 ABSTRACT

The overall objective research was to determine the quality of the

judgments of first and second instance on Habeas Corpus process for the
violation of the right to identity, according to the relevant regulatory,
doctrinal and jurisprudential parameters, in case No. 2273-2005 -
PHC/TC, the Judicial District of Lima, Lima.2014 type, quantitative,
qualitative; exploratory descriptive level; and non-experimental design;
retrospective and cross. Data collection was conducted from a selected
file by convenience sampling, using the techniques of observation, and
content analysis, and a checklist, valid through expert judgment. The
results revealed that the quality of the narrative, preamble and operative
part belonging to: the judgment of first instance was very Dawn, very high
quality and high range and the judgment on appeal: high, very high and
high. It was established that the quality of the judgments of the first and
second instance were range high and high, respectively.
