Dear Hon. Caindec:

I am writing you this letter for and on behalf of our client, Mr. Esperidion
Cañoneo, Jr., informing your good office that his Public Utility Bus service
with the service route “Cebu City-Toledo City and Vice versa” was
apprehended by your task force for allegedly traversing outside the
Franchise Route for which his Public Utility Bus service is intended. As a
result, his driver was issued with a Temporary Operator’s Permit (TOP) and
that his Public Utility Bus service was temporarily held under the custody of
your good office on the basis of the alleged violation.

For the information of your good office, the Public Utility Bus service of our
client was issued with a Certificate of Public Convenience to operate a PUB
service and is a grantee of a CPC with the validity until August 07, 2022
covering his FOTON unit bus with Plate No. 7R-124.

Our client sincerely apologizes and moves for the reconsideration of your
good office for the alleged violation. Our client actually followed the routes
of its franchise which is Cebu City-Toledo City and Vice Versa” but made a
slight mistake when it traverse the vicinity and the property of SM City
Seaside going to South Road Properties. On the other hand, our client did
not receive any objections or complaint from the management of the SM
City seaside and in fact when he went to the management of SM City
seaside, he asked for an apology when his driver was mistakenly traversing
their property going to South Road Properties.

At this point, our client humbly apologizes for the aforesaid incident as
there is still confusion on his driver as to the temporary route of the Public
Utility Bus due to the previous order of temporary suspension of the N.
Bacalso road for public bus.

With the kind indulgence of your good office, our client humbly moves for
the reconsideration that the violation of out of the line or traversing outside
the franchise route of his PUB service be lifted and that he be able to

operate his PUB service under the same franchise and CPC with the
undertaking not to commit the same error in the future.
