PETITION TO CANCEL PERFORMANCE BOND UNDER RULE 74 OF

THE RULES OF COURT

I, Mark Joseph A. Yonting, of legal age, Filipino, with residence at 143

Lincoln St. Brgy. Suba, Manjuyod, Negros Oriental, Philippines, under oath
and state that:

1. On May 1, 2015, an extrajudicial settlement pursuant to the Rules of

Court was effected between and among the heirs of the estate of the
deceased, Mariano G. Teves, whereby the said estate was adjudicated
to John Paul Q. Teves, now evidenced by Transfer Certificate of Title
No. 102938 of the Registry of Deeds of Dumaguete City;

2. Pursuant to the Rules of Court, a bond equivalent to the amount of the

subject property, was filed with the Register of Deeds of Dumaguete
City, to answer for whatever claims might be presented against the
said estate within two (2) years after the settlement and distribution
of the estate which was on March 1, 2015;

3. More than two (2) years have elapsed without any creditor’s claims
having been presented against the above estate, and therefore,
pursuant to Rule 74, Sections 1 and 4 of the Rules of Court, the said
bond may already be cancelled.
