CONSTITUTION AND BY-LAWS OF THE SUPREME PUPIL GOVERNMENT AND


SUPREME STUDENT GOVERNMENT IN ELEMENTARY
AND SECONDARY SCHOOLS

1. Recognizing the significant role and contributions of the Supreme Pupil Government
(SPG) and Supreme Student Government (SSG) in the schools and u nder the Student
Governments Program (SGP) , the Department of Education (DepEd) issues the enclosed
Constitution and By-Laws of the Supreme Pupil Government in Elementary Schools and
the Supreme Student Government in Secondary Schools, together with other documents, for
implementation in all schools nationwide starting School Year (SY) 2014-2015 and onwards.

Standard Elections Code

3. All prov1s10ns of DepEd Order No. 79, s. 2009 entitled Revised Stand ard Constitution
and By-Laws of the Supreme Stud ent Government in Second ary Schools inconsistent with this
Order are repealed. The provisions of this Order shall remain in force and in effect until
rescinded or amended.

THE CONSTITUTION AND BY-LAWS OF SUPREME PUPIL GOVERNMENTS AND


STU DENT GOVER NMENTS IN ELEMENTARY AND SECONDARY SCHOOLS

PREAMBLE

We, the students of Pontevedra North Elementary School, believing in the need for a better
organized Supreme Pupil Government and Supreme Stu dent Government and in the development of the
youth as future leaders of the nation, do hereby promulgate and adopt this Constitution and By-Laws of
the Supreme Pu pil Governments a nd Supreme Stu dent Governments in Elementary and Secondary Schools
that shall advance, implement, and maintain our goals and aspirations, embody the ideals and principles of
freedom, equality, justice and democracy, and promote the welfare of all students and academic standards of
our Alma Ma ter.

Article I
General Provisions

Section 1 This Constitution and By-Laws shall be known as the Constitution and By-Laws of
Supreme Pupil Governments and Supreme Student Governments of Pontevedra
North Elementary School which shall hereinafter be refer red to as the SPG / SSG.

Section 2 For the purposes of this Constitution and By-Laws, the following words used shall
have the meaning as ascribed to them in this section.
"Sl'G" refers to the Supreme Pupil Government.
"SSG" refers to Supreme Stu dent Government.

Article II
Name and Domicile

Section 1 The name of this Supreme Pupil Government / Supreme Student Government shall be
known as the [name of school] Supreme Pupil Government / Su preme Student
Government which shall hereinafter be referred to as the SPG / SSG.

Section 2 The seat of the SPG / SSC shall be located inside the premises of the school.

Article III
Declaration of Principles, Objectives and Policies

Principles

Section 1 The SPG / SSG shall have the power which emanates from the stu dent body. It shall be
an au tonomous, u nified, and the highest democra tic representa tive of the student bo<ly.

Section 2 The SPG / SSG shall uphold and ad here with the Mission Statement of the Department
of Ed ucation "to protect and to promote the righ t of every Filipino to quality, equi table,'
cu ltu re-based and com plete basic ed uca tion" where "studen ts learn in a child fi.'iend ly(
gen der-sensitive, safe and motiva ting environmen t."
2.1. The Mission Statement of the Department of Education shall serve as the
guide of the SPG / SSG in working to serve the best interest of the student
body.

Section 3 The SPG / SSG is fou nded on the principles of participatory democracy,
responsible serva n t-leadership, collaboration, unity, accou ntability, and eff iciency
in serving the stu dent body.

Section 4 The SPG / SSG shall be committed in pu tting these values, principles, and id,eals
into action through academ ic, socio-civic, leadershi p programs and activities.

Objective

s Section The SPG / SG shall be the forefront of the students' rights c,md welfare, and shall
be the model of the studen ts' excellence, grou nded on good cha racter, and deep
5 sense of m ora l val ues.

The Supreme Pu pil Government / Supreme Student Government shall have the
following objectives:
Section 6 To help students develop passionate love of country, values, and competencjes that
will enable them to realize their fu II potential and to con b·ibu te meaningfu lly in
bu ilding the nation;
To represent the students in the policy-making bod y of the school concerning the
students' rights and welfare;
To help develop a student-friend ly, safe, and motivating learning
environment;
To n u rture an inclusive, service-oriented, gender-sensitive, and environment
conscious comm unity;
To help develop self-conf idence, critical thinking, problem-s.olving, decision-
making, and learning among the student bod y and to u tilize these skills in
contribu ti ng towards nation bu ilding;
To em power the stu dents to strive for excellence in the academ ics, leadershi p,
and social responsibility; to encou rage the students to be proactive
members of the society;
To u phold the va lues, principles, and ideals of the Department of Ed u cation;
To serve, to protect, and to promote the rights and welfa re of every studen t.

Policies The SPG / SSG shall be the highest governing body of the students.

Section The SPG / SSG shall pu rsue at all times, the values of honesty a nd integrity in
service, renou ncing a 11 forms of corru ption and acts which are con trary to the
7 rules and regu lations of the school and the Department of Ed ucation.

Section 8 The SPG / SSG shall encou rage an open communication and dialogue with
other stud en t organizations, movements, and other sectors of society not
inconsistent with its principles and purposes.

Section 9
Section 10 The SPG / SSG shall remain at all times, accountable and transparent with all of its
tr.a nsactions involving the interest of its constituents who they must serve with
ou tmost responsibility, integrity, loyalty, efficiency, and professionalism.

Section 11 The SPG / SSG shall strive to pursue a n independ ent sta nd, not dicta ted by any other
sector, other tha n the students, as long as these are not contra ry to the Mission - Vision
Statement and Core Val ues of the Depa rtm n t of Ed ucation.

Article IV
Membership

Section 1 All bona fide students of [name of school] are members of the student body to
whom the SPG / SSG shall be comm i tted to serve and to be accou ntable at all times.

Article V
Bill of Rights

Section 1 Every student has the right to learn in an inclusive, child-friend ly, gender-sensitive,
safe, and motiva ting environment.

Section 2 Every student has the right to enjoy responsible freedom of speech and expression.

Section 3 Every studen t has the right to avail of all the services offered by the SPG / SSG which
incl udes bu t not limited to organizing, joining, and actively participa ting in clu bs,
organizations, grou ps, and other associa tions for pu rposes not con tra ry to existing
policies.

Section 4 Every studen t has the right to cond uct and to actively participate in all school activities
a nd programs.

Section 5 Every stu d ent has the right to informa tion of the programs, ru !es, policies, regulations,
and other ma tters concerning them.

Section 6 Every stu d ent has the right to suffrage, to apply for a position, to nomina te, and to be
elected into off ice, and to exercise other electoral practices.

Section 7 Every studen t has the right to responsible and ind ependen t opera tion of the stu den t
elections a nd stu dent publications.

Section 8 Every stu dent has the right to proper representation <1nd participation i n different
meetings and assem blies of the school on issues affecting the welfa re of the student
body.

Section 9 Every student has the right to recall their SPG / SSG representa tives.

Section 10 Every stu d ent has the right to due process.


Section 11 Every student has the right to professional competence from the teachers and scqool
administra tion.

Section 12 Every student has the right to be academically evaluated based on equal and objf ctive
criteria.

Section 13 Every student has the right to an open a nd regu lar student-teacher and student-school
admin istra tion d ialogue.

Section 14 Every student has the right to freely and responsibly express their concerns, views, and
grievances.

Section 15 Every stud ent has the right to equal, legitimate, and resp<;msible use of adeq uate, safe,
clean, and eff icient school facilities.

Section 16 All other rights as specified in DepEd Order No. 40, s. 2012 entitled DepEd Child
Protection Policy bu t are not specified herei n are included as rights of the stud ents.

Article VI
Duties and Obligations of Students

Section l Every student has the responsibility to observe and to u phold the laws of the Republic
of the Philippines, the rules and regulations of the School, and this Constitu tion at all
times.

Section 2 Every student shall exercise his/ her rights responsibly and in good faith.

Section 3 Every student shall support and promote the ideals, principles, thrusts, and objectives
of the SPG / SSG, the School, and the Department of Ed ucation.

Section 4 Every student shall u phold the values of honesty and integrity.

Section 5 Every student shall endeavor to achieve aca demic excellence and sha ll abide by the
ru Jes and regu lations governing his/ her academic responsibilities.

Section 6 Every stu d ent shall pu rsue to nu r tu re an inclusive, service-oriented, gender-sensitive,


and environment conscious comm u nity.

Section 7 Every st1dent shall abide by the Su preme Pu pil Government and Su preme Student
Government Constitu tion and By-Laws.

Section 8 Every studen t shall suppor t the activ ities and programs of the SPG / SSG and the
Depa rtment of Ed uca tion as approved by the appropriate DepEd issuances.

Section 9 Every stud ent shall strive to become a proactive mem ber of the society and to
contribu te in the development of his/ her comm unity.
Article VII
Powers, Duties and Responsibilities of the SPG I SSG

Section 1 The SPG / SSC shall be the hjghest governing body of the students.

Section 2 The SPG / SSG shall have the following functions and respon ibilities:
2.1. To uphold and enforce the prov1s10ns qf the
Supreme Pu pil Government / Supreme Student Government By-Laws and
Constitu tion;
2.2. To su pport and to promote the ideals, principles, thrusts, and objectiJJes of the
SPG / SSC, the School, and the Department of Ed ucation;
To ensure fair, eff icien t, and effective delivery of services to stud ent bod y;
To formula te and to recommend programs that will ad dress relevan t iss.ues and
concerns of the students;
2.5. To pla n, to implement, and to enforce policies designed to protect and promote
the students' rights and welfare;
2.6. To monitor and to evalua te the students' activities in the school and in the
comm unity;
2.7. To crea te committees as may be necessary to address the needs of the students;
To ma ke recommenda tions to school authorities regard ing stu dent matters, affairs, and
activities;
To serve as a representative of the students in voicing their opinions, su ggestions a nd
grievances;
To pa rticipate in the craf ting and formulation of School Improvement Plans
(SIPs);
To act as a Coordinating Cou ncil of all co-curricular organizations in the School;
2.12. To have such powers and duties as the school au thorities and the stµdent body
may, from time to time, grant or delegate, consistent with stated principles,
objectives, and school policies;
2.13. To spearhead all DepEd driven thrusts, projects, progrnms1 and activities of the
SPG / SSC;
To monitor and to coord inate with the Supreme Pu pil Government / Supreme Student
Governmen t Commission on Elections every election period;
To monitor and to coord inate elections of other recognized cam pus co-cu rricu la r
organizations;
To recommend to the School Head the granting, renewal or revocation of
accred itation of cam pus student organizations;
2.17. To tu m over financial assets, papers, documen ts, properties, and other
responsibilities to the incoming SPG / SSC Officers; and,
2.18. To submit financial and accomplishment reports to the school authori ties on a
monthly basis. A terminal report must be submitted to the school au thorities and
the incom ing SPG / SSC Officers during the tu rn-over of responsibilities.
Article VIII
Composition, Election, Qualifications and Term of Off ice of the SPG I SSG

Section 1 The off icers of the SPG are the d u ly elected President, Vice,President, Secretary,
Treasu rer, Aud itor, Pu blic Informa tion Officer, Peace Off \cer, and , Grade Level
Cou ncilors.

Section 2 The off icers of the SSG are the du ly elected President, Vice-President, Secretary,
Treasurer, Au ditor, Pu blic Information Officer, Peace Officer, Grade Level Cha irperson if
applicable and the Gra de Level Representatives.
Section 3 The Grad e Level Cou ncilor / Grade Level Representative who shall get the highest
nu mber of votes among the elected Grade Level Councilors / Represen ttives in the.ir
respective grad e level shall serve as the Grade Level Chairperson of the grad e level
concerned .
Section 4
All SPG / SSG elections shall be conducted school-wide annually.
Section 5
The cam paign procedures and elections shall be in accord ance with the SPG / SSG
COMELEC Standard Election Code.
Section 6
Ca ndid ates for all the SPG / SSG elective positions shall:
6.1. Be bona fide students;
Be of good academic stand ing with a general average of 85 and
above withou t any faili ng grad e d u ring the 1st to 3rd grading
period of the cu nent school year;
Be of good mora l cha racter;
Have not been subjected to any disciplinary sanction;
Have submitted the SPG / SSG Election Application Packet to be approved by a
Section 7 representative of the SPG / SSG Com mission on Elections;

Once elected, all SPG / SSG Off icers, except the Grade Level Chairpersons, Cou ncilors
and Representatives, shall be considered resigned and ineligible from all major elective
or appoi ntive positions in other clu bs and organizations. Major elective or appointive
positions shall refer to the positions of President, Vice-President, Secretary, Treasurer,
Auditor, Pu blic Information Officer, Peace Officer or equ ivalent positions, including
Edi tor-in-Chief, Managing Ed itor a nd Associa te Ed itor of the School Paper or
Pu bl ica tion.
Section 8
No residency shall be requ ired of the candidates for all the SPG / SSG elective positions.
Section 9

The off icers of the SPG / SSG shall hold office for one (1) school year.
Article IX
Duties and Functions of Student Government Officers

Section 1 The SPG / SSC President shall be the chief execu tive off icer of the SPG / SSC. He/She
sha ll have the following duties:
Official ly represent the student body at any function on or off the campus;
Preside over all meetings and / or may designate another off icer to preside for a specific
meeting;
Serve as ex-off icio member of all executive committees;
Enforce this Constitu tion, By-Laws, and other regulations tha t may be
promulgated;
Sign all the official m inu tes, project proposals, resolu tions, correspondences, ano
other official papers of the SPG / SSG;
Re presen t the SPG / SSG or designate his/ her representative for any external or
intcrna Iaffairs/ fu nctions;
Head the Coord inating Cou ncil of School Co-Cu rricu lar Organizations;
Implemen t SPG / SSG programs and projects;
Create Ad Hoc Committees, as the need arises. The Chairperson of which shall
be appointed by the SPG / SSG President; and,
Perform other fu nctions inherent and incidental to his/ her off ice.

Section 2 The Vice-President shall have the following du ties:


Assist the President in all matters where his/ her assista nce is 11ecessary;
Assu me the Office of the President should the position become vacant;
Supervise members in planning and arranging meetings, or programs of
activities;
Head the Internal Affairs Comm ittee, conceptualize programs, projects, and plan
activities with the Grade Level Cou ncilors / Representatives; and,
Perform other duties assigned by the SPG / SSC.

Section 3 The Secretary shall have the following du ties:


Keep accu rate records of the minutes and document proceed ings in every
meeting;
Keep a file of all the pertinent docu ments and papers of the SPG / SSG aml make
them accessible to the student body;
Provide immed iate d ocu men ta tions and reports for every im plemented project;
Ca IIand prepare all notices of SPG / SSC meetings;
Head the SPG / SSC Secretariat; and,
Perform other du ties assigned by the SPG / SSG.

Section 4 The Treasurer shall have the following du ties:


Keep all financial records of the SPG / SSC a nd be the one responsible for any
information related to the student activity fund;
Serve as the disbursing off icer of all the SPG / SSG's fu nds;
Prepare the annual budget of the SPG / SSC;
Prepare accurate and transparent financial reports every month, af ter every activity,
and at the end of term;
Form ulate pertinen t financial gu idelines for the organization;
Serve as an ex-officio member of any and all Finance Committee for the purpose
of considering bud geta ry and / or financial matters of the SPG / SSG;
Cond uct an inventory of a ll SPG / SSG property and subm it a report, in writi ng,
of its condition a nd state; and, '
Perform other d u ties assigned by the SPG / SSC.

Section 5 The Aud itor shall have the following duties:


Certify the legitimacy and correch1ess of the disbursement of funds;
Au d it al l expend itures of the SPG / SSG fu nds;
Assist the Treasu rer in form u lating guidelines and reports;
Keep and update the inven tory of all the SPG / SSG's property;
Act as the assista nt head of the Financia l Committee; and,
Perform other d u ties assigned by the SPG / SSC.

Section 6 The Public Information Off icer sha ll have the followi ng duties:
Dissem inate and promote the thrusts and objectives of the SPG / SSC;
Build a nd maintain a cred ible image for the SPG / SSG;
Take charge in the promotion of SPG / SSG projects and activities;

Head the Publicity Committee; and,


Perform other du ties assigned by the SPG / SSG.

Section 7 The Peace Officer shall have the following duties:


Help the presiding off icer in maintai ning peace and order du ring the meetings;
Act as disciplinary off icer, if necessary;
Maintain peace and order within the premises of the school;
Act as chief peace off icer and over all Sergeants-at-arms of subordinate
organizations and classes;
Chair the Students' Welfare Committee and appoint its merrybers; a nd,
Perform other du ties assigned by the SPG / SSC.

Section 8 The Grade Level Chairperson / s shall have the following du ties:
Act as the grad e level head coord inator of all SPG / SSG programs and projects to the
Grade Level Cou ncilor/ s / Representativ / s of his/ her grade level.
Perform other du ties assigned by the SPG / SSC.

Section 9 The Grade Level Councilor/ s and Represen tative/ s shall have the followi ng
d u ties:
9.1. Represent his/ her grade level in all of the meetings of the SPG / SSG;
Serve as the grieva nce desk for their respective grade level;
Conceptu alize and im plemen t programs and projects, and recom mend policies for
their respective grade level;
Assist in the effective im plementa tion of the SPG / SSG's programs a nd projects;
and,
Perform other d u ties assigned by the SPG / SSC.
Article X
Permanent Committees in the PupiVStudent Government

Section 1 There shall be seven (7) permanent com mittees in the SPG / SSC; namely, the Execu tive
Committee, I n ternal Affairs Committee, Secretaria t, Finance Committee, Pu blicity
Comm ittee, Studen ts' Welfare Com m ittee and the Special Projects Comm ittee. Members
of each com m ittee in the SPC / SSC shall be appoin ted by the President from ai;n ong the
officers of the homeroom organizations u pon which the recommenda tion of the
cha irperson of the committee.

Section 2 The Execu tive Committee shall be headed by the President and shall act as the
adm inistra tive arm of the SPC / SSC.

Section 3 The Internal Affairs Com mittee shall be headed by the Vice President and shall take
charge of all the ma tters regard ing the members of the SPC / SSC and their functions.

Section 4 The Secretariat shall be headed by the Secretary and shall be the official SPC / SSC work
grou p.

Section 5 The Finance Committee shall be headed by the Treasurer and shall be assisted by the
Aud itor. This committee shall ta ke charge of all monetary ma tters and properties of the
SPC / SSC.

Section 6 The Pu blicity Committee shall be headed by the Pu blic Information Off icer and slw.ll be
responsible for d isseminating information on matters concern ing the SPC / SSC.

Section 7 The Students' Welfare Committee shall be headed by the Peace Officer and sha ll look
af ter the rights of the stu dents and act u pon their complain ts.

Section 8 The Special Projects Com mittee shall be headed by a person appoin ted by the President
and shall im plement special programs and projects of the Depa rtment of Ed ucation.

Section 9 Other Committees, perma nent or ad hoc in natu re, may be created by the SPC / SSG as
the need arises.

Article XI
Homeroom Class Organizations

Section 1 There shall be a homeroom class organization in every section com posed of officers
parallel to the orga nizational structure of the SPG / SSC.

Section 2 The homeroom class organization shall be responsible in im plementing programs and
projects of each class.

Section 3 The homeroom class organization shall assist the SPG / SSC in implementing its
programs and projects.
Section 4 The homeroom class organization shall be guided by the designated class adviser who
m ust be part of the teaching staff of the school.

Article XII
Coordinating Council of Campus Co-Curricular Organizations

Section The Coord inating Cou ncil shall be headed by the President of the SPG / SSG as the

The Coordinating Council shall be com posed of the different Presidents of all recognized

legitimate campus co-curricu lar organ izations.

The Coordinating Cou ncil shall have the following fu nctions:


Section 3
Coordinate school-wide activities, which need the participation and involvement
of the whole student bod y;
Provide and support a consu ltative mechanism for the im plementation of the
various programs and projects of all co-cu rricu lar organizations;
Plan programs and synchronize student activities in the campus;
Serve as the venue to presen t accomplishment reports, financial reports, and
such other reports of the SPG/SSG and other organizations as 1eeded or
required; and,

Set ru les and standards for the collection of mem bership fees or contribu tions by
recognized campus co-curricular clubs or organizations for the approva l
of the School Head.

The Coord inating Council shall meet at least once every quarter or u pon notice of the

necessa ry.

The School Head shall serve as the Ad viser of the Coord inating Council. As such, all

resolu tions and agreements arrived at by the Coordinating Council shall be noted by the
School Head.

Article XIII
Adviser

Section 1 The SPG / SSG Adviser shall be endorsed to the School Head from among the three (3)
teacher-nominees submitted by the newly-elected SPG / SSG officers throu gh a
resol ution.

Section 2 The SPG / SSG Ad viser shall have the following qualifications:
Ha ve experience in orga nizational management;
With good character and repu tation in the school and community;
Com petent, able, and willing to work with the studen t leaders from plan ning to
im plementation of projects, programs and activities.
Section 3 The SPG / SSC adviser shall monitor all programs, projects, activities, and
meetings of the SPG / SSC at all times.

The Ad visorship in the SPG / SSC shall be equiva lent to one teaching load as
per Repu blic Act No. 4670

Section 5 The SPG / SSC COMELEC Ad viser shall be endorsed to the School Head from
among the three (3) teacher-nom inees subm itted by the COMELEC Chair throu gh a
r6'solu tion.

Section 6 The SPG / SSC COMELEC Adviser sha ll have the following qu al ifica tions:
Have experience in organizational management;
With good character and repu tation in the school and comm u nity;
6.3. Must be non-partisan and experienced in ha nd li11g student
government elections.

Section 7 The SPG / SSC COMELEC adviser shall moni tor all activities and meetings of
the SPG / SSC COMELEC at all times.

Article XIV
Commission on
Elections

Section 1 The Commission on Elections, herein referred to as the SPG / SSC COMELEC,
shall be established within (21) days before the day of election.

Section 2 The SPG / SSC COMELEC shall be the on ly agency that will managl! the
electoral process, inclu ding the cam pa ign.

Section 3 The SPG/SSG COMELEC mem bers shall have the following qu
alifications: 3:1. Must be non-pa rtisan;
3.2. Do not have a vested interested i n the election; and
3.4. Not in any way related to a ny of the cand id ates

Section 4 The composition of the members in the SPG COMELEC sha ll be three (3) from
Grade 4 and Grade 5, and four (4) from Grade 6.

Section 5 The composition of the mem bers in the SSC COMELEC shall be three (3) from
each Grade level.

Section 6 The mem bers of the SPG / SSC COMELEC shall select a Chairperson
among its m embers.

Section 7 The SPG / SSC COMELEC shall have the following du ties a nd responsibilities:
7.1. Cond uct fair, honest, and systematic elections;
Ad here to the Stand ard SPG / SSC Election Code;
Validate the electoral proceed ings and results;
Accept or revoke cand idacy;
Proclaim the new set of officers;
7.6. Keep all pertinent election papers/ docu men ts;
Decide on protests relative to the conduct and results of elections;
Prepare and d istribute the necessary election paraphernalia, certificate of candidacy
forms, and other election related materials before, during, and af er the election; and,
7.8. Disqualify cand idates who have violated any of the guidelines, which have been
promulgated.

Article XV
The General Assembly

Section 1 The General Assem bly of the SPG / SSG shall be composed of all elected Homeroom
Class Organization Presidents of the school.

Section 2 The General Assembly shall be a forum for information a nd consulta tions, from which
decisions shall be significan tly considered.

Section 3 The General Assembly shall be convened by the SPG / SSG President once every two
months and as the need arises.

Article XVI
Membership to the Division, Regional and National Federation of Supreme Student
Governments
Section 1
The SSG shall be, and shall remain to be, an automatic member of the Division, Regional
and National Federation of Supreme Student Governments.
Section 2
As such, the SSG shall abide by the rules and regulations issued by the proper federation
consistent with the policies and guidelines of the Department of Education.

Article XVII
Meeting and Quorum
Section 1
The SPG / SSG shall condu ct regula r meetings every first and third week of the month
or as agreed upon by the off icers of the SPG/SSG.
Section 2
Special meetings of the SPG / SSG may be called upon by the SPG / SSG President or by
a majority of the SPG / SSG officers.
Section 3
Majority of the officers of the SPG / SSG (50% + 1) shall constitute a q uorum.
Section 4
Each mem ber of the SPG / SSG is entitled to only one vote.
Section 5
If the votes end in a draw, the SPG / SSG Presiden t or the Acting Chair of the meeting
shall cast the vote to break the tie.
Section 6
No proxy shall be a llowed when voti ng.
Article )(\Tiii
Finance

Section 1 All receipts of moneys from all sources shall be evidenced by acknowledgement receipts.

Section 2 A monthly report on the receipts a nd / or collections made du ly signed by the Treasu1'!-r
and the Presiden t, and noted by the SPC / SSC Adviser sha ll be po.sted on lM
SPC / SSC bulletin board and be submitted to the School Hea d.

Section 3 The SPC / SSC shall deposit all funds received collected and shall maintain bankUig
con nection for the regu la r deposit and savings account of the SPC / SSC.

Section 4 The organization may accept cash donations from any mem ber or any public or priva.
person or institu tion, as long as it will not affect or compromise the integrity of the
SPC / SSC.

Section s The SPC / SSC may u ndertake fund-ra ising activities to su,bsidize its projects and
activities as long as it will not affect or com promise the integrity of the SPC / SSC.

Section 6 The SPC / SSC shall enjoy the freed om to determine its priori ties in the disbursement of
its funds, prov ided that it shall be actually, directly, a nd exclusively used to support
and / or finance SPC / SSC programs, projects and activities.

Section 7 All d isbursement and bank withd rawals shall be mad e in accord ance with the programs,
projects a nd activities of the SPC / SSC em bod ied in the yea rly action plan endorsed by
the SPC / SSC Adviser and d uly approved by the School Head.

Section 8 The SPC / SSC President and the Treasurer shall be the signatory of all fun<
d isbursements and bank withdra wals of the SPC / SSC. All fund disbursements m.1d
bank withd rawals must be accom panied with a n SPC / SSC resol u tion d u ly noted y
the SPC / SSC Adviser. All expenses m ust be supported by official receipts. The School
Head shall be provided a copy of a ll the resolu tions relative the disbu rsements. made.

Section 9 The SPC / SSC, through the Treasurer and the Aud itor, shall prom u lgate financial
gu idelines for proper financial management.

Section 10 At the end of every activity, the SPC / SSC shall liquida te expenses before another
d isbursement. Withou t this, succeeding bank withd rawals shall not be au thorized.
Fu nds of the SPC / SSC shall be audited at the end of the term of the SPC / SSC and at
the end of every activity.

Section 11 Financial statements shall be posted in the SPC / SSC Bu lletin Boa rd every month,
printed in every issue of the School Paper and, the School Head m ust be fu rnished with a
copy.
Article XIX
Impeachment, Resignation and Vacancies

Section 1 The off icers of the SPG / SSG may be impeached on the following grou nds:
l.1. Culpable violations of the Constitu tion a nd By-Laws;
Gross miscond uct, violation to person in authori ty, negligence, and disloyalty to the
cause of the SPG / SSG and the school;
Non-attendance in both regular and special meetings for three (3) times without
valid cause; and,
Abuse or misuse of power and authority.

Section 2 Two-thirds (2/3) vote of the General Assembly shall be necessary to decide after hearing
a case of impeachment.

$ection 3 The decision of the General Assembly shall be final. However, the off icer charged shall
be informed twenty (20) days prior to his/ her im peachment case proceedings, of the
charge/ cha rges against him/ her, to afford him / her the opportu nity to be heard with or
withou t a cou nsel in his/ her d efense.

Section 4 Resigna tion of an elected officer shall be in writing and shall take effect five (5) days af ter
the approval of the majority of the SPG / SSG officers.

Section 5 Resignation of an appointed offer shall be in writing and shall ta ke effect immed iately
af ter the approval of the appointing au thority.

Section 6 Any vacancy in any of the positions for the reason of death, resignation, impeachment,
shall be filled, subject to the recom mend ation of the SPG / SSG.

Section 7 Any vacancy in the SPG / SSG, except the position of the President, shall be filled,
within ten (10) school days from the day the position is rendered or considered vacant,
by appointment of the President from among the qu alified mem bers of the SPG /
SSG. Immed iately u pon a ppointment, the appointee shall serve the rema ining period.

Section 8 The SPG / SSG COMELEC shall certify as to the vacancy occu rring in the SPG / SSG
and the SPG / SSG Adviser shall certify the fact of appointment of the off icer to the
vaca nt position

Article XX
Ratification of the Constitution

Section 1 This (:onstitu tion and By-Laws ma y be amended or mod ified in fu ll or i n part once every
three (3) yea rs from its official issuance through a DepEd Order or Memorandu m.

Section 2 The school SPG / SSG, the Division, Regional and/ or Nationa I Federations of Student
Governments may propose amendments. Such proposal shall be carried throu gh a
resolution du ly signed and concu rred in by a majority of vote of the School SPG / SSG
officers, the Division, Regiona l or National Fed era tion officers concerned voting
separately.
Section 3 Proposed amendments shall be transmitted to the Office of the Undersecretary for
Regional Operations at least (1) month before holding any National Conference or events
orga nized for the purpose, where the same shall be submitted for consu lta tion,
d iscussion and deliberation.

Section 4 Amendments to this Consti tu tion and By-La ws shall take effect im mediately u pot.
approval of the Secreta ry of the Deparbnent of Ed ucation.

GOVERNMENTS IN ELEMENTARY AND SECONDARY SCHOOLS
Introduction

The Dep;;t rtment of Education Supreme Pu pil Government and Supreme Student Government
Program seeks to orga11ize anq institutionalize the Supreme Pu pil Government and Supre'me Student
Government in publk and private elementary and secondary schools nationwide with a view to 1m)ke it
efficien t and responsive to the needs of the studen t, school and the comm u nity. The Su preme Pupil
Governmen t and the Supreme Student Government plays a sign i fican t role in implementing the progra ms,
projects and activities and i n u pholding the values, princi ples and i deals of the Department of Ed uca tion.

Objectives

a. To help students develop passionate love of country, values, and com petencies tha t will enable
them to realize their fu ll potential and to contribu te meaningfully in building the nation;
b. To help d evelop a student-friendly, safe, and motiva ting learning environment;
c. To n u r ture an inclusive, service-oriented, gender-sensi tive, and environment conscious commu nity;
d. To help students to develop self-confidence, critical thinking, problem-solving, decision-ma king,
and to u tilize these skills in contribu ting towards nation build ing;
e. To em power the students to sh·ive for excellence in the academics, leadershi p, and social
responsibility towards being proactive mem bers of the society;
f. Stand ardize the By-Laws and Constitution in the Supreme Pupil Governmen ts and Supreme
Studen t Govern men ts;
g. Standardize election code for the Supreme Pu pil Governments and Supreme Pu pil Governments to
ensure fair, honest, orderl y and properly coord inated elections ;
h. Provide reference in monitoring and evaluating the performance of the Supremo Pu pil Governments
and Supreme Student Govern ments;
i. Ha rness the Supreme Pu pil Governmen ts and Supreme Student Govern men ts as partners in
achieving q uality educa tion and academic excellence in schools; and,
j. To make available real ex posure, experience and learning in responsibl e and partici pa tive
democracy in leadershi p.

Guidelines

1. Effective School Year 2014-2015 and every School Year af ter, all public schools nation wide shall
sh·ictly ad opt the Consti tu tion and By-Laws of Supreme Pu pil Government and Supreme Studen t
Governmen ts 111 Elementary and Second ary Schools. Private schools may freely adopt the same as they see
fit.

2. All School Heads are tasked to ensure and oversee the implementation of this DepEd Order in their
respective schools. All Division and Regional Coordinators of the Supreme Pu pil Government and Supreme
SL11dent Governmen t Progra m are required to report compliance with this DepEd Order to the Office of the
Undersecretary for Regional Operations, Department of Ed ucation Central Office (DepEd CO).

3. All previous DepEd Orders and Memorabilia issued in rega rd to the· Stu.dent Govern men t Progra m
inconsisten t with this Order shall be considered as n ull and void.

4. These policy guid elines shall take effect immediately upon approval and shall remain 111 force
until repealed, amended or rescinded.

COMMISSION ON ELECTIONS STANDARD ELECTION CODE

Article I
General
Provisions

Section This code shall be known as [name of school]


1 Supreme Pu pil Governmen t / Supreme Student Government Commission on Elections
Standard Election Code which shall hereinaf ter be referred to as SPG / SSG
COMELEC.

The SPG / SSG COMELEC sha II govern all regu lar and specia I elections of SPG / SS.
Section 2
The SPG / SSG COMELEC shall make every effort to com ply and to follow the
Section 3 standa rds set for in this code. This shall include, bu t not lim ited to:
The review of the ru les governing standard;
The adoption of ru les to achieve and to mainta in the maxim um d
egree fairness, impartiality, and eff iciency on the proced ures of
voting, inclu d ing wri te-in voti ng, cou nting, tabu lating, and
record ing of votes by voting system used in SPG / SSC elections.

For the pu rposes of this code, the following words and phrases used shall have the
Section 4 meaning as ascribed to them in this section:
4.1. "SPG / SSG COMELEC" refers to Supreme Pupil Governmen t / Supreme
Stu dent Government Commission on Elec tions.
"Cand idate" refers to a stu dent whose application for cand idacy
to an elective posi tion was eligible and qua lified to have his or her
name placed on a ballot and d u lly appro.ved by the SPG / SSC
COMELEC.
"Election calendar" refers to the period of time from the d
issemim1tion of information to the induction of newly elected off
icers.
"Campaigning" means any intentional action in su ppor t of, or in opposition to, a
cand idate or political party for an elective position, includ ing but not lim i ted to
the d istribution of literatu re and posting of election specific materials.
"Campaign Material" mea ns any print or electronic ma teria l used
for the purpose of suppor ting a candid ate or political pa rty. Cam pa
ign material shall inclu de, but not lim i ted to, fliers, posters, socia l
med ia posts, and clothing;
"Disqualify" means the SPG / SSC COMELEC removes a cand id ate
or politic<l l party from the ballot.
"Election" refers to the annual simu l ta neous election of SPG / SSC off
icers.
"Ballot" means the printed sheet of paper or secu re online d atabase con tai nin the
names of cand idates. ·
"Polling precinct" refers to the station where stu dents wri te and cast
their votes.
"Officer-elect" refers to a ca nd id ate who was proclaimed as a win ner in an
election bu t has not yet ta ken his/ her oath of office.
Article II
Name and
Domicile

Section 1 The name of this Supreme Pu pil Government / Supreme Student Government
Commission on Elections shall be known as the [name of school] Supreme Pupil
Government / Supreme Student Government Comm ission on Elections which shall
hereinaf ter be referred to as SPG / SSG COMELEC.

Section 2 The seat of the SPG / SSG COMELEC shall be located inside the premises of the school.

Article III
Declaration of Principles, Objectives and
Policies
Principles

Section 1

The SPG / SSG COMELEC shall u phold the values, principles, and ideals of the
Section 2 SPG / SSG By-Laws and Constitu tion, the School a nd the Depar tment of Education.

SPG / SSG COMELEC shall be committed in pu tting these values, principles and ideals
Objective into action by ensuring a free, orderly, a nd honest election for the student bod y.

Section 3
The SPG / SSG COMELEC shall be an independent agency of overseeing the cond uct,
complaints, and recommending validation or invalidation of the SPG / SSG elections. ·
Section 4
The SPG / SSG COMELEC shall exercise jurisdiction over all ma tters pertaining to
elections, plebiscite, and referenda within the SPG / SSG COMELEC Standa rd Election
Cod e.
Policies

Section 5
The SPG / SSG COMELEC shall be the highest governing body of the student elections.
Section 6
the SPG / SSG COMELEC shall pursue at all times, the values of im partiality, honesty,
and in tegrity in service, renou ncing all forms of corruption and acts which a re contra ry
to the ru les and regu lations of the school and the Depa rtment of Ed ucation.
Section 7
The SPG / SSG COMELEC shall strive to pu rsue an independ ent stand, im partial and
not dictated by any other sector, other than the students, as long as these are not
contrary to the SPG / SSG By-la ws and Constitu tion, the Mission-Vision Sta tement, a nd
Core Values of the Department of Ed ucation.

Article IV
Duties and Fu nctions of the SPG I SSG
Section 1 COMELEC

Tn accord ance with the SPG / SSG By-Laws and Constitu tion, the SPG / SSG COMELEC
shall have the following du ties and responsibilities:
1:1 . Cond uct fair, honest, and systematic elections;
l.2. Adhere to the Standard SPG / SSG Standard Election Cod e;

1.3. Va lidate the electoral proceed ings and results;


Accept or revoke cand idacy;
Proclaim the new set of off icers;
Keep all per ti nent election papers/ documents;
Decide on protests relative to the conduct and results of elections;
Prepa re and distribu te the necessa ry election paraphernalia, certificate of ca ndid
acy forms, and other election related materials before, durin g, and after the election;
and,
Disq ualify candidates who have violated any of the gu idelines, which have been
promu lgated.

Section 2 The Commission on Elections may create ad ditional rules and gu idelines, by a majority
vote at the SPG / SSG COMELEC meeting, to ensu re a fair and efficient election,
provided that any and all rules must com plete the rule making process by no la ter tha n
one week prior to the start of the election cycle. Any ru le created by the SPG / SSG
COMELEC m ust com ply and be consistent with the SPG / SSG By-La ws ancj
Constitu tion.

Section 3 At least n (10) days prior to enacting a ny rule, the SPG / SSG COMELEC shall post a
Notice of Proposed Rulemaking in the SPG / SSG Office. The SPG / SSG COMELEC
shall ensure that any Notice of Proposed Ru lema king contains the following:
General subject ma tter of the proposed ru lemaking;
The place of the meeting to collect information about the proposed area of ru
lemaking;
The time of the meeting and that any student is welcome to offer commen t on the general
subject matter.

Section 4 The SPG / SSG Chair shall ensure that any student who wishes to offer information to
the SPG / SSG COMELEC shall be given the opportu n ity to do so.

Section 5 If the SPG / SSG COMELEC enact any rule, the enacted rule must conform exactly to the
proposed rule.

Section 6 If a ru le takes effect during an election, the SPG / SSG COMLEC Cha ir shall provide
notice to all parties and to all independent cand idates of the newly prom u !gated ru le.

Section 7 The SPG / SSG COMELEC shall have the power to penalize violations or any other rules
properly prom ulga ted by the SPG / SSG COMELEC.

Article V
Composition, Qualification, Term of Off ice, and Vacancies of the SPG / SSG COMELEC

Section 1 The com position of the mem bers in the SPG COMELEC sha ll be three (3) from Grade 4
a nd Grad e 5, and four (4) from Grade 6.

Section 2 The off icers of the SPG COMELEC are the du ly elected SPG COMELEC Cha ir, Co-Chair
a nd Boa rd Mem bers.
Section 3 The composition of the mem bers in the SSG COMELEC shall be three (3) from each
Grade level.

Section 4 The off icers of the SPG COMELEC are the duly elected SPG COMELEC Chair, Co-Chair
and Board Members.

Section 5 Mem bers for the SPG / SSG COMELEC shall:


5.l. Be bona fide students;
Be of good academic standing with a general average of 85 and above withou t any
failing grade d u ring the 1st to 3rd grad ing period of the cu rrent school year;
Be of good moral character;
Have not been subjected to any disciplinary sanction;
Not involved nor have been involved in any position or aff.iliation with a
SPG / SSG political party or as an independent candid ate during the previous
election cycle;
All other qualifications as specified in the SPG / SSC By-Laws and Constitu tion
but a re not specified herein are included in the qu alification of the SPG / SSC
CO..MELE Members.
Section 6 All SPG / SSC COMELEC Officers shall be considered ineligible to ru n for the
SPG / SSC elections.

Section 7 No residency shall be required to all the mem bers of the SPG / SSC COMELEC.

Section 8 The officers of the SPG / SSC COMELEC shall hold off ice for one (1) school year.

Section 9 Vacancies on the Commission on Elections, occu rring prior to the end of qualifying, shall
be immediately filled for the d uration of that specific term by appointment by a majority
vote. Vacancies occurring after qualifyi ng and before the election shall remain u nfilled
u ntil after the end of the election.

Article VI
Duties and Functions of SPG I SSG COMELEC Officers

SPG / SSG COMELEC Chair

Section 1 The SPG / SSC COMELEC Chair shall be filled by the nomination of the SPG / SSC
COMELEC Board Mem bers, subject to the approva l of two-thirds of vote of the
aforemen tioned body.

Section 2 The SPG / SSC COMELEC Chair shall conduct and su pervise the elections of the
SPC / SSG.

Section 3 The SPG / SSC COMELEC Chair shall faithfu lly execute the duties and responsibilities
as designa ted in the SPC / SSC COMELEC Standard Election Code a nd other d u ties tha t
are deemed necessary to the proper conduct of an election.
Section 4 In the event of a vacancy in the office of the SPG / SSG COMELEC Chair, a new
Chair shall be chosen in pursuant to Section 1.

Section 5 The SPG / SSG COM ELEC Chair shall conduct a meeting immediately preceding the
first day of elections. The pu rpose of this meeting shall be to inform all stud ent& wishing
to par tici pa te in the upcom ing elections of the ru les, procedu res, and prper cond uct
requ ired during the election cycle as stated in the SPG / SSG COMELEC Standa rd
Election Code.

Section 6 The SPG / SSG COMELEC Cha ir shall be responsible for receiving the qualifying papers
a nd docu ments of the candidates.

Section 7 The SPG / SSG COMELEC Chair may grant a preliminary order that a political party or
cand idate cease and d esist from the d istribu tion of cam paign materia l where the
SPG / SSG COMELEC deems that a preponderance of available evidence leads to a
conclusion that:
There is a strong likelihood of a violation on a com plain t brou ght by the
offended party; and
Where the materia l is so offensive tha t it may irrepa rably harm the offended pa rty or
cand idate.

Section 8 The SPG• / SSG COMELEC Chair shall distribute all information concern ing the
SPG / SSG COMELEC Stand ard Election Code which includ es but not limited to the
req uired docu ments, dead lines, campaign ru les, and campaign laws.

Section 9 The SPG / SSG COMELEC Chair shall be responsible for the preparation of the ballot.

Section 10 The SPG / SSG COMELEC Chair shall ensure that all candid ates for a given off ice are
listed i n alphabetical order within party grou ps on the ballot. For the purpose of listing
ca ndidates, all independent candidates shall be grouped together in a lphabetical order as
if they were a pa r ty.

Section l1 In the event that a polling location becomes u navailable due to an even t or circu mstance
outside the control of the elections staff, the SPG / SSG COMELEC Chair, at his or her
d iscretion, may add or change a polling location to the nearest available bu ild ing so long
as it is properly noticed at the original polling location.

Section 12 The SPG / SSG COMELEC Cha ir shall provide the poll workers with written
instructions on how to assist studen ts with d isabilities. The instructions shall read as
follows: "Students with sight, vision or physica l im pairments may request a com panion
or poll wor ker to rea d and mark their ballot. You are to help any stud ent tha t req uests
this service."

Section 13 The SPG / SSG COMELEC Chair shall announce the election resu lts no earlier tha n one
(1) hou r af ter the closing of polls.

Section 14 The SPG / SSG COMELEC Chair shall ensure all ba llots are stored u ntil all com pla ints
a re resolved.
SPG / SSG COMELEC Co-Chair and Board Members

Section 15 The SPG / SSG COMELEC Chair shall appoint a Co-Chairperson and l}oarq Members
prior to the general election. The Co-Chairperson and the Board Members' term shall
end i n conju nction with the expiration of the natural term of the SPG / SSG COMELEC
Chair.

Section 16 The SPG / SSG COMELEC Co-Chairperson and Board Mem bers shall assist the
SPG / SSG Chair in the performa nce of his or her duties during the elections.

Article VII
SPG I SSG COMELEC Adviser

Section 1 The SPG / SSG COMELEC Chair shall endorse an adviser to the school head / principal
prior to the genera l election. Adviser's term shall end in conju nction with the expiration
of the natu ral term of the SPG / SSG COMELEC Officers.

Section 2 The SPG / SSG COMELEC Ad viser shall have the following qua lifications
2.l. Hve an experience in organizational management;
With good character and repu tation in the school and comm u nity;
Must be non-pa r tisan, and shall not hold nor have held any position as an ad viser
of SPG / SSG;
All other qualifications as specified in the SPG / SSG By-Laws and Constitu tion bu t are
not specified herein are inclu d ed in the qualification of the SPG / SSG COMELEC
Members.

Section 3 The SPG / SSG COMELEC Adviser shall monitor all activities and meetings of the SPG /
SSG COMELEC at all times.

Article VIII
Penalties and Complaints

Section l The SPG / SSG COMELEC shall issue penalties in accordance with the SPG / SSC
COMELEC Standard Election Code.

Section 2 Any ca nd idate or pol itical party who does not com ply with the SPG / SSG COMELEC
Standard Election Cod e or the proposed Rules and Regulations of SPG / SSG COMELEC
shall be subject to any or all of the following penalties:
Wa rning;
Reprimand;
Suspension of a political party from fielding a cand idate or candidates for off ices i n an
election; or
Any penalty deemed appropria te by the SPG / SSG COMELEC.

Section 3 A ny stud ent or studen t organization who intend s to bring a com plaint before the
SPG / SSG COMELEC alleging a violation of the SPG / SSG Standard Election Code
m ust identify all of the following:
The defendant individu al, organization or political party;
The specific section of the By-Laws and Constitu tion of SPG / SSG or SPG / SSG COMELEC Standard
Election Code that the plaintiff alleges the defendant viola ted;
A d etailed statement of the facts surrou nd ing the alleged violation; and,
The date and time that the compla int was filed.

Section 4 Any elections complain ts m ust be filed to the SPG / SSG COMELEC before the
election results are rea d. Fi ling a com pla int to the SPG / SSG COMELEC
means that the a ggrieved par ty delivers their com plaint to the SPG / SSG
COMELEC Chair.

Section 5 The SPG / SSG COMELEC sha ll dismiss withou t preju d ice a ny com plaint failing to
comply with Section 3.

Section 6 U pon receipt of the com plain t that meets all of the requirements of Section 3,
the SPG / SSG COMELEC shall determine whether probable cause exists to
believe that a viola tion has occurred.

Section 7 If wa rranted, the SPG / SSG COMELEC may assess a reasonable penalty u nd er
Section 2.

Section 8 The SPG / SS COMELEC shall keep a written record of all of its meetings, inclu
ding the evidence and testimony heard, the findings of the SPG / SSG COMELEC,
and the ru lings ma de. Within forty-eight (48) hours of a meeting.

Article IX
Election Qualification

Section 1 Any grou p or individual who wish to qualify as candidate(s) for SPG / SSG must
comply with the provisions of the SPG / SSG COMELEC Standard Election Code
and m ust adhere to the policies set forth by the Chair of the SPG / SSG
COMELEC and its board members.

Section 2 The qu alifications for the position in the SPG / SSG shall be in accorda nce with
the Standard Constitu tion and By-Laws of the Supreme Student Governments and
Su preme Pu pil Governmen ts in Elementary and Secondary Schools.

Section 3 Election Application Packets shall be distribu ted to the interested Cand idates by
the SPG / SSG COMELEC. The Candidates must provide the following to qualify
for the elections:
Certificate of Candid acy;
Copies (2x2) Photograph;
Report Card;
General Plan of Action;
Essay (based on the given set of questions in the Elections Applica tion Packet;
Reference form (in a signed and sealed envelope) from a current teacher and an a dult ou tside of the
school comm unity that is not a rela tive;
Parental Consent.
Section 4 No candidate's name shall appear on the ballot when that cand idate fails to qualify as a
candidate with SPG / SSG COMELEC prior to the time of the closing of the qualifying
period.

Section 5 No candidate shall qualify for more than one office. If a person qualifies for an ad ditional
off ice or cha nge of party, the previous qualifying shall be dee1ned void.

Section 6 Falsification of information may result in disqualification. Each cand idate sha ll
deter m ine that a ll informa tion regard ing his or her qua l ifications a re correct prior to his
or her qualifying for election.

Section 7 Pol itica l parties are not lia ble or pu nishable for an individual candidate's intentional or
grossly negligent falsification of information d v ring the qualifying stages of the election
if they d id not encou rage the ind ivid ua l's behavior. The SPG / SSG COMELEC shall
a llot the political party twenty four (24) hou rs to replace a candida te who inten tionally
or with gross negligence falsified information during qualifying. The political party m ust
choose a replacement for the d isqualified candidate from those cand idates who have
alread y qualified.

Section 9 If a candidate who has qualified for office and has been placed on the ballot by the SPG /
SSG COMELEC wishes to withd raw from the election, the candidate may withdraw if
the cand idate informs the SPG / SSG COMELEC in writing that the cand idate no longer
wishes to remain on the ballot no later than the day im mediately preced ing the first day
of the election. If a political party slated a cand idate, that political party may replace that
withdrawn candidate with a cand idate who has already been qualified as an
ind ependen t, prior to the final iza tion of the ballot.

Section 9 If campaign material in violation of SPG / SSG COMELEC is observed for fif teen (15)
min u tes or greater, the SPG / SSG COMELEC Chair or Co-Chair shall attem pt to contact
the offend ing candidate, the president of the offending political party or his or her
ru nn ing mates. If the SPG / SSG COMELEC is u nable to ma ke contact to the offend ing
political pa rty, the SPG / SSG COMELEC Chair or his or her board mem bers, shall
remove the offending ma terial.

Section 10 No candidate, grou p of cand idates, political pa rty personnel, staff mem ber, facu lty
mem ber, ad ministrator, or any other student or visitor may use the school's copy
machines, compu ter or other materials in the SPG / SSG Office at any time for any type
of par tisa n political purpose or use in any type of election cam paign.

Article X
Election Campaign

Section 1 Campaign period shall cover five (5) school days beginning on the An nou ncement of the
official list of cand id ates and ends immed iately before Election Day. If this proved
im possible, the cam paign period may be extended to not more tha n eight (8) school
days.
Section 2 Campaigns shall only be allowed during the prescri bed period set by the SPG / SSG
COMELEC and done in such a manner that on-going classes, conferences and other
school fu nctions will not be d rastically affected, distu rbed, ham pered, or d isru pted .

Section 3 The ma i ntena nce of a ca m paign website or socia l med ia page shall be perm i tted five (5)
d ays prior to the election.

Section 4 No cand idate shall give, offer, or promise to any stu dent or student organ ization any
benefit not au thorized by the Stand ard By-Laws and Constitution of the SPG / SSG in
order to in fluence the votes of that student or members of that orga nization.

Section 5 Cand ida tes shall ensure that all campaign material shall be labeled with the phrase
"Registered Political Advertisement" or a phrase of sim ilar im port approved by the
SPG / SSG COMELEC. The phrase shall be followed by the name of the ind ivid ual who
a u thorized the creation of, disbursement of, or payment for, a piece of campai
material.

Section 6 All ca m paign materia ls must be registered to the Chair of the SPG / SSG COMELEC.

Section 7 Proced ures for distribu tion a nd posting of cam paign ma terial not provided for by the
SPG / SSG COMELEC Standard Election Code may be established by the SPG / SSG
COMELEC for pu rposes not contrary with the SPG / SSC COMELEC Standard Election
Code.

Section 8 Any im personation of another political pa rty/ independent cand idate by a cand idate,
representative, or campaign material of another political pa rty / independent candidate
shall be consid ered an election violation.

Section 9 Ca m paign materials may only be posted in cam pus proper ty i n compliance with the
laws and regu lations of the school.

Section 10 No u nau thorized person may post or remove any campaign material of any cand \date or
political party.

Section 11 No candidate or political pa r ty shall destroy, remove, or steal any cam paign material of
another candidate or political par ty.

Section 12 Candida tes or representatives of a political par ty shall attach cam paign ma terials only to
areas d esignated by the SPG / SSC COMELEC.

Section 13 Candidates or representatives of a political party may engage i n classroom door-to-door


campa igning only u pon the a pproval of the classroom ad viser or concerned teacher and
limited to a maximum of ten (10) minu tes.

Section 14 Cmdid a tes may not cam paign or d istribu te cam pa ign materials i n any library or
d esignated study area.
Section 15 No cam paigning shall take place within 50 feet of the door of any polling location or
within 50 feet of any queue of voters d u ring the Election Day itself. Thus, candidates and
political members shou ld remove or d ispose of their campaign materials on the day
before the election period. Otherwise, campaign materials posted, d isplayed, and
d istribu ted du ring the election itself skall be held against the candidate or political party
responsible. Socia l med ia campaign and advertisements throu gh text or e-mail messages
to voters shou ld likewise cease on the day before the elections.

Section 16 Campaign materials ma y include a banner not to exceed 4' X 4' meters, and a poster not
exceed ing 8.5' X 11' inches.

Section 17 Threa ts to bodily harm, intimidation, coercion, and acts of the like are strictly prohibited.

Article XI
General Elections

Section 1 All polling places shall be opened from 8:00 AM to 5:00 PM with no lunch break. All
those within the premises of the polling places will be allowed to vote.

Section 2 Political pa rties and independent ca ndidates are entitled to one (1) poll watcher in the
polling place. The poll watcher shall present to the SPG / SSG COMELEC a written
a ppoin hnent as watcher from the candida tes or party whose interests he/ she represents.

Section 3 No qu alified elector may vote or be admitted to a voting booth u nless the elector
presents to a poll worker from the SPG / SSG COMELEC, his/ her identifica tion card.

Section 4 Each qualified elector shall be responsible for ensu ring that his or her registration and
add ress are cu rrent and correct on school's records.

Sectim 5 The Chair of the SPG / SSG COMELEC shall ensure that all polling locations have the
following:
A bu ilding, room, or area that can accommod ate voters especially those with d
isabilities;
Have a readily accessible tables, chairs certified list of voters, the ballot boxes and
official ballots and other necessary materials;
The list of candidates shall be written in bold letters on a ma nila paper and be
d isplayed in the voting a rea highly visible to the students wri ting their votes.

Section 6 Any elector who casts or attempts to cast m ore than one ballot, or tam pers with a n
election system, in any election shall be gu ilty of a violation a nd shall be investigated by
the of the SPG / SSG COMELEC.

Section 7 Ballots sha ll be u niform in size and color. The Ballot shall con tain:
A space for the voter's thum b mar k and signa tu re;
Voting instructions;
Na mes of the cand id ates.

Section 8 The SPG / SSG COMELEC shall prepare the off icial ballots for all students. No ballot
other than the official ballots shall be used or coun ted except in the event of failu re to
receive the off icial ballots on time, or when they were destroyed accidentally, and it is
im possible to provide new officia l ballots.

Section 9 The SPG / SSG COMELEC alone shall keep the key/ s to the padlocks/ s of the ballot
boxes in the polling precinct, it shall remain pad locked until the casting of votes is
f inished and the cou nting of votes begins.

Section 10 No mem ber from the SPG / SSG COMELEC shall ma ke any statement regard ing the
state of the polls or the cand idate/ s voted for by a par ticu la r student.

Article XII
Election Tabu la tion and Validation

Section 1 As soon as the casting of votes is finished, the poll clerks shall count the votes in the
place designated by SPG / SSG COMELEC. The cou nting of votes sha ll not be deleayed
or be postponed u nless d irected by the SPG / SSG COMELEC on accou nt of a pend ing
case, complaint of protest to the election cam paign or the casting of votes.

Section 2 Ca ndidates are prohibited from entering the place where the cou nting of votes is held
and i ts surrou nd ing area for the whole du ration of the aforementioned activity.

Section 3 If two or more competing cand idates tied, the position/ s being contested shall u ndergo a
special elections organized by SPG / SSG COMELEC. In case only one candidate ru ns
for a particu lar office, he/ she only needs one vote to assume his/ her post.

Section 4 The SPG / SSG COMELEC shall have sole responsi bility for validation of elections by a
majority vote provided any decision to invalidate is based u pon frau d or gross
u nfairness as suppor ted by the find ings of fact from the SPG / SSG COMELEC.

Section 5 Every ballot is presu med to be valid unless there is a clear and convincing reason to
justify its rejection.

Section 6 The SPG / SSG COMELEC shall proclaim the winner/ s accu mu lating the highest
nu mber of votes.

Section 7 The SPG / SSG COMELEC shall present the voting resu lts in a report certified by all the
mem bers of the SPG / SSG COMELEC conta ining the following:
Na mes of the cand id ates;
Nu m ber of votes received by each candid ate.

Section 8 An officer-elect may still be d isqualified on account of their recently discovered election
cam paign malpractices. However, a decision to d isq ualify an officer-elect m ust be
rendered before his/ her oath-taking.
Article XIII
Ratification of the Election
Code

Section 1 This Code may be amended or mod ified in fu II or in part once every three (3) years
from its official issuance through a DepEd Order or Memorandu m.

Section 2 If any provision of part hereof is held invalid and unconstitu tional, the remainder of
this Code not affected by such move shall remain valid.

Section 3 This Code shall take effect immed iately u pon the approval of the Secretary of
the Depa r tment of Education.
