clients.

PROFESSIONAL MISCONDUCT
WHAT IS THE PROCEDURE FOR MAKING A COMPLAINT AGAINST AN ARCHITECT?

Complaint shall be made to the Council of Architecture in Complaint Form No. XIV.

Copy of complaint will be sent to the accused Architect
copy to the Architect within sixty days of the receipt of the complaint;
Notice will be sent to the accused Architect -
Every notice the Disciplinary Committee under this rule shall be sent to the Architect or the
firm concerned by registered post with acknowledgment due.

WHAT IS THE PROCEDURE FOR MAKING A COMPLAINT AGAINST AN ARCHITECT?

Complaint will be dismissed


Council is of the opinion that there is no prima facie case against the Architect
Architect shall be informed accordingly.
Before dismissing the complaint,
complaint the Council may call for any additional particulars or
documents connected with the case

Enquiry shall be made –


on perusal of the complaint, the Council shall cause an enquiry to be made in the matter by the
Disciplinary Committee.

WHAT DISCIPLINARY ACTION CIVIL andd CRIMINAL ACTION IS TAKEN AGAINST AN ARCHITECT
FOUND GUILTY OF PROFESSIONAL MISCONDUCT?

If the Architect is found guilty of Professional Misconduct, he is liable for disciplinary action by the
Council of Architecture under section 30 of the Architects Act,1972.
The disciplinary action taken by the Council of Architecture against the Architect who has been
found guilty of Professional Misconduct, does not absolve him of his liabilities under the Code of
Civil Procedure, 1908 and the Code of Criminal Procedure, 1973, if any.

WHAT ARE THE COUNCIL OF ARCHITECTURE RECOMMENDATONS ON
THE PROFESSIONAL FEES TO BE PAID TO AN ARCHITECT IN INDIA?

The Architect is paid fees for the following reasons:

•The efforts involved in preparing designs

•The cost of supervision in terms of time of the Architect,

FEE STRUCTURE:

Percentage: The fee payable to the Architect shall be computed as a percentage of


the Actual Cost of the project works, as on completion.

Minimum payable fees: The fees listed in the Scale of Charges is the minimum
payable for the Architect’s services. However, depending on the complexity of the
project.

Negotiable fees: For works costing upto Rs 15 Lakhs, the professional fees may be
negotiable

Social slum housing: In view of the importance of social housing, slum upgradation
etc, the Architect’s fees are negotiable between the Architect and Client….. Fee Bidding
HOUSING –

Individual Independent House - 7.5% on the cost of works assigned.

Single Block Housing and Sites upto 0.5 hectares - 5.0% on the cost of works
assigned.

Sites more than 0.5 hectares and upto 2.5 hectares - 3.5% on the cost of works
assigned.

Sites more than 2.5 hectares and upto 5 hectares - 2.5% on the cost of works
assigned.

Sites more than 5 hectares - 2.0% on the cost of works assigned.

ALL PROJECTS OTHER THAN HOUSING - 5 0%

ARCHITECTURAL CONSERVATION, RETROFITTING, ADDITIONS, ALTERATIONS –7.5% on the cost of


works assigned.
INTERIOR ARCHITECTURE, SIGNAGE, GRAPHIC DESIGN - 7.5% on the cost of works assigned.

LANDSCAPE ARCHITECTURE - 7.5% on the cost of works assigned.

URBAN DESIGN - 1.0% on the cost of works assigned.

CONTRACTOR’SS BILLS - 1.0%

DOCUMENTATION AND COMMUNICATION CHARGES - 10% of the professional fees.

ADVISORY CONSULTANCY CHARGES - Rs 10,000 - per day for outstation project; Rs 4,000 -
per day for local project.
