TANGGAPAN NG SANGGUNIANG BARANGAY

RESOLUTION NO. 100-10

WHEREAS, recognizing the need to ensure the safety and security of the passengers of
jeepney vehicles, the City Council on its May 8, 2017 session, created City Ordinance No.
0010, series of 2017, entitled; “An Ordinance Protecting the Passengers of Jeepney Vehicles
from Forced Charity-Giving and Donations ”.

WHEREAS, the passage of said ordinance is expected to increase the participation of the


jeepney driver’s in this initiative as responsible citizens of the country in protecting its
passengers;

WHEREFORE, on motion of Member Susan Topp, duly seconded by Member Ysmel M. Hapitts;

BE IT RESOLVED, AS IT HEREBY RESOLVED, By the Sangguniang Panlungsod of Lipa, that the


following City Ordinance be, as it is hereby ADOPTED and APPROVED:

ORDINANCE NO. 0001, SERIES OF 2017 OTHERWISE KNOWN AS “AN ORDINANCE


PROTECTING THE PASSENGERS OF JEEPNEY VEHICLES FROM FORCED CHARITY-GIVING
AND DONATIONS.”

Be it ordained by the Sangguniang Panlungsod in its session assembled, that :

SECTION 1.– Declaration of Policy.– It is hereby declared the policy of the City of Lipa, Brgy.
Mataas na Lupa to:

a. develop a set of rules and regulations for the jeepney drivers on accepting people to their
vehicle who ask for donation and the likes;

b. to encourage all jeepney drivers for their cooperation and participation; and

c. to support the safety and security of their respective passengers;

SECTION 2.– Creation of the Rules and Regulations.- There shall be created a set of rules and
regulations governing the kind of donations, and the likes, that may be asked within the
jeepney vehicle.

d. To coordinate with and enlist all jeepeney drivers in Lipa City for a planned and concerted
effort to realistically attain full implementation of all the rules and regulations concerning the
safety and security of the passengers of jeepney vehicles;

e. To advise and endorse to the City Mayor, as the case maybe, measures necessary for the
improvement of the rules and regulations of jeepney vehicles of the City;

f. To promulgate and adopt rules and regulations covering the internal and administrative
functions of the same, as well, as rules and regulations for the safety and security of the
passengers of jeepney vehicles;

g. Submit to the City Mayor rules and regulations, and other guidelines adopted by the TMD
which would require the Local Executive’s attention including annual and periodic reports;

h. Submit Quarterly Report on the status of the rules and regulations, regulations in force and
other pertinent information and recommendations to the City Mayor for transmission to the
City Council;

i. Delegate any function and tasks to competent staff of the TMD;

j. Arbitrate through appropriate committee on administrative cases of jeepney associations;

k. Subject to the approval of the City Mayor, to arrange and to implement impeling plans,
programs, and policies;

l. Oversee the implementation of the Rules and Regulations for the Safety and Security of the
passengers of jeepney vehicles;

m. Performs such other functions as may be assigned by the office of the City Mayor.

n. Research, Development and Linkages

SECTION 3. – Meeting of the Board  –  The Board, consist of the City Mayor, the Secretary of
the Mayor, the head of the TMD and two other representatives from the traffic enforcement
unit, shall meet quarterly and that if any member, for one reason or another, can not attend
the meeting of the Board, that member may designate a representative to attend the meeting
for and in his behalf, which shall have the same right of the original member.

SECTION 4. – Functions of the Board. – The Board shall have the following functions :

a. Offer advice in developing constructive policies, standards, procedures and programs


relating to the improvement of the safety and security and the various problems confronting
the various forced charity or donation problems of the city;

b. Monitor the implementation of the rules and regulations of the city;

c. Review, recommend and approve all rules and regulations of the city;
d. Create appropriate committee as deemed necessary.

SECTION 5. – Secretariat of the Board – In the performance of its function, the Board shall
have its own Secretariat, headed by a Board Secretary.

c. Represent the council in matters/meetings/ conferences where representation may be


required or as agreed upon by the members of the council;

d. Call special meetings, whenever deemed necessary;

e. Furnish members, at its monthly meetings with a comprehensive report of the operations of
the council during the preceding month;

f. perform such other duties as maybe required by the Office of the City Mayor;

SECTION 6. – Quorum. Constituting a quorum is applying simply majority rule which is “50%
plus one (1). The Chairman may call special meetings as deemed necessary. The board shall
formulate guidelines on calling and the conduct of special meetings.

SECTION 7. Repealing Clause. All previous ordinance, executive orders, rules and regulations
or parts thereof which are inconsistent with this ordinance are hereby repealed and modified
accordingly.

SECTION 8. Separability Clause. If, for any reason or reasons, any part or provision of this
ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are
not affected thereby shall continue to be in full force and in effect.

SECTION 9. – Effectivity.-This Ordinance shall take effect ten (10) days after the publication
of a local newspaper.
