMPLOYESS AND THE
TIGARD-TUALATIN SCHOOL DISTRICT. Vendor is solely responsible for any injuries Vendor incurs in connection with I RUN FOR
DESMOND 5K EVENT LOCATED AT COOKS PARK, LOCATED AT COOKS PARK, 17005 SW 92nd Ave, TIAGARD OR 97224 and for
any damage that is done to Vendors property.

In exchange for permission to participate inI RUN FOR DESMOND 5K EVENT , Vendor agrees to indemnify, release, forever
discharge and hold harmless, Amy Zirkelbach/Coordinator of I RUN FOR DESMOND 5K EVENT and THE CITY OF TIGARD/
TIGARD TUALATIN SCHOOL DISTRICT and each of their directors, officers, employees, agents and volunteers from any responsibility, personal liability, claims, loss or damage of any kind, or expenses, including attorneys fees, arising out of or related to
Vendors application to and participation in I RUN FOR DESMOND 5k EVENT. This includes but is not limited to special, direct,
indirect incidental or consequential damages for injuries of any kind, including but not limited to loss of life or limbs, loss of
personal or business income, physical damages, or any other loss whether or not foreseeable. Neither Vendor, nor anyone
acting on the Vendors behalf, will bring or maintain any suit in any court to assert a claim against Amy Zirkelbach/Coordinator
of I RUN FOR DESMOND 5K EVENT, City Of Tigard, TigardTualatin School District and its directors, officers agents, employees
or other person, for any claim that Vendor might have arising out of Vendors application to participate in the I RUN FOR DESMOND 5K EVENT.

Requirements to vend or demonstrate within the event area:


Vendor agrees not to handle or sell any commodity not mentioned in their application. All products must be family
oriented and cannot promote or display violence, alcohol, tobacco, drugs or anything else that may be offensive in the
eyes of the Event Coordinator. Sales of lighters, knives or any other weapons will not be tolerated.
Vend from a designated booth space. Sidewalks need to be kept clear.
Completion of a hold harmless waiver

Payment Policy: Signed contract and full payment must be received by March 1, 2017
Sorry no refunds on booth fees.
