EXTRAJUDICIAL SETTLEMENT OF ESTATE

AND
DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:


We, _____________________________, a resident of Dumaguete City;
__________________________, a resident of Balosdiyot, Ballangaw, Misamis Occidental;
_______________________________, a resident of URC, Tolong, Sicopong, Sta. Catalina,
Negros Oriental and ___________________________, a resident of Martilo, La Libertad,
Negros Oriental, all of legal age, all married, Filipinos, and hereinafter called the HEIRS-
VENDOR, do hereby DECLARE AND MAKE MANIFEST:

W I T N E S S E T H:

That GLICERIO FLORDELIZ is the absolute owner of ½ undivided share of three (3)
parcels of land, Lots 1362, 1363 and 1368 all of Tanjay Cadastre, more particularly
bounded and described in Original Certificate of Title Nos. 6411, 6266 and 6225 of
the Land Records of Negros Oriental, respectively, to wit:

Parcel 1
“A parcel of land (Lot 1362 of the Cadastral Survey of
Tanjay), with the improvements thereon situated in Tanjay City.
Bounded: on the N, by Lot 1360; on the NE, by Lot 1311; on
the SE & SW, by Lot 1368; and on the W, by Lot 1361.
Containing an area of THREE THOUSAND SEVEN HUNDRED
and EIGHTY NINE (3,789 sq. m.) SQUARE METER, more or
less.”

Parcel 2

“A parcel of land (Lot 1363 of the Cadastral Survey of


Tanjay), with the improvements thereon situated in Tanjay City.
Bounded: on the NE, by Lot 1311; on the E, by Lot 1309; on
the SE, by Lots 1307 & 1305; and on the W, by Lots 1364 &
1368. Containing an area of ELEVEN THOUSAND SIX
HUNDRED and FORTY SEVEN (11,647 sq. m.) SQUARE
METER, more or less.”

Parcel 3

“A parcel of land (Lot 1368 of the Cadastral Survey of


Tanjay), with the improvements thereon situated in Tanjay City.
Bounded: on the NE, by Lots 1361 & 1362; on the E, by Lot
1363; on the SE, by Lots 1364, 1367 & 1366; on the SW, by
Lots 1366, 1370 & 1369 and on the NW, by Lots 1369, 1357 &
1361. Containing an area of TWENTY FOUR THOUSAND TWO
HUNDRED and EIGHTY ONE (24,281 sq. m.) SQUARE
METER, more or less.”

That _____________________________ died intestate a long time ago in Tanjay,


Negros Oriental, Philippines, leaving no known debts which not been settled to this date
and upon his death, he was survived by his six (6) children, namely:

That ______________________________ died intestate a long time ago in Tanjay,
Negros Oriental, Philippines, leaving no known debts which not been settled to this date
and upon her death, she was survived by her eleven (11) children, namely:
______________________________________________, all surnamed _____________;
That ROMULO FLORDELIZ SAGA also died intestate without any known debts,
whatsoever and upon his death, he was survived by his four (4) children being his
compulsory heirs, namely:_____________________;
That in accordance with Sec. 1, Rule 74, of the New Rules of Court, the above-
named compulsory heirs become the absolute owners pro-indiviso of 1/11 of 1/4
each undivided share of the above-described properties, to the execution of other,
subject, however to the liabilities imposed by Sec. 4, Rule 74, of the New Rules of
Court.
That for and in consideration of the sum of ONE HUNDRED FIFTY THOUSAND
PESOS (PHP 150, 000.00) Philippine Currency, to us in hand paid by STEPHANIE GIO
GUATH, of legal age, married, Filipino, with residence and postal address at Tabuc, San
Isidro, Tanjay City, Negros Oriental, Philippines, the receipt of which sum is hereby
acknowledged by us in complete and entire satisfaction, do by these presents,
hereby CEDE, SELL, TRANSFER and
CONVEY in a manner absolute and irrevocable, the 1/11 of 1/4 undivided share
containing an area 215 square meters, more or less of the above described
properties, unto and in favor of the STEPHANIE GIO GUATH, her heirs and/or assigns.

That the boundaries of which portion subject hereof are already known by the
parties upon signing of this instrument.

That the same parcel of land subject hereof is free from liens and encumbrances
and that we warrant to protect the VENDEE, her heirs and/or assigns in case of claims
by any third persons whomsoever on the same.

That the provisions of Article 1621 to 1623 of the New Civil Code has been
complied.

That the said parcel of land is not tenanted nor cultivated by any agricultural
lessee and that this document is made not to violate any existing law.

That the VENDEE, STEPHANIE GIO GUATH may register this document in
accordance with the laws and/or regulations.

IN WITNESS WHEREOF, We have hereunto set our hands on this

This instrument refers to an Extrajudicial Settlement of Estate and Deed of Absolute


Sale, consisting of two (2) pages including this page where the Acknowledgment is written,
all signed by them on the spaces provided respectively.
