CATERING AGREEMENT

This Catering Agreement is entered into this 24th day of April 2019 by and between
National Commission for Culture and Arts as represented by Mr. Rico S. Pablo, Jr., its
Executive Director, hereinafter referred to as the “CLIENT” and Bert’s Place as
represented by Mr. Ryan Angelino R. Dela Cruz, its proprietor, hereinafter referred as
the “CATERER”.

PARTICULARS

WHEREAS, the CLIENT will have an event/function described as follows:

EVENT: NATIONAL HERITAGE MONTH


LOCATION: ST. MATTHIAS CHURCH TUMAUINI, ISABELA
DATE/TIME: May 2, 2019 / 7:00 PM - 11:00 PM
GUEST COUNT: 300 PAX
COST/PAX: P265.00 + TRANSPORTATION FEE (3,000.00)
INCLUSIONS: FOOD (3 Main Dish, 2 Desserts,Juice)
Complete set of utensils
Waiters/waitresses

WHEREAS, the CATERER is a duly and registered licensed catering


company.

WHEREAS, the CATERER agrees to provide the catering service for


CLIENT’s above stated event/function.

NOW THEREFORE, both parties bind themselves and agree as follows:

1. FULL PAYMENT:
Final payment will be due and demandable on May 14, 2019. Interest and
penalties may apply if payment has not been made on due date.

2. MENU:
Shop N Go Gasoline Station, Purok 2, Guibang, Gamu,
Province of Isabela

Menu Selection are due and demandable atleast seven (7) days prior to the
event date. Late submissions are subject to product availability and/or upcharge.
Changes to menu made less than the said seven (7) days are subject to a fee
based on the discretion of the Caterer.

3. PAYMENT METHOD:
We accept cash and check.

4. GUEST COUNT:
Final Guest Count, not subject to reduction is due atleast seven (7) days prior
to the event date. Any additional Guest after the stated period is subject to
extra charges as may be imposed by the CATERER.

5. GUEST COUNT COVERAGE:


CLIENT will only be charged for the guaranteed number of guest served. If
there are a significant amount of attendees overt he guaranteed guest count,
the CATERER will charge the CLIENT accordingly and by discretion of the
CATERER. The latter is not responsible for an insufficient food quantity if there are
attendees over the guaranteed guest count.

6. CHILDREN:
Children under the age of five (5) are free of charge, unless the CLIENT
wishes to provide service/seating for them. Children six and up are charged
regular price. Please advise CATERER of significant number of children
under the age of five (5) in attendance.

7. FOOD QUANTITY:
Caterer will prepare between five to 10 percent of overage based on the final
number of guest count registered by the CLIENT. CLIENT will not be charged for
this.

8. TIME:
CLIENT will be billed for additional staff hours for any time extension beyond
the prior agreed upon time.

8.1 Hired Staff Hours - CLIENT will be charge five hundred (500.00) pesos for
any additional service that exceeds agreed upon time frame.

9. ASSIGNABILITY:

This contract is not assignable without the prior consent from the
CATERER.

10. CANCELLATION:
10.1 If the event is canceled, CLIENT is liable for atleast 50% of the cost of
the contract.

11. CATERER LIABILITY:


CLIENT absolves CATERER from any third party claims, except for actions
caused by the latter and negligence of its staff.

12. AMENDMENT:
Any amendment to this agreement shall come into force only after an
agreement is signed by both parties.

IN WITNESS WHEREOF, the parties have hereunto set their hands, this 24th day of
April 2019 at ,Gamu, Isabela, Philippines.
