1. Mr. Witness how long have you been a doctor?

2. Mr. Witness how long have you been a Medico-Legal Officer?

3. In that span of time you’ve gained knowledge and experience about


genital injuries caused by penetration, correct?

4. In your medico legal report you stated that there is a presence of


deep healed lacerations?

5. Mr. Witness how long does it take for a laceration to the female
genitalia take to heal?

6. That time to heal is that the standard, or may it vary from time to
time?

7. So Mr. witness deep healed lacerations may occur earlier, correct?

8. Mr. witness lacerations may heal later also, correct?

9. Mr. witness do lacerations vanish, or do they stay there forever?

10. Mr. witness these lacerations can be caused not only by


carnal knowledge but also by inserting other body parts or even
objects correct?

11. That in examining said lacerations it cannot be accurately


determined what was the actual thing that was inserted?

12. Mr. Witness in your report you examined Annabel on 21


February 2018, correct?

13. Mr. Witness the last date that the crime was allegedly
committed was 15 January 2018, correct?

14. Mr. Witness the period between the last act of the alleged
crime and your examination has a period of approximately 37 days
correct?

15. Mr. Witness in that span of time, based on your experience


another person or another thing may have been inserted into the
genetalia to cause the laceration, correct?

16. Mr witness based on your experience it may not have been


the accused who inserted anything to the genitalia because you
have no means of determining who or what entered with 100%
certainty, correct?

17. Mr.witness it is possible that even the victim Annabel had


caused such injuries to herself, in any ways or means possible,
correct?
18. Mr. witness, if it was not the victim, another person, may it
be male or female, could have caused the lacerations, correct?

19. Mr. Witness also in the purpose of laboratory examination


you stated “to determine the signs of sexual abuse/rape”, correct?

20. Is that correct Mr. witness?

21. Mr. witness is it not that the purpose of your examination is


to only determine whether there was penetration of the genitalia,
existence of lacerations, existence of a broken hymen, or other
relevant findings?

22. Mr. witness you examination cannot determine whether


indeed there was sexual abuse/ rape, correct since you do not
have knowledge of the facts of the case correct?

23. Mr. witness the method that you used to examine the victim
is it 100% accurate?

24. Mr. witness, if it is not 100% accurate there are times that
an examiner may report a different result?

25. Mr. witness based on your experience, there are cases where
there are several examination and not all results are the same,
correct?

26. Mr. witnesses there are instance that a prior doctor or


doctors may have concluded negative results but a subsequent
doctor may conclude positive correct?

27. Mr. witness are there any cases like this in your profession
that even reached the supreme court recording that your findings
are different from previous examiners?

28. Mr. witness may a man with diabetes be capable of


penetration?
