SPECIAL POWER OF ATTORNEY

I, ____, ___ years old, single, Filipino, and currently residing at _____, after
being made aware of my rights under our prevailing law, DO HEREBY DECLARE the
following:

1. I am the eldest legitimate child of the late ____, who passed away intestate on
______;
2. My mother ____ was one of the surviving legitimate heirs of my grandmother the
decedent _____, who passed away intestate on _____;
3. However, prior to the settlement of the estate of the decedent ______, my mother,
being one of the legitimate surviving heirs, passed away;
4. As such, I and my siblings, having survived our mother ______, step into her shoes
as among the surviving legitimate heirs of the decedent ____ through our late
mother ______, by right of representation under the law of succession;

MOREOVER, I am soon to leave for _____ on ____ and may not be able to
physically represent myself for the purpose of entering into an extra-judicial settlement
of estate of the late _____, as well as any other transactions pertinent thereto;

AS SUCH, I DO HEREBY NAME, CONSTITUTE, and APPOINT

currently residing at _____________________________ (address) to be my true
and lawful ATTORNEY-IN-FACT for me and in my name, place, and stead perform
the following acts, to wit:

1. To participate in the execution of the Extrajudicial Settlement of Estate of the


decedent _____;

2. To enter into any transactions such as partition, compromise agreement, sale,


assignment, lease, and any other form of disposition and / or encumbrance with
respect to the properties belonging to the estate of the late ______ in as far as my
interest as one of the representatives of my deceased mother _____ is concerned
and for purposes of extrajudicially settling the same;

3. To sign any stipulations and agreements that are to be entered into in the aforestated
Extrajudicial Settlement of Estate and appurtenant transactions; and
4. To receive and take custody of, if any, my share with respect to any proceeds that
may be consequent to the sale, gratuitous disposition, or lease of any of the
properties belonging to the estate of the late _____, in as far as my interest as a
compulsory heir is concerned, and to surrender the same to me as soon as
reasonably possible upon my demand;

WHEREFOR, my ATTORNEY-IN-FACT is HEREBY granted full power and


authority to perform any and all acts necessary, in my behalf as a compulsory heir to the
late _____as if I were performing the same in my personal capacity, to effectuate the
aforementioned Extrajudicial Settlement of Estate and appurtenant transactions,
FURTHER HEREBY RATIFYING AND CONFIRMING all that my ATTORNEY-IN-
FACT may also do or cause to be done under and by virtue of these presents. In no way
shall this Special Power of Attorney be construed as a waiver of my rights as a
compulsory heir, right to revoke this Special Power of Attorney, or right to assail the acts
and representations of my ATTORNEY-IN-FACT should these be inconsistent with or
contrary to the intention of herein instrument and my rights as a compulsory heir;

THUS, my ATTORNEY-IN-FACT binds him/herself to faithfully keep within the


bounds of herein Special Power of Attorney.
