 2018 AMENDED CONSTITUTION OF THE CNU-CLASS
PREAMBLE
We, the undergraduate students of the College of
Arts and Sciences imploring the aid of the Almighty God,
establish a student council that will unite the students of the
College of Arts and Sciences through the tests of democracy,
in order to recognize and define our rights and
responsibilities, among fellow Liberal students, faculty and
administration and instill in ourselves the spirit of active
involvement in issues affecting us, do ordain and
promulgate the constitution.
ARTICLE I
OFFICIAL NAME, NATURE, SEAL AND DOMICILE
Section 1. The organization shall be officially known as
Cebu Normal University- Council of Liberal Arts and
Sciences Students, and hereby referred to as CNU-CLASS.
Section 2. The seal shall constitute one concentric circle
with crown and book inside. The name of the body shall
appear inside, below the book. A balance scale for truth and
justice and Vitruvian man for Arts and Sciences shall be
found in the book.
Section 3. The office of the CNU-CLASS shall be established
within the domain of Cebu Normal University in either
within the facades of Arts or Sciences, Osmeña Boulevard,
Cebu City.
ARTICLE II
DECLARATION OF COUNCIL PRINCIPLES AND
OBJECTIVES
Section1. In pursuance of Section 1, Article XI of the 2015
Amended Constitution of the CNU-SSC the CNU-CLASS:
1.1 Shall be recognized as a campus-based
organization under the rules and regulations of
the College of Arts and Sciences;
1.2 Shall exercise utmost local autonomy from any
organizations such as CNU-SSC, EC, and NSC in
pursuance of activities concerning the
undergraduate students of the college;
1.3 Shall be established to carry out the College of
Arts and Sciences’ curricular, co-curricular and
extra-curricular, and administrative functions,
subject to limitations, provided by law; and
1.4 Shall be established to facilitate any necessary
arrangements for the peaceful settlements of
disputes between or among the integral
members of the college and its respective
departments.
Section 2. Declaration of Principles
2.1 The CNU-CLASS shall be a democratic and a
republican council;
2.2 The sovereignty resides in the undergraduate
students of the College of Arts and Sciences and are
the government authority shall emanate from them;
and
2.3 In pursuant to the Section 1, 1.2, of this Article,
the CNU-CLASS shall align matters of legalities
towards the 2015 Amended Constitution of the
CNU-SSC.
Section 3. Declaration of Objectives
3.1 The CNU-CLASS shall:
a. Become the voice of the students of the
College of Arts and Sciences and shall be an
active forum of free expression;
b. Promote and defend the rights and
welfare of the College of Arts and Sciences
undergraduate students;
c. Foster fraternal relationship with the
other organizations, may it be an endemic in
the college or not;
d. Actively participate in school activities
may it be co-curricular or extra-curricular
related;
e. Implement programs in accordance with
the goals and objectives of the College of Arts
and Sciences in particular and Cebu Normal
University in general;
f. Instill in the students the sense of
dedication, will to serve, courage and
bravery, perseverance, and endeavor a
selfless dynamic, servant and steward
leadership;
g. Be a liaison to promote better
understanding and communication with the
students of the College of Arts and Sciences,
faculty and administration; and
h. Uphold with an utmost respect in the 2015
Amended Constitution of the CNU- SSC.
Section 4. The CNU- CLASS shall hereby be known as a non-
profit organization and therefore any amount domination of
the council’s fund shall be neither distributed nor used to
and/for the personal use of any officer or member.
Section 5. The CNU-CLASS officers shall undergo due
process in all of their affiliations may it be sessions,
meetings, and or businesses.
ARTICLE III
JURISDICTION AND MEMBERSHIP
Section 1. The CNU-CLASS shall exercise jurisdiction over
the undergraduate students of College of Arts and Sciences.
Section 2. All undergraduate students of the College of Arts
and Sciences shall pay a membership fee every academic
year.
2.1 The CNU-CLASS Legislators shall determine the
amount of the membership fee and shall be duly
approved by a simple majority vote by the
undergraduate students of the College of Arts and
Sciences through a general consultation.
2.2 Any other fees asked by the council shall be
proposed through a general consultation.
Section 3. All members of the CNU-CLASS shall fill up the
necessary information on the Personal Data Sheet provided
for registration.
Section 4. The CNU-CLASS members shall enjoy the
following benefits:
4.1 Be recognized as an official member of CNU-
CLASS; and
4.2 Thirty percent (30%) discount, upon purchase
of any official CNU-CLASS merchandise.
Section 5. Membership shall be revoked on the following
grounds:
5.1 Expulsion from Cebu Normal University;
5.2 Transfer to another college or institution;
5.3 Discontinuance of study; and
5.4 Violation of the 2015 Amended CNU-SSC
Constitution and by-laws and the 2018 Amended
CNU-CLASS Constitution and by-laws.
Section 6. No refund shall be given to any member/s who
violated any grounds stated in Section 5 under this article.
ARTICLE IV
BILL OF RIGHTS
In pursuance of Section 9 of the Education Act of 1982 and
Article IV, Bill of Rights of the 2015 Amended Constitution
of the CNU-SSC, the members of the CNU-CLASS shall have
the following privileges:
Section 1. Every member of the CNU-CLASS has the right to
form, join and participate in any organizations and societies
recognized by the institution to foster their intellectual,
cultural, spiritual and physical growth and development, for
the purpose not contrary to the 2015 Amended Constitution
of the CNU-SSC, University by-laws and college rules and
regulations;
Section 2. Every member of the CNU-CLASS shall not be
deprived of information and consultations regarding the
council’s policies and regulations which may directly or
indirectly affect them before such matters are adopted.
2.1 Every member shall have the right to participate
and to be represented in any policy-making bodies
which directly affect their welfare as undergraduate
students of the College of Arts and Sciences.
Section 3. Every member has the right to be excused by
their instructors or professors from their classes for any
CNU-CLASS related activities, either co-curricular or extra-
curricular;
3.1 The Approval letter and Excuse letter duly
signed by the respective authorities shall serve as
documentation as the basis of the excuse.
Section 4. Every member shall not be deprived of any
special examinations or activities upon request of the
student provided with the necessary documents as stated in
Section 3, 3.1, of this Article;
Section 5. Every member of the CNU-CLASS shall have the
right to use or receive students’ facilities or equitable
services and students with special needs shall be given
priority.
Section 6. Every member of the CNU-CLASS shall have the
right to be free from excessive and involuntary contribution
from any organized campus-based organization, unless
reasonably deliberated and approved by their organization;
Section 7. Every member shall be free from any form of
punishment without due process of law;
7.1 In every disciplinary proceeding, every member
of the CNU-CLASS shall have the utmost right to due process
such as:
a. There must be an authorized body
clothed with judicial power to hear and
determine the matter before it;
b. Jurisdiction must be constitutionally
accorded over the person of the alleged
or over the property which is the subject
of the disciplinary proceedings;
c. That the alleged member must be given
the opportunity to be heard and to
present substantial evidence/s that
is/are required necessary for and by the
disciplinary proceedings; and
d. Judgment must be rendered after lawful
hearings.
Section 8. Every member shall have the right to information
on matters of public concerns, official records, documents
and papers pertaining to official acts, transactions or
decisions, and shall be made accessible to them, from and
by, the council, which is subject to such limitations as may
be provided by law, whereas confidentiality of both parties
shall be maintained and preserved;
Section 9. The privacy of communication and
correspondence of the members of the CNU-CLASS shall be
bound inviolable except upon constitutional request of the
concerned authorities and duly approved by the pertaining
laws of the council;
Section 10. Every member shall not be deprived of an
immediate reparation of grievances;
Section 11. The rights of the members to free expression of
opinions, suggestions and ideas, and to acquire of effective
channels of communication with the appropriate
administrative authority of the council;
Section 12. Every member shall have the right against
unreasonable searches and seizures; and
Section 13. Every member shall have the right to be
informed of the financial status regarding the various
expenditures and other accounts pertaining to the CNU-
CLASS internal and external funds every semester through
a General Assembly or any council initiatives necessary and
convenient.
ARTICLE V
DUTIES AND RESPONSIBILITIES OF THE MEMBERS
Section 1. Every student shall:
1.1 Uphold the university’s and college's
integrity and academic excellence;
1.2 Develop their potentials that they may be of
service to the university, family, and society;
1.3 Abide with the rules and regulations
implemented in and off the university regarding
his/her academic responsibility and moral
authority;
1.4 Attend, speak, and vote during called
meetings or elections; and
1.5 Exercise the mentioned rights and
responsibilities that they are answerable for any
infringement/violation to the welfare of the
students.
ARTICLE VI
SUFFRAGE
Section 1. Suffrage may be exercised by all undergraduate
students of the College of Arts and Sciences without
discrimination of race, creed, gender, social status, age and
degree program.
1.1 Any undergraduate student of the College of Arts
and Sciences who fails to register or comply the
rules and regulations set by the CNU U-
COMELEC shall be disqualified to vote.
ARTICLE VII
THE GENERAL ASSEMBLY
Section 1. The General Assembly shall be the highest
consultative body of the CNU-CLASS which convenes before
the end of the semester to be presided by the CNU-CLASS
Governor.
Section 2. The General Assembly shall be composed of all
bona fide CNU-CLASS undergraduate students, which shall
be called by the CNU-CLASS Governor.
Section 3. During the General Assembly, students may
approve the plans of the Executive or Legislative Branch or
may disapprove if found detrimental of their welfare as
students.
Section 4. During the General Assembly, students can give
suggestions or comments on the planned programs and
activities of the council provided that it does not violate the
student council constitution, college rules and regulation
and university by-laws.
Section 5. At least two-thirds (2/3) of the total number of
the CNU-CAS undergraduate students of the assembly shall
be considered binding and valid.
ARTICLE VIII
THE LEGISLATIVE BRANCH
Section 1. The Legislative power of the CNU-CLASS shall be
vested upon the Congress of the CNU-SSC.
Section 2. The Legislative body of the CNU-CLASS shall be
composed of the Board Members and the House of
Representatives.
Section 3. The Board Members shall be composed of four
(4) representatives from each year level, who shall be
elected by a simple plurality of votes from their respective
year levels under the College of Arts and Sciences.
Section 4. The Board Members of the CNU-CLASS shall have
the following qualifications:
4.1 Must be a bona fide undergraduate student of the
College of Arts and Sciences and of his/her
respective year level that he/she represents;
4.2 Must be of good moral character;
4.3 Must not be a working student in any offices in
the university;
4.4 Must not be an officer in any recognized campus-
based organization upon the induction day; and
 4.5 Must not have failing grades in any of the
subjects enrolled in the semester preceding the
Election Day.
Section 5. The Board Members of the CNU-CLASS shall have
the following powers:
5.1 Enact and promulgate laws, acts and resolutions
for the whole College of Arts and Sciences student
body upon representing their year level;
5.2 Elect or appoint a Chairperson and be the
spokesperson of the Board;
5.3 Hear out impeachment related complaints of the
CNU-CLASS Governor or any other elected or
appointed officers;
5.4 Be part of the Commission on Appointments of
the CNU-CLASS;
5.5 Deliberate the Budget Proposals submitted by
the CNU-CLASS officers as deemed necessary for the
releasing of money from the council funds; and
5.6 Exercise such other powers as may be deemed
proper and necessary for the interest and welfare of
the College of Arts and Sciences undergraduate
students provided that these may not be contrary to
any provision of this Constitution.
Section 6. The House of Representatives shall be composed
of four (4) representatives from any undergraduate degree
program of the College of Arts and Sciences who shall be
elected by a simple plurality of votes of the undergraduate
students of the College of Arts and Sciences.
Section 7. The House of Representatives shall have the
qualifications with the CNU-CLASS Board Members except
that they must come from each respective year levels.
Section 8. The House of Representatives shall have the
following powers:
8.1 Enact and promulgate laws, acts and resolutions
for the whole student body of the CNU-CAS;
8.2 Elect or appoint a House Speaker of the council
and be the spokesperson of the CNU-SSC to the CNU-
CLASS;
8.3 Represent the CNU-CLASS to the Congress of the
CNU-SSC in pursuance to Section 11, 11.1, Article 8
of the 2015 Amended CNU-SSC Constitution;
8.4 Be the voice of the CNU-CAS, to and of, the CNU-
SSC;
8.5 Hear out impeachment related complaints of the
CNU-CLASS Governor or any other elected or
appointed officers;
8.6 Be part of the Commission on Appointments of
the CNU-CLASS;
8.7 Deliberate the Budget Proposals submitted by
the CNU-CLASS officers as deemed necessary for the
releasing of money from the council funds; and
8.8 Exercise such other powers as may be deemed
proper and necessary for the interest and welfare of
the College of Arts and Sciences undergraduate
students provided that these may not be contrary to
any provision of this Constitution.
Section 9. The CNU-CLASS Vice-Governor shall be directly
appointed as the Presider of the Legislative Branch and shall
appoint a Legislature Clerk who shall not be an elected
officer of the CNU-CLASS.
Section 10. Duties and Functions of the Presider:
10.1 Shall preside every legislative session of the
CNU-CLASS;
10.2 Shall implement the rules and regulations of
the Legislative Branch;
10.3 Shall sign documents, acts, resolutions and
correspondence pertaining to the Legislative
Branch;
10.4 Shall decide all points of order;
10.5 Shall see to it that all resolutions of the
Legislative Branch are complied with;
10.6 Shall maintain order during sessions anytime
he/she deems it necessary
10.7 Shall give brief remarks, comments for
clarification of questions on any measure pending
deliberation by the Body provided that he/she shall
not express himself/herself either for or against the
said motion; and
10.8 In cases of equal votes, the presider shall break
the tie.
Section 11. The members of the Legislative Branch shall
elect a Deputy Presider who shall exercise the power and
duties of the Presider in the latter’s incapacities and
absences.
Section 12. The Legislature Clerk shall keep a record of all
the documents on all the proceedings, including minutes,
resolutions and any form of correspondence.
Section 13. No member of the Legislative Branch may hold
any other office in any recognized campus-based
organization.
Section 14. The members of the Legislative Branch shall be
the spearheads of each standing committee of the Section 15
of this Article.
Section 15. There shall be standing committees created that
includes the following:
a. Committee on Grievance
b. Committee on Support
c. Committee on Information
 d. Committee on Ways and Means
e. Committee on Cleanliness
f. Committee on Property Management
g. Volunteers’ Committee
h. Active Committee on Emergency Response Service
(ACERS)
Section 16. The Commission on Appointments of the CNU-
CLASS shall be composed of the Legislative body of the CNU-
CLASS and shall exercise the following:
16.1 Any members of the Commission shall not
interfere with the search of appointees to dismiss
the possible occurrence of biases.
16.2 The Commission on Appointments shall have
the power to evaluate and assess the approved
appointees on their performances and must submit
a semestral report in a joint session with the
Executive body and the Legislative body during the
General Meeting of the semester. (is a daily
monitoring needed or just performances during
preparations or event proper?)
16.3 No law shall be passed amending the duties and
responsibilities of the Commission.
Section 17. The members of the committees, either
recommended or walk-in applicants shall be deliberated
and approved by the Commission on Appointments of the
CNU-CLASS.
Section 18. Every resolution promulgated by the Legislative
Branch shall be subject for approval of the CNU-CLASS
Governor for implementation. The veto power of the CNU-
CLASS Governor may be overridden by two-third votes of
the Legislative body.
Section 19. The Legislative Branch shall hold a regular
Legislative Session twice a month. The specific day of the
said session shall depend on the House Rules as agreed by
the body. Special sessions may be called when necessary.
Section 20. The term of office of the members of the
Legislative Branch shall expire upon the induction of the
newly elected officers unless re-election occurs.
ARTICLE IX
THE EXECUTIVE BRANCH
Section 1. The Executive Power shall be vested upon the
CNU-CLASS Governor.
Section2. The Executive Branch shall be composed of the
elected CNU-CLASS Governor, Vice-Governor, Secretary,
Treasurer, Auditor and other appointed officials such as:
a. Internal Press Secretary;
b. External Press Secretary;
c. Assistant Treasurer; and
d. Members of the standing committees
Section 3. No student shall be elected or appointed or may
continue his/her term as a member of the Executive
Branch unless he/she is:
3.1 A bona fide student of the CNU-CLASS;
3.2 Must be of good moral character;
3.3 Must not be a working student in any offices in
the university;
3.4 Must not be an officer of any recognized
campus-based organization on the Induction Day or
appointment day; and
3.5 Must have no failing grades in any of the subjects
enrolled in the semester preceding the election or
appointment day.
Section 4. The duties and functions of the Governor:
4.1 Shall preside all General Assemblies and
General Meetings;
4.2 Shall implement or execute the policies, rules
and regulations of the CNU-CLASS;
4.3 Shall approve or disapprove resolutions,
communications, or any other documents of the
CNU-CLASS; 4.4 Shall represent the CNU-CLASS in
all matters affecting its interests;
4.5 Shall be the official spokesperson of the CNU-
CLASS;
4.6 Shall have the veto power to any resolutions
prejudicial to the welfare of the students provided
that failure to take action within four (4) days from
receipt thereof, such resolution shall be deemed
approved;
4.7 Shall recommend for the appointment of the
appointed officials; and
4.8 Shall perform such other functions and duties
as the law may authorize.
Section 5. The duties and functions of the CNU-CLASS Vice-
Governor:
5.1 Shall perform the functions and duties of the
CNU-CLASS Governor in the latter’s absence and
incapacities;
5.2 Shall assist the CNU-CLASS Governor in
supervising the projects and activities assigned to
the steering committees of the CNU-CLASS;
5.3 Shall be the presider of the Legislative Branch in
their Legislative Sessions; and
5.4 Shall perform such other functions and duties as
the law may authorize.
Section 6. The duties and functions of the CNU-CLASS
Secretary are as follows:
 6.1 Shall be the custodian of the official records of
the CNU-CLASS;
6.2 Shall take minutes of all the meetings called upon
by the CNU-CLASS Governor;
6.3 Shall act as the membership officer of the CNU-
CLASS;
6.4 Shall present a semestral report of all the
minutes and Executive orders to the CNU-
CLASS Governor; and
6.5 Shall perform such other functions and duties as
the law may authorize.
SECTION 7. The duties and responsibilities of the Press
Secretaries (Internal and External):
7.1 The Internal Press Secretary shall:
7.1.1 Take charge in the correspondence
within and going out of the office;
7.1.2 Assist the secretary in performing
his/her duties;
7.1.3 Present communications sent and
receives within the university premises to
the CNU-CLASS Governor; and
7.1.4 Perform such other functions and
duties as the law may authorize.
7.2 The External Press Secretary shall:
7.2.1 Take charge of the press related
external affairs;
7.2.2 Assist the secretary in performing
his/her duties;
7.2.3 Present communications sent and
received outside the university premises to
the CNU-CLASS Governor; and
7.2.4 Perform such other functions and
duties as the law may authorize.
Section 8. The duties and functions of the CNU-CLASS
Treasurer are as follows:
8.1 Shall keep records of all the accounts of the CNU-
CLASS;
8.2 Shall be the legal custodian of the funds and
properties of the organization;
8.3 Shall take charge and record all receipts and
disbursements;
8.4 Shall submit semestral financial report to the
CNU-CLASS Governor and other reports as required
by the CNU-CLASS Governor or the House of
Representatives;
8.5 Shall take charge of the collections of the CNU-
CLASS; and
8.6 Shall perform such other functions and duties as
the law may authorize.
SECTION 9. The duties and responsibilities of the CNU-
CLASS Assistant Treasurer:
9.1 Shall perform the duties and functions of the
Treasurer in the latter’s absence and incapacity;
9.2 Shall assist the Treasurer in performing his/her
duties;
9.3 Shall take charge of the keeping of receipts; and
9.4 Shall perform such other function and duties as
the law may authorize.
Section 10. The duties and functions of the CNU-CLASS
Auditor are as follows:
10.1 Shall check and examine all accounts pertaining
to the CNU-CLASS funds;
10.2 Shall be responsible for the accounting of
expenses, funds and others of which the CNU-CLASS
is in possession;
10.3 Shall submit audited reports to the CNU-CLASS
Governor and post a copy in the CNU-CLASS Bulletin
Board;
10.4 Shall report all financial discrepancies in the
disbursements of funds to the CNU-CLASS; and
10.5 Shall perform such other functions and duties
as the law may authorize.
Section 11. The CNU-CLASS Governor, Vice Governor,
Secretary, Treasurer and Auditor shall be elected at large by
a direct vote of all undergraduate students of the College of
Arts and Sciences for all terms of one (1) academic year and
shall begin right after induction.
Section 12: In case of death, permanent disability, removal
or resignation of the CNU-CLASS Governor, the Vice
Governor shall take the office of the unexpired term.
Section 13: The term of the office of the members of the
executive branch shall expire upon the induction of the
newly-elected/ appointed officers unless re-election or re-
appointment occurs.
ARTICLE 10
THE CONSTITUTIONAL COMMISSION
A. Commission on Audit
Section 1. The Commission on Audit of the CNU-CLASS shall
have a 2 Commissioners, recommended by the Governor
and duly approved by the Commission on Appointments.
Their qualifications shall be the same to the Executive and
Legislative Branch.
Section 2. Duties and Responsibilities
2.1 The Commission shall also be referred as CNU-
CLASS COA.
2.2 The CNU-CLASS COA shall have the power,
authority, and duty to examine, audit and settle all
accounts pertaining to the revenue and receipts of,
 and expenditures or uses of funds and property,
owned or held in trust by, or pertaining to the
Council.
2.3 The Commission shall have exclusive authority,
subject to the limitations in the article, to define the
scope of its audit and examination, establish the
techniques and methods required therefore, and
promulgate accounting and auditing rules and
regulations including those for the prevention and
disallowance of irregular, unnecessary, excessive,
extravagant, or unconscionable expenditures, or
uses of council’s funds and properties.
2.4 No resolution shall be passed, nor approved
exempting any entity of the council in any guise
whatever, or any investment of public funds, from
the jurisdiction of the Commission on Audit.
2.5 The Commission shall submit to the CNU-CLASS
Governor and the Legislative Body, within the time
fixed by both parties, a semestral report comprising
the financial condition and operation of the council.
2.6 The Commission may recommend measures
deemed necessary pertaining to the improvement of
the Council’s effectiveness and efficiency. It shall
submit such other reports as may be required by the

ARTICLE XI
THE CNU-CLASS ADVISER
ARTICLE XII
ACCOUNTABILITY OF PUBLIC OFFICERS
Section 1. Public office is a public trust. Public officers and
appointees must, at all times, be accountable to the students,
serve them with utmost responsibility, integrity, loyalty,
and efficiency; act with patriotism and justice, and lead
modest lives.
Section 2. All elected/appointed officers may be removed
from office on impeachment for, and conviction of, culpable
violation of the 1987 Philippine Constitution, all other Laws
enacted by the Philippine Government, 2015 CNU-SSC
Constitution, CLASS Constitution, treason, bribery, graft and
corruption, other high crimes, negligence of duties, or
betrayal of public trust.
Section 3. The Legislative Branch shall have the exclusive
power to initiate all cases of impeachment.
3.1 A verified complaint for impeachment may be
filed by any Member of the Legislative Branch or by any
student upon a resolution or endorsement by any Member
thereof, which shall be included in the Order of Business
within five session days, and referred to the Grievance
Committee within three session days thereafter. The
Committee, after hearing, and by a majority vote of all its
Members, shall submit its report to the Legislative Branch
within ten session days from such referral, together with the
corresponding resolution. The resolution shall be
calendared for consideration by the House within ten
session days from receipt thereof.
3.2 A vote of at least one-third of all the Members of
the Legislative Branch shall be necessary either to affirm a
favorable resolution with the Articles of Impeachment of the
Committee, or override its contrary resolution. The vote of
each Member shall be recorded.
3.3 In case the verified complaint or resolution of
impeachment is filed by at least one third of all the Members
of the Legislative Branch, the same shall constitute the
Articles of Impeachment, and trial by the Legislative Branch
shall forthwith proceed.
3.4 No impeachment proceedings shall be initiated
against the same official more than once within a period of
one year.
3.5 The Legislative Branch shall have the sole power
to try and decide all cases of impeachment. When sitting for
that purpose, the members shall be on oath or affirmation.
When the Governor is on trial, the Vice Governor, as the
presiding officer of the Legislative Branch, shall preside, but
shall not vote. When the Vice Governor is on trial, the Deputy
Presider of the Legislative Branch, shall preside and vote. No
person shall be convicted without the concurrence of two
thirds of all the Members of the Legislative Branch.
3.6 Judgment in cases of impeachment shall not
extend further than removal from office and disqualification
to hold any office under the Council, but the party convicted
shall nevertheless be liable and subject to prosecution, trial,
and punishment, according to law.
3.7 The Legislative Branch shall promulgate its rules
on impeachment to effectively carry out the purpose of this
section.
3.8 Judgment in cases of impeachment shall be
presented during the session of the Legislative Branch seven
days after the last impeachment trial.
Section 4. The right of the Council to recover properties
unlawfully acquired by elected/appointed officer, from
them or from their nominees or transferees(I need
enlightenment hahaha), shall not be barred by prescription,
laches, or estoppel.
ARTICLE XIII
VACANCIES
Section 1. In case of temporary and permanent vacancy in
the office of the Governor, the Vice Governor shall assume
the office. If the vacancy occurs to both the Governor and
Vice Governor, the adviser and COMELEC members shall
convene for a proper action.
Section 2. No special election for any offices shall be held
three (3) months before the regular election.

Section 3. In case of permanent vacancy of the Secretary,
Treasurer, Auditor, Board Members or House of
Representatives, the next candidate who obtained the
highest number of votes shall fill the vacancy of the
unexpired term.
Section 4. A temporary vacancy means officially filed leave
of meeting justifiable and excusable reason. A permanent
vacancy means an absence of more than the limitation
mentioned above.
Section 5. In case of permanent vacancy in the office of any
appointed officer, the Governor shall recommend officers,
who shall also undergo screening by the Commission on
Appointees, to assume the unexpired term
ARTICLE XIV
GENERAL PROVISIONS
Section 1. The CNU-CLASS shall open a separate bank
account for the Council’s Internal and External Funds.
Section 2. The CNU-CLASS funds shall be withdrawn by
three signatories: CNU-CLASS Treasurer, Governor and
Adviser.
Section 3. Every block per degree program of the College
of Arts and Sciences, through their Chairman, shall be given
a copy of the newly-amended CNU-CLASS Constitution.
Section 4. The CNU-CLASS shall have a fiscal autonomy.
Any financial matters shall be free from the University’s
own financial matters.
ARTICLE XV
TRANSITORY PROVISIONS
Section 1. There shall be an election of the CNU-CLASS
officers to be conducted by the CNU U-COMELEC during the
Unified Election at the end of the Academic Year. The
officers elected will hold the office for one (1) academic year
and the CNU U-COMELEC shall convene and conduct a
regular election for the new set of officers for the following
Academic Year.
Section 2. The incumbent officers of the CNU-CLASS shall
serve the student body until the newly elected officers for
the Academic Year are officially inducted into office.
Section 3. There shall be a formal turnover ceremony of the
documents such as the Constitution and by-laws, Executive
Orders and Legislative resolutions and the like between the
outgoing officers and the incoming elected officers during
the Oath Taking Ceremony.
ARTICLE XVI
EX-OFFICIO MEMBERS
Section 1. Officers who shall not seek for re-election are
automatically considered an ex - officio member of the
CNU-CLASS.
Section 2. The Ex-Officio members of the CNU-CLASS shall:
2.1 Serve as junior advisers of the CNU-CLASS
officers; and
2.2 Be an active liaison officer in any mode
appropriate between the current officers and the
members for the council’s efficiency in the delivery
of service.
Section 3. No ex-officio members of the CNU-CLASS shall
intervene on any administrative undertakings of the council
such as:
a. Financial planning;
b. Record keeping and billing;
c. Personnel management; and
d. Meetings --- Executive, Legislative Hearings,
Joint Session Hearings and Caucuses.
Section 4. No resolution, memorandum or decree shall be
passed, nor approved amending the Section 3 of this
article.
ARTICLE XVII
AMENDMENTS AND REVISIONS
Section 1. Any amendment to or revision of, this
constitution may be prepared by:
1.1 The House of Representatives and the Board
Members of the CNU-CLASS upon a vote of
three-fourths of all its members; or
1.2 A constitutional convention with the CNU-SSC
Senate to align the constitution to its Mother
Constitution— 2015 Amended Constitution of
the CNU-SSC.
Section 2. Amendments to the Constitution directly
proposed by the people through initiative upon a
jurisdiction of at least twelve per centum of the total number
of the members of the CNU-CLASS.
2.1 No amendment shall be authorized within five
(5) years following the ratification of this
Constitution.
Section 3. The House of Representatives and the Board
Members of the CNU-CLASS may call a constitutional
convention by a vote of two-thirds of all its members or by
a majority vote of all its members, the question of calling
such a convention may submit to the members of the CNU-
CLASS.
Section 4. Any amendment or revision of, this Constitution
under Section 1 shall be valid by a majority of votes in a
plebiscite which shall be held not earlier than sixty (60) days
nor later than ninety (90) days after the approval of such
amendment or revision.

4.1 Any amendment under Section 2 shall be valid

when ratified by a majority of votes in a plebiscite
which shall be held not earlier than sixty (60) days
nor later than ninety (90) days after the certification
by the CNU U-COMELEC of the sufficiency of the
petition.

ARTICLE XVIII
EFFECTIVITY

Section 1: The newly Amended Constitution of the CNU-

CLASS shall take effect right after the ratification through a
plebiscite called for such purpose.
