Subject: Industries manufacturing Essential / Non-Essential products close down


due to harsh rules laid down in the MHA circular dated April 15, 2020.

Dear Madam,

Considering the very stringent rules laid down as per the Guidelines issued by
Ministry of Home affairs dated April 15, 2020, the Industries in GIDC, Nandesari
have decided to closed down the manufacturing operations of Essential / Non-
Essential Pharma products till May 3, 2020. Four Pharma units have already
closed the operations yesterday at 5:30 PM due to very stringent and
unmanageable guidelines.

Guideline No. 15, point no. 2 page 6#13 states that “Establishments shall make
arrangement for stay of workers within their premises as far as possible and or
adjacent buildings and implement Standard Operating Protocol. The transportation
of workers to workplace shall be arranged by the employers in dedicated transport
ensuring social distancing.

Most of the units in GIDC, Nandesari are micro and small scale industries carrying
manufacturing activities in 1000 ~ 1500 sq mts plots. The industries can not able
to make arrangements for the employees to stay in the factory premises. Where
will they erect rooms in such a small plot. Further they will have to make
arrangements for big lockers for individual clothes and other essential items, more
number of bathrooms and toilets, frequent sanitization facilities for setrangi, dari
and blankets during each shifts, laundry arrangement for all the blankets, pillow
covers etc.

For transportation, micro and small scale industry cannot afford to ply buses with
only 30-40% occupancy covering villages in 20 km radius area.

Further, if any worker is found infected by COVID-19 virus, a FIR will be lodged
against the owner / Operator of the premises under Section IPC Sections 188
(disobedience to order promulgated by public servant), 269 (negligent act likely to
spread infection of disease dangerous to life), 270 (malignant act likely to spread
infection of disease dangerous to life) and 271 (disobedience to quarantine rule)
following directions of the district administrations.

A worker can get infected anywhere or he might not show the symptoms when the
industry restarts and can show symptoms later on which is not a fault or caused
by the industry. These are too harsh penalties. Industrialists should not be treated
as criminals.

The workers from the villages surrounding Nandesari are facing lot of hardships to
reach their factories in Nandesari. They are stopped by their Sarpanches from
leaving the villages. If at all they reach the factories, they are not allowed to reenter
the villages.

In view of guidelines, the industries from GIDC, Nandesari have decided to close
down their operations or not to restart the industry till May 3, 2020.
