This DEED made and executed this _______________ in Dumaguete City by and between:

ALEDA NICOLE J. ZERNA, a minor, Filipino, single and a resident of N. Escario St.,
Cebu City, Philippines, duly assisted by her guardian EDA GEMMA ZERNA, of legal age,
Filipino, married and a resident of N. Escario St., Cebu City, Philippines, hereinafter known as the
SECOND PARTY;
WITNESSETH:
WHEREAS, the FIRST PARTY is the absolute owner of a portion of a parcel of land, Lot
No. 1150 covered by Original Certificate of Title No. 16841, situated in Sacsac, Bacong, Negros
Oriental, Philippines, with all the improvements found thereon. That the FIRST PARTY’S
ownership is by virtue of an __________________________________ otherwise known as Doc. No. ___;
Page No. ___; Book No. ___; Series of ____ of the notarial register of Notary Public Atty.
____________________ in _________________, which parcel of land is more particularly described as
follows:
“A parcel of land (Lot No. 1150 of the Cadastral Survey of Bacong), with its
improvements, situated in the Barrio of Sacsac, Municipality of Bacong.
Bounded on the N., by Lot No. 568; on the E., by Lot No. 1151; on the S. by Lot
No. 1153; and on the W. by Lot No. 1149. Containing an area of ONE
THOUSAND SIX HUNDRED SEVENTY-SIX (1,676) SQUARE METERS,
more or less.”
That the FIRST PARTY has manifested her desire and willingness to sell her share, portion
of the above-described parcel of land together with the improvements standing thereon,
consisting a total area of EIGHTY-EIGHT (88) SQUARE METERS, more or less, to the SECOND
PARTY for a total consideration of EIGHTY-EIGHT THOUSAND PESOS (Php88,000.00), in
Philippine Currency, and the FIRST PARTY undertakes upon execution of this contract never to
encumber, dispose nor sell the same to any other third person or entity;
That the SECOND PARTY likewise has manifested her willingness and desire to purchase
the share of the portion of the above-described parcel of land together with all the improvements
found thereon;
FURTHER WITNESSETH:
That the FIRST PARTY and the SECOND PARTY agree to be bound on this DEED under
the following terms and conditions:
1. That upon the execution of this contract, the SECOND PARTY shall pay the amount
of FIFTY THOUSAND PESOS (Php50,000.00), in Philippine Currency, to the FIRST
PARTY as down payment;
3. The SECOND PARTY shall have the right to take possession of the improvements
situated in the land as part of the share of the FIRST PARTY and exercise all the rights
of an owner thereof;
4. The FIRST PARTY shall execute a Deed of Absolute Sale in favor of the SECOND
PARTY upon payment of the remaining balance for purposes of transfer of the title of
the above-described parcel of land under the name of the SECOND PARTY;
5. The SECOND PARTY will shoulder the capital gains tax, documentary stamp tax,
transfer tax, notarial fees and all administrative fees including processing fees
necessary for the transfer of Title to her name;

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for the City of Dumaguete and the Municipalities of Sibulan,
Valencia, Bacong Dauin, Zamboanguita and Siaton, this _________________ in Dumaguete City,
Philippines, personally appeared the parties with their respective proof of identity found below
their names. This instrument relates to the Deed of Conditional Sale of a portion of a parcel of land
known as Lot No. 1150 covered by Original Certificate of Title No. 16841, situated in Sacsac,
Bacong, Negros Oriental, Philippines, consisting of two (2) pages, including this page where the
acknowledgement is written and has been signed by the parties and their instrumental witnesses
on every page hereof and they acknowledge to me that the same is their free and voluntary act and
deed.
